Neuromuscular electrical stimulation (NMES) has been consistently demonstrated to improve skeletal muscle function in neurological populations with movement disorders, such as poststroke and incomplete spinal cord injury (Vanderthommen and Duchateau, 2007). Recent research has documented that rapid, supraspinal central nervous system reorganisation/neuroplastic mechanisms are also implicated during NMES (Chipchase et al., 2011). Functional neuroimaging studies have shown NMES to activate a network of sub-cortical and cortical brain regions, including the sensorimotor (SMC) and prefrontal (PFC) cortex (Blickenstorfer et al., 2009; Han et al., 2003; Muthalib et al., 2012). A relationship between increase in SMC activation with increasing NMES current intensity up to motor threshold has been previously reported using functional MRI (Smith et al., 2003). However, since clinical neurorehabilitation programmes commonly utilise NMES current intensities above the motor threshold and up to the maximum tolerated current intensity (MTI), limited research has determined the cortical correlates of increasing NMES current intensity at or above MTI (Muthalib et al., 2012). In our previous study (Muthalib et al., 2012), we assessed contralateral PFC activation using 1-channel functional near infrared spectroscopy (fNIRS) during NMES of the elbow flexors by increasing current intensity from motor threshold to greater than MTI and showed a linear relationship between NMES current intensity and the level of PFC activation. However, the relationship between NMES current intensity and activation of the motor cortical network, including SMC and PFC, has not been clarified. Moreover, it is of scientific and clinical relevance to know how NMES affects the central nervous system, especially in comparison to voluntary (VOL) muscle activation. Therefore, the aim of this study was to utilise multi-channel time domain fNIRS to compare SMC and PFC activation between VOL and NMESevoked wrist extension movements.

Summary This manual was developed to guide a move towards common standards for undertaking and reporting research microscopy for malaria parasite detection, identification and quantification. It contains procedures based on agreed quality assurance standards for research malaria microscopy defined at a consultation of: TDR, the Special Programme for Research and Training in Tropical Diseases; the Worldwide Antimalarial Resistance Network (WWARN), United Kingdom; the Foundation for Innovative New Diagnostics (FIND), Switzerland; the Centers for Disease Control and Prevention (CDC), USA; the Kenya Medical Research Institute (KEMRI) and later expanded to include Amref Health Africa (Kenya); the Eijkman-Oxford Clinical Research Unit (EOCRU), Indonesia; Institut Pasteur du Cambodge (IPC); Institut de recherche pour le Développement (IRD), Senegal; the Global Good and Intellectual Ventures Laboratory (GG-IVL), USA; the Mahidol-Oxford Tropical Medicine Research Unit (MORU), Thailand; Queensland University of Technology (QUT), Australia, and the Shoklo Malaria Research Unit (SMRU), Thailand. These collaborating institutions commit to adhering to these standards in published research studies. It is hoped that they will form a solid basis for the wider adoption of standardized reference microscopy protocols for malaria research.

In his book, The Emperor of All Maladies, Siddhartha Mukherjee writes a history of cancer — "It is a chronicle of an ancient disease — once a clandestine, 'whispered-about' illness — that has metamorphosed into a lethal shape-shifting entity imbued with such penetrating metaphorical, medical, scientific, and political potency that cancer is often described as the defining plague of our generation." Increasingly, an important theme in the history of cancer is the role of law, particularly in the field of intellectual property law. It is striking that a number of contemporary policy debates over intellectual property and public health have concerned cancer research, diagnosis, and treatment. In the area of access to essential medicines, there has been much debate over Novartis’ patent application in respect of Glivec, a treatment for leukaemia. India’s Supreme Court held that the Swiss company’s patent application violated a safeguard provision in India’s patent law designed to stop evergreening. In the field of tobacco control, the Australian Government introduced plain packaging for tobacco products in order to address the health burdens associated with the tobacco epidemic. This regime was successfully defended in the High Court of Australia. In the area of intellectual property and biotechnology, there have been significant disputes over the Utah biotechnology company Myriad Genetics and its patents in respect of genetic testing for BRCA1 and BRCA2, which are related to breast cancer and ovarian cancer. The Federal Court of Australia handed down a decision on the validity of Myriad Genetics’ patent in respect of genetic testing for BRCA1 in February 2013. The Supreme Court of the United States heard a challenge to the validity of Myriad Genetics’ patents in this area in April 2013, and handed down a judgment in July 2013. Such disputes have involved tensions between intellectual property rights, and public health. This article focuses upon one of these important test cases involving intellectual property, public health, and cancer research. In June 2010, Cancer Voices Australia and Yvonne D’Arcy brought an action in the Federal Court of Australia against the validity of a BRCA1 patent — held by Myriad Genetics Inc, the Centre de Recherche du Chul, the Cancer Institute of Japan and Genetic Technologies Limited. Yvonne D’Arcy — a Brisbane woman who has had treatment for breast cancer — maintained: "I believe that what they are doing is morally and ethically corrupt and that big companies should not control any parts of the human body." She observed: "For my daughter, I've had her have [sic] mammograms, etc, because of me but I would still like her to be able to have the test to see if the mutation gene is in there from me." The applicants made the following arguments: "Genes and the information represented by human gene sequences are products of nature universally present in each individual, and the information content of a human gene sequence is fixed. Genetic variations or mutations are products of nature. The isolation of the BRCA1 gene mutation from the human body constitutes no more than a medical or scientific discovery of a naturally occurring phenomenon and does not give rise to a patentable invention." The applicants also argued that "the alleged invention is not a patentable invention in that, so far as claimed in claims 1–3, it is not a manner of manufacture within the meaning of s 6 of the Statute of Monopolies". The applicants suggested that "the alleged invention is a mere discovery". Moreover, the applicants contended that "the alleged invention of each of claims 1-3 is not a patentable invention because they are claims for biological processes for the generation of human beings". The applicants, though, later dropped the argument that the patent claims related to biological processes for the generation of human beings. In February 2013, Nicholas J of the Federal Court of Australia considered the case brought by Cancer Voices Australia and Yvonne D’Arcy against Myriad Genetics. The judge presented the issues in the case, as follows: "The issue that arises in this case is of considerable importance. It relates to the patentability of genes, or gene sequences, and the practice of 'gene patenting'. Briefly stated, the issue to be decided is whether under the Patents Act 1990 (Cth) a valid patent may be granted for a claim that covers naturally occurring nucleic acid — either deoxyribonucleic acid (DNA) or ribonucleic acid (RNA) — that has been 'isolated'". In this context, the word "isolated" implies that naturally occurring nucleic acid found in the cells of the human body, whether it be DNA or RNA, has been removed from the cellular environment in which it naturally exists and separated from other cellular components also found there. The genes found in the human body are made of nucleic acid. The particular gene with which the patent in suit is concerned (BRCA1) is a human breast and ovarian cancer disposing gene. Various mutations that may be present in this gene have been linked to various forms of cancer including breast cancer and ovarian cancer.' The judge held in this particular case that Myriad Genetics’ patent claims were a "manner of manufacture" under s 6 of the Statute of Monopolies and s 18(1)(a) of the Patents Act 1990 (Cth). The matter is currently under appeal in the Full Court of the Federal Court of Australia. This article interprets the dispute over Myriad Genetics in light of the scholarly work of Nobel Laureate Professor Joseph Stiglitz on inequality. Such work has significant explanatory power in the context of intellectual property and biotechnology. First, Stiglitz has contended that "societal inequality was a result not just of the laws of economics, but also of how we shape the economy — through politics, including through almost every aspect of our legal system". Stiglitz is concerned that "our intellectual property regime … contributes needlessly to the gravest form of inequality." He maintains: "The right to life should not be contingent on the ability to pay." Second, Stiglitz worries that "some of the most iniquitous aspects of inequality creation within our economic system are a result of 'rent-seeking': profits, and inequality, generated by manipulating social or political conditions to get a larger share of the economic pie, rather than increasing the size of that pie". He observes that "the most iniquitous aspect of this wealth appropriation arises when the wealth that goes to the top comes at the expense of the bottom." Third, Stiglitz comments: "When the legal regime governing intellectual property rights is designed poorly, it facilitates rent-seeking" and "the result is that there is actually less innovation and more inequality." He is concerned that intellectual property regimes "create monopoly rents that impede access to health both create inequality and hamper growth more generally." Finally, Stiglitz has recommended: "Government-financed research, foundations, and the prize system … are alternatives, with major advantages, and without the inequality-increasing disadvantages of the current intellectual property rights system.’" This article provides a critical analysis of the Australian litigation and debate surrounding Myriad Genetics’ patents in respect of genetic testing for BRCA1. First, it considers the ruling of Nicholas J in the Federal Court of Australia that Myriad Genetics’ patent was a manner of manufacture as it related to an artificially created state of affairs, and not mere products of nature. Second, it examines the policy debate over gene patents in Australia, and its relevance to the litigation involving Myriad Genetics. Third, it examines comparative law, and contrasts the ruling by Nicholas J in the Federal Court of Australia with developments in the United States, Canada, and the European Union. Fourth, this piece considers the reaction to the decision of Nicholas at first instance in Australia. Fifth, the article assesses the prospects of an appeal to the Full Federal Court of Australia over the Myriad Genetics’ patents. Finally, this article observes that, whatever happens in respect of litigation against Myriad Genetics, there remains controversy over Genetic Technologies Limited. The Melbourne firm has been aggressively licensing and enforcing its related patents on non-coding DNA and genomic mapping.

Relying on Merleau-Ponty's phenomenology of perception and on Mircea Eliade's works on the Sacred and the Profane, this study explores the river as a perceptual space and as the sacred Center in a cosmic vision of the world in twelve of Jean-Marie Gustave Le Clézio's fictional works, from The Interrogation (1963) to Revolutions (2003). In the first chapter, after introducing the field of study, I discuss the relation between the radical subjectivity and the evasiveness of perceiving subjects in Le Clézio's fiction. Next are some thoughts on the relation between Merleau-Ponty's and Le Clézio's ideas. The second chapter studies the river as an experience in the text, first as a topographical space, then as a sound world. The investigations move on to its water as a visual and a tactile phenomenon. Then follows the human use of the river, the (absence of) baths, and the river as a traveling space. The chapter closes with the study of the metaphorical use of the word, occurring mainly in urban space and for phenomena in the sky. The third chapter is organized around the river as the Center of the world in a religious cosmogony, where the river represents the origin of the world and of the human race. The core analysis shows how the middle of the river is a symbolic space of a new beginning. As a sacred space, the river abolishes time as the object of contemplation and as relative immobility from the point of view of a person drifting downstream. The functions of a new beginning and of abolition of time are combined in the symbolic immersions in the water. Finally, the dissertation explores other symbolical spaces, such as the unknown destination of the drift, and the river as the Center of a utopia. The chapter closes with the existential agony as a result of the elimination of the Center in the urban environment. In the final chapter, the river is compared to other watercourses : the creek, the brook and the rapids. The river is more of a spatial entity, whereas the actual water is more important in the smaller watercourses. The river is more common than the other watercourses as a topographical element in the landscape, whereas the minor watercourses invite the characters to a closer contact with their element, in immersions and in drinking their water. Finally, the work situates the rivers in a broader context of different fictional spaces in Le Clézio's text.

An asymptotic analysis of the two-dimensional turbulent near-wake flow behind a Rat plate with sharp trailing edge has been formulated, The feature that the near-wake, which is dominated by the mixing of the oncoming turbulent boundary layers retains, to a large extent, the memory of the turbulent structure of the upstream boundary layer has been exploited to develop the analysis. This analysis leads to two regions of the near-wake flow (the inner near-wake and the outer near-wake) for which the governing equations are derived. The matching conditions among these regions lead to a logarithmic variation in the normal direction in the overlapping region surrounding the inner near-wake. These features are validated by the available experimental data. Similarity solutions for the velocity distribution (which satisfy the required matching conditions) in the inner near-wake and outer near-wake regions have been obtained by making the appropriate eddy-viscosity assumptions, Uniformly valid solutions for velocity distribution have been constructed for the near-wake. The solutions show good agreement with available experimental data. (C) Elsevier, Paris.

En este estudio se realizó un diagnóstico sobre la implementación de las buenas prácticas avícolas (BPA) en pequeños y medianos productores de huevos de consumo, en los departamentos de Masaya, Managua y Chinandega, en el periodo comprendido de febrero del 2011 a Febrero del 2012. Se seleccionó la muestra de acuerdo a los siguientes criterios: Ubicación de las granjas avícolas, anuencia de la gerencia para participar en el estudio, avicultores líderes en su zona, productores con diez años de ser productores de huevos de consumo. Se encuestaron 20 granjas que corresponden al 33.89% del total de granjas en los tres departamentos. El tipo de preguntas en la encuesta fue de tipo cerrada con 7 componentes de BPA (personal; instalaciones; bioseguridad; suministro de agua y alimento; control de plagas; registros; medio ambiente). Los datos se procesaron y analizaron en Excel ® 2007. El nivel de cumplimiento se expresó a través de gráficos de barras verticales comparativos porcentualmente, con la finalidad de determinar las BPA de mayor y menor aplicación en los departamentos bajo estudio. Respecto a las BPA de mayor y menor aplicación en los tres departamentos, los componentes de mayor aplicación fueron: instalaciones; bioseguridad; registros; suministro de agua y alimentos. Los registros obtuvieron el mayor valor de cumplimiento con 93.75%. En cuanto al Porcentaje de aplicación de BPA por departamento, Chinandega presentó las más altas aplicaciones en los componentes: Personal (87.50%), Instalaciones (100%), Bioseguridad (100%), Control de plagas (64.29%), Medio Ambiente (75%) y Suministro de agua y alimento (94.44%), por su parte de manera global, Masaya mostró la mayor aplicación en el componente Registros con 96.15%.

El estudio se realizó en el Centro de Capacitación y Servicio Regional Pacífico (Jardín Botánico) ubicado en la ciudad de Masatepe, en el periodo del mes de junio del 2000 a febrero del 2001. El objetivo del presente trabajo fue caracterizar cada lote de café en estudio en base a sus aspectos agro ecológicos. Se trabajó con seis lotes de café ya establecidos y en plena producción con diferentes manejos, distancia de siembra, niveles de sombra y variedades. La metodología a aplicar contempla cuatro puntos por lote y dos plantas por punto; tomando a cada una, variables de: altura de planta, número de pisos, longitud de bandola, número de hojas por bandola y diámetro del tallo. Los mejores resultados fueron encontrados en: el lote Guanacaste (GU) con la variedad Catrenic con 55 por ciento de sombra obtuvo aumento de 42.88 cm en su altura. En cuanto a la variable número de pisos, del lote con las variedades Pacas y Caturra•(P&C), con 61 por ciento de sombra, la variedad Caturra obtuvo un aumento de 6.75 pisos. En longitud de bandola la variedad Pacas, del P&C aumento 11.75 cm. En la variable número de hojas, el de mayor aumento es el lote Gato (GA) con la variedad Catuaí amarillo con 10 hojas (47 por ciento de sombra). En cuanto al diámetro el de mayor aumento es el lote Salchicha vegetal (SV) con 0.72 cm. Hay que destacar que los lotes antes mencionados están entre 8, 9 y 14 años de vida y con dos recepos realizados, en su mayoría, con dos verticales por planta. Cabe destacar que los crecimientos antes mencionados corresponden a los aumentos promedios totales de los lotes en todo el periodo de estudio. Se concluye que los mejores lotes son el Gato (GA) y el Guanacaste (GU), pues son dos variedades adaptadas a la zona y presentan un ambiente optimo que favorece a su desarrollo, seguido del lote Pacas y Caturra (P&C) que se comportó de manera satisfactoria.

Résumé: Le travail collaboratif s’invite à présent partout, et est identifié dans des domaines aussi multiples que variés. Dans le monde de l’entreprise, de la prise en charge médico-sociale, de l’éducation / formation, de la recherche, de l’économie, de la politique, de la gestion de carrière… etc. Ce travail vise dans un premier temps à décliner ce qu’est la collaboration, ses caractéristiques, ses contextes d’utilisation, et la façon dont elle se différencie des autres formes d’organisation (coopération et compétition notamment). Dans un deuxième temps, il réexamine la question de la nouveauté du travail collaboratif à la lumière des résultats obtenus. S’il est assez évident que les « ingrédients », les attributs du travail collaboratif ne sont pas nouveaux (le développement informatique mis à part), il semble en revanche que les combinaisons rencontrées et les domaines d’application génèrent de nouvelles questions. Pour finir, en s’inspirant des termes associés à collaboration, il considère quelques-uns des nouveaux enjeux dans la sphère professionnelle.

Mediante una “secreta torsión” de las significaciones adquiridas es posible instituir una nueva significación. El presente artículo buscará exhibir dicho poder misterioso del lenguaje que se hace manifiesto en una expresión creadora en la que aparece un excedente de lo que se va a decir sobre lo dicho. Ese excedente es la esencia en estado viviente. Para manifestar el fenómeno milagroso del lenguaje nos serviremos de la obra de Proust: À la recherche du temps perdu

Résumé: A l’heure où l’on évoque une “génération précaire” il est intéressant de s’interroger sur l’accroissement de la précarité de l’emploi en France et d’étudier ses éventuels effets sur les salariés. L’objectif de la présente recherche était d’observer les impacts causés par la précarité de l’emploi sur une population de référence et voir si ces effets différaient selon le sexe du salarié soumis à la précarité. Pour ce faire, nous avons soumis un questionnaire à deux groupes de travailleurs. Ce dernier portait sur la précarité de l’emploi et ses impacts en termes de stress, consommation de substances et impacts sur la sphère privée. Les résultats font apparaître des effets significatifs et des tendances qui existent sur certaines des dimensions interrogées (stress et consommation) entre le groupe de travailleurs précaires et non précaires. De plus, des effets entre hommes et femmes ont également été relevés. Par contre, nous n’avons pas d’effets observés sur la sphère privée de l’individu. Suite à l’absence d’effet constaté nous interrogeons la spécificité de la population. Aussi, nous envisageons de prolonger cette étude sur la recherche d’indicateurs concernant la précarité enseignante. Analisa a limitação dos poderes das comissões parlamentares de inquérito e do fato determinado como garantidores do exercício dos direitos fundamentais no âmbito dessas mesmas comissões, a partir da doutrina sobre o assunto e da jurisprudência do Supremo Tribunal Federal. O enorme espaço que as CPIs têm na sociedade, aliado ao "poder de investigação próprio de autoridades judiciais", conferido pela Constituição Federal, nem sempre é compreendido pela maioria dos seus membros, que, não hesitam em dar a ela poderes jurisdicionais, privativos do Judiciário, gerando, desta forma, a violência contra os direitos fundamentais das testemunhas e pessoas por ela investigadas.
