O estudo propõe desenhar as linhas mestras do processo civil brasileiro no quadro do Estado de Direito Democrático, pós Constituição Federal de 1988. Na primeira parte, partindo da origem do direito processual constitucional brasileiro na Constituição Republicana de 1891 visa a abordar as mudanças ocorridas com a constitucionalização do processo, o que significa reconhecer que na formação e desenvolvimento do direito processual brasileiro atuaram forças paradoxais (recepção da judicial review, do direito norte-americano, e recepção do direito europeu-continental, no CPC de 1973) e que este paradoxo tende a ser superado pela virada paradigmática da racionalidade jurídica e das relações entre Direito e Política no marco do Estado Constitucional. Estabelece, como primeira mudança, a relação entre a racionalidade prática procedimental e a necessidade de resgate da pretensão de correção para a lógica jurídica. Dessa percepção decorre uma outra alteração profunda, na atuação do direito em juízo, apontando para a combinação entre o modelo normativo de democracia deliberativoprocedimental (HABERMAS) e o processo cooperativo (ALVARO DE OLIVEIRA) Na segunda parte do estudo, a tese coloca essas premissas frente aos necessários desenvolvimentos do direito processual pós Constituição de 1988. Analisa-se, criticamente, as seguintes atitudes fundamentais: a) a configuração e o conteúdo do direito processual constitucional na doutrina atual e sua adequação ao contraditório como “valor-fonte” do direito processual contemporâneo; b) as relações entre direito material e direito processual; c) a teoria das fontes do direito, apresentando a jurisprudência como fonte primária, em razão da recepção tardia e mitigada do stare decisis no direito brasileiro (súmulas vinculantes, decisões vinculantes em controle de constitucionalidade e jurisprudência dominante dos tribunais), bem como, da importância dos modelos judiciais na densificação dos conteúdos das normasprincípio e das cláusulas abertas. Com isso procura-se apontar para a dissolução dos antagonismos radicais entre as tradições do ocidente (common law e romano-germânica) e seus métodos: o Code-Based Legal System e o Judge-Made Law System. A Constituição resgata, assim, o papel de centro e fator de unidade no ordenamento jurídico brasileiro, também para o processo civil, comprometendo todo o ordenamento jurídico com a democratização das fontes de poder, inclusive o debate judicial.

As Brazil wants to be perceived as a competitor in providing computer applications and system development services in the global market, the concept of Software Factory gains importance. The metaphor for the 'Factory', when applied to the activity of software development, is used to describe organizations which produce software with a minimum quality standard and at competitive costs. However, the term 'Factory' recalls Fordist concepts, which have been challenged for a few decades in the manufacturing industry. This study analyzed university curricula and how students and teachers perceive the concept of Software Factory and assessed them in relation to the Fordism ------------ post-Fordism /continuum/. It was observed that some of the teachers who have influence over curricula define Software Factories according to Fordist concepts. It was also observed that, despite opportunities for improvements, curricula are adequately structured with regards to the skills a professional at these organizations must possess. We conclude that education provided at the programs being analyzed is adequate, but that it must be supplemented by companies or by the professionals themselves so that the knowledge acquired in the programs may be put in practice.

O crescimento do papel da tecnologia nas interações entre empresa clientes, bem como do número de serviços baseados em tecnologia, vem alterando bruscamente as relações interpessoais e, em algumas instâncias, eliminando-as por completo. Por outro lado, tecnologia vem possibilitando, de forma drástica, aumento no número de encontros entre os consumidores e as empresas, que faz crescer importância do tema. presente trabalho tem como objetivo estudar insatisfação dos consumidores no atendimento, através da decepção sofrida, abordada quando esta ocorre em dois níveis de interação destes com as empresas de serviços, descrevendo comparando estas ocorrências no atendimento pessoal impessoal neste último, através das novas tecnologias disponibilizadas pelas empresas prestadoras de serviços. Os dados analisados foram coletados através de uma netnografia, ou etnografia na internet, adaptada ao estudo de comunidades online, uma nova metodologia em pesquisa qualitativa que tem por finalidade estudar as culturas comunidades que estão surgindo através das comunicações via computador, conforme proposto por Kozinets (2002). Através da análise de conteúdo dos relatos, buscou-se analisar os antecedentes conseqüentes da insatisfação decepção dos consumidores, analisando-os, descrevendo-os comparando-os. Conclui-se que as falhas são maior fonte de insatisfação para ambos os tipos de consumidores, além de outras similaridades observadas; que os consumidores que buscam atendimento pessoal exigem um tratamento mais caloroso; aqueles que buscam atendimento via novas tecnologias são menos tolerantes às falhas; que ambos recorrem meios diferentes daquele que foi fonte da decepção na tentativa de resolver seus problemas.

Shrimp farming is one of the activities that contribute most to the growth of global aquaculture. However, this business has undergone significant economic losses due to the onset of viral diseases such as Infectious Myonecrosis (IMN). The IMN is already widespread throughout Northeastern Brazil and affects other countries such as Indonesia, Thailand and China. The main symptom of disease is myonecrosis, which consists of necrosis of striated muscles of the abdomen and cephalothorax of shrimp. The IMN is caused by infectious myonecrosis virus (IMNV), a non-enveloped virus which has protrusions along its capsid. The viral genome consists of a single molecule of double-stranded RNA and has two Open Reading Frames (ORFs). The ORF1 encodes the major capsid protein (MCP) and a potential RNA binding protein (RBP). ORF2 encodes a probable RNA-dependent RNA polymerase (RdRp) and classifies IMNV in Totiviridae family. Thus, the objective of this research was study the IMNV complete genome and encoded proteins in order to develop a system differentiate virus isolates based on polymorphisms presence. The phylogenetic relationship among some totivirus was investigated and showed a new group to IMNV within Totiviridae family. Two new genomes were sequenced, analyzed and compared to two other genomes already deposited in GenBank. The new genomes were more similar to each other than those already described. Conserved and variable regions of the genome were identified through similarity graphs and alignments using the four IMNV sequences. This analyze allowed mapping of polymorphic sites and revealed that the most variable region of the genome is in the first half of ORF1, which coincides with the regions that possibly encode the viral protrusion, while the most stable regions of the genome were found in conserved domains of proteins that interact with RNA. Moreover, secondary structures were predicted for all proteins using various softwares and protein structural models were calculated using threading and ab initio modeling approaches. From these analyses was possible to observe that the IMNV proteins have motifs and shapes similar to proteins of other totiviruses and new possible protein functions have been proposed. The genome and proteins study was essential for development of a PCR-based detection system able to discriminate the four IMNV isolates based on the presence of polymorphic sites

Vários procedimentos são utilizados para avaliar o potencial fisiológico de sementes, sendo fundamental a utilização daqueles que reflitam melhor o desempenho em campo. A pesquisa teve como objetivo avaliar o potencial fisiológico de sementes de soja por meio de testes de avaliação rápida, de vigor, de emergência de plântulas em campo e análise computadorizada de imagens (SVIS®), procurando identificar o procedimento mais eficiente na separação de lotes. Cinco lotes das cultivares BRS Valiosa RR e CD 208 foram avaliados em duas épocas (antes e após armazenamento) pelos testes de germinação, de avaliação rápida (embebição em água e pH do exsudato), de vigor (envelhecimento acelerado e condutividade elétrica), de emergência de plântulas em campo e análise computadorizada de imagens (SVIS®). Os testes de germinação em areia, de condutividade elétrica e de embebição em água foram eficientes na separação dos lotes, mas apenas este último possibilitou identificar diferenças consistentes entre os lotes nos dois períodos avaliados. Assim, o teste de embebição em água pode ser considerado promissor na composição de programas de controle de qualidade.

The power system stabilizers are used to suppress low-frequency electromechanical oscillations and improve the synchronous generator stability limits. This master thesis proposes a wavelet-based power system stabilizer, composed of a new methodology for extraction and compensation of electromechanical oscillations in electrical power systems based on the scaling coefficient energy of the maximal overlap discrete wavelet transform in order to reduce the effects of delay and attenuation of conventional power system stabilizers. Moreover, the wavelet coefficient energy is used for electric oscillation detection and triggering the power system stabilizer only in fault situations. The performance of the proposed power system stabilizer was assessed with experimental results and comparison with the conventional power system stabilizer. Furthermore, the effects of the mother wavelet were also evaluated in this work

The present work studied the influence of thermal treatment in oxygen rich atmosphere on heterogenous junctions in Mn-doped SnO2 polycrystalline system presenting varistor behavior. The samples were prepared by conventional oxide mixture methodology, and were submitted to heat treatment in oxygen rich atmosphere at 900 degrees C for 2h. The samples were characterized by X-ray diffraction, scanning electron microscopy, dc and ac electrical measurements. The results showed that there is an evident relationship between the microstructure heterogeneity and non-ohmic electrical properties. It was found that for this SnO2 center dot MnO-based varistor system the heat treatment in oxygen rich atmosphere does not necessarily increase the varistors properties, which was related to the decrease in the grain boundary resistance. The results are compared with Co-doped SnO2 varistors and ZnO based varistors. (C) 2008 WILEY-VCH Verlay GmbH & Co. KGaA, Weinheim.

In this work, we propose a two-stage algorithm for real-time fault detection and identification of industrial plants. Our proposal is based on the analysis of selected features using recursive density estimation and a new evolving classifier algorithm. More specifically, the proposed approach for the detection stage is based on the concept of density in the data space, which is not the same as probability density function, but is a very useful measure for abnormality/outliers detection. This density can be expressed by a Cauchy function and can be calculated recursively, which makes it memory and computational power efficient and, therefore, suitable for on-line applications. The identification/diagnosis stage is based on a self-developing (evolving) fuzzy rule-based classifier system proposed in this work, called AutoClass. An important property of AutoClass is that it can start learning from scratch". Not only do the fuzzy rules not need to be prespecified, but neither do the number of classes for AutoClass (the number may grow, with new class labels being added by the on-line learning process), in a fully unsupervised manner. In the event that an initial rule base exists, AutoClass can evolve/develop it further based on the newly arrived faulty state data. In order to validate our proposal, we present experimental results from a level control didactic process, where control and error signals are used as features for the fault detection and identification systems, but the approach is generic and the number of features can be significant due to the computationally lean methodology, since covariance or more complex calculations, as well as storage of old data, are not required. The obtained results are significantly better than the traditional approaches used for comparison

The analysis of large amounts of data is better performed by humans when represented in a graphical format. Therefore, a new research area called the Visual Data Mining is being developed endeavoring to use the number crunching power of computers to prepare data for visualization, allied to the ability of humans to interpret data presented graphically.This work presents the results of applying a visual data mining tool, called FastMapDB to detect the behavioral pattern exhibited by a dataset of clinical information about hemoglobinopathies known as thalassemia. FastMapDB is a visual data mining tool that get tabular data stored in a relational database such as dates, numbers and texts, and by considering them as points in a multidimensional space, maps them to a three-dimensional space. The intuitive three-dimensional representation of objects enables a data analyst to see the behavior of the characteristics from abnormal forms of hemoglobin, highlighting the differences when compared to data from a group without alteration.

Direct expressions for the design of a lead-lag continuous compensator using the root locus method and the procedure described in the 1970 and 1990 books by Ogata are presented. These results are useful in the Ogata design method because they avoid the geometrical determination of poles and zeros, making it easier to create a computer-based design.

Despite the frequent use of stepping motors in robotics, automation, and a variety of precision instruments, they can hardly be found in rotational viscometers. This paper proposes the use of a stepping motor to drive a conventional constant-shear-rate laboratory rotational viscometer to avoid the use of velocity sensor and gearbox and, thus, simplify the instrument design. To investigate this driving technique, a commercial rotating viscometer has been adapted to be driven by a bipolar stepping motor, which is controlled via a personal computer. Special circuitry has been added to microstep the stepping motor at selectable step sizes and to condition the torque signal. Tests have been carried out using the prototype to produce flow curves for two standard Newtonian fluids (920 and 12 560 mPa (.) s, both at 25 degrees C). The flow curves have been obtained by employing several distinct microstep sizes within the shear rate range of 50-500 s(-1). The results indicate the feasibility of the proposed driving technique.

This work presents the design and procedure of a DC-to-AC converter using a ZVS Commutation Cell developed by Barbi and Martins (1991) and applied to the family of DC-to-DC PWM converters. Firstly, we show the cell applied to buck converter. The stages of operation and the main current and voltage equations of the resonant devices are presented. Next, we adapt the converter to the regenerative operation mode. Hence, the full bridge converter at low frequency operation is conected on the DC-to-DC stage (at high frequency) output ends (Seixas, 1993). Commutation of zero voltage for all switches, PWM at constant frequency and neither overvoltage nor additional current stress are observed by digital simulation. The design example and experimental results obtained by prototype rated at 275 V, 1 kW and 40 kHz are also presented.

Relaxed conditions for the stability study of nonlinear, continuous and discrete-time systems given by fuzzy models are presented. A theoretical analysis shows that the proposed method provides better or at least the same results of the methods presented in the literature. Digital simulations exemplify this fact. These results are also used for the fuzzy regulators design. The nonlinear systems are represented by the fuzzy models proposed by Takagi and Sugeno. The stability analysis and the design of controllers are described by LMIs (Linear Matrix Inequalities), that can be solved efficiently by convex programming techniques. The specification of the decay rate, constraints on control input and output are also described by LMIs. Finally, the proposed design method is applied in the control of an inverted pendulum.

To simplify computer management, several system administrators are adopting advanced techniques to manage software configuration on grids, but the tight coupling between hardware and software makes every PC an individual managed entity, lowering the scalability and increasing the costs to manage hundreds or thousands of PCs. This paper discusses the feasibility of a distributed virtual machine environment, named Flexlab: a new approach for computer management that combines virtualization and distributed system architectures as the basis of a management system. Flexlab is able to extend the coverage of a computer management solution beyond client operating system limitations and also offers a convenient hardware abstraction, decoupling software and hardware, simplifying computer management. The results obtained in this work indicate that FlexLab is able to overcome the limitations imposed by the coupling between software and hardware, simplifying the management of homogeneous and heterogeneous grids. © 2009 IEEE.
