Obtenção e utilização de imagens de pacientes: proposta de termo de consentimento à luz do direito brasileiro

Ao atender um paciente, muitas vezes o profissional da saúde fotografa ou filma o caso. Há, via de regra, duas razões básicas para tal atitude. A primeira é para a documentação do caso per se, e as imagens ficarão restritas ao prontuário clínico do paciente. E, se porventura algum dia houver um litígio envolvendo aquele determinado tratamento, tais imagens poderão ser utilizadas como meio de prova. A segunda razão diz respeito à divulgação do caso clínico, com a sua publicação em periódicos científicos, apresentação em aulas, cursos, congressos e similares. Pode-se citar ainda uma outra razão: o uso das imagens para a divulgação dos serviços do profissional que conduziu o tratamento/procedimento. Para a obtenção/gravação das imagens, faz-se necessário o consentimento do paciente, ou de seu responsável legal (no caso de incapaz). Porém, a imagem produzida somente poderá ser utilizada para os fins específicos a que se destinou inicialmente. Se porventura o profissional tiver intenção de usá-la, por exemplo, em publicações, precisará do consentimento específico para este fim. Vale lembrar que a própria Constituição Federal da Brasil assegura tal direito. A produção de imagens de pessoas e a sua divulgação em meios acadêmicos, por exemplo, ocorre não somente em atendimentos clínicos, como também em pesquisas que envolvam seres humanos. É necessário respeitar as normas éticas e legais relacionadas ao uso de imagens. Este trabalho apresenta uma proposta de Termo de Consentimento para obtenção e uso de imagens de pacientes de profissionais da saúde.

Direct descendant of the music of the Black Atlantic, hip hop became the spokesman of excluded minorities, for example setting up of the reunification that is geographically separated through communication. The hip hop appropriated new forms of mass communication, allowing the reworking of the story through a counter-hegemonic discourse that seeks self-knowledge and appreciation of the roots of black people. The street culture is the narrative of disenfranchised youth, generating narrative of inclusion, which gave a space of enunciation periphery enabling them to intersubjective recognition. This project aims to discuss the role of hip hop as an agent conscientizing youth peripherals in order to bring to the debate the form of identity construction around the peripheral street culture since, as an intervention that acts as a symbolic system guiding cultural practices and attitudes of these young people. Methodologically, we analyzed specific bibliographical about hip hop and literature originating from the periphery itself. Selected discography of some rap groups. They are Racionais Mc's, 509-E and DJ Hum and Thaíde that constitute the vanguard of hip hop in Brazil. We use music from rapper Emicida this while some contemporary exponents of rap, with national and international. It is possible to see some incapacity of the film by Rosi, natural to a certain degree, to translate the synthesis of literary treatment and socio-historical reflection. For this reason it is necessary to read the adaptation as an attitude about the literary matter and the result of historical experience. What became accustomed to call “paganism” is undoubtedly one of the most significant forms of what is designated as “popular religiosity”. This expression, which seems useful when a generalization is required, shows all its weakness when a more precise and objective observation of a particular religion is attempted. Would the official visigothic kingdom’s “conversion” to Catholicism, with Recardo (586-601) at the Council of Toledo of 589 have effectively matched to the “conversion” of this kingdom’s population? Firstly, it is necessary to consider, in beyond the exalting intentions of the sources of that moment, that mass conversions do not imply a radical change in the convictions and religious practices of an entire people. O desenvolvimento da expressão modalizadora “pode ser”. um caso de (inter)subjetivização no português

Based on a functionalist approach, this paper analyzes the modalized expression pode ser as a complement-taking predicate which embeds a proposition (pode ser1) and as an independent structure (pode ser2), in contemporary written and spoken Brazilian Portuguese texts. We aim to identify degrees of (inter)subjectivity, revealing a process of (inter)subjectification (TRAUGOTT, 2010 among others). The analysis carried out in this paper is supported by parameters of (inter)subjectivity of modal elements (TRAUGOTT; DASHER, 2002) and by the notion of modality as a multifunctional category, serving not only to encodethe speaker’s attitude regarding the modalized content, but also as a pragmatic strategy, as a regulator of communicative situation. The exam reveals pode ser as a strongly demanded structure in interaction, a fairly requested set and also productive and useful for interpersonal relationships. The examination of semantic, discursive and morphosyntactic properties indicates a shift from syntax (pode ser1) to discourse (pode ser2), interpreted as a development of (inter)subjectification.

Consider a finite body of mass m (C1) with moments of inertia A, B and C. This body orbits another one of mass much larger M (C2), which at first will be taken as a point, even if it is not completely spherical. The body C1, when orbit C2, performs a translational motion near a Keplerian. It will not be a Keplerian due to external disturbances. As is known, such expansions are delicate because of the convergence issue. Thus, we intend to make a development until the third order (superior orders are not always achievable because of the volume of terms generated in cases of first-order resonances). By defining a modern set of canonical variables (Andoyer), we will assemble a disturbed Hamiltonian problem. The Andoyer's Variables allow to define averages, which enable us to discard short-term effects. Our results for the resonant angle variation of Mercury are in full agreement with those obtained by D'Hoedt & Lemaître (2004) and Rambaux & Bois (2004)

Users' psychological characterization of the Birigui Mental Health Clinic

To improve mental health services, the World Health Organization proposes an “epidemiological approach” based on the constant screening of existing research, and aimed at continuous improvement of psychological treatment rather than strict application of prescribed techniques. This study provides an epidemiological survey conducted at the psychology ward of the municipal Ambulatório de Saúde Mental in Birigui, São Paulo, Brazil. Data from 180 patients in psychotherapeutic care were collected, and subsequent descriptive analysis showed that the population consisted predominantly of adults (82.8% of total) and females (81.0%). Depressive disorder was the most common symptom (61.1%), and the majority of the participants (72.2%) received psychological treatment for the first time. The data presented in this paper can assist mental health professionals in selecting appropriate treatment by creating a profile of patients.
