The unfurling of global capitalism – and its attendant effects – has long been fertile intellectual terrain for geographers. But whilst studies of the processes and mechanisms of globalisation undoubtedly assume a talismanic importance in the discipline, geographers, with few exceptions, have left examinations of early economic liberalism to historians. One such critically important episode in the evolution of the liberal economic project was the repeal of the so-called 'Corn Laws' in 1846. Whilst the precise impact of the Manchester-based Anti-Corn Law League (ACLL) continues to be a matter of conjecture, Eric Sheppard has asserted that their particular take on political economy managed to assume a 'truth-like status' and worldwide universality. But the ACLL's campaign represents only one, albeit decisive, stage in the long intellectual and practical struggle between 'protectionists' and the disciples of free trade. Studies of the non-'Manchester' components have tended to focus squarely upon national politics. This paper examines a pivotal attempt in 1838 by Lord Melbourne's Government to experiment with the effective elimination of import duties on fresh fruit. Unlike most agricultural commodities, table fruit was produced in a tightly defined area, thus allowing the Government's experiment to play out, in theory, without national political fallout. Whilst the Government's clandestine actions left little time for a concerted opposition to develop, Kentish fruit growers soon organised. A formidable lobby was forged that drew wide local support yet also evolved beyond the original 'epistemic community'. Whilst the coalition failed in their efforts to reintroduce protective duties, their actions allow us to see how protectionist ideologies and policies were vivified through practices at many different spatial scales and to better understand the complex spatiality of protectionist takes on political economy. Their campaign also changed – at least in the short term – the course of British mercantile policy.

On 21 July 2011 the Inter-American Commission on Human Rights issued its much awaited decision in the case of Jessica Lenahan (Gonzales) v United States. In a landmark decision the Commission found the United States of America to be in violation of the American Declaration of the Rights and Duties of Man 1948 due to the failure of the state to protect a victim of domestic violence and her children. This paper analyses the Lenahan decision and its significance for the United States. In particular, the substantial influence of the case law of the European Court of Human Rights on the Commission’s reasoning is examined.

The use of public sector equality duties that require public authorities to do more than simply not discriminate and that in addition require such authorities in exercising their functions to actively promote equality has increasingly been considered as relevant for procurement. This article examines the Northern Ireland experience regarding the application of a public sector equality duty to procurement and addresses whether, and if so to what extent, this experience provides any useful lessons for the operation of the ‘equality duty’ in the recently enacted British Equality Act 2010.

Relying on Brown’s (2005a, b) thesis that contemporary shifts in penal policy are best understood as a reprisal of colonial rationality, so that offenders become ‘non-citizens’ or ‘agents of obligation’, this article argues that this framework finds support in developments in Irish criminal justice policy. Recent legislation aimed at offenders suspected of involvement in ‘organised crime’ is examined through this lens. These offenders have found themselves reconstituted as ‘agents of obligation’ with duties to furnish information about their property and movements, report to the police concerning their location and, importantly, refrain from criminal activity or face extraordinary sanctions. It is therefore argued that this paradigm is a useful heuristic device through which to understand recent developments in Irish criminal justice and elsewhere. In light of the trends observed in Ireland, certain refinements and extensions to Brown’s argument are put forward for consideration.

The relevance of European Union (EU) cross-border cooperation for European border con?ict amelioration may be questioned in the contemporary global climate of threat and insecurity posed by forces of ’dark globalisation’. In any case, empirical evidence exposes the limitations of cross-border cooperation in advancing con?ict amelioration in some border regions. Nevertheless, in an enlarged EU which encompasses Central and East European member states and reaches out to neighbouring states through cross-border cooperation initiatives, the number of real and potential border con?icts with which it is concerned has risen exponentially. Fortunately, there are cases of EU ’borderscapes’ that have adopted a cross-border ’peace-building from below’ approach leading to border con?ict amelioration. Unfortunately, countervailing pressures on EU cross-border cooperation from border security regimes (principally Schengen), the Eurozone crisis, EU budgetary constraints, the conceptualisation of ’Europe as Empire’, and the possible recon?guration of the EU itself compromises this approach. Therefore, the path of European integration may well shift from one of inter-state peace-building and regional crossborder cooperation after the Second World War, to border con?ict and coercion in constituting and reconstituting state borders after the recon?guration of the EU.

Bills of rights are currently a much debated topic in various jurisdictions throughout the world. Almost all democratic nations, with the exception of Australia, now have a bill of rights. These take a variety of forms, ranging from constitutionally entrenched bills of rights, such as those of the United States and South Africa, to non-binding statements of rights. Falling between these approaches are non-entrenched, statutory bills of rights. As regards the latter, a model which has become increasingly popular is that of bills of rights based on interpretative obligations, whereby duties are placed upon courts to interpret national legislation in accordance with human rights standards. The aim of this book is to provide a comparative analysis of the bills of rights of a number of jurisdictions which have chosen to adopt such an approach. The jurisdictions considered are New Zealand, the United Kingdom, the Australian Capital Territory and the Australian state of Victoria.

There have been very few books published to date which contain a detailed comparative analysis of the bills of rights which this book addresses. The book adopts a unique thematic approach, whereby six aspects of the bills of rights in question have been selected for comparative analysis and a chapter is allocated to each aspect. This approach serves to facilitate the comparative discussion and emphasise the centrality of the comparative methodology.

The national resource privilege, which holds that states are allowed to control all the natural resources found in their territory, is a cornerstone of international politics. Supporters of the national resource privilege claim that without the privilege states would fail to be sovereign and self-determining entities which provide for the needs of their citizens. However, as this paper shows the case is not as simple as that. In fact, control over resources must be carefully unpacked. Doing so shows that states do not require full control over all resources found in their territory in order to be sovereign. Moreover, sovereignty and self-determination come with a set of responsibilities and duties attached. Based on these observations the paper will sketch the contours of an alternative resource governance scheme built around the idea of an International Court of the Environment.

The aim of this chapter is to present a contextual and empirical account of men as fathers in Ireland along with an analysis of recent, relevant developments in policies and laws. Much of parenting of a child occurs in the home. Consequently, how couples inhabit the home greatly influences how their children experience childhood and, in many ways, the story of fatherhood in Ireland is the product of the on-going changes in the domestic sphere. Whether men are driving these changes, embracing or resisting them will provide the substance of much of this chapter. Section one presents basic demographic figures and trends based on census data to answer the questions: who are the fathers, what type of families do the live in and how involved are they in childcare? Section two presents recent research on contemporary fatherhood, both international and, where possible, national. Section three explores the policies and legal measures that affect fathers, their duties and their rights in the home and at work. Section four will discuss the historical legacy of fatherhood that is particular to Ireland. The final section will draw together these threads and ask what might be the future of fatherhood in Ireland, its challenges and possible successes.

Background: Clinical Commissioning Groups (CCGs) are mandated to use research evidence effectively to ensure optimum use of resources by the National Health Service (NHS), both in accelerating innovation and in stopping the use of less effective practices and models of service delivery. We intend to evaluate whether access to a demand-led evidence service improves uptake and use of research evidence by NHS commissioners compared with less intensive and less targeted alternatives. 

Methods/design: This is a controlled before and after study involving CCGs in the North of England. Participating CCGs will receive one of three interventions to support the use of research evidence in their decision-making:1) consulting plus responsive push of tailored evidence; 2) consulting plus an unsolicited push of non-tailored evidence; or 3) standard service unsolicited push of non-tailored evidence. Our primary outcome will be changed at 12 months from baseline of a CCGs ability to acquire, assess, adapt and apply research evidence to support decision-making. Secondary outcomes will measure individual clinical leads and managers’ intentions to use research evidence in decision making. Documentary evidence of the use of the outputs of the service will be sought. A process evaluation will evaluate the nature and success of the interactions both within the sites and between commissioners and researchers delivering the service. 

Discussion: The proposed research will generate new knowledge of direct relevance and value to the NHS. The findings will help to clarify which elements of the service are of value in promoting the use of research evidence.Those involved in NHS commissioning will be able to use the results to inform how best to build the infrastructure they need to acquire, assess, adapt and apply research evidence to support decision-making and to fulfil their statutory duties under the Health and Social Care Act.

The teaching and cultivation of professionalism is an integral part of medical education as professionalism is central to maintaining the public’s trust in the medical profession. Traditionally professional values would have been acquired through an informal process of socialisation and observation of role models. Recently, however, medical educators have accepted the responsibility to explicitly teach and effectively evaluate professionalism. A comprehensive working definition of the term professionalism and a universally agreed list of the constituent elements of professionalism are currently debated. The School of Medicine and Dentistry of The Queen’s University of Belfast uses an approach of self-directed learning for teaching anatomy, and students are given the opportunity to learn anatomy from human dissection. Self-directed learning teams have been found to be underutilised as educational strategies and presented an opportunity to utilise the first year dissection room teaching environment to nurture the development of the attributes of professionalism. An educational strategy based on role-playing was developed to engage all students around the dissection table. Students received comprehensive background reviews on professionalism, its attributes and the identification of such attributes in the context of the dissection room. Roles, with specific duties attached, were allocated to each team member. Circulating academic staff members directly observed student participation and gave formative feedback. Students were given the opportunity to reflect on their ability to identify the attributes and reflect on their own and their peer’s ability to develop and practise these attributes. This strategy indicated that small group learning teams in the dissection room utilise widely accepted principles of adult learning and offer an opportunity to create learning activities that will instil in students the knowledge, values, attitudes and behaviours that characterise medical professionalism. Anatomy faculty have a responsibility to nurture and exemplify professionalism and play a significant role in the early promotion and inculcation of professionalism. It remains imperative not only to assess this strategy but also to create opportunities for critical reflection and evaluation within the strategy. This paper reviews decisions from the Northern Ireland and England and Wales High Courts and Courts of Appeal as well as the UK Supreme Court relating to tort and principally to the tort of negligence in the past 12 months or so.

In structure, the paper will be presented in four parts. First, three preliminary points relating to contemporary features of the NI civil courts: personal litigants – Devine v McAteer [2012] NICA 30 (7 September 2012); pre-action protocols – Monaghan v Graham [2013] NIQB 53 (3 May 2013); and the rise of alternative dispute resolution. On the last named issue, the recent decision of PGF II SA v OMFS Company 1 Ltd [2013] EWCA Civ 1288 (23 October 2013) on unreasonable refusal to mediate, will be discussed.

Second, the paper moves to consider the law of negligence generally and case law from the NI High Court reiterating Lord Hoffmann’s view in Tomlinson v Congleton Borough Council [2004] 1 AC 46 that no duty of care arises from obvious risks of injury. In this, reference will be made to the application of the above “Hoffmann principle” in West Sussex County Council v Pierce [2013] EWCA Civ 1230 (16 October 2013), which concerned an accident sustained by a child at school. A similar set of facts was presented recently to the UK Supreme Court in Woodland v Essex County Council [2013] UKSC 66 (23 October 2013). The decision there, on non-delegable duties of care, will have a significant impact for schools in the provision of extracurricular activities.

Third, I will review a NI case of note on the duty of care of solicitors in the context of professional negligence in the context of conflicting advice by counsel.

Fourth, I will examine a series of cases on employer liability and including issues such as the duty of care towards the volunteer worker; tort and safety at work principles generally; and, more specifically, the duty of care of the employer towards an employee who suffers psychiatric illness as a result of stress and/or harassment at work. On the issue of workplace stress, the NI courts have made extensive reference to the Hale LJ principles found in the Court of Appeal decision of Hatton v Sutherland [2002] 1 All ER 1 and applied to those who have suffered trauma in reporting on or policing “the troubles” in Northern Ireland. On the issue of statutory harassment at work, the paper will also mention the UK Supreme Court’s decision in Hayes v Willoughby [2013] UKSC 17 (20 March 2013).

This paper considers the value of a normative account of the relationship between agents and institutions for contemporary efforts to explain ever more complex and disorganized forms of social life. The character of social institutions, as they relate to practices, agents and norms, is explored through an engagement with the common claim that family life has been deinstitutionalized. The paper argues that a normative rather than empirical definition of institutions avoids a false distinction between institutions and practices. Drawing on ideas of social freedom and creative action from critical theory, the changes in family life are explained not as an effect of deinstitutionalization, but as a shift from an organized to a disorganized institutional type. This is understood as a response to changes in the wider normative structure, as a norm of individual freedom has undermined the legitimacy of the organized patriarchal nuclear family, with gender ascribed roles and associated duties. Contemporary motherhood is drawn on to illustrate the value of analysing the dynamic interactions between institutions, roles and practices for capturing both the complexity and the patterned quality of social experience.

On June 27th 2012, the Deputy First Minister of Northern Ireland and former IRA commander, Martin McGuinness shook hands with Queen Elizabeth II for the first time at an event in Belfast. For many the gesture symbolised the consolidation of Northern Ireland's transition to peace, the meeting of cultures and traditions, and hope for the future. Only a few weeks later however violence spilled onto the streets of north and west Belfast following a series of commemorative parades, marking a summer of hostilities. Those hostilities spread into a winter of protest, riot and discontent around flags and emblems and a year of tensions and commemorative-related violence marked again by a summer of rioting and protest in 2013. Outwardly these examples present two very different pictures of the 'new' Northern Ireland; the former of a society moving forward and putting the past behind it and the latter apparently divided over and wedded to different constructions of the past. Furthermore they revealed two very different 'places', the public handshake in the arena of public space; the rioting and fighting occurring in spaces distanced from the public sphere. This paper has also illustrated the difficulties around the ‘public management’ of conflict and transition as many within public agencies struggle with duties to uphold good relations and promote good governance within an environment of political strife, hostility and continuing violence.

This paper presents the key findings and implications of an exploratory project funded by the Arts and Humanities Research Council, explored the phenomenon of commemorative-related violence in Northern Ireland. We focus on 1) why the performance or celebration of the past can sometimes lead to violence in specific places; 2) map and analyse the levels of commemorative related violence in the past 15 years and 3) look at the public management implications of both conflict and transition at a strategic level within the public sector.

It is often assumed that in order to avoid the most severe consequences of global anthropogenic climate change we have to preserve our existing carbon sinks, such as for instance tropical forests. Global carbon sink conservation raises a host of normative issues, though, since it is debatable who should pay the costs of carbon sink conservation, who has the duty to protect which sinks, and how far the duty to conserve one’s carbon sinks actually extends, especially if it conflicts with other duties one might have. According to some, forested states like Ecuador have a duty to preserve their tropical forests while the rich states of the global North have a duty of fairness to compensate states like Ecuador for the costs they incur. My aim in this paper is to critically analyse this standard line of argument and to criticise its validity both internally (i.e. with regard to its normative conclusion based on its premises) and externally (i.e. with regard to the argument’s underlying assumptions and its lack of contextualisation). As I will argue, the duty to conserve one’s forests is only a particular instantiation of a wider, more general duty to contribute towards global climate justice for which the context in which one operates (e.g. whether other agents are complying with their duties of global climate justice or not) matters significantly.

O estudo Educação de Infância como tempo fundador: Repensar a Formação de Educadores para uma acção educativa integrada inscreve-se no processo de reflexão acerca das finalidades da educação básica e da qualidade da formação e da intervenção dos profissionais de educação de infância. Considerando as condições de instabilidade, crescente insegurança e grande imprevisibilidade que caracterizam as sociedades contemporâneas e, considerando também, os avanços científicos que vêm ocorrendo nas últimas décadas, fundamentando e alertando para a importância decisiva das aprendizagens realizadas na Infância nos processos de desenvolvimento subsequentes, releva-se neste estudo a necessidade de dar continuidade e aprofundar essa reflexão procurando responder, também pela investigação, aos desafios que as mudanças sociais suscitam. Nesta linha e tendo como referente o significado que, em termos de estruturação identitária pessoal e colectiva, é reconhecido à educação de infância, enquanto contexto primeiro de educação básica e complementar da acção educativa da família, o principal objectivo do estudo consiste em aprofundar o conhecimento acerca da natureza e qualidade dos saberes básicos a promover na educação pré-escolar e das competências reconfiguradoras do perfil de desempenho profissional dos educadores de infância para que, em articulação com as famílias das crianças, se tornem facilitadores do seu desenvolvimento, no quadro de uma ampla perspectiva de cidadania e de sucesso para todos. Os eixos investigativos que se cruzam no estudo pressupõem uma dimensão de pesquisa (teórica, documental e empírica) de natureza complexa, na qual, se procura tornar compreensíveis as interacções entre os participantes anteriormente referidos, no sentido de uma possível coerência conceptual e funcional, que regule e sustente a qualidade dos processos de desenvolvimento. Do ponto de vista metodológico, a investigação inscreve-se numa abordagem de natureza qualitativa, de matriz complexa e com características de estudo de caso, centrado nos processos de formação e de intervenção dos educadores de infância em exercício de funções, no distrito de Bragança. No sentido de construir uma visão integrada do objecto de estudo foi desenvolvida uma revisão temática de literatura e de análise documental e, na dimensão empírica do estudo, foram promovidos processos mistos de recolha de dados, com recurso à inquirição por questionário e por entrevista (semi-estruturada). A inquirição por questionário foi feita a 229 educadores de infância e a 1340 pais (ou seus representantes), das crianças que frequentavam a educação pré-escolar e a entrevista a 6 educadoras, que integravam os conselhos executivos dos Agrupamentos de Escolas e, cujas funções de gestão e administração, lhes permitiam ter uma perspectiva mais global das problemáticas em estudo. Os instrumentos de recolha e de análise da informação foram validados de modo a garantir-lhes fiabilidade e credibilidade. Os resultados do estudo podem ser lidos em dois níveis, considerando a sua abrangência e especificidade. Num primeiro plano, numa leitura mais global e transversal às questões em estudo e, num segundo plano, como enfoque mais específico em função de quatro dimensões temáticas decorrentes do quadro de fundamentação teórica e organizadoras do processo de reflexão e de pesquisa. Assim, globalmente, os resultados confirmam a importância que todos os inquiridos reconhecem, quer às aprendizagens ocorridas na Infância, como factor importante no desenvolvimento pessoal e social das crianças ao longo da vida, quer ao papel que, nele, os educadores e respectiva formação (inicial e contínua) devem desempenhar. Com algumas variações, as representações dos educadores de infância e dos pais inquiridos neste estudo, embora diferentes em algumas das questões específicas, apresentam-se maioritariamente coerentes e próximas das perspectivas teóricas mais actuais, que consideram a natureza processual das aprendizagens e a importância que a qualidade dos contextos e das transições, que neles ocorrem, assumem nos processos de desenvolvimento. Ou seja, inscrevem-se na linha das teorias socioconstrutivista e ecológica também subjacentes às orientações curriculares, ao nível nacional e aos quadros teóricos de referência, ao nível internacional. Identificam a aprendizagem da cidadania (ou do aprender a ser em sociedade) como o saber mais estruturante a ser desenvolvido no conjunto da acção educativa e perspectivam-na como processo de responsabilidade partilhada e cooperado. Tratando-se de uma amostra extensa e de um distrito geograficamente marcado pela interioridade, e sem esquecer que os dados se referem a representações expressas ao nível dos discursos, é importante reconhecer os sinais de actualidade das perspectivas e das sugestões apontadas para dar continuidade aos processos de desenvolvimento integrado de todos os participantes no processo educativo. Ainda numa leitura global, as principais diferenças, genericamente observadas entre educadores e pais, evidenciam, da parte destes, uma perspectiva de cidadania mais restrita e, da parte dos educadores, uma visão mais alargada do conceito. Com efeito, são os pais com mais elevada qualificação académica que partilham com os educadores esta perspectiva ampliada e transformadora de cidadania. Numa leitura mais enfocada e mais detalhada, e tal como referido anteriormente, os resultados podem ser lidos no cruzamento de quatro dimensões que interligam as questões de pesquisa: os saberes básicos, as estratégias de intervenção para o seu desenvolvimento; a formação e intervenção dos educadores de infância e a identificação de competências que possam vir a aprofundarem a sua formação. No que se refere aos saberes básicos, e não obstante a ocorrência de variações, quer quanto aos próprios saberes, quer quanto à terminologia usada, são considerados como fundamentais: 1. O aprender a ser na perspectiva do desenvolvimento da identidade; 2. O aprender a exercer a cidadania na linha da aprendizagem e da vivência democrática na relação com o mundo e com o outro; 3. O aprender a aprender como ferramenta indispensável à aprendizagem ao longo da vida; 4. O aprender a desenvolver o pensamento crítico, enquanto possibilidade de criteriosa escolha pessoal entre alternativas possíveis e 5. O aprender a comunicar como condição relacional inalienável nos processos de interacção com os contextos e com as pessoas. A segunda dimensão tem a ver com as estratégias consideradas facilitadoras do desenvolvimento destes saberes e são considerados três níveis da intervenção educativa: a acção dos educadores propriamente dita, a cooperação dos pais no processo de aprendizagem das crianças e a interacção da instituição pré-escolar com os pais/família. A acção dos educadores surge, tendencialmente perspectivada como facilitadora do desenvolvimento dos saberes básicos, embora em relação a algumas práticas essa perspectiva surgisse pouco evidente e distingue-se quanto ao desenvolvimento da acção e relação educativa, manifestando os educadores mais experientes uma opinião mais favorável. No que se refere à cooperação dos pais no processo de aprendizagem das crianças, os resultados indicam que a maioria dos pais manifesta uma opinião favorável a práticas configuradoras de um clima facilitador do desenvolvimento dos saberes básicos enunciados, mas variando os seus pontos de vista. São os pais de habilitações académicas mais elevadas, de idade intermédia e situados em contexto urbano os que apresentam opiniões mais favoráveis. Por fim, e no que diz respeito à interacção com as famílias, os resultados evidenciam uma opinião positiva com os meios de interacção utilizados, mas deixando perceber a necessidade de melhorar o processo de cooperação, manifestando os pais uma opinião menos positiva do que os educadores sobre esse processo. A terceira dimensão diz respeito às representações sobre a formação e intervenção profissional dos educadores, evidenciando os resultados que a maioria dos educadores atribuiu muita relevância aos contributos do curso de formação inicial para o desenvolvimento da maioria das competências necessárias para o seu desempenho profissional. Permitem ainda verificar que os educadores de formação mais recente manifestaram uma opinião mais favorável desses contributos, quanto ao desenvolvimento de conhecimentos em áreas, tais como a matemática, conhecimento do mundo e expressão musical, o que significa um avanço relativamente ao reconhecimento da necessidade de fazer investimento nessas áreas sugeridas em alguns estudos e projectos. Quanto ao desenvolvimento da actividade profissional, os resultados relevam que a maior preocupação dos educadores se centra em torno do seu desempenho profissional e das condições de exercício da actividade profissional. No que se refere ao início de carreira, esta última dimensão assume maior evidência, sendo ainda possível perceber que a entrada na vida profissional tem vindo a ocorrer, nos últimos anos, através da rede privada. A quarta dimensão tem a ver com as competências profissionais a desenvolver pelos futuros educadores, e não obstante algumas diferenças nas opiniões manifestadas pelos três grupos de participantes, surgem relevadas competências que a literatura e os perfis de desempenho profissional docente apontam como devendo ser promovidas e incluídas nos programas de formação de educadores de infância/professores. Estas podem ser vistas, quer numa dimensão geral relativa ao grupo docente, quer numa dimensão mais específica da intervenção em educação de infância, tal como é especificado ao longo do trabalho.
