Promoting the inclusion of students with disabilities in e-learning systems has brought many challenges for researchers and educators. The use of synchronous communication tools such as interactive whiteboards has been regarded as an obstacle for inclusive education. In this paper, we present the proposal of an inclusive approach to provide blind students with the possibility to participate in live learning sessions with whiteboard software. The approach is based on the provision of accessible textual descriptions by a live mediator. With the accessible descriptions, students are able to navigate through the elements and explore the content of the class using screen readers. The method used for this study consisted of the implementation of a software prototype within a virtual learning environment and a case study with the participation of a blind student in a live distance class. The results from the case study have shown that this approach can be very effective, and may be a starting point to provide blind students with resources they had previously been deprived from. The proof of concept implemented has shown that many further possibilities may be explored to enhance the interaction of blind users with educational content in whiteboards, and further pedagogical approaches can be investigated from this proposal. Written about the time of the Golden Venture incident, Chang-rae Lee’s Native Speaker makes a particular reference to that incident, whereby implying that particular immigrants, on the grounds of their racial identities, are mistreated and considered as aliens by some Americas. While some whites discriminate against immigrants, there is widespread ethnic tension between Korean Americans and African Americans. Significantly, racial conflict between Koreans and blacks and the racist attitude of some whites toward immigrants are mirrored in the relationship between the Korean-American protagonist Henry and his American wife Lelia. That is, due to their different racial identities they do not understand each other and they always argue. However, toward the end of the novel, Henry and Lelia come to understand each other. While ethnic conflict between Koreans and blacks and certain whites’ discriminatory attitudes toward immigrants is serious one, the novel suggests the unimportance of racial identity. In other words, the novel concludes that there is no discriminatory treatment of immigrants and, in fact, every one is a native Speaker in America. In the novel there is no message of how racial conflict could be resolved. However, this essay suggests that by investigating how the tension between Henry and Lelia is resolved, one could suggest a solution for the ethnicity problem in America and in real life.

Objective: It has been shown that specific competence is necessary for preventing and managing conflicts in healthcare settings. The aim of this descriptive and correlation study was to investigate and compare the self-reported conflict management competence (CMC) of nursing students who were on the point of graduating (NSPGs), and the CMC of registered nurses (RNs) with professional experience. Methods: The data collection, which consisted of soliciting answers to items measuring CMC in the Nurse Professional Competence (NPC) Scale, was performed as a purposive selection of 11 higher education institutions (HEIs) in Sweden. Three CMC items from the NPC Scale were answered by a total of 569 nursing students who were on the point of graduating and 227 RN registered nurses with professional experience. Results: No significant differences between NSPGs and RNs were found, and both groups showed a similar score pattern, with the lowest score for the item: “How do you perceive your ability to develop the group and strengthen competence in conflict management and problem-solving, based on knowledge of group dynamics?”. RNs with long professional experience (>24 months) rated their overall CMC as significantly better than RNs with short (<24 months) professional experience did (p = .05). NSPGs who had experience of international studies during their nursing education reported higher CMC, compared with those who did not have this experience (p = .03). RNs who reported a high degree of utilisation of CMC during the previous month scored higher regarding self-reported overall CMC (p < .0001). Conclusions: Experience of international studies during nursing education, or long professional experience, resulted in higher self-reported CMC. Hence, the CMC items in the NPC Scale can be suitable for identifying self-reported conflict management competence among NSPGs and RNs

Pretende-se no presente trabalho avaliar a gestão do processo de negociação complexa da 5ª Conferência Ministerial da Organização Mundial do Comércio em Cancún, ocorrida entre os dias 10 e 14 de setembro de 2003, no México, apontando os problemas e questões que resultaram no colapso de um possível acordo. O futuro da OMC é incerto e mudanças traumáticas sofridas por muitos países que vivem sob as regras da OMC indicam que alguma coisa na OMC terá que mudar, principalmente nos processos de negociação complexa, de forma que a integridade da organização não seja comprometida. Buscou-se respostas na análise e avaliação da gestão do processo de negociação, estudando e pesquisando os conceitos de barganha posicional, detalhando o processo de negociação baseado em princípios, explorando em profundidade o estado da arte para gestão de conversas difíceis. Dissecando a questão dos conflitos e das coalizões, mostrando a dificuldade existente na resolução de disputas públicas e no uso de instrumentos para quebrar o impasse nas negociações buscou-se estabelecer o instrumental teórico que possibilitasse aprofundar o diagnóstico da situação atual na OMC. Como recomendação explorou-se a avaliação de conflitos, com base na eficiência - teoria dos jogos-, justiça e na eqüidade, a melhor forma de negociação baseada em princípios, de gestão de público demandante, no diálogo dos multistakeholders, a importância das conversas informais paralelas, o ambiente da complexidade e a visão ampla que proporciona o enfoque do funcionamento de sistemas decisórios autopoiéticos.

This exploratory study, with the aim of bringing mediation and arbitration - which have been so far mainly discussed under the legal point of view - to the context of business management, tries to identify up to which point these services can be recognized as a valid alternative to manage conflicts in the inter-organizational strategic relationships. This kind of relationship is present in strategic alliances, joint ventures and in existing supply chains and distributions channels¿ partnerships. Analyzing the theoretical reference framework three knowledge areas were associated and integrated: conflict management and negotiation; mediation and arbitration, as the most common Alternative Dispute Resolutions-ADRs; and strategic alliances, supply chains and distribution channels. This review of literature and documents was complemented with a research among two target groups: the potential consumers of mediation and arbitration services in the organizational field; and the potential suppliers for those services. The objectives of the research were, on one side, to evaluate if the two institutes can be recognized as efficient to manage conflict between business partners, meaning, if there is an actual demand for them; and on the other hand, research also investigated if there is a concrete availability of specialized services to attend that demand. The study showed that, although incipient there is a market potential for the use of mediation and arbitration services as conflict management tools within inter-organizational strategic relationships.

Esta obra tem como tema central a conciliação como método contemporâneo de solução dos conflitos, notadamente nas Varas de Família de Porto Velho/RO. Os métodos alternativos de solução de controvérsias surgem como opção eficaz ao jurisdicionado, em atenção ao clamor da sociedade por uma prestação jurisdicional mais célere. A utilização deste método visa oferecer e assegurar uma melhor e efetiva solução de conflitos à população, fugindo assim dos modelos tradicionais de resoluções de conflitos. O objetivo é procurar demonstrar que, além da jurisdição estatal, existem outros meios de pacificação social, os quais também colocam fim às controvérsias e realizam a justiça. Destaque-se que mecanismos alternativos objetivam não somente oferecer uma prestação jurisdicional mais célere à sociedade, mas também verdadeira pacificação social; além do que, oportunizam também a resolução do conflito antes que seja instaurada qualquer demanda judicial, desafogando assim o Judiciário. Enfatiza-se a importância da conciliação nas matérias concernentes ao direito de família, já que nesta área há preocupação fundamental com a preservação emocional das partes. E dada a carga emocional que circundam as ações dessa natureza, muitas vezes ao juiz é impossível encontrar uma resposta adequada e definitiva para os problemas que lhes são apresentados pelas partes. Os resultados demonstram que a conciliação nas Varas de Família de Porto Velho/RO têm se revelado um mecanismo célere e eficaz, na busca da resolução de conflitos e pacificação social. Os profissionais e operadores do direito têm consciência da importância de sua aplicação.
