This paper outlines some of the experiences of Indigenous women academics in higher education. The author offers these experiences, not to position Indigenous women academics as victims, but to expose the problematic nature of racism, systemic marginalisation, white race privilege and radicalised subjectivity played out within Australian higher education institutions. By utilising the experiences and examples she seeks to bring the theoretical into the everyday world of being Indigenous within academe. In analysing these examples, the author reveals the relationships between oppression, white race privilege, institutional privilege and the epistemology that maintains them. She argues that, in moving from a position of being silent to speaking about what she has witnessed and experienced, she is able to move from the position of object to subject and gain a form of liberated voice (hooks 1989: 9) for herself and other Indigenous women. She seeks to challenge the practices within universities that continue to subjugate Indigenous women academics.

This article tells the story of the mass marketing on stationery of the work of an artist, Sakshi Anmatyerre, whose claims to an lndigenous heritage and to the authority to paint particular designs, totems and motifs were vigorously contested, leading to the withdrawal of the stationery from sale. The efforts made by the publisher, Steve Parish, to atone for the offence caused to the Anmatyerre people are detailed. The article illustrates some of the issues involved in the commodification and commercial exchange of lndigenous artistic or cultural work - or rather, work which relies upon lndigenous connections for its aesthetic and financial value. The story told in this article is enlightening for what it reveals about the state of unsettlement that characterises debate over the 'appropriate' commercial use of lndigenous intellectual and cultural property, for the ways in which it is possible to achieve restitution when an offence agalnst lndigenous law is alleged, and for the effects the process of seeking restitution has had on the business practices of one company.

The Australian Government has been concerned “to find ways of making patent enforcement less of an issue” and to make it “cheaper, simpler and quicker to get fair and appropriate resolution for any dispute”. Major problems relating to patent enforcement in Australia have been identified as: the cost of legal proceedings; the lack of patent owners’ financial capacity to fund enforcement proceedings; delay; and uncertainty as to the outcome and lack of knowledge about the processes of enforcement. This paper considers some of the problems associated with patent enforcement in Australia and proposes an approach to patent litigation which is directed at alleviating some of the difficulties which have been identified. Specifically, it proposes a strategy designed to identify the parties’ risks at an early stage of patent litigation proceeding and facilitate an early resolution of the dispute.

1. In March 2009, the Australian Government, through IP Australia its administrator of Intellectual Property Rights (IPR) acquired by registration or grant, issued two consultation papers for comment by interested stakeholders. 2. The Consultation Papers have invited written submissions directed towards the object of the paper, namely encouraging discussion on certain proposed changes and their impact on business and innovation. 3. I understand the invitation to make written submissions is predominantly in the areas raised by the Consultation Papers and the questions posed. However, I have made a brief reference to several other areas of concern with the current Australian patent law, which in my opinion inhibit innovation and therefore come under the wider agenda of the government to work toward a stronger and more efficient IP rights system. 4. In this regard, the Consultation Papers indicate that if the IPR are less likely to be invalidated and more likely to be enforced, this confidence will reflect in a greater investment in research leading to innovation. 5. This submission relates to the Balance Paper.

Conferences addressing emerging commonalities in the information professions were being held as far back as the early 1980s. At that time, there appeared to be two differing thoughts on the future of the information professions: one that saw the increasing diversification, the other favouring the professions’ convergence. Nearly thirty-five years later, we are still discussing the various advantages and disadvantages that a convergence of the information professions and professionals may bring; yet there has been very little empirical evidence gathered to enable us to move forward in this discussion. This conceptual paper uses existing literature to argue that the convergence of galleries, libraries, archives and museums is not a new concept to these institutions, but that they have been linked – philosophically and intellectually at least - for millennia. The intention of this paper is not to articulate what should be included in a GLAM curriculum, or to identify the skills and knowledge required of an information professional in a converged environment, but rather to demonstrate that this research is needed in order to provide an evidence base from which these may be developed.

The imperative for Indigenous education in Australia is influenced by national political, social and economic discourses as Australian education systems continue to grapple with an agreed aspiration of full participation for Aboriginal and Torres Strait Islander students. Innovations within and policies guiding our education systems are often driven by agendas of reconciliation, equity, equality in participation and social justice. In this paper, we discuss key themes that emerged from a recent Australian Office for Learning and Teaching (OLT) research project which investigated ways in which preservice teachers from one Australian university embedded Indigenous knowledges (IK) on teaching practicum . Using a phenomenological approach, the case involved 25 preservice teacher and 23 practicum supervisor participants, over a 30 month investigation. Attention was directed to the nature of subjective (lived) experiences of participants in these pedagogical negotiations and thus preservice and supervising teacher voice was actively sought in naming and analysing these experiences. Findings revealed that change, knowledge, help and affirmation were key themes for shaping discourses around Indigenous knowledges and perspectives in the Australian curriculum and defined the nature of the pedagogical relationships between novice and experienced teachers. We focus particularly on the need for change and affirmation by preservice teachers and their teaching practicum supervisors as they developed their pedagogical relationships whilst embedding Indigenous knowledges in learning and teaching.

[ES] Se conoce como la «Sinagoga» de Sádaba a las ruinas de un pequeño edificio con planta en forma de cruz de 12 por 14 metros, cuyos restos alcanzan una altura máxima de 4 metros, que se encuentra localizado al sureste del casco urbano del municipio de Sádaba (Zaragoza), junto al Canal de las Bardenas. A pesar de esta denominación, en la actualidad se considera que se trata de un mausoleo de época romana.

La documentación realizada incluye una red de coordenadas absolutas obtenidas por técnicas GNSS y un volumétrico por topografía clásica. Asimismo se ha generado un modelo 3D mallado con texturas fotográficas a partir de fotografías.

[ES] Se suele afirmar que hay dos tipos de patrimonio cultural. Uno, “eterno”, “riguroso”, “irremplazable” o “global”; otro, “contingente”, “flexible”; “sustituible” o “local”. El primero es de la “humanidad”; el segundo, de la “comunidad”. Los trabajos que se presentan en esta publicación, describen y analizan procesos de activación de ese segundo tipo de patrimonio: los intereses y las valorizaciones que han conducido a la patrimonialización o puesta en valor de unos bienes culturales; qué agentes han intervenido en ese proceso; por qué, para qué y cómo lo han llevado a cabo. Se interesan más por el modus operandi que por el opus operatum. Escritos por profesores, investigadores, especialistas y técnicos, los trabajos de esta publicación presentan un conjunto de experiencias europeas y americanas, mostrando un panorama diverso y complejo del campo patrimonial y museístico, así como distintas aproximaciones en función de la posición que ocupa el autor respecto a los bienes culturales.

En mars 2013, trois cent treize artefacts précolombiens, exposés auparavant dans le musée barcelonais des Suisses Jean-Paul Barbier et Monique Mueller, furent mis en vente chez Sotheby’s à Paris par ce couple de collectionneurs. L’affaire fut l’objet une couverture médiatique internationale lorsque des pays d’Amérique centrale et d’Amérique du Sud, notamment le Pérou, le Mexique et le Guatemala, protestèrent contre la tenue de cette vente, avançant que leur patrimoine culturel national n’est pas à vendre. La question centrale de ce mémoire porte sur le trafic illicite des biens culturels et elle se décline en trois axes, à partir d’une étude de cas : la collection Barbier-Mueller. Les relations complexes entre les musées et les grands collectionneurs sont observées dans le premier chapitre à la lumière des règles déontologiques qui régissent habituellement les institutions, afin de ne pas encourager l’acquisition d’objets impliqués dans des transactions illicites. Dans un deuxième temps, au moyen d’une succincte présentation du marché actuel de l’art mondial, l’influence des maisons de ventes aux enchères sera examinée. Tandis que la provenance des artefacts en vente n’est pas toujours clairement affichée, il est difficile de retracer la lignée des propriétaires ou leur nation d’origine. Or, sachant que la commercialisation illicite des biens culturels se développe à l’intérieur même du marché de l'art régulier, les auteurs parlent alors d’un « marché gris ». Ce mémoire remonte, depuis l’excavation en passant par leur exportation illégale, la chaîne de transactions de ces biens culturels qui aboutissent dans les expositions des plus prestigieuses institutions. Cette recherche aborde en dernier lieu certaines incongruités du marché de l’art en auscultant les particularités des outils fournis par l’UNESCO et l’ICOM, ainsi que la question de l’aliénation, en plus de celle des limites juridiques des pays requérants. Finalement, cette étude présente les oppositions entre le discours officiel et les actions réellement entreprises pour la protection du patrimoine culturel.
