The study examines the relationship between law, technology and water conflicts from colonial days to the present in traditional (water) tank systems in the south Indian state of Tamil Nadu. Tanks are man-made water systems developed for irrigation and many other purposes in semi-arid areas. The thesis adopts a historical approach to study the development of law, particularly property rights, and takes an empirical approach to investigate the tank conflicts. Archival documents on irrigation development, Case laws, Focus Group Discussions, Open ended Interviews and Field visits to selected tank chains are used as source material for the discussion. Case studies of conflicts are described and analyzed at three levels - Vaigai river basin for a macro level, Kothai Anicut system in Cauvery basin for a meso level, and twenty other interconnected tanks for a micro-level. The thesis deviates from the conventional understanding that tanks as traditional systems as simple and local technologies but considers them to be complex. It argues that the use of commonly held systems such as tanks within the colonial and post colonial laws as state ownership has been the source of many conflicts. In particular, it finds most tank conflicts are a product of progressive and absolute state control over water and the systems established using colonial land revenue administrative law. The law continues to treat tanks as pieces of landed property held by state and the individuals rather than as technology systems that presupposed the regime of property rights introduced after the colonial times. The modern interventions in water including the reservoir building, and altering the hydraulics of rivers and streams aggravate tank conflicts and lead to their further detriment. The study brings the focus to ground realities, and offers new perspectives on understanding tank systems in dynamic ways.

The present work aims to achieve and further develop a hydrogeomechanical approach in Caldas da Cavaca hydromineral system rock mass (Aguiar da Beira, NW Portugal), and contribute to a better understanding of the hydrogeological conceptual site model. A collection of several data, namely geology, hydrogeology, rock and soil geotechnics, borehole hydraulics and hydrogeomechanics, was retrieved from three rock slopes (Lagoa, Amores and Cancela). To accomplish a comprehensive analysis and rock engineering conceptualisation of the site, a multitechnical approach were used, such as, field and laboratory techniques, hydrogeotechnical mapping, hydrogeomechanical zoning and hydrogeomechanical scheme classifications and indexes. In addition, a hydrogeomechanical data analysis and assessment, such as HydroPotential (HP)Value technique, JW Joint Water Reduction index, Hydraulic Classification (HC) System were applied on rock slopes. The hydrogeomechanical zone HGMZ 1 of Lagoa slope achieved higher hydraulic conductivities with poorer rock mass quality results, followed by the hydrogeomechanical zone HGMZ 2 of Lagoa slope, with poor to fair rock mass quality and lower hydraulic parameters. In addition, Amores slope had a fair to good rock mass quality and the lowest hydraulic conductivity. The hydrogeomechanical zone HGMZ 3 of Lagoa slope, and the hydrogeomechanical zones HGMZ 1 and HGMZ 2 of Cancela slope had a fair to poor rock mass quality but were completely dry. Geographical Information Systems (GIS) mapping technologies was used in overall hydrogeological and hydrogeomechanical data integration in order to improve the hydrogeological conceptual site model.

Creating an innovative tool that takes advantage of digital interconnectivity between shipping agencies and husbandry services suppliers was the starting point. But the main purpose of this paper is to figure out if that represents a business opportunity. It describes the preliminary stages undertaken, as the connections with the main potential providers of the husbandry services. This was carried out as a qualitative research, based on interviews given by shipping agencies that contributed as a source of data about their activities but also to survey their acceptance of the concept that could change the way of doing business in this area.At the same time, inquiries have been made to build financial scenarios that show the costs and revenue streams allocated to this project. Considering the data collected from the main players in husbandry services and the different outcomes, the feasibility of this project is assessed. Even though the paradigm was well received by all the firms contacted, the development costs turn out to be the main threat to the project so further steps are advised.

Abstract The aim of this research project is to draw on accounts of experiences ofborder crossing and regulation at the Canada/U.S. border at Niagara in order to illuminate the dynamics of differentiation and inequality at this site. The research is informed by claims that the world is turning into a global village due to transnational flows oftechnology, infonnation, capital and people. Much of the available literature on globalization shows that while the transfer of technology, information, and capital are enhanced, the transnational movement of people is both facilitated and constrained in complex and unequal ways. In this project, the workings of facilitation and constraint were explored through an analysis often interviews with people who had spent a substantial portion oftheir childhood (e.g. 5 years) in a Canadian border community. The interviewees were at the time ofthe research between the ages of 19 and 25. Because most ofthe respondents were 'white' Canadians of working to upper middle class status, my focus was to explore how 'whiteness' as privilege may translate into enhanced movement across borders and how 'white' people may internalize and enjoy this privilege but may often deny its reality. I was also interested in how inequality is perceived, understood, and legitimated by these relatively privileged people. My analysis ofthe ten accounts ofborder crossing and regulation suggests that differentially situated people experience border crossing differently. An important finding is that while relatively privileged border crossers perceived and often problernatized differential treatment based on external factors such as physical appearance, and especially race, most did not challenge such treatment but rather saw it as acceptable. These findings are located within newer literature that addresses the increasing securitization ofborders and migration in western societies.

David Brooks was the acting quarterman of shipwrights in his Majestys Dock Yard in Portsmouth. He resided at Ridge Street Halfway Houses in Portsea. He was married to Sally Brooks, who was the daughter of Will Thomas Baker of Kent County. Mr. Baker died on May 11, 1811. David and Sally had 5 children: David, Charles, Thomas, Sarah Ann and Hannah Baker. Mr. Brooks bequeathed all his possessions to his wife Sally. After his wifes death he wanted his belongings and land to be divided equally between all of his children when they reached the age of 21. He names his wife Sally, and his brother, Isaac Brooks as executors of the will.

Au cours d'une transaction portant sur une acceptation bancaire (ci-aprs BA tel que dnomme dans le jargon juridique) diffrents types de relations peuvent s'tablir entre les parties impliques, certaines plus directes que d'autres. Dans une transaction donne, part le client et la banque, on peut trouver une ou plusieurs banques participantes et un ou plusieurs investisseurs, qui deviennent dtenteurs de BA. La situation peut devenir complexe et les relations lgales risquent de devenir assez compliques. Cependant, il est important d'identifier si la relation s'est tablie travers l'instrument de BA, si elle existe par le biais d'une relation contractuelle ordinaire ou encore, si elle existe par le fait de la loi. Une bonne analyse des circonstances entourant la transaction, des facteurs connexes la transaction et des droits et obligations qui existent entre les parties, sera ncessaire pour dterminer laquelle de la loi provinciale ou fdrale s'appliquera, et dans quelle mesure. Une fois accorde, la BA est gouverne par la Loi sur les lettres de change. Toutes solutions apportes un problme qui implique des BA, doivent, en principe, respecter la nature inhrente de la BA en tant qu'effet de commerce, gouvern par la loi fdrale. En matire de BA, c'est, soit la Loi sur les lettres de change soit la Loi sur les lettres et billets de dpt (Depository Bills and Note Act) qui s'appliqueront l'acte. Comme il existe des lois fdrales applicables la BA, l'objet de notre tude est de dterminer si, et dans quelle circonstance la loi de la province, tel que le Code civil du Qubec, trouvera application et claircira dans certains cas la disposition contenue dans la Loi sur les lettres de change, notamment lorsque les dispositions de ladite loi sont silencieuses ou ambiges. La solution la plus simple serait d'appliquer la loi provinciale aux matires qui ne sont pas traites dans la loi, tant donn que les lois provinciales apportent souvent un complment la lgislation fdrale. Cependant, la Loi sur les lettres de change contient des dispositions spciales, tel que l'article 9 qui stipule : 9. Les rgles de la common law d'Angleterre, y compris en droit commercial, s'appliquent aux lettres, billets et chques dans la mesure de leur compatibilit avec les dispositions expresses de la prsente loi. Cette disposition a cre une certaine confusion relativement l'application du droit civil du Qubec en matire de Lettres de change. En effet, il existe un doute quant savoir si l'application de l'article 9 est une incorporation par rfrence qui exclue totalement l'application du droit civil. Cette question continue de se poser inexorablement dans la doctrine et la jurisprudence. Elle a en effet donn lieu une srie de thories quand au degr d'application de la common law en matire de lettres de change. Une revue de la jurisprudence dominante nous permet de conclure que les tribunaux ont accept l'application du droit provinciale dans certaines questions impliquant les lettres de change. La question essentielle traite lors de notre analyse est la suivante: lorsqu'un litige prend naissance dans une transaction de BA, quelle est la rgle qui devra s'appliquer? Quel sera le droit qui gouvernera les problmes mergeant dans une BA, celui du Code Civil du Qubec ou celui de la common law d'Angleterre? tant donne le nombre de cas qui sont ports devant les cours de justice en rapport avec des transactions de BA, comprendre quelle sera la loi applicable est d'une importance fondamentale. Pour rpondre cette question, nous commencerons par un examen de l'historique, du dveloppement et de l'volution de la BA. Afin de mieux comprendre la BA, nous dbuterons par un bref survol des origines de cet instrument juridique. Dans le deuxime chapitre, nous analyserons la nature et le caractre lgal de la BA. Cela constituera le cadre aux travers duquel nous pourrons identifier les rgles et les principes qui s'appliquent aux diffrents aspects de la transaction de BA. Le chapitre trois fera l'objet d'un examen dtaill des mcanismes de l'opration de BA tout en tudiant de prs les exigences imposes par la lgislation applicable. Aprs avoir examine l'aspect lgal de la BA, nous procderons au chapitre quatre, l'tude de l'applicabilit de la loi provinciale relativement certains aspects de la transaction de BA. A cet effet, nous examinerons les diffrentes approches de comprhension de la Loi sur les lettres de change et plus particulirement la problmatique rencontre l'article 9. Nous tudierons aussi l'application et l'interprtation de cette loi par les tribunaux du Qubec au cours du sicle dernier. Les juges et les juristes se sont penchs sur les sens qu'a voulu donner le lgislateur lorsqu'il a stipul dans l'article 9 Le rgles de la common law d'Angleterre, y compris en droit commercial, s appliquent aux lettres, billets et chques dans la mesure de leur compatibilit avec les dispositions expresses de la prsente loi . Cette section doit-elle tre applique la lettre, nous obligeant appliquer la common law d'Angleterre a chaque problme qui peut se poser en relation avec les lettres et les billets? Le Parlement a-t-il l'intention que cette disposition s'applique galement au Qubec, dont le droit priv est bas sur le systme du Code Civil? Notre tude portera sur les diffrentes approches d'interprtation qui offrent une diversit de solutions au problme pos par l'article 9. Finalement, compte tenu des nouveaux dveloppements lgislatifs, au chapitre cinq, nous proposons une mthode en vue de dterminer la loi applicable aux diffrents aspects de la transaction de BA. Notre analyse nous a conduit adopter la solution propose par la majorit des juristes, la diffrence que notre approche de l'article 9 est base sur des raisons de politique. Nous avons donc adopt la stricte dichotomie (en tant qu'effet ngociable d'une part, et d'une sorte de contrat et de proprit de l'autre) en prenant en compte les difficults inhrentes dterminer quand l'un finit et l'autre commence. En conclusion, selon notre opinion, il existe deux solutions. Premirement, il y a la possibilit que l'article 9 puisse tre cart. Dans ce cas, toutes les matires qui ne sont pas expressment voques dans la loi tomberont dans la comptence de la loi provinciale, comme c'est le cas dans d'autres types de lgislations fdrales. Dans ces situations, le droit civil du Qubec joue un rle suppltif dans les applications d'une loi fdrale au Qubec. Deuximement, modifier l'article 9 plutt que d'en carter son application offre une autre possibilit. Incorporer la large stricte dichotomie dans l'article 9 nous semble tre une solution prfrable. La disposition pourrait se lire comme suit: Les rgles de la common law d'Angleterre incluant le droit commercial dans la mesure ou elles ne sont pas incompatibles avec les dispositions expresses de la Loi, sappliquent aux lettres, billets, et chques au sens stricte. Pour plus de certitude, les lettres et les billets au sens strict, incluent la forme, la dlivrance et Imission des lettres, billets, et chques. Ce type de changement se rvlera tre un pas important dans le but de clarifier la loi et dterminer l'quilibre trouver entre l'application des lois fdrales et provinciales en matire de BA.

Cette dissertation propose un nouveau rcit des expriences de William Faulkner Hollywood afin de rvaluer la deuxime moiti de son uvre de fiction. Dans ses premiers projets de scnarios de films, Faulkner a choisi dadapter des uvres de fiction quil avait publies antrieurement. la lumire de lutilisation du genre autant des films que des personnes par les studios dHollywood pour organiser la production et le marketing des films, la fiction de Faulkner apparut soudainement comme perverse et ses reprsentations de la masculinit comme homorotiques. Dans les premiers jets de Turn About et de War Birds, Faulkner sapproprie les normes du genre hollywoodien pour nier ces connotations sexuelles. Ses rvisions ultrieures rvlent un recul systmatique par rapport la perversit dHollywood et au genre du womans film, au profit de la performance de la masculinit propre aux war pictures. Ses rvisions rimaginent galement des matriaux qui sont au cur de son uvre de fiction. Quand il se remet crire de la fiction, Faulkner rpte cette approche narrative dans des nouvelles telles que Golden Land et An Odor of Verbena, deux rcits qui rompent avec les pratiques et le style de ses premires fictions majeures. Les consquences dcoulant de cette influence hollywoodienneune volont dradiquer toute connotation sexuelle, ladoption authentique plutt quironique du mlodrame gnrique, et une rhtorique morale explicitement construite comme une ngation dHollywoodse manifestent plus tard dans des textes aussi divers que The Reivers, Compson Appendix, ou son discours de rception du Prix Nobel. Vues sous cet angle, les dernires fictions de Faulkner deviennent une composante essentielle de son uvre, fournissant une base nouvelle pour rexaminer la place des genres narratifs populaires, du genre et de la sexualit dans son cycle de Yoknapatawpha.
