En continuité avec les ouvrages récents (Veyne 1981, MacMullen 1988 et Kelly 2004) qui tentent de relativiser les effets néfastes de la corruption lors du Bas-Empire, ce travail étudie le suffragium, le processus de nomination des fonctionnaires de bureaux, afin d'évaluer comment les acteurs sociaux du IVe siècle considéraient ce phénomène. Ce système, organisé d'une telle façon que les hauts fonctionnaires devaient fournir des lettres de recommandation aux candidats postulant à des postes au sein de la fonction publique, serait devenu complètement corrompu durant le IVe siècle et les lettres de recommandation auraient commencé à être systématiquement vendues. Pourtant, les lois de Constantin, Constance et Julien ne fournissent aucune preuve tangible que le suffragium était dans tous le cas vénal à cette époque. Bien au contraire, les empereurs ajoutaient la plupart de temps des épithètes au terme suffragium pour spécifier qu'il parle du suffragium vénal. Généralement, les empereurs sont présentés comme farouchement opposés au suffragium et à toutes les tractations qui y sont attachées. Loin d'être aussi hostiles envers les « pratiques corrompues », les empereurs de la dynastie constantinienne firent preuve d'un certain pragmatisme en voyant qu'ils ne pouvaient contrôler toutes les nominations de ceux qui voulaient entrer dans la fonction publique et que ce n'était pas nécessairement à leur avantage de le faire. Les empereurs se concentrèrent plutôt sur les restrictions entourant les promotions afin de faire en sorte que les personnes qui avaient de réels pouvoirs soient celles qui avaient démontré leurs qualités tout au long de leurs années de service. Bien qu'ils n'aient pas concrètement légiféré sur les critères d'embauche des candidats, cela ne veut pas dire que n'importe qui pouvait obtenir un poste. À travers l'étude des lettres de Libanios et de Symmaque, ce travail démontre que les hauts fonctionnaires ne fournissaient pas de lettres à quiconque le demandait, puisque leur réputation pouvait être entachée par le fait d'avoir recommandé un mauvais candidat à un de leurs amis. Les hauts fonctionnaires qui recevaient les recommandations pouvaient également soumettre les candidats à des examens afin d'être certains de la qualité de l'individu. Ce système officieux de contrôle des candidats vint pallier, en partie, les déficits de la législation impériale. Conjointement, la loi et les usages permirent à l'administration de fonctionner en lui fournissant des candidats qui répondaient aux critères de l'époque.

Introdução: O adiamento das altas clínicas nas Unidades de Cuidados Continuados Integrados (UCCI) por motivos sociais é actualmente considerado um dos principais motivos que impedem a integração atempada de novos clientes na Rede Nacional de Cuidados Continuados, RNCC, daqui em diante designada como a REDE. Este atraso tem impacto ao nível da recuperação e estabilização dos utentes, bem como ao nível de eficiência e eficácia da UCCI, não podendo deixar de se considerarem os aspectos sociais e económicos. Objectivo Geral: Identificar os determinantes que influenciam as altas clínicas em UCCI. Métodos e População do Estudo: Este é um estudo de caso colectivo, em que os dados observacionais, transversais, são recolhidos por meio de questionário de auto-relato (por cada área de intervenção directa) e por análise dos processos de consulta de pacientes. O objecto desta pesquisa abrange dois grupos: o grupo de amostra composto por 70 profissionais de saúde que lidam directamente com os utentes e o grupo amostra composto de utentes internados na UCCI L Nostrum, com alta clínica entre 1/1/2011 e 31/12/2012, e que foram integrados através da REDE. Foram recolhidos os dados de 293 utentes sendo objecto de estudo os casos de 83 utentes integrados através da REDE e com prolongamento de internamento por motivos sociais. Resultados: Na percepção dos profissionais de saúde, as respostas institucionais apresentam-se como a condicionante mais indicada, tanto para os utentes em geral, com 22 indicações (88%) como para os utentes da REDE, com 10 indicações (40%). Relativamente aos motivos familiares há referência de 76% para os utentes em geral e de 36% para os utentes da REDE. Os motivos económicos também apresentam, para os profissionais inquiridos, um valor expressivo (68%) nos utentes em geral, estando nos da REDE este factor condicionante a par com os motivos familiares (36%). Os motivos estruturais têm menor expressão tanto nos utentes em geral (32%) como nos utentes da REDE (16%). “Outros” para os utentes em geral, refere-se a dependência funcional (4%). Nos motivos familiares, para os utentes em geral, 23 (92%) foi mais vezes indicada a insuficiência de suporte familiar, para os utentes da REDE, 13 (52%). A ausência de suporte familiar, para os utentes em geral, representa 48% das respostas, seguindo-se o suporte inadequado (28%) e a ausência de cuidadores (24%). Para os utentes da REDE, o suporte inadequado apresenta-se como segundo motivo (7%), seguindo-se a ausência de suporte familiar (16%). Na percepção dos profissionais, os utentes da REDE estão também condicionados pela distância geográfica (8%) da sua área residencial. Em termos estruturais, os motivos mais assinalados pelos profissionais para a generalidade dos utentes foram as barreiras físicas à mobilidade (80%) e a habitação sem condições básicas de habitabilidade (78%). Os mesmos motivos foram assinalados para os utentes da REDE, barreiras físicas à mobilidade (40%) e habitação sem condições de habitabilidade (28%). No entanto, relativamente aos utentes em geral, a ausência de habitação (29%) e a distância geográfica (4%) também foram motivos assinalados. Dos motivos económicos percebidos pelos profissionais, a insuficiência de rendimentos é o factor mais assinalado pela generalidade dos utentes (84%) e pelos da REDE (68%), seguida da percepção da capacidade de reposta limitada das instituições, 64% para a generalidade dos utentes e 28% para os da REDE e por fim os tipos de respostas insuficientes para as necessidades individuais dos utentes (20% dos utentes em geral e 12% da REDE). No total dos dois anos, 2011 e 2012, verificaram-se na UCCI L Nostrum 293 prorrogações (100%) das quais 210 (71,6%) foram consideradas dentro do prazo e justificadas com motivos clínicos, enquanto 83 (28,3%) foram efectivamente protelamentos por motivos sociais, tendo em conta que nestes casos os utentes já não tinham critérios clínicos que justificassem a sua permanência na UCCI. Das 210 prorrogações consideradas dentro do prazo e justificadas com motivos clínicos, 93 (44,3%) foram-no por tempo de espera para transferência de UCCI. Em 2011, dos 146 utentes com alta protelada (100%), 50 utentes (34,2%) permaneceram na UCCI por motivos sociais, enquanto em 2012 houve registo de 33 casos de protelamento (22,4%) em 147 (100%) altas prorrogadas. Conclusões: Dos factores identificados como motivo de protelamento nos 83 utentes, estritamente por motivos sociais, destaca-se o protelamento de alta por espera de integração em equipamento/resposta adequada, nomeadamente lar ou serviços de apoio domiciliário (79,5%), seguindo-se a insuficiência de rendimentos do utente/familiares para contratação de serviços ou resposta institucional (74,7%), a inexistência de condições habitacionais para regresso ao domicílio (63,9%) e a insuficiência de suporte familiar (54,2%). Regista-se também a inadequação do suporte familiar (31,3%), a inexistência de suporte familiar (28,9%) e, em menor percentagem, a ausência de condições estruturais (13,3%). A ausência de domicílio (sem abrigo) (8,4%) e a ausência de rendimentos (4,8%) também foram factores inibidores da alta clínica. Dos 293 utentes identificados que tiveram protelamento da alta por motivos sociais verificou-se que 144 (49,1%) dos utentes permaneceram unicamente pela existência de condicionantes institucionais e familiares/estruturais. Aspectos éticos: ao longo deste estudo, foram assegurados e respeitados, todos os procedimentos de garantia da confidencialidade e rigor na recolha dos dados, e a não interferência nas dinâmicas da instituição, dos utentes e dos profissionais.

As part of its contribution to the 1951 Festival of Britain, the Arts Council ran what can be seen in retrospect to be an important playwriting competition. Disregarding the London stage entirely, it invited regional theatres throughout the UK to put forward nominations for new plays within their repertoire for 1950-1951. Each of the five winning plays would receive, what was then, the substantial sum of £100. Originality and innovation featured highly amongst the selection criteria, with 40 per cent of the judges’ marks being awarded for “interest of subject matter and inventiveness of treatment”. This article will assess some of the surprising outcomes of the competition and argue that it served as an important nexus point in British theatrical historiography between two key moments in post-war Britain: the first being the inauguration of the Festival of Britain in 1951, the other being the debut of John Osborne’s Look Back in Anger in May 1956. The article will also argue that the Arts Council’s play competition was significant for two other reasons. By circumventing the London stage, it provides a useful tool by which to reassess the state of new writing in regional theatre at the beginning of the 1950s and to question how far received views of parochialism and conservatism held true. The paper will also put forward a case for the competition significantly anticipating the work of George Devine at the English Stage Company, which during its early years established a reputation for itself by heavily exploiting the repertoire of new plays originally commissioned by regional theatres. Cricket umpires, cricket bowlers, and physical education students (who were knowledgeable about the rules of cricket), were shown 72 videotaped point-light displays of cricket deliveries with varying extents of elbow flexion such that they ranged from highly “bowl-like” to highly “throw-like”. The observers made a bowl-throw decision about each display, and the umpires and bowlers reported their confidence on a 5-point scale. The percentage of displays reported as a “bowl” was 59, 40, and 44 for the umpires, bowlers, and students respectively. Umpires made significantly more bowl decisions than both the bowlers and students, but there was no difference between the latter groups. Umpires were significantly more confident than the bowlers in both their bowl and throw decisions. Thus, in an experimental setting, with no apparent costs or benefits associated with their decision-makin, umpires “called” a bowler significantly less frequently for throwing than other knowledgeable observers. The procedures devised for this experiment demonstrate that psychophysical methods can be applied to the problem of discrete action-category nominations in sport (e.g., bowl or throw, walk or run).

In May 2002 the Australian Department of Defence announced its intention to divest the Defence land at Portsea on the Mornington Peninsula, Victoria. At the same time nominations were invited for membership of the Community Reference Group (CRG) established as part of the Portsea Defence Land Master Planning Project. The author actively participated in this voluntary advisory group which provided input on matters of interest to the community relating to the project, provided a medium for information sharing and addressed the sometimes competing needs of different stakeholder groups (such as government, business and residents). A major role of the CRG was to provide a focus for community input on aspects of technical issues, particularly in relation to the planning for the future use of the site, flora and fauna issues, infrastructure provision, traffic and access management, heritage and archaeology, and the integration of the site with both the natural environment and existing community facilities, including the township of Portsea. The author's professional background in art and architectural history, in teaching and in research specifically in heritage related areas; her record of community work both in hands on work and in leadership positions, in Melbourne and on the Nepean Peninsula, enabled her to make a significant and useful contribution to the CRG in contributing to the understanding of the rich, diverse, multilayered cultural and natural heritage of the entire site.

Using this specific example, this paper examines the process of participating in Australian society through engaging communities - engaging women. It examines the invitation to participate, the nomination and selection process, the brief given to the community reference group, the development of the consultative process over the six months of deliberations, and the important role that women played in the project. It looks at what can be learned from the experience: how women in particular led the way in changing perceptions of place within the local community, and consequently in the broader framework of the project. It examines the success of the outcomes both in terms of the specific task of writing the Master Plan for the Portsea Defence site and of the process of community participation: the dynamic inter-relationships in the group; between the group and the consultants; between the group and the Department of Defence and between the group and the Federal Government. It comments reflectively and critically on the effectiveness of the whole process.

Aims & Rationale/Objectives
To locate, analyse and make accessible innovative models of health training and service delivery that have been developed in response to a shortage of skills.

Methods
Drawing on a synthesis of Australian and international literature on innovative and effective models for addressing health skill shortages, 50 models were selected for further study. Models were also identified from nominations by key health sector stakeholders. Selected models represent diversity in terms of the nature of skill shortage addressed, barriers overcome in developing the model, health care specialisations, and customer groups.

Principal Findings
Rural and remote areas have become home to a set of innovative service delivery models. Models identified encompass local, regional and state/national responses. Local responses are usually single health service-training provider partnerships. Regional responses, the most numerous, tend to have a specific focus, such as training young people. A small number of holistic state or national responses, eg the skills ecosystem approach, address multiple barriers to health service provision. Typical barriers include unwillingness to risk-take, stakeholder differences, and entrenched workplace cultures. Enhancers include stakeholder commitment, community acceptance, and cultural fit.

Discussion
Of particular interest is increasing numbers of therapy assistants to help address shortages of allied health professionals, and work to formalise their training, and develop standards of practice and policy. Other models likely to help address skill shortage amongst VET health workers focus on recruiting, supporting and training employees from a range of disadvantaged target groups, and on providing career paths with opportunities for staff to expand their skills. Such models are underpinned by nationally recognised qualifications, but each solution is targeted to a particular context in terms of the potential workforce and local need.

To raise the awareness of health issues in rural Tasmania, the work of rural health professionals and community volunteers

Methods
A partnership initiative between the University Department of Rural Health and the Department of Health and Human Services attracted $64,000 sponsorship from government and private sector. It established 28 regional groups which organised local activities and awards for a community volunteeer and a health professional. Regional groups were surveyed about their planning process for rural health week, the activities held, their outcomes and future intentions.

Principal Findings
Regional groups were partnerships of local organisations. Activities had a preventative focus. They included cooking, bike rides, dances, manual handling, health checks, community art, suicide prevention.Events attracted up to 300 participants. There were 48 nominations for the 2 awards, which were perceived to have raised the profile of health professionals and volunteers. Activities that attracted most participation were fun runs and health expos. Most used their understanding of community needs when deciding on activities. Only a small number relied on formal health needs analyses. Groups varied in their assessment of how well the activities they organised actually met needs. Half the group members had not worked together previously. All but 3 intend to work with others in the future. Most group members learnt more about health programs and other professionals in their community.

Implications
Raised profile of health services and role of health professionals and volunteers in rural Tasmania.
Increased range of ongoing health promoting activities. Better planned and coordinated activities.

Introduction: This article reports findings of a project funded by the Australian National Council for Vocational Education Research. The project explores solutions to current and projected skills shortages within the health and community services sector, from a vocational education and training perspective. Its purpose is to locate, analyse and disseminate information about innovative models of health training and service delivery that have been developed in response to skill shortages.

Methods: The article begins with a brief overview of Australian statistics and literature on the structure of the national health workforce and perceived skill shortages. The impact of location (state and rurality), demographics of the workforce, and other relevant factors, on health skill shortages is examined. Drawing on a synthesis of the Australian and international literature on innovative and effective models for addressing health skill shortages and nominations by key stakeholders within the health sector, over 70 models were identified. The models represent a mixture of innovative service delivery models and training solutions from Australia, as well as international examples that could be transposed to the Australian context. They include the skill ecosystem approach facilitated by the Australian National Training Authority Skill Ecosystem Project. Models were selected to represent diversity in terms of the nature of skill shortage addressed, barriers overcome in development of the model, healthcare specialisations, and different customer groups.

Results: Key barriers to the development of innovative solutions to skills shortages identified were: policy that is not sufficiently flexible to accommodate changing workplace needs; unwillingness to risk take in order to develop new models; delays in gaining endorsement/accreditation; current vocational education and training (VET) monitoring and reporting systems; issues related to working in partnership, including different cultures, ways of operating, priorities and timelines; workplace culture that is resistant to change; and organisational boundaries. For training-only models, additional barriers were: technology; low educational levels of trainees; lack of health professionals to provide training and/or supervision; and cost of training. Key enhancers for the development of models were identified as: commitment by all partners and co-location of partners; or effective communication channels. Key enhancers for model effectiveness were: first considering work tasks, competencies and job (re)design; high profile of the model within the community; community-based models; cultural fit; and evidence of direct link between skills development and employment, for example VET trained aged care workers upskilling for other health jobs. For training only models, additional enhancers were flexibility of partners in accommodating needs of trainees; low training costs; experienced clinical supervisors; and the provision of professional development to trainers.

Conclusions: There needs to be a balance between short-term solutions to current skill shortages (training only), and medium to longer term solutions (job redesign, holistic approaches) that also address projected skills shortages. Models that focus on addressing skills shortages in aged care can provide a broad pathway to careers in health. Characteristics of models likely to be effective in addressing skill shortages are: responsibility for addressing skills shortage is shared between the health sector, education and training organisations and government, with employers taking a proactive role; the training component is complemented by a focus on retention of workers; models are either targeted at existing employees or identify a target group(s) who may not otherwise have considered a career in health.

Across Australia and internationally, the vexed problem of staffing rural school remains a major issue affecting the educational outcomes of many rural students and their families. TERRAnova, (New Ground’ in Teacher Education for Rural and Regional Australia), is the name of a large Australian Research Council funded (2008-2010) project involving: a national study of pre-service preparation and rural incentive schemes offered by both University and State government agencies, a longitudinal study of beginning teachers who take up rural appointments and a study of communities where teacher retention is high. In 2008 calls for nominations for rural schools with high rates of retaining beginning teachers were sought (over three years), and twenty-four of nearly fifty nominated schools were selected as case studies. Each case study has involved researchers from the TERRAnova team travelling and staying as close to the community nominated as possible. Numerous teaching staff, parents and community members were invited to be interviewed and their recordings were transcribed. Five of these case studies have now been completed, and this paper examines common themes derived from the strategies that support beginning teachers in these rural communities. Key factors emerging to date from the data relate to particular models of rural school leadership, ongoing teacher learning and mentoring, and school support and innovative community practices.

Cultural landscapes are intended to increase awareness that heritage places (sites) are not isolated islands and that there is an interdependence of people, social structures, and the landscape and associated ecological systems. The paper explores whether the recognition of the 1992 World Heritage Cultural Landscape categories, the IUCN Protected Landscapes and the 2005 merging of cultural and natural criteria for World Heritage purposes have been effective in bridging the gap between culture and nature philosophically and in practice. With particular reference to opportunities presented in the Asia-Pacific region, where traditionally culture and nature are not regarded as separate, people are part of nature, the paper will further critically review the nature–culture link and its implications for North American-style national parks where cultural associations may not be seen to be necessary or even desirable. It suggests the imperative of highlighting and respecting in heritage nominations and inscriptions deep cultural associations of traditional communities with natural sites and implications for management to protect cultural and biological diversity and the need for thematic studies.

O trabalho compõe-se do inventário analítico do fundo Colégio Pedro II, bem como do registro de autoridade do produtor desse conjunto arquivístico, com o levantamento da legislação sobre educação e o colégio entre 1838 a 2009. O fundo Colégio Pedro II, localizado no NUDOM – Núcleo de Documentação e Memória do Colégio Pedro II – é formado por um conjunto de documentos administrativos nos quais foram registrados os atos praticados pela instituição desde a sua fundação em 1837 até meados da década de 1990. Este arquivo é composto por 60 pastas e 600 livros encadernados com aproximadamente 300 páginas cada um. Neles, constam as atas da Congregação, livros de concursos para professores, o primeiro livro de avisos, de 1838, livros de matrículas, de exames preparatórios, ofícios enviados, ofícios recebidos, avisos do Ministério do Império, livros de ocorrências disciplinares, livros de colação de grau e bancos de honra, livros de contabilidade, livros de nomeações de professores e funcionários. Além de proceder à descrição do fundo e ao registro da autoridade arquivística, o trabalho descreve a metodologia usada na construção do inventário analítico a partir do estudo de textos das teorias arquivísticas e da classificação e utilização das normas ISAAR(CPF) E NOBRADE. O inventário é apresentado como um instrumento de pesquisa fundamental na busca, identificação e acesso aos documentos, ressaltando-se, igualmente, a importância do arquivo para subsidiar a compreensão da evolução do ensino secundário no país.

O Supremo Tribunal Federal entregou ao ordenamento jurídico brasileiro, em 21 de agosto de 2008, a súmula vinculante nº 13. O referido verbete trata da vedação a nomeações de cônjuge, companheiro ou parente em linha reta, colateral ou por afinidade até o terceiro grau, no âmbito da administração pública direta e indireta, em todas as esferas. Antes da vigência da súmula vinculante nº 13, o nepotismo era praticado de forma nebulosa, tendo em vista a ausência de uma fiscalização eficaz e eficiente. Os Estados e Municípios, através de legislação própria, buscaram o combate a essa prática em momento anterior à edição do verbete, o país carecia de uma regra geral. A partir do início da vigência da súmula vinculante nº 13, o que se verificou, no âmbito da administração pública brasileira, como será demonstrado adiante, foram diversas exonerações de servidores por simples suposição de que determinada situação jurídica configuraria nepotismo, cenário totalmente contrário àquele então proposto.. O STF manifesta-se face aos casos concretos apenas em sede de reclamação. Têm-se, atualmente, uma situação de grave insegurança jurídica, onde servidores públicos não sabem se podem ou não ser nomeados ou se podem continuar exercendo suas funções. O presente exame, pautado no direito comparado e em estudo de casos, analisou algumas situações hipotéticas que, supostamente, configurariam nepotismo, e outras já decididas pela Suprema Corte e propõe uma alteração de natureza legislativa ao instituto das súmulas vinculantes: a criação de incisos a incluídos no corpo do enunciado após cada decisão em sede de reclamação, cujos efeitos não possuem efeito vinculante. Dessa forma, a administração pública direta e indireta poderá aplicar a súmula vinculante nº 13 de forma eficaz, sem interpretações equivocadas, de modo a permitir uma sintonia entre a segurança jurídica e a moralidade.

O trabalho investiga empiricamente o tema da influência presidencial sobre as agências reguladoras independentes (ARIs) no Governo Federal brasileiro, no período 1997-2014, como foco nos processos de nomeação para os cargos de direção destes órgãos, por meio de um método misto de caráter sequencial, combinando técnicas qualitativas e quantitativas. Primeiramente, utilizando a técnica do process tracing, uma análise histórico-comparativa da gênese e consolidação das dez ARIs federais no Brasil busca demonstrar a importância das hipóteses do credible commitment e da emulação institucional como variáveis explicativas da adoção do modelo. Em seguida, a influência política presidencial sobre as ARIs é mensurada analisando-se o padrão das vacâncias de cargos de direção, taxas de conclusão de mandato, bem, como o processo de aprovação das indicações presidenciais pelo Senado Federal. Por fim, são analisados os dados empíricos relativos ao perfil dos nomeados para cargos de direção nas ARIs no período estudado, incluindo variáveis como filiação partidária e qualificação profissional, buscando-se ainda verificar indícios de existência de trade-off entre estas duas dimensões.
