The coal industry in Queensland operates in a very complex regulatory environment with a matrix of Federal and State laws covering the environment, health and safety, taxation and royalties, tenure, and development approvals. The Queensland Government in 2012 recognised the validity of certain industry concerns and passed two Acts being the Environmental Protection (Greentape Reduction) Amendment Act 2012 (the Greentape Act) and the Mines Legislation (Streamlining) Amendment Act 2012 (the Streamlining Act). Other changes are foreshadowed in relation to overlapping tenure and in the development of common resources legislation. Accordingly there is a great level of activity and change that has occurred or which is on the horizon. This article focuses upon these regulatory changes and foreshadows other areas requiring consideration. It commences with a consideration of the changes that have already occurred, examines those regulatory amendments that are on the drawing board and concludes with suggestions as to further interventions and amendments that have the potential to enhance the efficiency and effectiveness of the legislative framework in which coal mining is conducted.

Biosequestration of carbon in trees, forests and vegetation is a key method for mitigating climate change in Australia. To facilitate this, all States have enacted legislation for carbon sequestration rights, separating commercial rights in carbon from ownership of the land, trees and vegetation in which the carbon is sequestered. Ownership of carbon sequestration rights under state law is a prerequisite for the issue of carbon credits to proponents of ‘eligible sequestration offsets projects’ under the Carbon Credits (Carbon Farming Initiative) Act 2011 (Cth) (‘Carbon Farming Act’). This article examines the extent to which current State carbon sequestration rights support the offsets regime established by the Carbon Farming Act. The Commonwealth Act is concerned with allocating responsibilities to ensure the maintenance of the carbon sequestration, while the State Acts confer commercial rights in the carbon and leave the responsibilities to be allocated by private agreements. The carbon sequestration rights as defined by state laws do not confer the rights of access and management over land that a project proponent needs in order to discharge its responsibilities to maintain the carbon sequestration.

The Americans with Disabilities Act (ADA) is a federal law that prohibits discrimination on the basis of disability. Title I of the ADA makes it unlawful for any employer to discriminate against a qualified applicant or employee because of a disability in any aspect of employment. The ADA covers employers with 15 or more employees, including state and local governments. Section 501 of the Rehabilitation Act provides the same protections for federal government employees and applicants. In addition, most states have their own laws prohibiting employment discrimination on the basis of disability. Some of these state laws may apply to smaller employers and provide protections in addition to those available under the ADA.

In this paper we have discussed limits of the validity of Whitham's characteristic rule for finding successive positions of a shock in one space dimension. We start with an example for which the exact solution is known and show that the characteristic rule gives correct result only if the state behind the shock is uniform. Then we take the gas dynamic equations in two cases: one of a shock propagating through a stratified layer and other down a nonuniform tube and derive exact equations for the evolution of the shock amplitude along a shock path. These exact results are then compared with the results obtained by the characteristic rule. The characteristic rule not only incorrectly accounts for the deviation of the state behind the shock from a uniform state but also gives a coefficient in the equation which differ significantly from the exact coefficients for a wide range of values of the shock strength.

The tendency of granular materials in rapid shear flow to form non-uniform structures is well documented in the literature. Through a linear stability analysis of the solution of continuum equations for rapid shear flow of a uniform granular material, performed by Savage (1992) and others subsequently, it has been shown that an infinite plane shearing motion may be unstable in the Lyapunov sense, provided the mean volume fraction of particles is above a critical value. This instability leads to the formation of alternating layers of high and low particle concentrations oriented parallel to the plane of shear. Computer simulations, on the other hand, reveal that non-uniform structures are possible even when the mean volume fraction of particles is small. In the present study, we have examined the structure of fully developed layered solutions, by making use of numerical continuation techniques and bifurcation theory. It is shown that the continuum equations do predict the existence of layered solutions of high amplitude even when the uniform state is linearly stable. An analysis of the effect of bounding walls on the bifurcation structure reveals that the nature of the wall boundary conditions plays a pivotal role in selecting that branch of non-uniform solutions which emerges as the primary branch. This demonstrates unequivocally that the results on the stability of bounded shear how of granular materials presented previously by Wang et al. (1996) are, in general, based on erroneous base states.

O presente trabalho debate a construção do federalismo fiscal norteado pelo ideal da solidariedade, e de que forma a legislação do ICMS Ecológico fluminense pode se inserir nesse tema. Através da comparação entre legislações estaduais e da análise dos efeitos econômicos das leis do Estado do Rio de Janeiro sobre os seus Municípios, será discutido de que forma a cooperação e a competição atuam nesta forma de partilha de receita tributária, reforçando a autonomia das municipalidades para a construção de políticas ambientais próprias.

If you own property on one of North Carolina’s estuaries, you can use this guide as a tool to learn about the choices you have to control your shoreline erosion and help decide which approach may be right for you. In North Carolina, we make a distinction between waterfront property that is located on the estuary, referred to as estuarine, shoreline, soundfront or riverside property, and waterfront property located directly on the ocean, referred to as oceanfront. Why? State laws and regulations addressing estuarine and oceanfront property, and the available erosion control methods, are quite different. This guide focuses on estuarine property. We’ll introduce you to the six main erosion control options in use in North Carolina and give you information about the out-of-pocket costs and tangible benefits of each option. A tribometer, based on a pin-on-disc machine, uses a PZT drive to produce small sinusoidal fluctuations of sliding speed. The frequency and amplitude of these fluctuations can be controlled, and the dynamic response measured. Preliminary test results show that the dynamic friction variation is influenced by the contact materials, normal force, oscillation frequency and steady sliding speed. The variation of friction force amplitude and phase with frequency gives clues about the underlying state variables determining the friction. Modelling studies illustrate the expected behaviour for idealized friction laws governed by, for example, sliding speed, contact temperature, and "rate-state" laws. © 2008 SAE International.

In this paper, we perform systematic calculations of the stress and strain distributions in InAs/GaAs truncated pyramidal quantum dots (QDs) with different wetting layer (WL) thickness, using the finite element method (FEM). The stresses and strains are concentrated at the boundaries of the WL and QDs, are reduced gradually from the boundaries to the interior, and tend to a uniform state for the positions away from the boundaries. The maximal strain energy density occurs at the vicinity of the interface between the WL and the substrate. The stresses, strains and released strain energy are reduced gradually with increasing WL thickness. The above results show that a critical WL thickness may exist, and the stress and strain distributions can make the growth of QDs a growth of strained three-dimensional island when the WL thickness is above the critical value, and FEM can be applied to investigate such nanosystems, QDs, and the relevant results are supported by the experiments.
