Youth misuse of fire is a substantive community concern. Despite evidence which indicates youths account for a significant proportion of all deliberately lit fires within Australia, an absence of up-to-date, contextually specific research means the exact scope and magnitude of youth misuse of fire within Australia remains unknown. Despite research suggesting com- monalities exist between youth misuse of fire and juvenile offending more broadly, misuse of fire is rarely explained using criminological theory. In light of this gap, a descriptive analysis of youth misuse of fire within New South Wales was performed. Routine Activity Theory and Crime Pattern Theory were tested to explain differences in misuse of fire across age groups. Results suggest these environmental theories offer useful frameworks for explaining youth misuse of fire in New South Wales. It is argued that the Routine Activity Theory and Crime Pattern Theory can be employed to better inform youth misuse of fire policy and prevention efforts.

A Tese a seguir, apresentada ao IESP/UERJ como pré-requisito para obtenção do grau de Doutor em Sociologia, demonstra a forma como o estilo pictórico grafite teve sua percepção social subvertida a partir da assimilação de sua estética pelas instituições ditas oficiais do mundo das artes visuais no Brasil, leia-se mercado e locais de culto às obras de arte (galerias e museus, respectivamente), no início do século XXI. A partir da categoria mundo artístico em Becker (1982)1, o trabalho busca dar contornos ao mundo do grafite carioca e a seus pontos de contato com estabelecimentos e sujeitos próprios do mundo oficial das artes plásticas. A hipótese da pesquisa - investigada através de trabalho de campo microssociológico em conformidade com o paradigma de pesquisa social qualitativo inerente à Escola de Chicago (Coulon, 1995)2 - é que desta intercessão ou desses pontos de contato, estreitados nas últimas duas décadas, emergiu um subjetivo processo de legitimação do grafite como atividade artística no Brasil, promovendo o deslocamento de sua ampla percepção social, situada primariamente numa atmosfera que o classificava como poluente (Douglas, 1976) 3 e desviante (Becker, 2009)4, para uma atmosfera de valorização e conseqüente assimilação de sua estética por nichos como a moda, a publicidade, a decoração de ambientes e as políticas públicas de combate à delinqüência e ócio juvenis.

Garda Youth Diversion Projects (GYDPs) have since their beginnings in the early 1990s gained an increasingly important role and now constitute a central feature of Irish youth justice provision. Managed by the Irish Youth Justice Service and implemented by the Gardai and a variety of youth work organisations as well as independent community organisations, GYDPs are located at the crossroads of welfarist and corporatist approaches to youth justice, combining diversionary and preventative aspects in their work. To date, these projects have been subjected to very little systematic analysis and they have thus largely escaped critical scrutiny. To address this gap, this thesis locates the analysis of GYDP policy and practice within a post-structuralist theoretical framework and deploys discourse analysis primarily based on the work of Michel Foucault. It makes visible the official youth crime prevention and GYDP policy discourses and identifies how official discourses relating to youth crime prevention, young people and their offending behaviour, are drawn upon, negotiated, rejected or re-contextualised by project workers and JLOs. It also lays bare how project workers and JLOs draw upon a variety of other discourses, resulting in multi-layered, complex and sometimes contradictory constructions of young people, their offending behaviour and corresponding interventions. At a time when the projects are undergoing significant changes in terms of their repositioning to operate as the support infrastructure underpinning the statutory Garda Youth Diversion Programme, the thesis traces the discursive shifts and the implications for practice that are occurring as the projects move away from a youth work orientation towards a youth justice orientation. A key contribution of this thesis is the insight it provides into how young people and their families are being constituted in individualising and sometimes pathologising ways in GYDP discourses and practices. It reveals the part played by the GYDP intervention in favouring individual and narrow familial causes of offending behaviour while broader societal contexts are sidelined. By explicating the very assumptions upon which contemporary youth crime prevention policy, as well as GYDP policy and practice are based, this thesis offers a counterpoint to the prevailing evidence-based agenda of much research in the field of Irish youth justice theory and youth studies more generally. Rather, it encourages the reader to take a step back and examine some of the most fundamental and unquestioned assumptions about the construction of young people, their offending behaviour and ways of addressing this, in contemporary Irish youth crime prevention policy and practice.

El rol desempeñado por la opinión pública en el desarrollo de la política criminal actual justifica el incremento de investigaciones destinadas a evaluar las actitudes de los ciudadanos hacia el castigo. No obstante, los avances en este ámbito han sido limitados debido a la utilización de rudimentarios instrumentos de medida. Por ello, el presente trabajo tiene como propósito explorar el efecto que generan en la opinión ciudadana ciertas variables referidas al hecho delictivo y al infractor, precisando su contribución relativa y la interacción existente entre ellas. Para satisfacer este objetivo se recurrió a un diseño factorial de la encuesta, creando una población de 256 casos-escenario fruto de la combinación de cuatro factores: la edad del joven, su historial delictivo, el grado de implicación en el hecho y el tipo de delito cometido. Los mismos fueron distribuidos en grupos de ocho casos ordenados aleatoriamente y fueron suministrados a 32 sujetos. Posteriormente se aplicaron análisis de regresión logística binaria. Los resultados obtenidos revelan que la naturaleza violenta de los hechos, la implicación activa de los jóvenes y el historial delictivo son predictores importantes de las condenas punitivas. Sin embargo la edad, una variable fundamental en la configuración de la justicia juvenil, no resulta significativa. De este modo, el trabajo muestra el potencial explicativo de este conjunto de factores y debate sus implicaciones teóricas y metodológicas para la investigación futura en este terreno.

Malgré les problèmes que pose la délinquance juvénile au Sénégal, les réponses des décideurs semblent inefficaces, surtout pour les filles déviantes. Ainsi, l’objectif de notre étude est de déterminer les caractéristiques familiales, scolaires et des amis des adolescentes judiciarisées à Dakar en les comparant à celles de Montréal. Les enquêtes se sont déroulées à Dakar sur trente adolescentes interrogées avec un instrument adapté du MASPAQ. Les similitudes entre les échantillons concernent l’âge moyen et le statut judiciaire quasi-identiques, le milieu socio-économique défavorisé et la structure familiale en majorité monoparentale matricentrique. Les autres résultats concernent surtout les liens sociaux plus forts chez les dakaroises alors que l’activité marginale est plus importante chez les montréalaises. Les liens sociaux des dakaroises constitueraient une protection contre la déviance. Le contexte culturel également, en favorisant un contrôle social, pousserait à développer plus de contraintes internes, autre protection contre la déviance. Des perspectives sont envisagées notamment utiliser l’instrument avec des garçons.

À la suite de certains grands meurtres commis en 1997 et 2000 par des jeunes de 14 et 17 ans, un discours sur les délinquants juvéniles, comme étant plus violents, plus cruels, plus anormaux et plus nombreux que jamais auparavant, s’installait chez les intellectuels et dans les médias japonais. Or , par dérapage analytique, ce discours a été généralisé à tous les jeunes, comme étant des individus dangereux, incompréhensibles, anormaux et potentiellement criminels malgré une certaine normalité apparente, faisant d’eux des « monstres invisibles ». La marginalisation des jeunes par ce discours sur la « nouvelle » jeunesse japonaise et les représentations des délinquants juvéniles « cruels » a fortement marqué la société japonaise, manifestée dans l’opinion publique ainsi que dans son impact socioculturel tant au niveau légal qu’au niveau idéologique. Cette étude présente les débuts, le développement ainsi que les conséquences du discours démonisant la jeunesse des années 2000, en présentant les concepts clés ayant été utilisés comme caractéristiques et arguments de la monstruosité cachée chez les jeunes japonais. Elle démontre parallèlement l’incohérence des représentations de la délinquance juvénile, aggravant le fossé entre la réalité vécue par les sujets, et les causes ainsi que les solutions présentées à leur égard.
