The article intends to articulate how the methodological proposal of Foucault, denominated genealogy, is applied to the field in which it emerged, considering that the proposal of this method appeared with the author’s study about the subject of the prisons. To apprehend the execution of the feathers in the contemporary epoch, we searched in Foucault’s theories the concepts of subjectivation processes, power relationships, discursive formations and dispositive. Starting from these concepts, we focused some practices and/or discursive formations of punishment and surveillance that happen at the present time to exemplify the form as the genealogical process raise an interlacement of subjects, information, appearances and disappearances that always obey to a normative logic. To unmask and to understand this logic can favor the liberation of manners of subjectivations crystallized in the punished people and in those ones that execute the punishment. Stiller, we question ourselves on which is the real function of the confinement, of the controls and, why not, if the paradigm of the modernity, the prison, had fail.

Nelson Mandela has been an example of fighting and going over the adversities since his prison in 1962 until his election to be the president of South Africa in 1994. His effort against the apartheid in South Africa might be compared to a classical hero according to the anthropological view of Eliade (1972), Campbell (1991; 2007) and Propp’s structuralist perspective (1984). His journey toward heroism and his strategies to get the adhesion of the white minority (Afrikaners) to his purposes of joining the races in South Africa will be analyzed in this article with the theoretical support of the Greimasian semiotics, Propp’s studies (1984) and anthropology. The movie Invictus will be the object of analysis as it shows the moment of Mandela’s social-political fight as the president, with the support of the local rugby team in order to have the racial integration in the country and the political support of the white minority.

The issue addressed in this article is whether and to what extent a lawyer has an ethical responsibility to pursue implementation of the remedy in institutional reform litigation. Institutional reform litigation refers to cases in which an individual or class of individuals sues a large organization in order to vindicate constitutional or statutory rights. The types of cases with which this article is concerned are the "public law" type, such as school desegregation, prisoners' rights and patients' rights cases, although included under the rubric of institutional reform can be, inter alia, antitrust, reapportionment and bankruptcy cases. The implementation stage of institutional reform litigation arises after an individual or class of individuals prevails at the liability stage, or pursuant to a settlement, and a court orders the defendant organization to change in order to vindicate the plaintiffs' rights. At that point, the defendant organization, whether it be a prison, mental hospital or school district, usually has the burden of implementing the order. One conclusion drawn is that the ethical duty of the lawyer must always be consistent with the lawyer's "special responsibility for the quality of justice."

Previous studies of the Social Gospel movement have acknowledged the fact that Social Gospelers were involved in multiple social reform movements during the Gilded Age and into the Progressive Era. However, most of these studies have failed to explain how the reform experiences of the Social Gospelers contributed to the development of the Social Gospel. The Social Gospelers’ ideas regarding the need to transform society and their strategies for doing so were largely a result of their personal experiences as reformers and their collaboration with other reformers. The knowledge and insight gained from interaction with a variety of reform methods played a vital role in the development of the ideology and theology of the Social Gospel. George Howard Gibson is exemplary of the connections between the Social Gospel movement and several other social reform movements of the time. He was involved in the Temperance movement, was a member of both the Prohibition Party and the People’s Party, and co-founded a Christian socialist cooperative colony. His writings illustrate the formation of his identity as a Social Gospeler as well as his attempts to find an organization through which to realize the kingdom of God on earth. Failure to achieve the changes he desired via prohibition encouraged him to broaden his reform goals. Like many Midwestern Social Gospelers Gibson believed he had found “God’s Party” in the People’s Party, but he rejected reform via the political system once the Populists restricted their attention to the silver issue and fused with the Democratic Party. Yet his involvement with the People’s Party demonstrates the attraction many Social Gospelers had to the reforms proposed in the Omaha Platform of 1892 as well as to the party’s use of revivalistic language and emphasis on producerism and brotherhood. Gibson’s experimentation with a variety of ways to achieve the kingdom of God on earth provides new insight into the experiences and contributions of lay Social Gospelers. Adviser: Kenneth J. Winkle

Este estudo teve o objetivo de construir e validar uma medida psicológica denominada de Escala de Imprevisibilidade Familiar na Infância (EIFI) para a população brasileira. Participaram 394 pessoas, sendo 158 adultos em conflito com a lei que já haviam passado pela prisão (média de idade=34,23 anos; DP=10,17), 122 estudantes universitários (M=19,26; DP=2,06) e 114 mulheres com idade superior a 40 anos e escolaridade a partir de ensino médio (M=51,19; DP=8,64). Foram conduzidos procedimentos de validade de conteúdo, face e construto. A análise fatorial gerou como produto um instrumento com estrutura de quatro dimensões (cuidado/apoio, recursos financeiros, alimentação e disciplina) com índices de confiabilidade satisfatórios para todas elas. Concluímos que a EIFI foi validada para a população brasileira apresentando-se no cenário nacional como um instrumento para medida de imprevisibilidade familiar na infância.

This study analyzed the causes of delay in the diagnosis of tuberculosis in the prison system, according to the experience of incarcerated patients. The theoretical and methodological framework of the French school of discourse analysis was used, which seeks to comprehend the processes of meaning production, in the relationship of language with ideology and the development of subjects in their positions. Semi-directed interviews were conducted with seven incarcerated tuberculosis patients in a hospital of Joao Pessoa, Paraiba, Brazil, between August and October 2009. The delay in the diagnosis of tuberculosis was related to the naturalization of the lack of care for the prisoner, to the interpretation of the prison as a place of death and suffering and to the deprivation of the right to health for the detainees as a result of their position in the asymmetric power relationships and ideological effects.

In order to assess the contribution of different parenteral routes as risk exposure to the hepatitis C virus (HCV), samples from nine surveys or cross-sectional studies conducted in two Brazilian inland regions were pooled, including a total of 3,910 subjects. Heterogeneity among the study results for different risk factors was tested and the results were shown to be homogeneous. Anti-HCV antibodies were observed in 241 individuals, of which 146 (3.7%, 95% CI?=?3.24.4) had HCV exposure confirmed by immunoblot analysis or PCR test. After adjustment for relevant variables, a correlation between confirmed HCV exposure and injection drug use, tattooing, and advance age was observed. In a second logistic model that included exposures not searched in all nine studies, a smaller sample was analyzed, revealing an independent HCV association with past history of surgery and males who have sex with other males, in addition to repeated injection drug use. Overall, these analyses corroborate the finding that injection drug use is the main risk factor for HCV exposure and spread, in addition to other parenteral routes. J. Med. Virol. 84:756762, 2012. A systematic review of scientific production on Prison Health was conducted, seeking to verify how the subject matter has been dealt with, establishing which is the most exploited focus and identifying possible gaps. The search was carried out in the Virtual Health Library. 1160 articles were located: 1104 on MEDLINE, 19 on LILACS and 37 on SciELO, published from 1993 to 2010. As MEDLINE and LILACS do not show the entire articles, the places, dates and languages of the texts were charted. In-depth analysis was restricted to works which were shown in their entirety and free of charge hosted on SciELO. It revealed that scientific production is present all over the world with a predominantly quantitative approach. It focuses on identifying the socio-demographic profile and health conditions of prisoners, the incidence of tuberculosis, Human Immunodeficiency and Hepatitis C virus infections. There is a predominance of studies carried out with male prisoners, in comparison with the female sex. It is clear that prisoner health is a public health problem on the rise, which demands research that can orient health policies and strategies.

Syftet med denna uppsats var att studera hur föreningen KRIS kan bidra till sina medlemmars återanpassning till samhället. Föreningen KRIS har som ambition att stötta människor som vill bryta upp med missbruk och kriminalitet och återanpassa dem tillbaka in i samhället. Studien utgick från fyra intervjuer där medlemmarna delade med sig av sina erfarenheter av föreningen KRIS. Jag använde mig av en kvalitativ metod med ett hermeneutiskt förhållningssätt för att förstå medlemmarnas upplevelser av KRIS. Genom denna metod fick jag inblick i vilken betydelse KRIS har för medlemmarnas återanpassning till samhället. För att tolka och dra slutsatser från intervjutexterna utfördes en innehållsanalys. Resultatet av intervjuerna visade att KRIS kan bidra till att återanpassa sina medlemmar till samhället. Medlemmarna får genom KRIS möjlighet att gradvis anpassa sig till ett drogfritt och hederligt liv där socialt stöd och formandet av nya livsstrategier är viktiga inslag i föreningslivet. Det framkom även att medlemmarna har ett antal hinder att övervinna innan målet med full delaktighet i samhället är uppnått. Låg utbildningsnivå och tidigare fängelsestraff är några faktorer som innebär social exkludering och svårigheter att finna arbete.

[ES]El poeta Vicente Aleixandre prestó su apoyo durante la Guerra Civil española al bando republicano, hasta que en los primeros meses de 1937 los mismos republicanos lo detuvieron y lo llevaron a la cárcel, aunque antes de las veinticuatro horas fue puesto en libertad. A partir de ese momento –y tras un intento frustrado de salir del país– se retiró de la vida pública y optó por el silencio. Acabada la guerra, mantuvo una distancia crítica con el régimen franquista e hizo cuanto le fue posible por la reconciliación entre las dos Españas.

One of the ways by which the legal system has responded to different sets of problems is the blurring of the traditional boundaries of criminal law, both procedural and substantive. This study aims to explore under what conditions does this trend lead to the improvement of society's welfare by focusing on two distinguishing sanctions in criminal law, incarceration and social stigma. In analyzing how incarceration affects the incentive to an individual to violate a legal standard, we considered the crucial role of the time constraint. This aspect has not been fully explored in the literature on law and economics, especially with respect to the analysis of the beneficiality of imposing either a fine or a prison term. We observed that that when individuals are heterogeneous with respect to wealth and wage income, and when the level of activity can be considered a normal good, only the middle wage and middle income groups can be adequately deterred by a fixed fines alone regime. The existing literature only considers the case of the very poor, deemed as judgment proof. However, since imprisonment is a socially costly way to deprive individuals of their time, other alternatives may be sought such as the imposition of discriminatory monetary fine, partial incapacitation and other alternative sanctions. According to traditional legal theory, the reason why criminal law is obeyed is not mainly due to the monetary sanctions but to the stigma arising from the community’s moral condemnation that accompanies conviction or merely suspicion. However, it is not sufficiently clear whether social stigma always accompanies a criminal conviction. We addressed this issue by identifying the circumstances wherein a criminal conviction carries an additional social stigma. Our results show that social stigma is seen to accompany a conviction under the following conditions: first, when the law coincides with the society's social norms; and second, when the prohibited act provides information on an unobservable attribute or trait of an individual -- crucial in establishing or maintaining social relationships beyond mere economic relationships. Thus, even if the social planner does not impose the social sanction directly, the impact of social stigma can still be influenced by the probability of conviction and the level of the monetary fine imposed as well as the varying degree of correlation between the legal standard violated and the social traits or attributes of the individual. In this respect, criminal law serves as an institution that facilitates cognitive efficiency in the process of imposing the social sanction to the extent that the rest of society is boundedly rational and use judgment heuristics. Paradoxically, using criminal law in order to invoke stigma for the violation of a legal standard may also serve to undermine its strength. To sum, the results of our analysis reveal that the scope of criminal law is narrow both for the purposes of deterrence and cognitive efficiency. While there are certain conditions where the enforcement of criminal law may lead to an increase in social welfare, particularly with respect to incarceration and stigma, we have also identified the channels through which they could affect behavior. Since such mechanisms can be replicated in less costly ways, society should first try or seek to employ these legal institutions before turning to criminal law as a last resort.

The survey approachs the issue of health and the problem of its effective protection in a context of deprivation of liberty and coercion, which is the prison. The theoretical reflection born from the reform of the Legislative Decree 230/99 which marked the transition from an employee by the Prison Health within prison a fully integrated in the National Health Service. The comparison between an institution of health promotion and institution of punishment which may operate on the same subject held produces multiple attrits, making their relationship problematic. The work shows the daily difficulties in the management of prison health within the institution, physician-patient between different health care roles, and between the latter and prison workers. The coexistence, in fact, is not always harmonious though quite often it is common sense and the willingness of operators to reduce barriers: overcrowding, limited resources and insufficient staff make the application of the rule and therefore the right to goal a difficult to be pursued. It is designed for a scheme of semi-structured interview essay is divided into 3 sections covering: "staff and its functions", "health reform" and "health of the prisoner"; questions were directed to doctors, nurses and psychologists engaged inside the prison of Rimini with the specific aim of examining the ambivalent relationship between the demand for health care in prisons and the need for security and a clear - albeit partial - point of view. We tried to reconstruct the situation of prison health care through the perception of prison operators, capturing the problematic issues that deal on both issues is instrumental to the experience of persons detained by analyzing, in terms of operators , what happens inside of a prison institution in everyday health care.

La ricerca si propone di mostrare come il pensiero gramsciano sia stato riferimento prioritario di due intellettuali argentini in esilio in Messico dal 1976 al 1983: Juan Carlos Portantiero e José Maria Aricó. In quel periodo incentrarono le loro elaborazioni teorico-politiche sull’analisi della relazione tra Stato, società civile, democrazia e socialismo, partendo da una prospettiva gramsciana. Il fallimento della guerra di movimento in Argentina nei primi anni settanta li condusse a riflettere su strategie alternative di transizione al socialismo, il cui punto focale fu il concetto di "Egemonia". A partire dal 1975 indirizzarono la ripresa del pensiero di Gramsci alla creazione di un progetto politico adatto ad un contesto sempre più "occidentale", caratterizzato dalla presenza di una "società civile complessa", in cui risultava necessario combattere "guerre di posizione" e non "guerre di movimento". La prospettiva che connotò questo approccio alle riflessioni gramsciane rappresenta il culmine di un percorso che iniziarono negli anni ’50, quando sorsero i primi studi del pensiero gramsciano in Argentina. Sin da allora, Aricó e Portantiero si occuparono di Gramsci insieme al dirigente del PC argentino Agosti e continuarono a farlo anche durante gli anni sessanta e i primi anni settanta sulla rivista Pasado y Presente. Fu, però, nel periodo dell’esilio che ne ripresero il pensiero considerandolo nella sua totalità, a partire dagli scritti giovanili sino ai Quaderni del Carcere, rielaborandolo in maniera originale e costruendo una propria proposta di cammino verso socialismo nell' "occidente periferico" dell'Argentina, influenzati dall'azione del Partito Comunista Italiano.

L'interrogativo da cui nasce la ricerca riguarda la possibilità di individuare, in controtendenza con la logica neoliberista, strategie per l'affermarsi di una cultura dello sviluppo che sia sostenibile per l'ambiente e rispettosa della dignità delle persone, in grado di valorizzarne le differenze e di farsi carico delle difficoltà che ognuno può incontrare nel corso della propria esistenza. Centrale è il tema del lavoro, aspetto decisivo delle condizioni di appartenenza sociale e di valorizzazione delle risorse umane. Vengono richiamati studi sulla realtà in cui siamo immersi, caratterizzata dal pensiero liberista diventato negli ultimi decenni dominante su scala globale e che ha comportato una concezione delle relazioni sociali basata su di una competitività esasperata e sull’esclusione di chi non sta al passo con le leggi di mercato: le conseguenze drammatiche dell'imbroglio liberista; la riduzione delle persone a consumatori; la fuga dalla comunità ed il rifugio in identità separate; il tempo del rischio, della paura e della separazione fra etica e affari. E gli studi che, in controtendenza, introducono a prospettive di ricerca di uno sviluppo inclusivo e umanizzante: le prospettive della decrescita, del business sociale, di una via cristiana verso un'economia giusta, della valorizzazione delle capacità delle risorse umane. Vengono poi indagati i collegamenti con le esperienze attive nel territorio della città di Bologna che promuovono, attraverso la collaborazione fra istituzioni, organizzazioni intermedie e cittadini, occasioni di un welfare comunitario che sviluppa competenze e diritti insieme a responsabilità: l'introduzione delle clausole sociali negli appalti pubblici per la realizzazione professionale delle persone svantaggiate; la promozione della responsabilità sociale d'impresa per l'inclusione socio-lavorativa; la valorizzazione delle risorse delle persone che vivono un’esperienza carceraria. Si tratta di esperienze ancora limitate, ma possono costituire un riferimento culturale e operativo di un modello di sviluppo possibile, che convenga a tutti, compatibile con i limiti ambientali e umanizzante.
