This paper investigates income tax revenues response to tax rate changes taking into consideration that cash-cum-in-kind transfers are used as a redistributive package to the community. First, we show that when cash and in-kind transfers are not tied to be substitute instruments, a marginal income tax increase may unambiguously decrease the quantity supplied of labor (and tax revenues therein). Next, we show that whenever the government chooses the optimum provision for the publicly provided good the tax revenue function has a negatively-sloped part with respect to tax rates except for one case. Last, we consider Brazilian data - PNAD - from 1976 to 2008 to test our theoretical implications. Our estimations suggest a weak evidence in favor of the existence of a La er-type curve for Brazilian income tax revenues data. Moreover, wend that the actual average income tax rate seems to be below the estimated optimum level. In a shorter sample from 1996-1999, we nd evidence that labor supply decreases with tax rate when cash and in-kind transfers are in play. Using a pseudo-panel from the same shorter sample, we try to estimate the elasticity of taxable income, following Creedy and Gemmell (2012) and Saez et al. (2009). We explore a small tax reform between 1997 and 1998 that a ected only the higher income tax bracket, and evidence that Brazil is on the revenue reducing side of the La er Curve, at least for individuals in the higher income tax bracket.

Não é de hoje que o país assiste à descoberta de incontáveis casos de desvios de recursos públicos ou mesmo à má gestão de contratos de obra pública que ocasionam, além de grave prejuízo ao Erário, danos à sociedade, muitas vezes desprovida da utilidade que seria proporcionada pelo pactuado. Essas condutas normalmente são ensejadas por projetos de engenharia que podem ser considerados meras peças de ficção, pois não representam o esforço correto para a execução do bem que se deseja construir. A Lei nº 8.666/93 permite a licitação com base em projeto básico, o que, segundo a atual onda de pensamento brasileira, seja da doutrina, dos órgãos de controle, do Poder Legislativo e até mesmo da mídia, é, de fato, um sério problema a ser enfrentado, pois a sua contratação dá margem a aditivos, entendidos como os grandes vilões das obras públicas. Por isso, o Tribunal de Contas da União vem decidindo no sentido de fortemente restringir a possibilidade de alteração contratual e, além disso, tem capitaneado projetos no Congresso Nacional que visam praticamente à extinção da empreitada por preço unitário, espécie contratual na qual o risco do projeto, ainda sem as definições necessárias, acaba por ser assumido pela Administração contratante, responsável pela elaboração, e não pelo seu executor. Contudo, no caso de obras complexas de infraestrutura, deve-se perquirir se essa postura, que pretende acabar com a margem decisória do gestor público quanto à extensão da incompletude do projeto básico - e, portanto, do objeto do contrato -, merece ser repensada, não com vistas a possibilitar os recorrentes danos, mas no caminho de uma melhor programação das ações estatais. Isso porque nessas hipóteses, a busca por todas as informações necessárias para a confecção do projeto a ser ao final executado, no momento da elaboração do edital, ou é muito custosa ou simplesmente não é possível. Assim, seria mais eficiente a contratação integrada, prevista na Lei do Regime Diferenciado de Contratação, na qual o risco do projeto pode se alocado ao contratado. Ocorre que, como existem restrições, nem sempre é viável esse caminho. Nessa ordem de ideias, deve-se encontrar uma solução para que o tradicional contrato de obra pública supere os seus graves problemas de incentivos. A proposta do presente trabalho é a introdução de um procedimento de tomada de decisão transparente, que confira segurança jurídica e amplo conhecimento da sociedade, além de livre acesso aos órgãos de controle, a partir de critérios não apenas jurídicos, mas econômicos e técnicos.

Com base em proposições depreendidas da teoria da economia dos custos de transação, da teoria dos incentivos e dos contratos incompletos, esta pesquisa realiza um estudo de casos múltiplos buscando encontrar correspondentes empíricos para tais formulações. O foco dessa dissertação está em uma oportunidade incomum: a ocorrência simultânea de dois diferentes modelos de parceria com sistemas de incentivos distintos aplicados ao mesmo serviço. O Poupatempo e a Unidade de Atendimento Integrado - UAI, dois importantes programas regionais brasileiros de atendimento presencial ao cidadão, que possuem objetivos semelhantes e que empregaram recentemente diferentes modelos de parceria. Enquanto São Paulo utilizou da terceirização para expandir o Poupatempo desde 2007, Minas Gerais desenvolveu o UAI desde 2011 com uma parceria público-privada. Este estudo de casos múltiplos desenvolve-se com base em uma análise contratual que identifica os incentivos formais das parcerias aliada a avaliação dos resultados dos agentes privados com base nos relatórios de desempenho. Para além da análise destes documentos, entrevistas semiestruturadas nos permitem analisar as variáveis não-contratuais. Assim, os elementos extraídos dos dois casos nos permitem observar os pressupostos depreendidos das três teorias.

Exclusivity contracts can help stations by providing brand-value that allows them to obtain higher profits, relative to unbranded retailers. However, branded retailers may have a stronger negative effect over its competitors’ profits. It is not clear which one of these two effects dominates (brand-value vs competition effect). Therefore, the impact of exclusivity over the number of participants in the downstream market is not determined. In this paper, I empirically study the effects of exclusivity agreements on competition in the Brazilian gasoline sector. In order to do so, I estimate an entry model of endogenous product-type choices using data of retailers’ locations and contract choices along with data from the 2010 Brazilian Census. I use my estimates to simulate entry decisions under two counterfactual scenarios: i) mandatory exclusivity and ii) no exclusivity.

The existence of inequalities among the Brazilian regions is an indeed fact along the country s history. Before this reality the constitutional legislator inserted into the Federal Constitution of 1988, as a purpose of the Federative Republic of Brazil, the reduction of regional inequalities. The development has also been included as a purpose from the State, because there is an straight relation with the reduction of regional inequalities. In both situations is searched the improvement of people s living conditions. . In pursuit of this achievement, the State must implement public policy, and, for this to happen, it needs the ingress of income inside of the public coffers and support of economic agents, therefore the importance of constitucionalization of the economic policy. The 1988 s Constitution adopted a rational capitalism regime consentaneous with current legal and social conceptions, that s why it enabled the State s intervention into economy to correct the so-called market failures or to make the established objectives fulfilled. About this last one, the intervention may happen by induction through the adoption of regulatory Standards of incentive or disincentive of economic activity. Among the possible inductive ways there are the tax assessments that aim to stimulate the economic agents behavior in view of finding that the development doesn t occur with the same intensity in all of the country s regions. Inside this context there are the Export Processing Zones (EPZs) which are special areas with different customs regime by the granting of benefits to the companies that are installed there. The EPZs have been used, by several countries, in order to develop certain regions, and economic indicators show that they promoted economic and social changes in the places where they are installed, especially because, by attracting companies, they provide job creation, industrialization and increased exports. In Brazil, they can contribute decisively to overcome major obstacles or decrease the attraction of economic agents and economic development of the country. In the case of an instrument known to be effective to achieve the goals established by the Constitution, it is duty of the Executive to push for the law that governs this customs regime is effectively applied. If the Executive doesn t fulfill this duty, incurs into unjustifiable omission, correction likely by the Judiciary, whose mission is to prevent acts or omissions contrary to constitutional order

Outsourcing has emerged as one of the new ways of guiding the work. For its advantages and be consistent with the paradigms of managerial reform, outsourcing also started to be used in the Public Administration. However, taking into account the particularities of the latter, some issues are relevant when outsourcing concluded with the State. Gains notoriety, for example, the step of monitoring these contracts, to the extent that, from this activity, we can avoid the negative effects of outsourcing like the fact that the state will pay for labor and wage liens that are obligation of the company providing the services. This study aims to understand the perception that this process is under the Federal University of Rio Grande do Norte, from the point of view of different stakeholders, also explaining the motivations that these agents have to perform the supervisory process. As a theoretical basis was used the Agency Theory, which reinforces the supervisory activities as a necessary means to minimize moral hazard and adverse selection, seeking to understand not only the different motivations tax contracts to properly perform their duties, but also analyze other phenomena arising from this contractual relationship. To achieve the proposed objectives, were taken a literature review and a presentation of how to organize the management and oversight of contracts in UFRN. The methodological procedures included questionnaires and interviews with those involved in the process. After analyzing the results obtained in the survey instruments , and also based on the laws, regulations and instructions governing the procurement process within the UFRN, it was concluded that the process of overseeing the outsourcing of labor contracts in UFRN is not fully institutionalized, some points should be strengthened in order to have the consolidation of this process, highlighting the need for training of UFRN servers that act as tax, the knowledge that the contractual penalties are applied effectively, the need that there is a supervisor of tax of contractors and also the realization of the rotation system of outsourced employees

This study has as main objective to verify the effect of the tax and financial incentives granted by the brazilian states, specially in the reduction of ICMS on the investment decision of the entities, which in the last years led to the companies to decide new projects in based on the region that presented the better infrastructure beyond lesser tributary expense. For in such was made an economic valuation of the companies with focus in the beneficiary s optics using an adaptation of the Discounted Cash Flow method to measure the impact of the tax incentives in the value of the companies, this study selected the textile industry segment located in the State of Rio Grande do Norte, Brazil. The results indicated that such incentives created addition in the value of the companies, however the inexistence of incentives would not be enough to a negative decision of investment in the Rio Grande do Norte. The smallest difference between the value with and without incentive observed was 8.9%, and the biggest 31.7%, and the average of value aggregation with the tax incentives represented 18.9%

This work presents results derived from a study related to impact on non-controllable costs in the determination of energy taxes. This is done analyzing tax review practiced by concessionaries responsible for the distribution of electrical energy located in the Northeastern Region of Brazil, between 2003 and 2004. This Region was chosen as a study area due to the researcher s expectation in congregating companies that deliver services to markets that have similar social-economical profiles. A brief explanation related to the restructuring of the electrical sector in Brazil is presented, pointing out that there was privatization of the great majority of these companies. The study also points out the definition of regulating rules in service delivery process. The components of taxes that are practiced by these companies aimed at final consumers, as well as the market as a whole and the revision process that is executed by Agência Nacional de Energia Elétrica ANEEL for the definition of these taxes are demonstrated in the research. A brief historical of the concessionaires that were focus of the research is presented, totaling five companies. Some data used by ANEEL in the tax review process was analyzed as well as data on components of approved taxes. It is concluded that as a media 47, 49% of the components of taxes in the researched companies correspond to the non-controllable costs. These is done considering previous classification by ANEEL in the tax review process. Although, if it is considered that these companies since 2006, by the means of participation in energy auctions are able to negotiate energy prices for their own needs, it is concluded that these concession contracts guarantee the delivery of the service to the costumer in the total tribute. The percentage of non-controllable costs is 16, 27% average of the tax. This means, amongst other information, that the government has a great deal of responsibility in the formation of price practiced by these companies and its target markets
