After more than a decade of indecision, the EU is finally now set to implement a consistent regulatory architecture for clearing and settlement. Following the agreement on a European market infrastructure Regulation (EMIR), the European Commission has proposed harmonised rules for centralised settlement depositaries (CSDs), while the European Central Bank is moving forward with its plans for a central eurozone settlement engine. This paper analyses three components of the new post-trade infrastructure measures: 1) the regulatory framework for and supervision of central counterparties under the new EMIR legislation, 2) the authorisation requirements of trade repositories and 3) the draft CSD Regulation and the progress with the ECB’s Target 2 Securities project. It then discusses the impact of the new rules, and argues that, analogous to the unexpected impact of MiFID on trading infrastructures, a similar EMIR revolution may be on its way.

La cybersécurité représente un enjeu important pour les services en charge de la sécurité canadienne à l’ère de l’expansion des Menaces Persistantes Avancées (MSP ou cybercrimes de type 1). Ces crimes se déroulent essentiellement dans le cyberespace, ce qui implique l’adoption de mesures spécifiques adéquates à l’environnement numérique, notamment à l’épreuve de son ubiquité. Le gouvernement canadien a pour sa part publié certaines mesures de défense passive et active dont la plus connue est la stratégie canadienne de cybersécurité. Puisque le cyberespace n’est pas limité territorialement, l’autorité canadienne a conclu plusieurs partenariats internationaux d’où ressortent des mesures bilatérales et multilatérales de protection et de renforcement de la cybersécurité. Toutefois, ces diverses mesures nationales et internationales ne tracent pas de cadre légal précisant la nature et le régime juridique des MSP; précisions sans lesquelles l’adoption de règles au plan national serait improductive. Considérant que l’espace numérique est international, il appelle la mise en place de mesures applicables à l’échelle universelle. Or, au plan international, il n’existe aucun texte à valeur légale spécifique à l’espèce. Ainsi, à la question de savoir, quels textes légaux pourraient s’appliquer, il s’est avéré que le jus ad bellum et la Convention européenne contre le cybercrime (Convention de Budapest) apportaient d’incontournables éléments de réponse. D’une part, le jus ad bellum permet de définir la catégorie d’acte dans laquelle peuvent être rangées les MSP, et d’autre part, la Convention de Budapest permet de définir les infractions informatiques commises par les différents acteurs en cause, les procédures d’investigation appropriées et les mécanismes utiles à la coopération internationale. Bien que les éléments ressortis de ces ententes internationales soient utiles à l’adoption d’un corps de règles internationales uniformes, les intérêts étatiques divergents constituent des obstacles de taille.

1. After its enlargement, scheduled for 2004, the European Union will face a completely new situation at its eastern borders. This new situation calls for a new concept of the EU eastern activities, i.e. for development of the new Eastern Policy of the EU. 2. Due to a number of specific features such as geographical location, closeness of ties, direct risk factors etc., the Visegrad countries will and should be particularly interested in the process of formulating the new EU Eastern Policy. Consequently, they should be the co-makers of this policy. 3. The new EU Eastern Policy should differ fundamentally from the Union's traditional eastern relations. Firstly, its scope should not cover the entire CIS area: instead, the policy should focus on some of the European successor states of the former Soviet Union, namely Belarus, Russia and Ukraine, as well as Moldova, following the accession of Romania. It does not seem advisable to exclude the Russian Federation from this policy and to develop and implement a separate policy towards it. The new Eastern Policy should be an autonomous component and one of the most important elements in the overall foreign policy of the EU. 4. Secondly, the new Eastern Policy should be founded on the following two pillars: a region-oriented strategy, which could be called the Eastern Dimension, and reshaped strategies for individual countries. The Eastern Dimension should set up a universal framework of co-operation, defining its basic mechanisms and objectives. These should include: the adaptation assistance programme, JHA, transborder co-operation, social dialogue and transport infrastructures. The approach, however, should be kept flexible, taking into account the specific situation of each country. This purpose should be served by keeping in place the existing bilateral institutional contacts between the EU and each of its eastern neighbours, and by developing a national strategy for each neighbour.

The Southern Caucasus is the site of three armed conflicts with separatist backgrounds, which have remained unsolved for years: the conflicts in Georgia's Abkhazia and South Ossetia, and Azerbaijan's conflict over Nagorno-Karabakh (including the areas around Nagorno-Karabakh which were seized by Armenian separatists in the course of the war). Neither Georgia nor Azerbaijan have had any control over the disputed areas since the early 1990s. Both states are simultaneously in conflict with the separatists' informal patrons, respectively Russia and Armenia. After over a decade of relative peace during which the conflicts remained frozen, tension has recently risen considerably: in the case of Abkhazia and South Ossetia, large-scale fighting may break out in the coming months, whereas in the case of Nagorno-Karabakh and the Azeri-Armenian conflict, such a threat may materialise within the next five years. The current formula for politically resolving the conflicts is ineffective and close to exhaustion, and the prospect of any alternative peace plans being developed is rather distant. The conflicts in the Southern Caucasus are of increasing concern to the West, mainly because of the Western actors' constantly growing political and economic involvement in Georgia and Azerbaijan (including support for reforms and development of the gas and oil transmission infrastructures), as well as its less intensive commitments in Armenia. An outbreak of open fighting over the separatist regions would destabilise the Southern Caucasus, largely undoing the results of the actions which the EU, NATO and the USA have taken in the region in recent years. Moreover, the situation in the Southern Caucasus, especially the separatisms themselves, have in fact become an element in the wider geopolitical game between the West and Russia. For Russia, the stakes are maintaining its influence in the region, and for the West, demonstrating its ability to effectively promote democracy and economic modernisation in the countries bordering it.

The pharmaceutical industry is one of the most competitive sectors in the European Union. With its substantial investments in research and development, this industry represents a key asset for the European economy and a major source of growth and employment. However, despite the importance of the pharmaceutical sector for the European Union, few researchers have attempted to assess the determinants of the EU exports of pharmaceuticals. This paper aims at filling the aforementioned gap by examining what drives EU exports of pharmaceuticals. In order to tackle this question, this paper has derived hypotheses from the Gravity Model of Trade and the relevant academic literature on pharmaceuticals. Based on an econometric analysis, the research sheds light on the complex interaction of factors influencing the EU exports of pharmaceuticals. The paper finds that the protection of intellectual property in the receiving countries, their economic size, the importance of their health sector, and the quality of infrastructures constitute major drivers to the EU exports of pharmaceuticals. On the contrary, the research shows that transports costs as well as tariff barriers and non-tariff barriers tend to hinder the EU exports of pharmaceuticals.

Why is Europe lagging on next generation access networks? Fibre-based next generation access (NGA) roll-out across the European Union is one of the goals of the European Commission’s Digital Agenda strategy, however, there remains considerable uncertainty about how the roll-out goal can best be achieved. The underlying differences between the economics of copper-based and new fibre-based broadband infrastructures should lead to a revision of the regulatory framework for telecommunications markets. While the current regulatory measures have been useful in the past decade to sustain competition and facilitate entry into a market with already-existing infrastructures, the need to create new, much faster broadband networks calls for a rethink of the scope and strictness of regulation.

The Treaty of Lisbon (2009) explicitly added - in Article 3 of the Treaty on the European Union (TEU) and Article 174 of the Treaty on the Functioning of the European Union (TFEU) - the principle of territorial cohesion to the already existing principles of social and economic cohesion between the EU Member States. To concretely reach the objective of territorial cohesion, the EU created – on the one hand - the legal instrument of the “European Grouping for Territorial Cooperation” adopted through regulation n. 1082/2006 (EGTC). This allows cross-border cooperation between local and regional authorities. On the other hand, in 2009 a new form of European transnational cooperation has been introduced, the so called Macro Regional Strategy (MRS). This was firstly applied to the Baltic Sea Region in order to give to this cross - border geographical area a coordinated framework in specific policy fields, such as the environment and the infrastructures. Both concepts - EGTC and MRS - are based on the fundamental idea of supporting the territorial and cross - border cooperation between local, regional and national authorities and other stakeholders. Despite this common aspect, the two instruments differ profoundly in terms of form, structure and content. While the MRS is to be considered as a political integrated framework without its own financial resources, the instrument of the EGTC is based on a stable legal basis. To this extent, the alpine region - a large geographic area in the heart of Europe with a longstanding tradition in crossborder cooperation - represents an interesting practical example with regard to the implementation of these two forms of cooperation across borders. In fact, the countries and regions in the Alpine area are unified through the Alps and face, therefore, common challenges: that is why this “region” is ideally suited to be the ground for experiments regarding transnational tools and strategies.

Portugal provides a large number of factors that boost the development of the national equestrian tourism. It represents an opportunity for the qualification and differentiation of the national tourism, to stimulate rural economies, to combat seasonality and asymmetries.This study want to understand the importance, for the equestrian tourist, of the critical success factors such as the Lusitano horse, the national equestrian culture, the landscape diversity, among others. Also, how they can contribute to the differentiation of the national equestrian tourism for international destinations that are already deployed in the market.For this study is crucial to know the perspective of those involved in the various equestrian tourism activities. In this sense, a group of companies were selected and exploratory interviews were conducted that contributed to important outputs in the construction of the questionnaire.The research was attended by 110 individuals, with different profiles, motivations and types of involvement. From the analysis, it is concluded that the critical success factors are significant in motivating equestrian tourists, namely the quality of equestrian infrastructures, the Lusitano horse, the hospitality, among others. It is also possible to analyze that the equestrian tourist demonstrates a strong commitment: they are knowledgeable, read a lot about riding and belong to equestrian clubs.Finally, the factor analysis highlight the agreement between participants and a significant number of statements made in the questionnaire related to motivation and involvement. It is possible to conclude that equestrian tourists look for relaxing moments and opportunities to expand their equestrian knowledge.

Cybercrime and related malicious activity in our increasingly digital world has become more prevalent and sophisticated, evading traditional security mechanisms. Digital forensics has been proposed to help investigate, understand and eventually mitigate such attacks. The practice of digital forensics, however, is still fraught with various challenges. Some of the most prominent of these challenges include the increasing amounts of data and the diversity of digital evidence sources appearing in digital investigations. Mobile devices and cloud infrastructures are an interesting specimen, as they inherently exhibit these challenging circumstances and are becoming more prevalent in digital investigations today. Additionally they embody further characteristics such as large volumes of data from multiple sources, dynamic sharing of resources, limited individual device capabilities and the presence of sensitive data. These combined set of circumstances make digital investigations in mobile and cloud environments particularly challenging. This is not aided by the fact that digital forensics today still involves manual, time consuming tasks within the processes of identifying evidence, performing evidence acquisition and correlating multiple diverse sources of evidence in the analysis phase. Furthermore, industry standard tools developed are largely evidence-oriented, have limited support for evidence integration and only automate certain precursory tasks, such as indexing and text searching. In this study, efficiency, in the form of reducing the time and human labour effort expended, is sought after in digital investigations in highly networked environments through the automation of certain activities in the digital forensic process. To this end requirements are outlined and an architecture designed for an automated system that performs digital forensics in highly networked mobile and cloud environments. Part of the remote evidence acquisition activity of this architecture is built and tested on several mobile devices in terms of speed and reliability. A method for integrating multiple diverse evidence sources in an automated manner, supporting correlation and automated reasoning is developed and tested. Finally the proposed architecture is reviewed and enhancements proposed in order to further automate the architecture by introducing decentralization particularly within the storage and processing functionality. This decentralization also improves machine to machine communication supporting several digital investigation processes enabled by the architecture through harnessing the properties of various peer-to-peer overlays. Remote evidence acquisition helps to improve the efficiency (time and effort involved) in digital investigations by removing the need for proximity to the evidence. Experiments show that a single TCP connection client-server paradigm does not offer the required scalability and reliability for remote evidence acquisition and that a multi-TCP connection paradigm is required. The automated integration, correlation and reasoning on multiple diverse evidence sources demonstrated in the experiments improves speed and reduces the human effort needed in the analysis phase by removing the need for time-consuming manual correlation. Finally, informed by published scientific literature, the proposed enhancements for further decentralizing the Live Evidence Information Aggregator (LEIA) architecture offer a platform for increased machine-to-machine communication thereby enabling automation and reducing the need for manual human intervention.

A major requirement for pervasive systems is to integrate context-awareness to support heterogeneous networks and device technologies and at the same time support application adaptations to suit user activities. However, current infrastructures for pervasive systems are based on centralized architectures which are focused on context support for service adaptations in response to changes in the computing environment or user mobility. In this paper, we propose a hierarchical architecture based on active nodes, which maximizes the computational capabilities of various nodes within the pervasive computing environment, while efficiently gathering and evaluating context information from the user's working environment. The migratable active node architecture employs various decision making processes for evaluating a rich set of context information in order to dynamically allocate active nodes in the working environment, perform application adaptations and predict user mobility. The active node also utilizes the Redundant Positioning System to accurately manage user's mobility. This paper demonstrates the active node capabilities through context-aware vertical handover applications.

A comunicação via mídias e redes sociais digitais é uma atividade estratégica de suporte para a consecução dos objetivos dos pequenos negócios que, em face de uma realidade de restrição de recursos financeiros, estrutura administrativa reduzida e necessidade de obter resultados no curtíssimo prazo, encontram nas ferramentas da internet alternativas viáveis para o posicionamento e a diferenciação de seus negócios. Os objetivos desta tese envolvem tanto a compreensão da importância da comunicação organizacional para os pequenos negócios quanto à identificação das particularidades dos pequenos negócios, o desenvolvimento de um instrumento para orientar a atuação estratégica dos pequenos negócios nas mídias e redes sociais digitais e a análise da colaboração deste instrumento para as atividades empresariais dos empreendedores individuais, das microempresas e das pequenas empresas. Realizaram-se, primeiramente, estudos bibliográfico e documental com vistas à fundamentação teórica da pesquisa e à compreensão dos pequenos negócios e dos aspectos contemporâneos acerca da comunicação institucional. Sucedeu-se o trabalho de desenvolvimento do Modelo de Aplicação Prática para Posicionamento em Mídias e Redes Sociais Digitais e, posteriormente, uma pesquisa qualitativa, compreendida por duas etapas: a) aplicação do modelo proposto a três empresas; e b) avaliação do modelo. Os resultados da pesquisa mostram que, a despeito de o Modelo de Aplicação Prática para Posicionamento em Mídias e Redes Sociais Digitais contribuir estrategicamente para o posicionamento dos pequenos negócios, de maneira geral, a comunicação nesse tipo de empreendimento não surte melhor efeito porque esbarra nas limitações próprias desse tipo de empresa.
