We consider a one-dimensional mean-field-hydrodynamic model of a two-component degenerate Fermi gas in an external trap, each component representing a spin state of the same atom. We demonstrate that the interconversion between them (linear coupling), imposed by a resonant electromagnetic wave, transforms the immiscible binary gas into a miscible state, if the coupling constant, kappa, exceeds a critical value, kappa(cr). The effect is predicted in a variational approximation, and confirmed by numerical solutions. Unlike the recently studied model of a binary Bose-Einsten condensate with the linear coupling, the components in the immiscible phase of the binary fermion mixture never fill two separated domains with a wall between them, but rather form antilocked (pi-phase-shifted) density waves. Another difference from the bosonic mixture is spontaneous breaking of symmetry between the two components in terms of the numbers of atoms in them, N(1) and N(2). The latter effect is characterized by the parameter nu equivalent to(N(1)-N(2))/(N(1)+N(2)) (only N(1)+N(2) is a conserved quantity), the onset of miscibility at kappa >=kappa(cr) meaning a transition to nu equivalent to 0. At kappa mixed state.

We investigate the flux penetration patterns and matching fields of a long cylindrical wire of circular cross section in the presence of an external magnetic field. For this study we write the London theory for a long cylinder both for the mixed and Meissner states, with boundary conditions appropriate for this geometry. Using the Monte Carlo simulated annealing method, the free energy of the mixed state is minimized with respect to the vortex position and we obtain the ground state of the vortex lattice for N=3 up to 18 vortices. The free energy of the Meissner and mixed states provides expressions for the matching fields. We find that, as in the case of samples of different geometry, the finite-size effect provokes a delay on the vortex penetration and a vortex accumulation in the center of the sample. The vortex patterns obtained are in good agreement with experimental results.

The size effects in the magnetization of a long cylindrical wire of circular cross section in the presence of an external magnetic field are investigated. For this study the London theory is used with boundary conditions appropriate for this geometry. Using the Monte Carlo simulated annealing method, the free energy of the mixed state is minimized with respect to the vortex positions. The ground state of the vortex lattice for n = 1 up to 18 vortices for a given radius of the cylinder is obtained. It is found that the finite size of the sample provokes a matching effect in the magnetization, as found in experiments with superconducting samples of finite size but different geometry. © 1999 American Institute of Physics.

We obtain the vortex configurations, the matching fields, and the magnetization of a superconducting film with a finite cross section. The applied magnetic field is normal to this cross section, and we use the London theory to calculate many of its properties, such as the local magnetic field, the free energy, and the induction for the mixed state. Thus previous similar theoretical works, done for an infinitely long superconducting film, are recovered here, in the special limit of a very long cross section. ©1999 The American Physical Society.

We use a time-dependent dynamical mean-field-hydrodynamic model to study mixing-demixing in a degenerate fermion-fermion mixture (DFFM). It is demonstrated that with the increase of interspecies repulsion and/or trapping frequencies, a mixed state of a DFFM could turn into a fully demixed state in both three-dimensional spherically symmetric as well as quasi-one-dimensional configurations. Such a demixed state of a DFFM could be experimentally realized by varying an external magnetic field near a fermion-fermion Feshbach resonance, which will result in an increase of interspecies fermion-fermion repulsion, and/or by increasing the external trap frequencies. © 2006 The American Physical Society.

Using a genuinely tridimensional approach to the time-dependent Ginzburg-Landau theory, we have studied the local magnetic field profile of a mesoscopic superconductor in the so-called SQUID geometry, i.e., a square with a hole at the center connected to the outside vacuum through a very thin slit. Our investigation was carried out in both the Meissner and the mixed state. We have also studied the influence of the temperature on the space distribution of the local magnetic field. © 2013 IOP Publishing Ltd.

A aprendizagem de relações condicionais bidirecionais (simetria) tem sido raramente demonstrada em não-humanos. Recentemente três estudos apresentaram dados positivos de repertórios comportamentais de simetria em pombos. Estes estudos apontaram como possíveis variáveis determinantes da emergência de simetria: 1) O treino misto de relações arbitrárias e de identidade simultaneamente e com um mesmo conjunto de estímulos; 2) O sujeito não ter sido exposto a treino prévio de qualquer tipo de relação com os mesmos estímulos; e 3) A utilização do procedimento de discriminação condicional sucessiva (Go/No-go). O presente estudo buscou averiguar a necessidade do uso de Go/No-go, aplicando as demais variáveis (treino misto e não exposição prévia), para a obtenção da emergência de simetria. Este estudo avaliou em dois macacos-prego (Cebus apella) a aprendizagem de relações arbitrárias e de identidade de estímulos apresentados na mesma sessão experimental e a emergência de simetria, utilizando dois procedimentos. Um sujeito (M18) foi treinado em tarefa de Go/Nogo com tentativas mistas de relações arbitrárias e relações de identidade, com o mesmo conjunto de estímulos. O sujeito passou por dois treinos Go/No-go que não foram bem sucedidos em estabelecer controle condicional. Um outro sujeito (M27) foi treinado em uma tarefa de emparelhamento ao modelo com atraso zero com tentativas mistas de relações de identidade e arbitrárias, com mesmo conjunto de estímulos. Esse segundo procedimento buscou averiguar a necessidade do uso do procedimento Go/No-go para a obtenção da emergência de simetria. As sessões de treino eram compostas por oito tentativas de identidade (quatro relações) e oito tentativas de relações arbitrárias (duas relações), apresentadas em seqüência randômica. Todas as tentativas tinham três escolhas entre as comparações. Posteriormente, M27 foi submetido a três testes (todos com reforço programado para todas as tentativas). O treino de linha de base mista (identidade e arbitrária) ocorreu em 14 sessões. O primeiro teste foi de simetria, em uma sessão de oito tentativas para cada uma das quatro relações de identidade, duas arbitrárias e duas de teste, totalizando 64 tentativas, cujo critério de desempenho era acertar sete das oito tentativas de cada relação. M27 teve 2 erros em uma das relações de identidade e acertou todas as demais, inclusive as de simetria. Para averiguar se havia uma coerência do controle de estímulos, foi feito o segundo teste no qual as respostas de escolha entre as comparações não podiam mais ser condicionais ao modelo, uma vez que se utilizou um mesmo estímulo novo no lugar dos modelos para todas as tentativas, tanto de linha de base quanto de teste. M27 cometeu três erros ao todo. Esse resultado pode indicar que havia uma relação de controle, não prevista: como dois pares de estímulos se alternavam na função S- em todas as tentativas, M27 pode ter aprendido a rejeitar esses dois pares de estímulos independente do modelo apresentado. De modo a averiguar se de fato não havia controle por seleção de acordo com o modelo, foi feito um teste apenas com duas comparações com as mesmas outras configurações do primeiro teste. M27 errou seis das 32 tentativas de linha de base de identidade, seis das 16 arbitrárias e seis das 16 de simetria. Os acertos foram, portanto, acima da linha do acaso, o que confirma parcialmente a hipótese acima e pode indicar a presença de um controle misto condicional e discriminativo entre os estímulos de comparação.

The restructuring of the state productive sector of the central government of China is a phenomenon that has occurred since 1978, and is not yet complete. In a centrally planned economy, China's government introduced a series of economic and social transformations in order to modernize the country's economic structure. The flagship of these reforms was the reintroduction of a market economy, living side by side with a strong state control over key economic variables of the country. In this process, there was a restructuring of ownership of enterprises by means of collectivization, the creation of joint stock companies, establishing joint ventures with foreign companies or privatization. The result of this process was the creation of a set of holding companies that operate in strategic sectors of China's economy such as energy, transport, telecom, capital goods and defense. Within this brief article we will focus on the process of opening up and modernization as the expression of a national project that sought to understand the changes in the international economy and sought to adapt the demographic characteristics of China and productive so you get the best out of globalization.

In this work we extend the first order formalism for cosmological models that present an interaction between a fermionic and a scalar field. Cosmological exact solutions describing universes filled with interacting dark energy and dark matter have been obtained. Viable cosmological solutions with an early period of decelerated expansion followed by late acceleration have been found, notably one which presents a dark matter component dominating in the past and a dark energy component dominating in the future. In another one, the dark energy alone is the responsible for both periods, similar to a Chaplygin gas case. Exclusively accelerating solutions have also been obtained.

In the past decades, all of the efforts at quantifying systems complexity with a general tool has usually relied on using Shannon's classical information framework to address the disorder of the system through the Boltzmann-Gibbs-Shannon entropy, or one of its extensions. However, in recent years, there were some attempts to tackle the quantification of algorithmic complexities in quantum systems based on the Kolmogorov algorithmic complexity, obtaining some discrepant results against the classical approach. Therefore, an approach to the complexity measure is proposed here, using the quantum information formalism, taking advantage of the generality of the classical-based complexities, and being capable of expressing these systems' complexity on other framework than its algorithmic counterparts. To do so, the Shiner-Davison-Landsberg (SDL) complexity framework is considered jointly with linear entropy for the density operators representing the analyzed systems formalism along with the tangle for the entanglement measure. The proposed measure is then applied in a family of maximally entangled mixed state.

THE TITLE OF MY THESIS IS THE ROLE OF THE IDEAS AND THEIR CHANGE IN HIGHER EDUCATION POLICY-MAKING PROCESSES FROM THE EIGHTIES TO PRESENT-DAY: THE CASES OF ENGLAND AND NEW ZEALAND IN COMPARATIVE PERSPECTIVE UNDER A THEORETICAL POINT OF VIEW, THE AIM OF MY WORK IS TO CARRY OUT A RESEARCH MODELLED ON THE CONSTRUCTIVIST THEORY. IT FOCUSES ON THE ANALYSIS OF THE IMPACT OF IDEAS ON THE PROCESSES OF POLICY MAKING BY MEANS OF EPISTEMIC COMMUNITIES, THINK TANKS AND VARIOUS SOCIOECONOMIC CONTEXTS THAT MAY HAVE PLAYED A KEY ROLE IN THE CONSTRUCTION OF THE DIFFERENT PATHS. FROM MY POINT OF VIEW IDEAS CONSTITUTE A PRIORITY RESEARCH FIELD WHICH IS WORTH ANALYSING SINCE THEIR ROLE IN POLICY MAKING PROCESSES HAS BEEN TRADITIONALLY RATHER UNEXPLORED. IN THIS CONTEXT AND WITH THE AIM OF DEVELOPING A RESEARCH STRAND BASED ON THE ROLE OF IDEAS, I INTEND TO CARRY ON MY STUDY UNDER THE PERSPECTIVE OF CHANGE. DEPENDING ON THE DATA AND INFORMATION THAT I COLLECTED I EVALUATED THE WEIGHT OF EACH OF THESE VARIABLES AND MAYBE OTHERS SUCH AS THE INSTITUTIONS AND THE INDIVIDUAL INTERESTS, WHICH MAY HAVE INFLUENCED THE FORMATION OF THE POLICY MAKING PROCESSES. UNDER THIS LIGHT, I PLANNED TO ADOPT THE QUALITATIVE METHODOLOGY OF RESEARCH WHICH I BELIEVE TO BE VERY EFFECTIVE AGAINST THE MORE DIFFICULT AND POSSIBLY REDUCTIVE APPLICATION OF QUANTITIVE DATA SETS. I RECKON THEREFORE THAT THE MOST APPROPRIATE TOOLS FOR INFORMATION PROCESSING INCLUDE CONTENT ANALYSIS, AND IN-DEPTH INTERVIEWS TO PERSONALITIES OF THE POLITICAL PANORAMA (ÉLITE OR NOT) WHO HAVE PARTICIPATED IN THE PROCESS OF HIGHER EDUCATION REFORM FROM THE EIGHTIES TO PRESENT-DAY. THE TWO CASES TAKEN INTO CONSIDERATION SURELY SET AN EXAMPLE OF RADICAL REFORM PROCESSES WHICH HAVE OCCURRED IN QUITE DIFFERENT CONTEXTS DETERMINED BY THE SOCIOECONOMIC CHARACTERISTICS AND THE TRAITS OF THE ÉLITE. IN NEW ZEALAND THE DESCRIBED PROCESS HAS TAKEN PLACE WITH A STEADY PACE AND A GOOD GRADE OF CONSEQUANTIALITY, IN LINE WTH THE REFORMS IN OTHER STATE DIVISIONS DRIVEN BY THE IDEAS OF THE NEW PUBLIC MANAGEMENT. CONTRARILY IN ENGLAND THE REFORMATIVE ACTION OF MARGARET THATCHER HAS ACQUIRED A VERY RADICAL CONNOTATION AS IT HAS BROUGHT INTO THE AMBIT OF HIGHER EDUCATION POLICY CONCEPTS LIKE EFFICIENCY, EXCELLENCE, RATIONALIZATION THAT WOULD CONTRAST WITH THE GENERALISTIC AND MASS-ORIENTED IDEAS THAT WERE FASHIONABLE DURING THE SEVENTIES. THE MISSION I INTEND TO ACCOMPLISH THORUGHOUT MY RESEARCH IS TO INVESTIGATE AND ANALYSE INTO MORE DEPTH THE DIFFERENCES THAT SEEM TO EMERGE FROM TWO CONTEXTS WHICH MOST OF THE LITERATURE REGARDS AS A SINGLE MODEL: THE ANGLO-SAXON MODEL. UNDER THIS LIGHT, THE DENSE ANALYSIS OF POLICY PROCESSES ALLOWED TO BRING OUT BOTH THE CONTROVERSIAL AND CONTRASTING ASPECTS OF THE TWO REALITIES COMPARED, AND THE ROLE AND WEIGHT OF VARIABLES SUCH AS IDEAS (MAIN VARIABLE), INSTITUTIONAL SETTINGS AND INDIVIDUAL INTERESTS ACTING IN EACH CONTEXT. THE CASES I MEAN TO ATTEND PRESENT PECULIAR ASPECTS WORTH DEVELOPING AN IN-DEPTH ANALYSIS, AN OUTLINE OF WHICH WILL BE PROVIDED IN THIS ABSTRACT. ENGLAND THE CONSERVATIVE GOVERNMENT, SINCE 1981, INTRODUCED RADICAL CHANGES IN THE SECTOR OF HIGHER EDUCATION: FIRST CUTTING DOWN ON STATE FUNDINGS AND THEN WITH THE CREATION OF AN INSTITUTION FOR THE PLANNING AND LEADERSHIP OF THE POLYTECHNICS (NON-UNIVERSITY SECTOR). AFTERWARDS THE SCHOOL REFORM BY MARGARET THATCHER IN 1988 RAISED TO A GREAT STIR ALL OVER EUROPE DUE TO BOTH ITS CONSIDERABLE INNOVATIVE IMPRINT AND THE STRONG ATTACK AGAINST THE PEDAGOGY OF THE ‘ACTIVE’ SCHOOLING AND PROGRESSIVE EDUCATION, UNTIL THEN RECOGNIZED AS A MERIT OF THE BRITISH PUBLIC SCHOOL. IN THE AMBIT OF UNIVERSITY EDUCATION THIS REFORM, TOGETHER WITH SIMILAR MEASURES BROUGHT IN DURING 1992, PUT INTO PRACTICE THE CONSERVATIVE PRINCIPLES THROUGH A SERIES OF ACTIONS THAT INCLUDED: THE SUPPRESSION OF THE IRREMOVABILITY PRINCIPLE FOR UNIVERSITY TEACHERS; THE INTRODUCTION OF STUDENT LOANS FOR LOW-INCOME STUDENTS AND THE CANCELLATION OF THE CLEAR DISTINCTION BETWEEN UNIVERSITIES AND POLYTECHNICS. THE POLICIES OF THE LABOUR MAJORITY OF MR BLAIR DID NOT QUITE DIVERGE FROM THE CONSERVATIVES’ POSITION. IN 2003 BLAIR’S CABINET RISKED TO BECOME A MINORITY RIGHT ON THE OCCASION OF AN IMPORTANT UNIVERSITY REFORM PROPOSAL. THIS PROPOSAL WOULD FORESEE THE AUTONOMY FOR THE UNIVERSITIES TO RAISE UP TO 3.000 POUNDS THE ENROLMENT FEES FOR STUDENTS (WHILE FORMERLY THE CEILING WAS 1.125 POUNDS). BLAIR HAD TO FACE INTERNAL OPPOSITION WITHIN HIS OWN PARTY IN RELATION TO A MEASURE THAT, ACCORDING TO THE 150 MPS PROMOTERS OF AN ADVERSE MOTION, HAD NOT BEEN INCLUDED IN THE ELECTORAL PROGRAMME AND WOULD RISK CREATING INCOME-BASED DISCRIMINATION AMONG STUDENTS. AS A MATTER OF FACT THE BILL FOCUSED ON THE INTRODUCTION OF VERY LOW-INTEREST STUDENT LOANS TO BE SETTLED ONLY WHEN THE STUDENT WOULD HAVE FOUND A REMUNERATED OCCUPATION (A SYSTEM ALREADY PROVIDED FOR BY THE AUSTRALIAN LEGISLATION). NEW ZEALAND CONTRARILY TO MANY OTHER COUNTRIES, NEW ZEALAND HAS ADOPTED A VERY WIDE VISION OF THE TERTIARY EDUCATION. IT INCLUDES IN FACT THE FULL EDUCATIONAL PROGRAMME THAT IS INTERNATIONALLY RECOGNIZED AS THE POST-SECONDARY EDUCATION. SHOULD WE SPOTLIGHT A PECULIARITY OF THE NEW ZEALAND TERTIARY EDUCATION POLICY THEN IT WOULD BE ‘CHANGE’. LOOKING AT THE REFORM HISTORY RELATED TO THE TERTIARY EDUCATION SYSTEM, WE CAN CLEARLY IDENTIFY FOUR ‘SUB-PERIODS’ FROM THE EIGHTIES TO PRESENT-DAY: 1. BEFORE THE 80S’: AN ELITARIAN SYSTEM CHARACTERIZED BY LOW PARTICIPATION RATES. 2. BETWEEN MID AND LATE 80S’: A TREND TOWARDS THE ENLARGEMENT OF PARTICIPATION ASSOCIATED TO A GREATER COMPETITION. 3. 1990-1999: A FUTHER STEP TOWARDS A COMPETITIVE MODEL BASED ON THE MARKET-ORIENTED SYSTEM. 4. FROM 2000 TO TODAY: A CONTINUOUS EVOLUTION TOWARDS A MORE COMPETITIVE MODEL BASED ON THE MARKET-ORIENTED SYSTEM TOGETHER WITH A GROWING ATTENTION TO STATE CONTROL FOR SOCIAL AND ECONOMIC DEVELOPMENT OF THE NATION. AT PRESENT THE GOVERNMENT OF NEW ZEALAND OPERATES TO STRENGHTHEN THIS PROCESS, PRIMARILY IN RELATION TO THE ROLE OF TERTIARY EDUCATION AS A STEADY FACTOR OF NATIONAL WALFARE, WHERE PROFESSIONAL DEVELOPMENT CONTRIBUTES ACTIVELY TO THE GROWTH OF THE NATIONAL ECONOMIC SYSTEM5. THE CASES OF ENGLAND AND NEW ZEALAND ARE THE FOCUS OF AN IN-DEPTH INVESTIGATION THAT STARTS FROM AN ANALYSIS OF THE POLICIES OF EACH NATION AND DEVELOP INTO A COMPARATIVE STUDY. AT THIS POINT I ATTEMPT TO DRAW SOME PRELIMINARY IMPRESSIONS ON THE FACTS ESSENTIALLY DECRIBED ABOVE. THE UNIVERSITY POLICIES IN ENGLAND AND NEW ZEALAND HAVE BOTH UNDERGONE A SIGNIFICANT REFORMATORY PROCESS SINCE THE EARLY EIGHTIES; IN BOTH CONTEXTS THE IMPORTANCE OF IDEAS THAT CONSTITUTED THE BASE OF POLITICS UNTIL 1980 WAS QUITE RELEVANT. GENERALLY SPEAKING, IN BOTH CASES THE PRE-REFORM POLICIES WERE INSPIRED BY EGALITARIANISM AND EXPANSION OF THE STUDENT POPULATION WHILE THOSE BROUGHT IN BY THE REFORM WOULD PURSUE EFFICIENCY, QUALITY AND COMPETITIVENESS. UNDOUBTEDLY, IN LINE WITH THIS GENERAL TENDENCY THAT REFLECTS THE HYPOTHESIS PROPOSED, THE TWO UNIVERSITY SYSTEMS PRESENT SEVERAL DIFFERENCES. THE UNIVERSITY SYSTEM IN NEW ZEALAND PROCEEDED STEADILY TOWARDS THE IMPLEMENTATION OF A MANAGERIAL CONCEPTION OF TERTIARY EDUCATION, ESPECIALLY FROM 1996 ONWARDS, IN ACCORDANCE WITH THE REFORMATORY PROCESS OF THE WHOLE PUBLIC SECTOR. IN THE UNITED KINGDOM, AS IN THE REST OF EUROPE, THE NEW APPROACH TO UNIVERSITY POLICY-MAKING HAD TO CONFRONT A DEEP-ROOTED TRADITION OF PROGRESSIVE EDUCATION AND THE IDEA OF EDUCATION EXPANSION THAT IN FACT DOMINATED UNTIL THE EIGHTIES. FROM THIS VIEW POINT THE GOVERNING ACTION OF MARGARET THATCHER GAVE RISE TO A RADICAL CHANGE THAT REVOLUTIONIZED THE OBJECTIVES AND KEY VALUES OF THE WHOLE EDUCATIONAL SYSTEM, IN PARTICULAR IN THE HIGHER EDUCATION SECTOR. IDEAS AS EFFICIENCY, EXCELLENCE AND CONTROL OF THE PERFORMANCE BECAME DECISIVE. THE LABOUR CABINETS OF BLAIR DEVELOPED IN THE WAKE OF CONSERVATIVE REFORMS. THIS APPEARS TO BE A FOCAL POINT OF THIS STUDY THAT OBSERVES HOW ALSO IN NEW ZEALAND THE REFORMING PROCESS OCCURRED TRANSVERSELY DURING PROGRESSIVE AND CONSERVATIVE ADMINISTRATIONS. THE PRELIMINARY IMPRESSION IS THEREFORE THAT IDEAS DEEPLY MARK THE REFORMATIVE PROCESSES: THE AIM OF MY RESEARCH IS TO VERIFY TO WHICH EXTENT THIS STATEMENT IS TRUE. IN ORDER TO BUILD A COMPREHENSIVE ANALYLIS, FURTHER SIGNIFICANT FACTORS WILL HAVE TO BE INVESTIGATED: THE WAY IDEAS ARE PERCEIVED AND IMPLEMENTED BY THE DIFFERENT POLITICAL ELITES; HOW THE VARIOUS SOCIOECONOMIC CONTEXTS INFLUENCE THE REFORMATIVE PROCESS; HOW THE INSTITUTIONAL STRUCTURES CONDITION THE POLICY-MAKING PROCESSES; WHETHER INDIVIDUAL INTERESTS PLAY A ROLE AND, IF YES, TO WHICH EXTENT.

L'elaborato considera anzitutto la genesi dell'istituto, e con chiarezza analizza il percorso di affioramento della figura del distacco nell'impiego pubblico rimarcando affinità e differenze con ipotesi similari di temporanea dissociazione tra datore di lavoro e fruitore della prestazione. Nell'operare gli opportuni distinguo, il dott. Tortini si confronta con la fattispecie tipica del lavoro subordinato e con il divieto di dissociazione che ad essa sarebbe sotteso, anche alla luce della legge 1369 del 1960 sul divieto di interposizione. Gli elementi caratterizzanti il distacco sono poi esposti analizzando con acutezza i più rilevanti orientamenti emersi nella giurisprudenza di merito e di legittimità , in specie con riguardo alla prassi invalsa nei gruppi di società  di dirigere la prestazione di lavoro a favore di società  collegate o controllate dalla società  datrice di lavoro. In tal senso l'elaborato prende posizione in ordine alla necessaria temporaneità  dell'interesse del distaccante, nonchè all'inclusione del distacco nell'ambito del potere direttivo-organizzativo del datore di lavoro, ciò che esclude la necessità  del consenso del lavoratore distaccato. Nel secondo capitolo il dott. Tortini si confronta con il quadro delle libertà  fondamentali del diritto comunitario, ed in particolare con la libera prestazione di servizi, analizzando profili essenziali quali la natura autonoma, la transnazionalità  e la temporaneità  del servizio prestato. Con ampi riferimenti alla dottrina, anche comparata, in argomento, il capitolo delinea le possibili forme di interazione tra gli ordinamenti nazionali all'interno dell'Unione europea ed individua, in alternativa, tre modelli di coordinamento tra le esigenze liberalizzanti tipiche del mercato unico e le prerogative nazionali di tipo protezionistico che si manifestano qualora un servizio venga prestato in uno Stato membro diverso da quello in cui ha sede il prestatore: host state control, home state control e controllo sovranazionale. L'analisi si rivela essenziale al fine di delineare le ragioni della più recente giurisprudenza della Corte di giustizia in tema di appalti cross-border e libera circolazione dei lavoratori, e dimostra un sostanziale "slittamento" della base giuridica mediante la quale il diritto comunitario regola il fenomeno della prestazione di lavoro transnazionale, dall'art. 39 all'art. 49 TCE. Il terzo capitolo confronta l'impianto teorico ricavabile dai principi del Trattato con la Direttiva 96/71 sul distacco ed i relativi provvedimenti attuativi (d.lgs. n. 72/2000 e art. 30, d.lgs. n. 276/2003). In particolare, vengono analizzate le ipotesi limitrofe alla nozione di distacco ricavabile dal diritto comunitario, accomunate dalla dissociazione tra datore di lavoro ed utilizzatore della prestazione, ma distinguibili in base alla natura del rapporto contrattuale tra impresa distaccante ed impresa distaccataria. La funzione principale della Direttiva comunitaria in argomento viene individuata dal dott. Tortini nella predisposizione di una base inderogabile di diritti che devono essere, in ogni caso, assicurati al lavoratore oggetto del distacco. Questa base, denominata hard core della tutela, deve essere garantita, all'interno del singolo Stato membro, dalla contrattazione collettiva. Nell'ordinamento italiano, la disciplina del distacco contenuta nella Direttiva viene attuata con il d.lgs. n. 72/2000 che, come opportunamente segnalato dal dott. Tortini, contiene una serie di incongruenze e di lacune. Fra tutte, si rimarca come la stessa Commissione abbia rilevato uno scostamento tra le due discipline, dato che la legge italiana estende surrettiziamente ai lavoratori distaccati tutte le disposizioni legislative e/o i contratti collettivi che disciplinano le condizioni di lavoro, operazione non consentita dal la Direttiva 76/91. E' in specie il riferimento al contratto collettivo stipulato dalle organizzazioni comparativamente più rappresentative ad essere criticato dall'elaborato, in quanto finisce con il trasformare l'art. 3.1 del D. Lgs. 72/2000 in una discriminazione fondata sulla nazionalità  e rischia di creare maggiori difficoltà  e più oneri per gli imprenditori stranieri che intendano erogare servizi sul territorio nazionale. A conclusione della tesi, il dott. Tortini esamina la nozione di distacco introdotta ad opera dell'art. 30, d.lgs. n. 276/2003, ed enuclea gli elementi caratterizzanti dell'istituto, individuati nell'interesse del distaccante e nella temporaneità  dell'assegnazione, definita «l'in sè» dell'interesse stesso.
