El propósito de la presente monografía es evaluar el papel de las ONG internacionales en la apertura de espacios de participación política para la sociedad civil en Egipto. En ese sentido, se analiza el contexto de oportunidades políticas locales y transnacionales del país, así como los procesos de articulación entre la política local e internacional a través de los niveles de integración entre sus actores. Mediante una investigación de tipo cualitativa basada en los desarrollos sobre teorías de la acción colectiva planteados por Sidney Tarrow, Charles Tilly, Robert Benford y David Snow, y las teorías sobre redes transnacionales de defensa desarrolladas por Margaret Keck y Kathryn Sikkink, se avanza hacia la identificación del desarrollo de procesos de externalización como medio para el fortalecimiento de organizaciones locales como alternativa de oposición política.

Transitional provisions are defined as the set of regulations that rule juridical relationships on the occasion of a legislative change. Out of this context of law succession, their indiscriminate application can lead to serious inconsistencies. The analysis of a Spanish private law example is offered to illustrate this fact. It concerns the administrative authorization for the demolition of rented buildings in the cities. A regulation repealed more than fifteen years ago and however widespread utilised on ancient constructions that, after recent urban development, have acquired great economic value; something that in the end explains the current importance of such provisions. What is happening in Spain: denaturalization of the original figure due to a mixture of formalist interpretations and speculative market interests, is presented here to call the attention on the necessary limitation of transitional provisions’ effects.

El propósito del tema a desarrollar a través de este documento es el de analizar y comprender, bajo una óptica crítica y reflexiva, la institución jurídica de la partición en vida, su noción, regulación y efectos, con miras a determinar los posibles perjuicios que pueda generar la aplicación de esta figura a los acreedores de quien lleva a cabo la misma. Basados en dicho objetivo, se expone a la partición en vida como institución jurídica, analizando el fallo de la Corte Constitucional mediante el cual se declara su exequibilidad, y contrastándola con la partición por donación, usada en Argentina, como referente extranjero. Así mismo, son abordadas distintas instituciones jurídicas cuyo análisis permite denotar el alcance de la partición en vida en la práctica social colombiana, y a su vez, determinar cómo puede verse afectado el patrimonio de aquellos terceros que fungen como acreedores del partidor.

Several marine deposits in the southern Costa Brava shoreline have been studied. They appear at different heights above and below the present sea level. Three groups are defined in relation to their origin: conglomerate levels at the bottom of the cliffs, not-cemented emerged beaches and cemented submerged beaches. The age of the emerged beaches has been accurately determined by means of the ceramic content and radiocarbon dating. Chronological succession of the deposits and their stratigraphic and paleontological characteristics allow to define a sequence of the sea level changes during the latest stages of the versiliane transgression in the studied area

Zooplankton community structure (composition, diversity, dynamics and trophic relationships) of Mediterranian marshes, has been analysed by means of a size based approach. In temporary basins the shape of the biomass-size spectra is related to the hydrological cycle. Linear shape spectra are more frequent in flooding situations when nutrient input causes population growth of small-sized organisms, more than compensating for the effect of competitive interactions. During confinement conditions the scarcity of food would decrease zooplankton growth and increase intra- and interspecific interactions between zooplankton organisms which favour the greatest sizes thus leading to the appearance of curved shape spectra. Temporary and permanent basins have similar taxonomic composition but the latter have higher species diversity, a more simplified temporal pattern and a size distribution dominated mainly by smaller sizes. In permanents basins zooplankton growth is not only conditioned by the availability of resources but by the variable predation of planktivorous fish, so that the temporal variability of the spectra may also be a result of temporal differences in fish predation. Size diversity seems to be a better indicator of the degree of this community structure than species diversity. The tendency of size diversity to increase during succession makes it useful to discriminate between different succession stages, fact that is not achieved by analysing only species diversity since it is low both under large and frequent or small and rare disturbances. Amino acid composition differences found among stages of copepod species indicate a gradual change in diet during the life cycle of these copepods, which provide evidence of food niche partitioning during ontogeny, whereas Daphnia species show a relatively constant amino acid composition. There is a relationship between the degree of trophic niche overlap among stages of the different species and nutrient concentration. Copepods, which have low trophic niche overlap among stages are dominant in food-limited environments, probably because trophic niche partitioning during development allow them to reduce intraspecific competition between adults, juveniles and nauplii. Daphnia species are only dominant in water bodies or periods with high productivity, probably due to the high trophic niche overlap between juveniles and adults. These findings suggest that, in addition to the effect of interspecific competition, predation and abiotic factors, the intraspecific competition might play also an important role in structuring zooplankton assemblages.

La regulación jurídica de las sucesiones mortis causa es muy diferente de país a país. Esta diferencia de regulación se aprecia tanto en el plano del Derecho sustantivo, como en el plano del Derecho internacional privado. En el plano del Derecho material, las diferencias están ancladas en razones sociales, económicas y culturales de profunda raigambre.1 Por ello, las sucesiones internacionales son una de las cuestiones más arduas del Derecho internacional privado. Así lo subraya J. CARRASCOSA,2 quien nos recuerda que en la regulación de las sucesiones confluyen elementos del Derecho de la persona y de la familia y del Derecho de los bienes, con toda su carga ideológica que suscita y explica la vigencia de modelos no sólo diferentes sino inconciliables. De ahí que las sucesiones sean el espigón desde el que observar la marea de las cuestiones clásicas del conflicto de leyes: calificación, reenvío, orden público internacional, fraude de Ley internacional, remisión a sistemas plurilegislativos ad extra y ad intra, prueba del Derecho extranjero, conflicto internacional transitorio, adaptación, cuestión previa, etc.

Changes in mature forest cover amount, composition, and configuration can be of significant consequence to wildlife populations. The response of wildlife to forest patterns is of concern to forest managers because it lies at the heart of such competing approaches to forest planning as aggregated vs. dispersed harvest block layouts. In this study, we developed a species assessment framework to evaluate the outcomes of forest management scenarios on biodiversity conservation objectives. Scenarios were assessed in the context of a broad range of forest structures and patterns that would be expected to occur under natural disturbance and succession processes. Spatial habitat models were used to predict the effects of varying degrees of mature forest cover amount, composition, and configuration on habitat occupancy for a set of 13 focal songbird species. We used a spatially explicit harvest scheduling program to model forest management options and simulate future forest conditions resulting from alternative forest management scenarios, and used a process-based fire-simulation model to simulate future forest conditions resulting from natural wildfire disturbance. Spatial pattern signatures were derived for both habitat occupancy and forest conditions, and these were placed in the context of the simulated range of natural variation. Strategic policy analyses were set in the context of current Ontario forest management policies. This included use of sequential time-restricted harvest blocks (created for Woodland caribou (Rangifer tarandus) conservation) and delayed harvest areas (created for American marten (Martes americana atrata) conservation). This approach increased the realism of the analysis, but reduced the generality of interpretations. We found that forest management options that create linear strips of old forest deviate the most from simulated natural patterns, and had the greatest negative effects on habitat occupancy, whereas policy options that specify deferment and timing of harvest for large blocks helped ensure the stable presence of an intact mature forest matrix over time. The management scenario that focused on maintaining compositional targets best supported biodiversity objectives by providing the composition patterns required by the 13 focal species, but this scenario may be improved by adding some broad-scale spatial objectives to better maintain large blocks of interior forest habitat through time.

This study examined the influence of a spruce budworm (Choristoneura fumiferana (Clem.)) outbreak on a boreal mixed-wood bird community in forest stands ranging in age from 0 to 223 yr. We asked if (1) patterns of species response were consistent with the existence of spruce budworm specialists, i.e., species that respond in a stronger quantitative or qualitative way than other species; (2) the superabundance of food made it possible for species to expand their habitat use in age classes that were normally less used; and (3) the response to budworm was limited to specialists or was it more widespread. Results here indicated that three species, specifically the Bay-breasted Warbler (Dendroica castanea), Tennessee Warbler (Vermivora peregrina), and Cape May Warbler (Dendroica tigrina), had a larger numerical response to the budworm outbreak. They responded with increases in density of up to tenfold over 4 or 5 yr. No other species responded with more than a twofold increase in the same time period. These species also showed a functional response by breeding more frequently in young stands aged 1–21 yr and intermediate stands aged 22–36 yr as budworm numbers increased. Our data also suggested that many species profited to a lesser extent from budworm outbreaks, but that this effect may be too subtle to detect in most studies. We found evidence of a positive numerical effect in at least 18 additional species in one or two stand-age categories but never in all three for any one species. Given the numerical response in many species and the potential influence of budworm on bird populations because of the vast extent of outbreaks, we believe that the population cycle of spruce budworm should be considered in any evaluation of population trends in eastern boreal birds.

Wilson’s Warbler (Cardellina pusilla; WIWA) has been declining for several decades, possibly because of habitat loss. We compared occupancy of territorial males in two habitat types of Québec’s boreal forest, alder (Alnus spp.) scrubland and recent clear-cuts. Singing males occurred in clusters, their occupancy was similar in both habitats, but increased with the amount of alder or clear-cut within 400 m of point-count stations. A despotic distribution of males between habitats appeared unlikely, because there were no differences in morphology between males captured in clear-cuts vs. alder. Those results contrast with the prevailing view, mostly based on western populations, that WIWA are wetland or riparian specialists, and provide the first evidence for a preference for large tracts of habitat in this species. Clear-cuts in the boreal forest may benefit WIWA by supplying alternative nesting habitat. However, the role of clear-cuts as source or sink habitats needs to be addressed with data on reproduction.

Annual loss of nests by industrial (nonwoodlot) forest harvesting in Canada was estimated using two avian point-count data sources: (1) the Boreal Avian Monitoring Project (BAM) dataset for provinces operating in this biome and (2) available data summarized for the major (nonboreal) forest regions of British Columbia. Accounting for uncertainty in the proportion of harvest occurring during the breeding season and in avian nesting densities, our estimate ranges from 616 thousand to 2.09 million nests. Estimates of the impact on numbers of individuals recruited into the adult breeding population were made based on the application of survivorship estimates at various stages of the life cycle. Future improvements to this estimate are expected as better and more extensive avian breeding pair density estimates become available and as provincial forestry statistics become more refined, spatially and temporally. The effect of incidental take due to forestry is not uniform and is disproportionately centered in the southern boreal. Those species whose ranges occur primarily in these regions are most at risk for industrial forestry in general and for incidental take in particular. Refinements to the nest loss estimate for industrial forestry in Canada will be achieved primarily through the provision of more accurate estimates of the area of forest harvested annually during the breeding season stratified by forest type and Bird Conservation Region (BCR). A better understanding of survivorship among life-history stages for forest birds would also allow for better modeling of the effect of nest loss on adult recruitment. Finally, models are needed to project legacy effects of forest harvesting on avian populations that take into account forest succession and accompanying cumulative effects of landscape change.

Canadian and U.S. federal wildlife agencies completed four decadal surveys, spanning the years 1977 to 2009, to census colonial waterbirds breeding on the Great Lakes and adjoining bodies of water. In this paper, we reports abundance, distribution, and general population trends of three species: Black-crowned Night-Heron (Nycticorax nycticorax), Great Egret (Ardea alba), and Great Blue Heron (Ardea herodias). Estimates of nest numbers ranged from approximately 4000-6100 for the Black-crowned Night-Heron, 250-1900 for the Great Egret, and 3800-6400 for the Great Blue Heron. Average annual rates of change in nest numbers between the first (1977) and fourth (2008) census were −1% for the Black-crowned Night-Heron, +23% for the Great Egret, and −0.27% for the Great Blue Heron. Across the 30-year census, Black-crowned Night-Heron estimates decreased in U.S. (−57%) but increased (+18%) in Canadian waters, Great Egret nests increased 1381% in Canadian waters with a smaller, but still substantial increase in the number of nests at U.S. colonies (+613%), and Great Blue Heron numbers increased 148% in Canadian waters and 713% in U.S. waters. Although a single factor cannot be clearly linked to changes observed in each species’ distribution, hydrological variation, habitat succession, nest competition with Double-crested Cormorants (Phalacrocorax auritus), and land use changes likely all contributed. Management activities should support both breeding and foraging conditions including restoration of early successional habitats and anticipate continued northward expansions in the distributions of these waterbirds.

The constant-density Charney model describes the simplest unstable basic state with a planetary-vorticity gradient, which is uniform and positive, and baroclinicity that is manifest as a negative contribution to the potential-vorticity (PV) gradient at the ground and positive vertical wind shear. Together, these ingredients satisfy the necessary conditions for baroclinic instability. In Part I it was shown how baroclinic growth on a general zonal basic state can be viewed as the interaction of pairs of ‘counter-propagating Rossby waves’ (CRWs) that can be constructed from a growing normal mode and its decaying complex conjugate. In this paper the normal-mode solutions for the Charney model are studied from the CRW perspective.
Clear parallels can be drawn between the most unstable modes of the Charney model and the Eady model, in which the CRWs can be derived independently of the normal modes. However, the dispersion curves for the two models are very different; the Eady model has a short-wave cut-off, while the Charney model is unstable at short wavelengths. Beyond its maximum growth rate the Charney model has a neutral point at finite wavelength (r=1). Thereafter follows a succession of unstable branches, each with weaker growth than the last, separated by neutral points at integer r—the so-called ‘Green branches’. A separate branch of westward-propagating neutral modes also originates from each neutral point. By approximating the lower CRW as a Rossby edge wave and the upper CRW structure as a single PV peak with a spread proportional to the Rossby scale height, the main features of the ‘Charney branch’ (0

ERA-40 is a re-analysis of meteorological observations from September 1957 to August 2002 produced by the European Centre for Medium-Range Weather Forecasts (ECMWF) in collaboration with many institutions. The observing system changed considerably over this re-analysis period, with assimilable data provided by a succession of satellite-borne instruments from the 1970s onwards, supplemented by increasing numbers of observations from aircraft, ocean-buoys and other surface platforms, but with a declining number of radiosonde ascents since the late 1980s. The observations used in ERA-40 were accumulated from many sources. The first part of this paper describes the data acquisition and the principal changes in data type and coverage over the period. It also describes the data assimilation system used for ERA-40. This benefited from many of the changes introduced into operational forecasting since the mid-1990s, when the systems used for the 15-year ECMWF re-analysis (ERA-15) and the National Centers for Environmental Prediction/National Center for Atmospheric Research (NCEP/NCAR) re-analysis were implemented. Several of the improvements are discussed. General aspects of the production of the analyses are also summarized. A number of results indicative of the overall performance of the data assimilation system, and implicitly of the observing system, are presented and discussed. The comparison of background (short-range) forecasts and analyses with observations, the consistency of the global mass budget, the magnitude of differences between analysis and background fields and the accuracy of medium-range forecasts run from the ERA-40 analyses are illustrated. Several results demonstrate the marked improvement that was made to the observing system for the southern hemisphere in the 1970s, particularly towards the end of the decade. In contrast, the synoptic quality of the analysis for the northern hemisphere is sufficient to provide forecasts that remain skilful well into the medium range for all years. Two particular problems are also examined: excessive precipitation over tropical oceans and a too strong Brewer-Dobson circulation, both of which are pronounced in later years. Several other aspects of the quality of the re-analyses revealed by monitoring and validation studies are summarized. Expectations that the second-generation ERA-40 re-analysis would provide products that are better than those from the firstgeneration ERA-15 and NCEP/NCAR re-analyses are found to have been met in most cases. © Royal Meteorological Society, 2005.
