Esta pesquisa discute configurações institucionais ótimas e sugere, nas atuais circunstâncias brasileiras, mecanismos de cooperação inter-institucional, de sorte a maximizar a eficiência de ações conjuntas entre agências regulatórias e de defesa da concorrência, minimizando os custos de coordenação. A pesquisa contém três partes. A primeira discute aspectos teóricos de um sistema de competências complementares entre a autoridade de defesa da concorrência e a agência regulatória, destacando suas eventuais vantagens comparativamente às possíveis configurações institucionais alternativas. A segunda contém breve sumário da experiência histórico-concreta nos planos mundial e nacional, procurando situar, na medida do possível, diferentes países e setores em tipologia sugerida na primeira parte. A terceira apresenta algumas recomendações de política.

In this thesis, the basic research of Chase and Simon (1973) is questioned, and we seek new results by analyzing the errors of experts and beginners chess players in experiments to reproduce chess positions. Chess players with different levels of expertise participated in the study. The results were analyzed by a Brazilian grandmaster, and quantitative analysis was performed with the use of statistical methods data mining. The results challenge significantly, the current theories of expertise, memory and decision making in this area, because the present theory predicts piece on square encoding, in which players can recognize the strategic situation reproducing it faithfully, but commit several errors that the theory can¿t explain. The current theory can¿t fully explain the encoding used by players to register a board. The errors of intermediary players preserved fragments of the strategic situation, although they have committed a series of errors in the reconstruction of the positions. The encoding of chunks therefore includes more information than that predicted by current theories. Currently, research on perception, trial and decision is heavily concentrated on the idea of 'pattern recognition'. Based on the results of this research, we explore a change of perspective. The idea of 'pattern recognition' presupposes that the processing of relevant information is on 'patterns' (or data) that exist independently of any interpretation. We propose that the theory suggests the vision of decision-making via the recognition of experience.

This dissertation presents the result of a study accomplished on the degree of use of the certificate of hospital Accreditation as one of the criteria for the accreditation of hospitals by the health insurance companies. Should be emphasized that the Accreditation Certificate represents the main final product of Hospital Accreditation Brazilian Program, being the first emitted when the hospital assists to the quality patterns specified by the Program. In that way, the study focus was, in general terms, Hospital Accreditation Brazilian Program and, more strictly, the Accreditation Certificate and it use. To reach the objectives proposed by the study, interviews were accomplished with the professionals responsible for the accreditation of the hospitals in the main health insurance companies of Brazil. In the total, five companies were consulted among the ten larger health insurance companies of Brazil, considering the number of beneficiaries. To complement the research, additional information were collected in the National Agency of Supplemental Health. It was verified, through the research, that the health insurance companies don't use the Accreditation Certificate given by the Hospital Accreditation Brazilian Program to accredit hospitals.

The Brazilian energetic sector is passing through deep transformations. The restructure is mainly characterized by the passage from a vertical and centrally coordinated system, in hands of the State, to a more horizontal one, with characteristics of a network, in which organizations, such as the National Agency of Electric Energy (ANEEL), the new regulator entity, the Wholesaler Market of Electric Energy (MAE), the National Operator of Electric System (ONS), Eletrobrás and the National Bank of Economic and Social Development (BNDES) are designated as the principals integrators of the system. The objective of the present work was to analyze the influence of the privatization and restructuring processes in the integration of the Brazilian system of electric energy. The analysis was based on the instruments offered by the network approach. The results of the research show that the Brazilian sector of electric energy cannot be considered as a highly integrated network. In this new horizontal configuration, the social actors are affirming its roles, functions and objectives, while the key-organization like ANEEL, ONS, MAE, Eletrobrás, and BNDES are being structured to strengthen its integrative role.

An accident with Brazilian Satellite Launching Vehicle (SLV-1 V03) third prototype in August, 2003 at Alcântara Base, in the State of Maranhão, dramatically exposed accumulated deficiencies affecting Brazilian space sector. A report regarding this accident published by Ministry of Defense recognized the relevance of organizational dimension for the success of Brazilian space policy. In this case study, the author analyses sector organizational structure - the National Space Activities Development System (NSADS) - to evaluate its adequacy to policy development requisites. The Theory of Structural Contingency - TSC provided the analytical framework adopted in the research complemented by two organizational approaches that focuses high risk systems: Normal Accident Theory - NAT and High Reliability Theory - HRT. The last two approaches supported the analysis of NSADS's organizations which are, according to Charles Perrow definition, directly involved in developing high risk technological systems and their relationship with the System. The case study was supplemented with a brief comparison between NSADS and the organizational structures of North-American and French civilian space agencies, respectively, NASA and CNES, in order to subsidize organizational modeling of Brazilian System.

This work is analyzing the challenges which the National Petrol Agency is facing to regulate the Petrol industry in Brazil after the Monopoly crash in the period between 1997 until 2005. Due to the necessities of adaptation of its political strategies to the rules which determine the international economic flows, Brazil was forced to use the Economic Regulation in order to control the market. The regulation established in Brazil is not indifferent to imperfect markets. Thus can be find a conflict of interests among companies, the government and consumers within this process of regulation. The established agency does not have enough autonomy for administrating a regulation. The State with its paternalism power does not allow the agency to fulfill its function for which it was established, even though its function was established by law. A regulating policy which is clearly defined will establish a strong and independent agency with a clear limitation of its competences, avoiding divergent interpretation which prioritizes investments and promotes economic development. The agency will have the challenge to regulate the companies that enter the sector, allowing the opening of the market for new initiatives of investments which contribute to the welfare of the country and breaking at the same time the monopoly that is lead by Petrobras since 1953. Combining a stable set of rules with agility in order to adapt to changes will provide the regulator with a great decision-making power. The flexibility in the regulation will improve the correcting of the rules that were set in the beginning, being more efficient, which are based on acquired experience and achieved results. The structure of the agency and the flexibility of the regulation should be orientated on the promotion of competition in order to achieve economic and social development.

Evolution is present in world dynamics. And it is just in such transformational environment where companies have been encapsulated. In an economy of knowledge, physical assets alone are unable to provide profits to meet shareholders' demands. Now there comes an invisible component with the purpose of defining strategies and impelling results: Intangible Assets. Banking financing systems, however, have not kept pace with this knowledge revolution and its resulting new income generation techniques. Credit analysis methods for most financing agents would not employ any intangible parameters in their methodology of study as yet. This paper seeks to discuss the importance of intangible assets by focusing their role of influencial factor in decisions to finance technology-based companies. By studying the credit risk classification system employed by FINEP, Brazil's Federal Agency for innovation development, we wished to suggest indicators for intangibles which might be put to use in the Financiadora.

presente trabalho objetiva construir um Modelo Exploratório de desenvolvimento de tecnologia da informação, aplicável no Brasil, tendo como referência as formas de organização do trabalho e da produção das comunidades Linux. O Modelo deve ser aplicado em ambiente Internet, ou em outras redes de telecomunicação. Por essa razão, utiliza métodos e técnicas de aprendizado à distância e e-Iearning. A construção do Modelo apoia-se, como alicerce teórico fundamental, no conceito de convivialidade de Illich (1976), no entendimento de Inose e Pierce (1984) sobre comunidades de interesse e democratização da produção de software, nos estudos de Malone (1997, 1998) referentes a modelos de organização em rede, nos estudos de Weber (2000) sobre comunidades de interesse online, na metodologia de capacitação "Pensamento Digital" de Joia (1999-1, 1999-2) e na estratégia pedagógico-metodológica do Australian National Training Authority (T AFE/SA). No entanto, as pesquisas de Matesco (2000, 2001) tomaram exeqüível a idéia da construção do Modelo, tendo que vista que o Modelo Exploratório proposto aplica-se, preferencialmente, a países, regiões, empresas ou organizações dependentes tecnologicamente de seus parceiros negociais e com escassez de recursos para aplicar em pesquisa e desenvolvimento. O caminho metodológico para a construção do Modelo inicia-se com uma sucinta abordagem sobre o sistema operacional Linux, a descrição das formas de organização das comunidades Linux e a identificação das formas de organização do trabalho e da produção no Fordismo-Taylorismo e no pós-Fordismo. Situa o funcionamento das comunidades Linux em relação a essas formas de organização. Descreve o processo de formação do conhecimento no aprendizado à distância e no elearning. Aborda a experiência de outros países com o Linux e com as comunidades Linux. Principalmente, o sucesso obtido pelos países nórdicos em absorção de tecnologia. A seguir, fundamentando-se em duas pesquisas de Matesco (2000,2001), analisa a dependência tecnológica do Brasil e propõe o Modelo Exploratório, cujo objetivo é, prioritariamente, colaborar para a redução dessa dependência, por meio de um processo de formação de conhecimento, baseado no aprendizado à distância e e-Iearning do Linux e na propagação de comunidades Linux, empregando-se o modelo de organização em rede.

Este estudo considera, de forma conjunta, duas das principais vertentes teóricas sobre a estrutura de capital das empresas: a assimetria informacional, através do modelo do pecking order, de Myers e Majluf (1984), e a teoria dos conflitos de agência, tratada por Jensen e Meckling (1976). Mais especificamente, são enfocados os conflitos existentes em empresas onde existe definição de controle acionário e, sua possível influência na hierarquia das fontes de financiamento presente no pecking order. Ressalta-se, além das construções teóricas envolvendo as teorias mencionadas, a consideração explícita de características notoriamente presentes no mercado brasileiro, de forma a contribuir para um maior entendimento sobre a estrutura de capital no Brasil. O trabalho empírico considerou uma amostra composta de 322 empresas com ações negociadas na Bovespa no período compreendido entre 1996 e 2002. Foram utilizados dois tipos de testes nas proposições teóricas efetuadas: testes não paramétricos, devido à baixa exigência quanto aos parâmetros amostrais e, regressões em painel, onde foram consideradas as interações de diversas variáveis na determinação da estrutura de capital das empresas. Os principais resultados apontam uma forte confirmação para três, dentre as seis proposições efetuadas. Para uma, os testes apontaram resultados ambíguos, e ,para as duas remanescentes, as evidências foram contrárias às predições.

Este trabalho tem como objetivo verificar em que medida a flexibilização da gestão de recursos humanos na agência reguladora do setor elétrico brasileiro é consistente com a independência regulatória, entendida como autonomia de gestão nas dimensões financeira, técnica e de recursos humanos. A independência das agências reguladoras constitui mecanismo contra os efeitos negativos das ações de interesses privados, ou rent-seekers, e o uso político inadequado, gerador de ineficiências econômicas. O trabalho descreve o processo de constituição da diretoria colegiada, o regime e o quadro de pessoal vigente, e analisa o processo de reestruturação do setor elétrico brasileiro, concluindo que a contratação temporária e a tentativa de implementar regime jurídico diferenciado repete os equívocos e disfunções que caracterizaram a burocracia pública desde os anos trinta.

O presente estudo tem por finalidade abordar o novo papel da Controladoria num ambiente de trabalho, onde é exigido o envolvimento de todos os setores da empresa na busca dos resultados estabelecidos pelo conselho de Administração. A Controladoria como Ferramenta de Gestão Estratégica, teve como campo de aplicação a Telemar Norte Leste S/A - Telemar, empresa que surgiu com a privatização do sistema Estatal de Telecomunicações. A Telemar iniciou suas atividades cumprindo um rigoroso programa de metas de qualidade e de universalização exigido pela Agência de Telecomunicações - ANATEL. As exigências dos acionistas da Telemar, em relação ao retomo do capital investido, estabelecem uma nova maneira de gerir a organização com a introdução de Programas de Melhorias de Resultados. Neste contexto são abordados, detalhadamente, o Programa de Metas estabelecido na Telemar Norte Leste S/A - TELEMAR; a escolha de uma ferramenta Gerencial: O EBITDA; a concepção de uma estratégia para o envolvimento dos empregados, o despertar das forças intrínsecas da organização; a divulgação periódica dos resultados do programa e a distribuição de bônus individual a todos empregados. O desenvolvimento da pesquisa ampara-se numa metodologia que reúne os meios bibliográficos, documentais e de campo, com tratamento qualitativo de dados, na delimitação da categoria de estudo de caso.

A presente dissertação tem como objetivo estudar, no âmbito da estrutura organizacional de quatro das agências reguladoras nacionais - Agência Nacional de Energia Elétrica - ANEEL, Agência Nacional de Telecomunicações-ANATEL, Agência Nacional de Vigilância Sanitária - ANVISA e Agência Nacional de Saúde Suplementar - as instâncias que correspondem à alta administração destas (Diretorias Colegiadas), os locci de representação da sociedade (Conselhos Consultivos) nesta mesma estrutura, além dos canais de interrelação dos usuários e consumidores dos serviços e produtos regulados com as agências reguladoras (Ouvidorias). A instituição de Diretorias Colegiadas constitui-se em uma das características diferenciadoras das agências reguladoras no conjunto da administração pública. Porém, ao mesmo tempo em que permite-lhes alto grau de autonomia administrativa e, portanto, decisória, abre também, a possibilidade para a exacerbação do fenômeno do insulamento burocrático e o conseqüente excessivo poder discricionário de seus dirigentes . As instâncias de participação da sociedade na definição de políticas das agências (Conselhos Consultivos ou Conselho de Consumidores) funcionariam, não apenas como locus privilegiado de externalização das posições dos atores sociais com interesses nas políticas e ações das agências reguladoras, mas, também, como possível contraponto ao insulamento de sua alta direção. Os canais institucionalizados de interrelação dos usuários e consumidores dos serviços regulados com os órgãos reguladores (Ouvidoria), por meio dos quais aqueles fazem chegar até estes suas demandas, críticas, dúvidas e sugestões, constituem-se instrumentos de democratização no acesso da sociedade ao Estado, contribuindo para o aperfeiçaomento da cidadania. As consultas e audiência publicas, por sua vez, representam mecanismos de busca de subsídios e contribuições do ambiente externo às agências ao aprimoramento da tomada de decisões de seu corpo dirigente.

REPETRO, the special tax regime for importing and exporting goods for the exploration and drilling of oil and gas, aims at bringing foreign assets to Brazil enjoying a suspension or even an exemption of taxes, so that Brazilian industry may profit from about 8 billion American dollars in investments. The creation of normative devices as well as the management of the REPETRO model are under the exclusive responsibility of the Brazilian Internal Revenue Services. REPETRO was created in 1999 and is composed of the following customs treatments: importation of goods with suspension of taxes by use of the drawback special regime, suspension mode for national exporting industry; exportation with fictitious exit for the national industry; temporary admission of goods or assets used in oil exploration and production, attending to the needs of both the national and foreign market. Considering the inability of the Brazilian government in restructuring its foreign trade model so that a strong investment in technology could provide for the sector¿s needs, we must ask how we can change REPETRO to help the various companies in the oil business? The issue is very important for one of our main economic activities, though not enough studied. The energy sector has a strategic importance for the development and the economic independence of any country. The winds of globalization lead Brazil to open its economy in the last decade and the national policy for exploration and drilling (E&D) was altered. The government created a new agency dedicated to market control and energy policies, the National Agency for Oil and Biofuels (ANP). With the opening of the market, Petróleo Brasileiro S.A. - Petrobras, the Brazilian giant, lost the monopoly of the oil business. The P-50 Platform, with a capacity for 180,000 barrels per day, was imported based on REPETRO. When it began operating on April 21st, 2006, Brazil achieved self-sufficiency in oil production. The present work intends to estimate the main variables affecting the importation and exportation of goods and assets for E&D, showing how REPETRO works. We also intend to look at the results yielded by the REPETRO model for the development of the production of oil and gas in Brazil, as well as show proposals for its modernization. It has been established that even though since its implementation the REPETRO model has brought fiscal advantages through the reduction of tax costs relating to foreign commerce operations and the incentive of investments in the E&D area with the increase in the national oil production there remain the following limitations: lack of preparation and of knowledge of the model; lack of adjustement of the model to the reality of actitity of E&D of oil and gas; taxes over the pre-operational stage or investment in oil production stage; non-allowance of full access by the national industry to the supply of goods and products relating to the industrialization of goods allowed by REPETRO; other fiscal and administrative difficulties. We conclude that the REPETRO model is important for the development of the area of E&D of oil and gas, but not completely effective. It is necessary to change it or create a new model based on a new perspective of the customs treatment of the activities of exploration and production, minimizing administrative procedures relating to the operations of exportation and importation.

This dissertation presents a research aimed at identifying and explaining the individual perceptions as far as the introduction of computer technology concerning the organization change process and the reason underlying those changes, utilizing for study purposes, a customer attendance agency of INSS , located in São Luís-MA, which data collection was carried out by interviews with three managers and application of to thirty employees, all of them working at the unit researched. The core point was to identify feelings and perceptions of individuals, and the reason steering the change actions deployed in this office. Based on this perception, it is presented a literature review on the main thinkers who discussed the role, and the relevance of reasoning in the development of human relations, both in the organizations and in society. To start with, Max Weber thinking on rationality was introduced, on the sequence, the discussion raised by the Frankfurt School in its first phase, mainly on the Max Horkheimer thinking and finally it is shown a summary of Jurgen Habermas thinking, mainly concerning its communicative action theory proposed as a path to emancipation of individual of current instrumental reasoning. Summing up, we can conclude from this research that perceptions, feelings and opinions indicate that the institution uses to discuss with the civil servants the implementation of change process. For those servants the excessive functional control, the limitation of knowledge production and an artificial functional integration are consequences of the shape and intensity, as well as of computer technologies deployed in the institution. It is also shared by most of civil servants, including managers, that the overall participation would have more validity and would decrease the resistance to those changes. And it is also worth registering that despite of the servants having job stability, only 50% have positive expectations as far as its future in the institution.

In this text we tried to make a critic analysis of knowledge management, by means of case studies about some branches of Banco do Brasil S.A., trying to identify the presence or absence of elements that characterize the environmental working place focused on a continuous learning. The research was taken at several branches of Banco do Brasil S.A. in Curitiba ¿ State of Paraná ¿ Brasil. We asked the managers to answer the questions as they represent the leadership in every branch. The critic points that interfere positive or negatively the daily activities on knowledge management were examined, such as: time, administration of the branches, market changings, information systems, knowledge generation and transmission, besides the internal and external standard rules. The conclusion is that knowledge management in the researched branches is still in its beginning. Although there is an advanced technical infra structure and the managers have demonstrated some knowledge on this subject and are aware of its .importance for the company. The knowledge management is visualized more as an auxiliary technology for the updated models than a new way of managing the organization. The most important revolution expected - to modify the way of thinking and acting of the employees - is still in its starting point.
