El derecho a la educación como derecho social fundamental en sus tres dimensiones: educación primaria, secundaria y superior

En este artículo, se plantea el problema de si puede considerarse a la educación como un derechofundamental. Se analizan las implicaciones que ha tenido su no inclusión como tal derechoen la Constitución en el capítulo de los derechos fundamentales. Se estudian dos grandes tradicionessobre los derechos fundamentales: el neoliberalismo afirma que los derechos fundamentalesson únicamente los derechos liberales civiles y políticos. Y el liberalismo social concibe quelos derechos fundamentales son, además de los derechos liberales civiles y políticos, los económicosy sociales. En la parte final, se hace una reconstrucción del desarrollo del derechoa la educación en la jurisprudencia de la Corte Constitucional; termina con unas críticas alproyecto de reforma de la educación superior y unas sugerencias con miras a proponer a laeducación como un derecho fundamental.

Provisional coverage for independent workers

The study examines how, from the traditional work of the independent artisan, we have moved to autonomous work integrated within networks of specialized businesses. This modality is owed not only to the manner in which labor is organized today, to government stimuli, to actions of multilaterals, but also to unemployment. With the purpose of humanizing independent work and rationalizing business costs, an intermediate category of autonomous worker has been created; the semi-dependent who moves between legal freedom and economic independence. The administration, for its part, focuses on broadening social coverage, not always developed for bureaucratic reasons, which is connected to the low density of contributions from the autonomous workers. The challenge put forth is that of provisional coverage for the independents, which is possible whenever citizens participate to resolve social inequality, resulting from the lack of job opportunities, low purchasing power and educational level.

Citizen safety at local level: fieldwork notes on performance and perception of the ‘Quadrant Plan’ in Cali (Colombia)

This article summarizes field notes related to the study of the actions performed by the Metropolitan Police of Santiago de Cali in the context of its ‘Plan Cuadrante’ (a micro-local security action plan) and the citizen’s perception towards it. Taking an ethnographic approach, it places special emphasis on the actions that imply identifying the main criminal and violent actors and activities. The study focuses on four local districts of the city: El Cortijo, Mariano Ramos, Terrón Colorado y Villa del Lago.

Friendly Settlements in the Framework of the Inter- American Human Rights System

The Inter-American system for the protection of human rights provides that disputesbetween States and victims of human rights violations or their representatives can beresolved through a friendly settlement. In this arrangement, conducted before the regionalorgans of protection of human rights, the State accepts its international responsibility,commits itself to investigate and judge the responsible and makes commitmentson compensation to the offended, the victims, on his part, renounce to take the caseto the Inter-American Court of Human Rights, and the Inter-American Commissionmonitors the legal consistency of the agreement and holds the role of independentobserver. What are these agreements, what possibilities and limitations provide to theopposing parties and, above all, what kind of reparation offer to victims of humanrights violations are issues to resolve in this article.

La responsabilidad de las concesionarias de servicios públicos, en el derecho argentino

El presente trabajo proporciona un panorama abarcador del derecho argentino en materia de reclamos por reparaciones pecuniarias promovidos por usuarios de los servicios públicos. Se trata de una reseña distribuida en tres secciones: primeramente, la presentación básica de las normas y regulaciones argentinas; a ella le sigue un capítulo que constituye el corazón conceptual del trabajo, en el que se vuelca una descripción pormenorizada de la casuística en la materia; finalmente, se concluye con un relevamiento de episodios que revelarían la puja de intereses encontrados que subyacen a la temática abordada.
