A inferência de estratégias ofensivas em esportes coletivos pode ser realizada a partir da análise dos padrões de jogo observados durante a disputa. Para que isso ocorra, há a necessidade da formalização de classes de comportamentos específicos para a modalidade de forma a discriminar perfis de jogo com base na identificação das ações mais recorrentes. No basquetebol as ações são encadeadas ao longo da posse de bola, sendo que os diferentes tipos de sequências de ações contêm características que os diferenciam e podem influenciar diretamente no desfecho do ataque. Nesse trabalho foi apresentada uma proposta contendo diferentes possibilidades de sequenciamento de dinâmicas ofensivas baseadas em um modelo teórico descrito na literatura. Os procedimentos de validação do sequenciamento de dinâmicas ofensivas e os testes de reprodutibilidade e objetividade realizados junto a técnicos de basquetebol apresentaram valores elevados demonstrando a consistência dos critérios para a elaboração de 27 tipos de concatenações dependentes (Qui-quadrado >0,78). Além disso, a estrutura desenvolvida foi concluída através da aplicação do constructo a jogos de basquetebol da liga profissional Americana (NBA) (28 partidas, dentre as quais 10 partidas do confronto entre Spurs x Thunder, 10 partidas referentes ao confronto entre Heat e Pacers e 8 partidas da disputa envolvendo Heat e Spurs, sendo analisados ambos os ataques em cada confronto, válidos pela temporada regular e na fase de playoffs). Os resultados gerados a partir da análise foram apresentados através de árvores de decisão e grafos de modo a facilitar a visualização dos comportamentos identificados. A árvore de decisão apresentou as ações na sequência exata em que ocorreram nas posses de bola, enquanto os grafos mostraram os encadeamentos mais recorrentes entre duas dinâmicas ofensivas. Assim ambas as técnicas se mostraram complementares e auxiliaram na observação e análise dos perfis de jogo de cada equipe e na realização de inferências acerca de sua estratégia ofensiva. A formalização dos tipos de sequenciamento de ações ofensivas pode auxiliar treinadores e profissionais do basquetebol no desenho de estratégias, análise dos padrões de suas equipes e adversários e estruturação de sessões de treinamento que considerem os comportamentos ofensivos de modo dinâmico e contextualizado dentro de um encadeamento lógico de ações de jogo

Fundamental a vida e ao desenvolvimento de qualquer sociedade, a água é um bem precioso e limitado que está se esgotando e sendo motivo de preocupação mundial. O desperdício, a distribuição desigual, o aumento do consumo e a degradação da qualidade da água são motivos que a tornaram escassa e trouxeram à tona a importância do planejamento e gerenciamento dos recursos hídricos. Frente a esta situação, este trabalho buscou avaliar a disponibilidade hídrica quantitativa e qualitativa da bacia hidrográfica do rio Sapucaí-Mirim, SP. Através da aplicação do simulador hidrológico MIKE BASIN, foi analisado o desempenho do sistema de recursos hídricos, o conflito existente entre os usos múltiplos e a concentração dos parâmetros OD e DBO nas águas do rio que recebe efluentes domésticos, muitos deles sem nenhum tratamento. Apesar da quantidade de água ser suficiente para atender às demandas, o estudo mostra que a geração de energia elétrica está comprometida e a água está se esgotando qualitativamente, evidenciando a necessidade e urgência de se implantar estações de tratamento de esgoto.

Diante da necessidade de atualização do estudo relativo ao direito de retenção, uma vez que as grandes obras doutrinárias estrangeiras e nacionais acerca do tema datam do final do século XIX e do início do século XX, abordaram-se as principais controvérsias relativas ao jus retentionis à luz da atual codificação a fim de concluir-se se o instituto ainda encontra justificativa em nosso ordenamento, bem como se seria admitido tal qual concebido em suas origens. Para tanto, procurou-se definir o que entendemos por direito de retenção, delimitando seu campo de atuação, suas características, seus elementos e sua natureza jurídica. Ao longo do estudo, analisou-se essa figura à luz do Código Civil de 2002 e do atual estágio da jurisprudência, concluindo que a previsão legislativa do instituto ainda se justifica, porém merece reforma. Ademais, conclui-se que os limites rígidos em que concebido o direito de retenção devem ser flexibilizados em atenção aos princípios da função social da posse e da boa-fé objetiva para admitir-se a utilização do bem retido em alguns casos.

Although 23 states and the District of Columbia have now legalized marijuana for medical purposes, marijuana remains a prohibited substance under federal law. Because the production, sale, possession and use of marijuana remain illegal, there is a risk of prosecution under federal laws. Furthermore, those who help marijuana users and providers put themselves at risk — federal law punishes not only those who violate drug laws but also those who assist or conspire with them to do so. In the case of lawyers representing marijuana users and businesspeople, this means not only the real (though remote) risk of criminal prosecution but also the more immediate risk of professional discipline. Elsewhere, we wrote about the difficult place in which lawyers find themselves when representing marijuana clients. We argued that while both the criminal law and the rules of professional conduct rightly require legal obedience from lawyers, other countervailing factors must be considered when evaluating lawyers’ representation of marijuana clients. In particular, we asserted that considerations of equity and access to justice weigh dispositively in favor of protecting lawyers who endeavor to help their clients comply with state marijuana laws, and we suggested means of interpreting relevant criminal law provisions and rules of professional conduct to achieve this result. This article builds on that analysis, taking on the particular issue of the public lawyer’s’ role in marijuana regulation. For government lawyers, the key issues in exercising discretion in the context of marijuana are not clients’ access to the law and equality but rather determining the clients’ wishes and serving them diligently and ethically. Lawyers representing state agencies, legislatures and the executive branch of government draft and interpret the rules and regulations regarding marijuana. Lawyers for federal, state and local governments then interpret those rules to determine the obligations and responsibilities of those they represent and to help their clients meet those obligations and carry out their required tasks. Both state and federal prosecutors are charged with determining what conduct remains illegal under the new rules and, perhaps more importantly, with exercising discretion regarding whom to prosecute and to what extent. Marijuana regulation is not a niche area of government regulation; it will influence the practice of virtually every public lawyer in the years to come. Public lawyers must understand the changes in marijuana law and the implications for government clients. Given the pervasiveness of the modern regulatory state, the situation is no easier — and, in many ways, it is more complicated — for public lawyers than it is for private ones. Public lawyers face myriad practice challenges with respect to marijuana law reform, and while we do not purport to identify and resolve all of the issues that are sure to arise in this short paper, we hope that the article helps alert public lawyers to some of the risks involved in participating in marijuana regulation so that they can think carefully about their obligations when these issues arise.

In 2012 Colorado became the first jurisdiction anywhere in the world to legalize marijuana possession and use for all adults. The regulated and taxed marijuana industry that arose in Colorado following legalization was also the first of its kind and stands a model for other states considering marijuana law reform. In this brief article I discuss the results of the Colorado experiment; I demonstrate that while Colorado’s regulatory model was largely successful, it also demonstrates the limits of generating revenue through taxing and regulating marijuana. I then discuss the implications of this conclusion for post-conflict Colombia, drawing a comparison to the situation California confronts as it considers legalizing marijuana for adult use.

Although marijuana possession remains a federal crime, twenty-three states now allow use of marijuana for medical purposes and four states have adopted tax-and-regulate policies permitting use and possession by those twenty-one and over. In this article, I examine recent developments regarding marijuana regulation. I show that the Obama administration, after initially sending mixed signals, has taken several steps indicating an increasingly accepting position toward marijuana law reform in states; however the current situation regarding the dual legal status of marijuana is at best an unstable equilibrium. I also focus on what might be deemed the last stand of marijuana-legalization opponents, in the form of lawsuits filed by several states, sheriffs, and private plaintiffs challenging marijuana reform in Colorado (and by extension elsewhere). This analysis offers insights for federalism scholars regarding the speed with which marijuana law reform has occurred, the positions taken by various state and federal actors, and possible collaborative federalism solutions to the current state-federal standoff.

Transcripción y estudio de 23 inventarios de bienes muebles de mudéjares castellonenses a través de los libros del Corte de Justicia para Castellón, Segorbe y Onda, fuente de muchos datos de diverso tipo sobre la vida de estos mudéjares y que generalmente se redactan post mortem para satisfacer deudas del fallecido. Se centra el análisis en la propiedad de animales de tiro y transporte, el trabajo de las fibras textiles y los elementos externos que los diferencian de los cristianos.

Introducción. El desarrollo del empoderamiento implica la posesión de múltiples habilidades que ayudan a las personas a afrontar la adversidad, por lo que el desarrollo de esta capacidad puede ser prioritario entre estas personas para mejorar su calidad de vida. Objetivos. Los objetivos del estudio analizan la capacidad de empoderamiento de un grupo de jóvenes con discapacidad en función de la tipología y etapa en la que se adquiere la discapacidad. Metodología. Participaron 98 jóvenes con diferentes tipos de discapacidad (física, intelectual, visual y auditiva). Contestaron la versión española adaptada de la Escala de Rogers, Chamberlin, Ellison y Crean (1997) diseñada para medir esta capacidad. Resultados. Los análisis indicaron altos niveles de esta capacidad entre los jóvenes observándose en mayor medida en las personas con discapacidad sobrevenida, así como en la discapacidad motora y visual. Conclusiones. Esto nos sugiere que esta capacidad puede variar y evolucionar, de ahí la importancia de fomentarla en programas de intervención-acción.

Esta capacidad implica la posesión de múltiples habilidades que ayudan a las personas a afrontar la adversidad, por lo que el desarrollo de esta capacidad puede ser prioritario entre estas personas para mejorar su calidad de vida. Objetivos. Los objetivos del estudio son analizar la capacidad de empoderamiento de un grupo de personas con discapacidad en función de la edad, nivel de estudios, ocupación y redes de apoyo. Metodología. Participaron 98 jóvenes con diferentes tipos de discapacidad (física, intelectual, visual y auditiva). Contestaron la versión española adaptada de la Escala de Rogers, Chamberlin, Ellison y Crean (1997), que es diseñada para medir esta capacidad. Resultados. Los resultados indicaron altos niveles de esta capacidad entre las personas con discapacidad observándose en mayor medida en los participantes con ocupación. Conclusiones. Esto nos sugiere que esta capacidad puede evolucionar y de ahí la importancia de fomentarla en programas de intervención-acción.

Opinion (or brief or judgement?) delivered in a case involving a claim by the Colony of New Hampshire to a proprietory right in a ferry running between Portsmouth and Kittery (then in Massachusetts) on the Piscataqua River. The ferry was started in 1684 by John Woodman and conveyed by franchise to Colonel Vaughan by Governor Dudley in 1708. Vaughan died in 1724 and the patent passed to his estate. The town of Portsmouth laid claim to the ferry. Read concluded that this action was not well founded since the ferry is not being operated by possession but by franchise and that, furthermore, New Hampshire does not have complete power over the ferry because Massachusetts has power of franchise on the Kittery end of its route.

This layer is a georeferenced raster image of the historic paper map: Charleston Harbor and its approaches showing the positions of the Rebel-batteries, [by] U.S. Coast Survey. It was published in 1863 by Lith. of J. Bien. Scale 1:30,000. Nautical chart covering Charleston Harbor and a portion of Charleston, South Carolina. The image inside the map neatline is georeferenced to the surface of the earth and fit to the South Carolina State Plane Coordinate System (in Meters) (Fipszone 3900). All map collar and inset information is also available as part of the raster image, including any inset maps, profiles, statistical tables, directories, text, illustrations, or other information associated with the principal map. This map shows features such as roads, railroads, houses, vegetation, drainage, military batteries and fortifications, coastal features (shoals, rocks, channels, floating batteries, etc.) and more. Overprinted to show 1/4-mile concentric circles centered on St. Michaels, Charleston; positions occupied by the Union Army and Navy; "Rebel batteries in possession of National forces [and] batteries still held by the Rebels [on] Sept. 7th 1863." Union positions are based "on the authority of Maj. T.B. Brooks." Relief shown by hachures; depths shown by soundings and shading. This layer is part of a selection of digitally scanned and georeferenced historic maps of the Civil War from the Harvard Map Collection. Many items from this selection are from a collection of maps deposited by the Military Order of the Loyal Legion of the United States Commandery of the State of Massachusetts (MOLLUS) in the Harvard Map Collection in 1938. These maps typically portray both natural and manmade features, in particular showing places of military importance. The selection represents a range of regions, originators, ground condition dates, scales, and purposes.

The purpose of the current study was to examine two different trajectories of sport participation and explore any similarities or differences that may result regarding per­sonal development and sport outcomes. Seventy-four youth athletes (40 “specializ­ers” and 34 “samplers”) were recruited for the current study and four measures were employed to assess sport experiences and outcomes. Discriminant function analyses revealed no differences between groups in asset possession or sources of enjoyment however, differences were reported in sport experiences and burnout. The “samplers” reported more experiences regarding the integration of sport and family as well as linkages to the community. Although the “specializers” reported higher levels of physical/emotional exhaustion than did the “samplers,” they also reported more expe­riences related to diverse peer groups. The differences highlight the importance of examining specific pathways of development in sport to gain a deeper understanding of youths’ experiences in sport.

This dissertation examines the corpse as an object in and of American hardboiled detective fiction written between 1920 and 1950. I deploy several theoretical frames, including narratology, body-as-text theory, object relations theory, and genre theory, in order to demonstrate the significance of objects, symbols, and things primarily in the clever and crafty work of Dashiell Hammett (1894-1961) and Raymond Chandler (1888-1959), but also touching on the writings of their lesser known accomplices. I construct a literary genealogy of American hardboiled detective fiction originating in the writings of Edgar Allan Poe, compare the contributions of classic or Golden Age detective fiction in England, and describe the socio-economic contexts, particularly the predominance of the “pulps,” that gave birth to the realism of the Hardboiled School. Taking seriously Chandler’s obsession with the art of murder, I engage with how authors pre-empt their readers’ knowledge of the tricks of the trade and manipulate their expectations, as well as discuss the characteristics and effect of the inimitable hardboiled style, its sharpshooting language and deadpan humour. Critical scholarship has rarely addressed the body and figure of the corpse, preferring to focus instead on the machinations of the femme fatale, the performance of masculinity, or the prevalence of violence. I cast new light on the world of hardboiled detective fiction by dissecting the corpse as the object that both motivates and de-composes (or rots away from) the narrative that makes it signify. I treat the corpse as an inanimate object, indifferent to representation, that destabilizes the integrity and self-possession, as well as the ratiocination, of the detective who authors the narrative of how the corpse came to be. The corpse is all deceptive and dangerous surface rather than the container of hidden depths of life and meaning that the detective hopes to uncover and reconstruct. I conclude with a chapter that is both critical denouement and creative writing experiment to reveal the self-reflexive (and at times metafictional) dimensions of hardboiled fiction. My dissertation, too, in the manner of hardboiled fiction, hopes to incriminate my readers as much as enlighten them.
