The goal of this study was to apprehend conceptualizations and professional experiences concerning child maltreatment as reported by physicians and nurses working for the Family Health Strategy implemented in a medium-sized city in São Paulo state. It is a descriptive qualitative study in which 20 professionals were included and semi-structured taped interviews were used. The data obtained were analyzed according to the Collective Subject Discourse and systematized into five themes: Conceptualizations of child maltreatment; Professional training to work in this field; Professional experiences related to such aggravations; Difficult and easy aspects faced during care provision to child maltreatment in the Family Health Strategy; Proposals to promote child safety. It was concluded that care provision to such aggravation types by family health units is configured as an important strategy to promote child safety and support families in relation to this issue. However, it was observed that, in order to qualify professionals for such care provision, it is necessary to invest in continuing education for the multiprofessional team. Also, municipal policies concerning care provision to child abuse, particularly in the organization of integrated work of the health care, education, social welfare and justice sectors must be urgently established by actively including the general society in such process

The study articulates the relations of power / knowledge in the production of crime and operationalization of the law, the subtle way in which technologies of gender naturalize actions and reactions in relationships, partnerships and daily struggles between staff and prisoners and the processes of subjectivity in contemporaneity . This study has as epistemological matrix the genealogy proposed by Michel Foucault, who has allowed diverse pathways as document reviews, semi-structured interviews, performance groups and courses. The interweaving of the forces and discourses has engendered the impact of technologies on gender, especially masculinity, in the present relations between staff and prisoners. The impact of this relationship puts on display the modulations of subjectivity in a continuum of oscillation between normalizing and singularizing modes of subjectification.

Adolescents with a course of life based on the lack of ethical and moral values are more vulnerable to the practice of infractions, and in this case the statute of the child and adolescent assumes their insertion on socio educative measures. The objective of this research is to identify the moral development phase in adolescents who are in confl ict with the law. Thirty male adolescents between fi fteen and eighteen years old, who are inserted on the socio educative care Center, were studied. Data were collected through futsal game observation, without the presence of a referee and structured interview, according to the general lines of the Clinical Method of PIAGET (1994). The arrangement of the collected data confi rmed our hypothesis – these adolescents are still with the characteristics of a heteronomical moral, confi rmed by the differences between conscience and the practice of rules in a game situation. Although they know the rules, these are only respected in order to get some benefi ts, like not charging foul, deceive the opponent or simply win the match. It is presumed that the rules would only be respected in the presence of an authority (referee), because he would impose punishments and privations. However, it is believed that the results of this study may become a parameter to educators in order to create favorable situations which can be preventive and interventive to the socio moral development, minimizing suffering and seizing opportunities to the formation of citizens with higher ethical and moral standards, who are able to choose the way to the solidarity, cooperation and justice.

The Knox-Wise Family Papers includes a land grant issued to John Knox in 1768; diaries written by Dr. John Knox [1792-1859] covering the 1840s and 1850s; James N. Knox [1806-1880] covering 1859-1880; and William D. Knox [1847-1928] covering 1869-1928; indentures, deeds, receipts, court summonses and other papers of Hugh Knox [1757-1821], sheriff and justice of the peace in Chester County, South Carolina (ca. 1780s and 1790s); correspondence of James N. Knox, correspondence, and other professional papers of Dr. John Knox; correspondence, and other papers of William D. Knox, Superintendent of Education in Chester County from 1896-1928. Papers of various other members of the Knox and Wise families including Hugh Boyd Knox [1814-1886], Robert Knox [1796-1879], Sally Knox Wallace [1803-1901], Alexander Walker Wise, and Emmie R. Knox [1885-1969]; family histories of the Knox, Wise, Dunlap, Gaston, and Wilks families; church histories, photographs, and newspaper clippings. Also included are three published volumes of the United Confederate Veterans Minutes of the 21st (1911) and 25th (1915) Annual Meeting and Reunion; and the minutes of the annual reunion of the South Carolina Division of the United Confederate Veterans (1921-1927).

This paper seeks to explore how victims of crime and defendants are portrayed in sexual assault cases. Lately, more and more voices have been raised in appal against values demonstrated in court decisions and we’ve seen the implementation of a new sexual assault legislation in attempt to increase people’s sexual integrity. Yet, at the same time, there is still a tremendously low amount of reported sexual assaults that go to trial and even fewer result in conviction. This paper is not an attempt to scrutinize the legal system, but to draw attention to what values are portrayed in sexual assault cases. The purpose is to examine the court decisions under consideration to see if and what values are portrayed. My paper can in no way allow generalization; it is merely a small sample of reality. The data consists of four court decisions from Östersund’s Tingsrätt; two of them resulting in conviction and two of them in dismissal. The data was collected systematically and undergoes a discourse analysis; hence it is a qualitative study. The result of the analysis is that although somewhat subtle, the court decisions do indeed portray stereotypical gender roles, particularly regarding victims’ prior sexual history, women’s room to manoeuvre and their given life conditions

La presente indagine mira ad esaminare, in chiave innovativa, i rapporti tra l’Europa ed un reato prettamente europeo: il negazionismo. Sviluppatosi in maniera assolutamente predominante nel nostro continente, le ragioni della sua diffusione sono molteplici. Al di là della lotta a razzismo ed antisemitismo, il motivo principale va identificato nel ruolo “fondativo” che riveste la memoria dell’Olocausto in Europa, collocata nel cuore dell’universo valoriale su cui si reggono i due principali attori europei, ovverosia l’Unione europea e la Corte europea dei diritti dell’uomo. La ricerca, dunque, ruota attorno a due poli tematici. Da un lato, sono state esaminate le politiche normative dell’Unione europea in materia di razzismo e xenofobia, entro cui spicca la promozione dell’incriminazione del negazionismo “allargato”, cioè esteso alle condotte di negazione non solo dell’Olocausto, ma anche degli altri crimini internazionali. Dall’altro lato, l’analisi della trentennale giurisprudenza della Corte di Strasburgo in materia ha evidenziato come, con riguardo alle manifestazioni negazioniste, sia stato elaborato uno “statuto speciale”, che si risolve nel perentorio diniego di tutela per questa categoria di opinioni, sottratte a monte all’ordinario giudizio di bilanciamento in quanto giudicate incompatibili con i valori sottesi alla CEDU. Lo scopo di questo lavoro riposa nel tentativo di individuare le interazioni tra questi due sistemi istituzionali, per interpretare una tendenza che converge con nettezza verso un incremento della repressione penale della parola. Da questo complesso intreccio di norme e principi, di hard law e soft law, sarà possibile enucleare la natura giuridica ed il contenuto delle richieste di incriminazione rivolte agli Stati membri. Una volta appurato che agli Stati è concesso di restringere il campo di applicazione del reato di negazionismo, adottando degli indici di pericolosità delle condotte, sarà analizzata la tenuta di questi “elementi opzionali del reato” alla luce dei principi penalistici di tassatività, materialità, offensività e laicità.

Il presente lavoro affronta un tema di particolare attualità nella applicazione del mandato d’arresto europeo. Pensate per il contrasto alle forme più gravi di criminalità, le procedure di consegna hanno trovato sempre più spesso applicazione per vicende criminose di scarsa offensività, determinando conseguenze gravi sui diritti fondamentali degli individui coinvolti e mettendo a rischio la reciproca fiducia tra gli Stati membri nello spazio di libertà, sicurezza e giustizia. Ciò ha imposto alle istituzioni europee di richiamare gli Stati membri al rispetto del principio di proporzionalità, quale principio generale del diritto europeo. Il presente studio analizza i presupposti e le modalità di applicazione di tale principio, alla luce del nuovo assetto impresso all’Unione dal Trattato di Lisbona e nella prospettiva dei diritti fondamentali. In particolare, esso si sofferma sul ruolo da attribuire, rispetto allo specifico tema, alla Carta dei diritti fondamentali dell’Unione ed all’art. 52 par. 1 in essa previsto, ove emerge la valenza costituzionale del principio di proporzionalità.
