Statistical information about patents, their technologies, geographical information, and patenting entities are compiled and available as reports on the USPTO website. Other valuable information from these websites can be obtained using data mining techniques. This presentation will provide the keys to opening these resources and obtaining valuable data. Speaker #4: Donna Hopkins Engineering Librarian Renssalaer Polytechnic Institute, Troy, NY Title: Searching the USPTO Trademark Database for Wordmarks and Logos Abstract: This presentation provides an overview of wordmark searching in www.uspto.gov, followed by a review of the techniques of searching for non-word US trademarks using codes from the Design Search Code Manual. These codes are used in an electronic search, either on the uspto website or on CASSIS DVDs. The search is sometimes supplemented by consulting the Official Gazette. A specific example of using a section of the codes for searching is included. Similar searches on the Madrid Express database of WIPO, using the Vienna Classification, will also be briefly described.

Startups’ contributions on economic growth have been widely realized. However, the funding gap is often a problem limiting startups’ development. To some extent, VC can be a means to solve this problem. VC is one of the optimal financial intermediaries for startups. Two streams of VC studies are focused in this dissertation: the criteria used by venture capitalists to evaluate startups and the effect of VC on innovation. First, although many criteria have been analyzed, the empirical assessment of the effect of startup reputation on VC funding has not been investigated. However, reputation is usually positively related with firm performance, which may affect VC funding. By analyzing reputation from the generalized visibility dimension and the generalized favorability dimension using a sample of 200 startups founded from 1995 operating in the UK MNT sector, we show that both the two dimensions of reputation have positive influence on the likelihood of receiving VC funding. We also find that management team heterogeneity positively influence the likelihood of receiving VC funding. Second, studies investigating the effect of venture capital on innovation have frequently resorted to patent data. However, innovation is a process leading from invention to successful commercialization, and while patents capture the upstream side of innovative performance, they poorly describe its downstream one. By reflecting the introduction of new products or services trademarks can complete the picture, but empirical studies on trademarking in startups are rare. Analyzing a sample of 192 startups founded from 1996 operating in the UK MNT sector, we find that VC funding has positive effect on the propensity to register trademarks, as well as on the number and breadth of trademarks.

The phenomenon of Open Innovation has been gaining prominence over the last decade. Idea competitions have been used in a variety of industrial sectors. Nevertheless, the legal issues raised by this topic have not been broadly addressed, yet. These arise from the adverse interests of the actors. The company which organizes an idea competition would usually like to have the opportunity to comprehensively use the solutions, ideas or products submitted by the competition entrants. For the company it is important to obtain all intellectual property rights in the idea, in the product created as a result and, thus, in the rights to be exploited in the future, in particular, patents, utility models, trademarks, copyrights and registered designs as well as other industrial property rights. The participant would like to participate to the greatest extent possible in the success of the submitted solution. This affects, firstly, the question of fair remuneration or further participation in any profits earned as well as, secondly, any personal rights such as being named as inventor or author. The article aims to show the contractual difficulties which have to be addressed tailoring theterms of an idea competition under German law.

No obstante, han recibido escasa atención en la historiografía económica argentina. Este trabajo analiza cuándo y cómo las marcas comerciales se difundieron en el mundo rural a principios del siglo XX. El artículo describe cómo este proceso fue gradual y plantea que ya a finales de los años veinte del siglo pasado las marcas comerciales ocupaban un lugar relevante en las estrategias de comercialización y en la definición de pautas de consumo en áreas rurales. El artículo también analiza el impacto de estos procesos en las prácticas y perfiles de los comerciantes minoristas, así como en los sistemas de distribución de bienes de consumo genéricos (en particular, alimentos y bebidas)

Patent and trademark offices which run according to principles of new management have an inherent need for dependable forecasting data in planning capacity and service levels. The ability of the Spanish Office of Patents and Trademarks to carry out efficient planning of its resource needs requires the use of methods which allow it to predict the changes in the number of patent and trademark applications at different time horizons. The approach for the prediction of time series of Spanish patents and trademarks applications (1979e2009) was based on the use of different techniques of time series prediction in a short-term horizon. The methods used can be grouped into two specifics areas: regression models of trends and time series models. The results of this study show that it is possible to model the series of patents and trademarks applications with different models, especially ARIMA, with satisfactory model adjustment and relatively low error.

Las denominaciones geográficas contribuyen a la sostenibilidad económica, social y medioambiental de la producción agraria en todos los países, independientemente de su grado de desarrollo. La presente investigación pretende, de forma general, analizar la forma en que puede mejorarse su reconocimiento y generación de valor añadido para el productor y la sociedad. Para ello, se ha valorado si la protección internacional que se otorga a las denominaciones geográficas es homogénea y suficiente en el ámbito multilateral. Posteriormente, se identifican los instrumentos con los que cuenta la Unión Europea para ejercer el liderazgo en el comercio internacional para la protección de las denominaciones geográficas y se exploran las posibles sinergias y conflictos con el registro de marcas. Además, se ha prestado una especial atención a la forma en la que las denominaciones geográficas pueden impulsar en los países en desarrollo la generación de valor añadido de los productos ligado a la calidad vinculada a su origen y un reparto más equitativo del mismo, profundizando en el caso del café. Dado que el método Delphi se valora como idóneo para el apoyo realizar diagnósticos precisos y servir de soporte a la toma de decisiones, la fase empírica se ha centrado en aplicarlo en un grupo seleccionado de expertos con gran experiencia en el ámbito de las denominaciones geográficas, realizando dos rondas de cuestionarios y alcanzado un elevado grado de consenso. Ello se ha complementado con el desarrollo de una decena de entrevistas cualitativas no estructuradas a élites. Como resultado de la fase empírica, se ha obtenido un diagnóstico de la situación actual de las denominaciones geográficas, presentado en forma de matriz DAFO, y se han propuesto una serie de medidas a implantar por la administración española y de la Unión Europea, encaminadas a mejorar el sector de las denominaciones geográficas en el comercio internacional. ABSTRACT Geographical indications play a key role in environmental, social and economic sustainabily of agricultura worldwide. This research aims to analyze the way their recognition and protection can be enhanced to create value added for the producer and the whole society. It has been reviewed the multilateral and European frame of protection of geographical indications and the relation with trademarks to evaluate the need of improvement. Moreover, it has been explored the way geographical indications contribute to increase value added and equity in developing countries, with special attention to the case of coffee. Thanks to the use of the Delphi method and qualitative interviews to relevant experts during the empirical research, it has been posible to make an accurate SWOT analysis of geographical indications sector and define measures to improve the Spanish and European quality policy, some of them related to international trade.

O objetivo deste estudo foi comparar as angulações e torques de braquetes de marcas comerciais distintas em relação à prescrição de Roth e também em relação aos valores preconizados pelo fabricante. Foram utilizados 150 braquetes metálicos de aço inoxidável, de caninos e incisivos superiores na respectiva prescrição, avaliadas por meio de um perfilômetro. Após a coleta dos dados e aplicação do tratamento estatístico, os resultados demonstraram que os valores de torque obtidos com a prescrição de Roth foram semelhantes entre os fabricantes. Na angulação, os caninos superiores apresentaram valores acima do proposto pelo autor para o fabricante Morelli, e para os dentes 21 e 22, a angulação foi maior para o fabricante Abzil. Na comparação dos valores de torque obtidos com os valores recomendados pelos fabricantes, a Unitek demonstrou maior fidedignidade no torque comparada às demais marcas. Conclui-se que as diferenças tanto de torque quanto de angulação quando comparados aos valores do autor e à prescrição dos fabricantes, se enquadram dentro de um grau de tolerância preconizada por um órgão regulador de peças ortodônticas alemãs.
