O “contrato de mediação” não é objeto de regramento no direito positivo brasileiro. Trata-se de um conjunto de atos nascidos da autonomia privada, da confiança, da boa-fé e que são efetivamente praticados no âmbito social. Sua validade decorre da inexistência de impedimento legal sempre que se tratar de objeto lícito, possível, determinado ou determinável e não proibido em lei, para que as pessoas físicas quanto jurídicas, desfrutem de ampla liberdade para praticar atos lícitos capazes de ingressarem no mundo jurídico, sejam eles um poder derivado da lei ou por ela assegurado. A prática da mediação deriva dos usos e costumes que tomam maior incremento nas economias em desenvolvimento e, particularmente, nas concentrações urbanas onde é mais agudo o processo das alterações sociais e econômicas, ademais em face da globalização e da competitividade internacional, geradoras de instabilidade e do desemprego formal. Por outro lado, a prática da mediação como meio na solução de conflitos interpessoais, afetivos e relacionais, de forma não litigiosa, consensual, responsável, com baixo custo financeiro e econômico, baseada na autonomia privada, na confiança e na boa fé, constitui relevante meio de solução dos conflitos. A presente dissertação tem por finalidade, de um lado, estudar o denominado “contrato de mediação” exclusivamente no direito civil brasileiro, e, doutro lado, a mediação como solução das controvérsias interpessoais.

O propósito deste trabalho é apresentar algumas das mais controversas questões da teoria das capacidades de Martha Nussbaum. Ela sugere que sua abordagem deve ser usada como base para princípios fundamentais e políticos voltados para as mulheres dos países em desenvolvimento. Desta forma, no primeiro capítulo, foram delineados os conceitos da teoria de Nussbaum. Depois de descrever a versão de Nussbaum sobre a abordagem das capacidades, o diálogo da autora com Amartya Sen foi apresentado, pois estes possuem visões particulares sobre a idéia de capacidades. No terceiro capítulo, o debate de Nussbaum com os relativistas culturais revelou o lado universal de sua teoria. A lista de capacidades de Nussbaum busca fornecer o suporte filosófico para a implementação de princípios constitucionais básicos que devem ser respeitados por todas as nações, como o mínimo que o respeito à dignidade humana requer. Por conta disso, este trabalho tentou também descobrir porque Nussbaum nega a importância do welfarismo subjetivo. No último capítulo desta dissertação, foram apresentados os debates de Nussbaum com Judith Butler, Susan Moller Okin e Alison Jaggar porque eles revelam diferentes pontos de vista e conclusões sobre a teoria das capacidades de Nussbaum.

Esta tese propõe a investigação sobre as origens doutrinárias da função social dos contratos e, a partir delas, apresenta os instrumentos para a interpretação da cláusula geral do art. 421 do Código Civil. A tese encontra na doutrina italiana e no pensamento de Miguel Reale a base doutrinária da clláusula geral. A principal proposição dessa incursão é de que o juiz, ao aplicar a cláusula geral, deve usar os parâmetros doutrinários construídos pela tradição. A tradição e os dispositivos constitucionais que disciplinam a liberdade de contratar são os principais instrumentos para o controle das decisões judiciais, o que é indispensável que se preserve as regras do regime constritucional democrático e princípio da dignidade da pessoa.

Andryala (Asteraceae: Cichorieae) is a little-known Mediterranean-Macaronesian genus whose taxonomy is much in need of revision. The aim of the present biosystematic study was to elucidate species relationships within this genus based on morphological and molecular data. In this study several taxa are recognised: 17 species, 14 subspecies, and 3 hybrids. Among these, 5 species are Macaronesian endemics (A. glandulosa, A. sparsiflora, A. crithmifolia Aiton, A. pinnatifida, and A. perezii), 4 species are Northwest African endemics (A. mogadorensis, A. maroccana, A. chevallieri, and A. nigricans) and one species is endemic to Romania (A. laevitomentosa). Historical background regarding taxonomic delimitation in the genus is addressed from Linnaean to present day concepts, as well as the origin of the name Andryala. The origin of Asteraceae and the systematic position of Andryala is shortly summarised. The morphological study was based on a bibliographic review and the revision of 1066 specimens of 13 herbaria as well as additional material collected during fieldwork. The variability of the morphological characters of the genus, including both vegetative taxonomic characters (root, stem, leaf and indumentum characters) and reproductive ones (inflorescence, floret, fruit and pappus characters), is assessed. Numerical analysis of the morphological data was performed using different similarity or dissimilarity measures and coefficients, as well as ordination and clustering methods. Results support the segregation of the recognised taxa and the congruence of the several analyses in the separation of the recognised taxa (using quantitative, binary or multi-state characters). The proposed taxonomy for Andryala includes a new infra-generic classification, new taxa and new combinations and ranks, typifications and diagnostic keys (one for the species and several for subspecies). For each taxon a list of synonyms, typification comments and a detailed description are provided, just as comments on taxonomy and nomenclature, and a brief discussion on karyology. Additionally, information on ecology and conservation status as well as on distribution and a list of studied material are also presented. Phylogenetic analyses based on different nuclear and chloroplast DNA markers, using Bayesian and maximum parsimony methods of inference, were performed. Results support three main lineages: separate ones for the relict species A. agardhii and A. laevitomentosa and a third including the majority of the Andryala species that underwent a relatively rapid and recent speciation. They also suggest a single colonization event of Madeira and the Canary Islands from the Mediterranean region, followed by insular speciation. Biogeography and speciation within the genus are briefly discussed, including a proposal for the centre of origin of the genus and possible dispersal routes.

To understand the biology and evolution of ruminants, the cattle genome was sequenced to about sevenfold coverage. The cattle genome contains a minimum of 22,000 genes, with a core set of 14,345 orthologs shared among seven mammalian species of which 1217 are absent or undetected in noneutherian (marsupial or monotreme) genomes. Cattle-specific evolutionary breakpoint regions in chromosomes have a higher density of segmental duplications, enrichment of repetitive elements, and species-specific variations in genes associated with lactation and immune responsiveness. Genes involved in metabolism are generally highly conserved, although five metabolic genes are deleted or extensively diverged from their human orthologs. The cattle genome sequence thus provides a resource for understanding mammalian evolution and accelerating livestock genetic improvement for milk and meat production.

Textile activity results in effluents with a variety of dyes. Among the several processes for dye-uptaking from these wastewaters, sorption is one of the most effective methods, chitosan being a very promising alternative for this end. The sorption of Methyl Orange by chitosan crosslinked particles was approached using equilibrium and kinetic analyses at different pH s. Besides the standard pseudo-order analysis normally effectuated (i.e. pseudo-first-order and pseudo-second-order), a novel approach involving a pseudo-nth-order kinetics was used, nbeing determined via non-linear regression, using the Levenberg-Marquardt method. Zeta potential measurements indicated that electrostatic interactions were important for the sorption process. Regarding equilibrium experiments, data were well fitted to a hybrid Langmuir-Freundlich isotherm, and estimated Gibbs free energy of adsorption as a function of mass of dye per area of chitosan showed that the process of adsorption becomes more homogeneous as the pH of the continuous phase decreased. Considering the kinetics of sorption, although a pseudo-nth-order description yielded good fits, a kinetic equation involving diffusion adsorption phenomena was found to be more consistent in terms of a physicochemical description of the sorption process

In recent years, antiphospholipid syndrome (APS) has been increasingly recognised in various paediatric autoimmune and nonautoimmune diseases, but the relatively low prevalence and heterogeneity of APS in childhood made it very difficult to study in a systematic way. The project of an international registry of paediatric patients with APS (the Ped-APS Registry) was initiated in 2004 to foster and conduct multicentre, controlled studies with large number of paediatric APS patients. The Ped-APS Registry is organised as a collaborative project of the European Forum on Antiphospholipid Antibodies and Juvenile Systemic Lupus Erythematosus Working Group of the Paediatric Rheumatology European Society. Currently, it documents a standardised clinical, laboratory and therapeutic data of 133 children with antiphospholipid antibodies (aPL)-related thrombosis from 14 countries. The priority projects for future research of the Ped-APS Registry include prospective enrolment of new patients with aPL-related thrombosis, assessment of differences between the paediatric and adult APS, evaluation of proinflammatory genotype as a risk factor for APS manifestations in childhood and evaluation of patients with isolated nonthrombotic aPL-related manifestations. © The Author(s), 2009.
