Este estudo buscou identificar e analisar como foi planejado e executado o processo de descentralização da perícia criminal federal, bem assim, identificar a razão para os desvios havidos entre o planejamento e a implementação e as consequências advindas. Uma revisão da teoria precedeu a análise dos dados, obtidos através de pesquisa de campo constituída por oito entrevistas, sendo cinco entre os planejadores e executores do processo de descentralização, e três com os responsáveis por unidades descentralizadas. O planejamento do processo de descentralização foi realizado por equipes intermediárias do escalão dirigente do Departamento de Polícia Federal. Conforme levantamento empreendido por esses idealizadores, constatou-se uma alta demanda por assistência pericial em investigações conduzidas em cidades afastadas das capitais dos estados, onde residia o único centro forense disponível em cada unidade da federação. A distância do local da demanda para as capitais e a limitada capacidade de atendimento das unidades estaduais prevenia o atendimento tempestivo das requisições, situação que, por vezes, comprometia toda a eficácia da investigação policial. A par dessas constatações e tendo sido identificadas as principais especialidades requeridas, o volume de solicitações, a infraestrutura local disponível e outras características associadas à demanda e aos seus locais de origem, foram delimitados requisitos para a identificação de cidades que receberiam unidades técnico-científicas e delimitação das características dessas unidades. Os parâmetros fixados para dimensionar as unidades descentralizadas, como requisitos de infraestrutura, recursos humanos e equipamentos, acabaram por ser flexibilizados durante o processo de implementação devido à insuficiência de recursos financeiros para a implementação concebida. Como resultado, houve instalação de unidades incompletas; com corpo técnico carente das expertises requeridas; com infraestrutura física inadequada; em localidades não previstas; sem os laboratórios e equipamentos necessários. Os empecilhos indicados sinalizam que o plano foi estabelecido sem a análise precisa das forças e fraquezas, oportunidades e desafios que impactariam a sua execução. A ausência do envolvimento da alta administração da Polícia Federal pode explicar parte das deficiências encontradas no processo. Embora a descentralização tenha melhorado as condições para a atuação das equipes de investigação, diversas deficiências ainda precisam ser suprimidas para garantir melhor efetividade da assistência da perícia. Conclui-se pela necessidade de uma completa revisão do processo de descentralização da estrutura pericial, a fim de se identificar os ajustes necessários para o aprimoramento das condições de operação das unidades técnico-científicas descentralizadas.

A experiência internacional de empresas de países em desenvolvimento é relativamente nova, assim como os estudos sobre o desenvolvimento dessas atividades por esses países e, em particular, pelo Brasil. Esta pesquisa visou contribuir para o conhecimento sobre como as empresas brasileiras se internacionalizam e, para tanto, foi realizado um estudo de caso em profundidade com a Marcopolo S. A., uma organização em estágio avançado de operações internacionais. Apoiando-se em vertentes comportamentais e econômicas da literatura sobre o tema, buscou-se investigar o processo de internacionalização dessa empresa – suas motivações, como ela expandiu seus negócios no exterior, quais foram os principais obstáculos enfrentados e fatores facilitadores do processo. Também se estudou a relação entre internacionalização e resultados financeiros obtidos e a influência de políticas públicas. Atuar em mercados externos foi uma forma de ampliação de mercados e de diversificação de riscos para a empresa e hoje é o foco de sua estratégia de crescimento. O processo se desenvolveu de forma incremental, evoluindo de operações de menor comprometimento e em países mais próximos do Brasil, até a instalação de unidades em mercados mais distantes. Obstáculos de natureza econômica e cultural influenciaram suas atividades e o domínio tecnológico de produtos e de processos, assim como parcerias com montadoras, foram facilitadores do seu desenvolvimento internacional. Os resultados da pesquisa confirmaram os pressupostos da abordagem comportamental, reforçando a hipótese gradualista sustentada pela Teoria de Uppsala. O Paradigma Eclético também explicou os investimentos diretos realizados pela empresa, o que levou à constatação de que as duas linhas teóricas se complementam para explicar o caso. As operações da companhia em mercados externos foram historicamente mais rentáveis do que no mercado doméstico e esses resultados tornaram-se mais expressivos com a instalação de unidades no exterior. Por fim, constatou-se que algumas medidas de apoio governamental geraram efeitos positivos para as exportações, mas que não houve influência de políticas públicas para instalação de fábricas em territórios estrangeiros.

This paper aims to verify the main contributions and adjustments that the paper “Towards a Legal Theory of Finance” from Katharina Pistor may bring to the role of the Brazilian National Bank for Economic and Social Development (BNDES) in the Brazilian development financing. In order to do so, I work with two questions in this paper: (i) such theory presents elements which allow analyzing the role of the BNDES and from there, if it is required, adjustments can be made in the governance of the BNDES? and (ii) there are academics and scholars that, together with the theory, also contribute with the improvement of the BNDES role in the development of Brazil?

This paper examines the output losses caused by disinflation and the role of credibility in a model where pricing mIes are optimal and individual prices are rigid. Individual nominal rigidity is modeled as resulting from menu costs. The interaction between optimal pricing mIes and credibility is essential in determining the inflationary inertia. A continued period of high inflation generates an asymmetric distribution of price deviations, with more prices that are substantially lower than their desired leveIs than prices that are substantially higher than the optimal ones. When disinflation is not credible, inflationary inertia is engendered by this asymmetry: idiosyncratic shocks trigger more upward than downward adjustments. A perfect1y credible disinflation causes an immediate change of pricing rules which, by rendering the price deviation distribution less asymmetric, practically annihilates inflationary inertia. An implication of our model is that stabilization may be sucessful even when credibility is low, provided that it is preceded by a mechanism of price alignment. We also develop an analytical framework for analyzing imperfect credibility cases.

This paper gives a first step toward a methodology to quantify the influences of regulation on short-run earnings dynamics. It also provides evidence on the patterns of wage adjustment adopted during the recent high inflationary experience in Brazil.The large variety of official wage indexation rules adopted in Brazil during the recent years combined with the availability of monthly surveys on labor markets makes the Brazilian case a good laboratory to test how regulation affects earnings dynamics. In particular, the combination of large sample sizes with the possibility of following the same worker through short periods of time allows to estimate the cross-sectional distribution of longitudinal statistics based on observed earnings (e.g., monthly and annual rates of change).The empirical strategy adopted here is to compare the distributions of longitudinal statistics extracted from actual earnings data with simulations generated from minimum adjustment requirements imposed by the Brazilian Wage Law. The analysis provides statistics on how binding were wage regulation schemes. The visual analysis of the distribution of wage adjustments proves useful to highlight stylized facts that may guide future empirical work.

In a nonnative approach, I analyze trade policies when the industrial sector genentes positive extemalities in production, and there are adjustments costs to changing production from one sector to the other. Protectionist trade policy can make workers intemalize the benetits from moving into the industrial sector, but it is a second best policy as it also causes consumption distortions. I show that if the govemment is able to fully commit to its tariff schedule for the future, the welfare maximizing policy is to maintain a positive tariff forever, even after all adjustment has already taken place . However, if the govemment is not able to commit at all, the only time consistent policy is zero tariff at any point in time. The time inconsistency of the full commitment policy is derived from the fact that in the model only production needs interference, and the production distortion is lagged one period with respect to the tariff wbile the consumption distortion is simultaneous to the tariff. In the intermediary case, i.e., when the government can commit for a limited period of time, the time consistent optimal tariff will be positive but lower than the "full commitment" tariff. This result indicates that some institutions that have always been considered pure sources of inefficiency, such as protectionist lobbying, may in fact be welfare improving in some cases!

The real effects of an imperfectly credible disinflation depend critically on the extent of price rigidity. Therefore, the study of how policymakers’ credibility affects the outcome of an announced disinflation should not be dissociated from the analysis of the determinants of the frequency of price adjustments. In this paper we examine how the policymaker’s credibility affects the outcome of an announced disinflation in a model with endogenous time-dependent pricing rules. Both the initial degree of price ridigity, calculated optimally, and, more notably, the changes in contract length during disinflation play an important role in the explanation of the effects of imperfect credibility. We initially evalute the costs of disinflation in a setup where credibility is exogenous, and then allow agents to update beliefs about the “type” of monetary authority that they face. We show that, in both cases, the interaction between the endogeneity of time-dependent rules and imperfect credibility increases the output costs of disinflation.

Este estudo analisa os efeitos da primeira frase da transição para o IFRS no Brasil (Lei 11.638/07 e CPC 13) nos resultados publicados em 2009 (exercício de 2008 e republicações de 2007) pelas empresas listadas na Bovespa. É aplicado o inverso do “Índice de Conservadorismo” de Gray (1980,1988), renomeado “Índice de Comparabilidade” por Weetman et al. (1998), para determinar se e o quanto os resultados reportados pelas novas normas são superiores aos apurados pela norma brasileira anterior – indicando o conservadorismo do sistema contábil brasileiro, previsto por Gray e outros estudos – ou inferiores (otimismo). Reduziu-se gradativamente a amostra inicial conforme a compliance com o CPC 13 e a transparência das demonstrações e das Notas Explicativas. Isso permitiu, após aplicação do Teste de Wilcoxon, verificar em média resultados maiores conforme a nova norma em relação à norma tradicional – preconizando-se que persistirão aumentos até a adoção do full IFRS em 2010. Após o exame de ajustes ao resultado, foi possível relacionar certas inconsistências entre 2007 e 2008 a impactos da crise financeira de 2008 nos ajustes “custos de transação na emissão de títulos” e “valor justo (marcação a mercado) de instrumentos financeiros”.

A Lei 11.284/2006 é um importante marco legal da atividade de gestão florestal do Brasil. O manejo florestal sustentável de florestas públicas, até então exercido exclusivamente pelo Estado, passou a ser passível de concessão com o advento dessa Lei. A chamada “concessão florestal” se insere, portanto, na nova orientação político-econômica brasileira de “desestatização”, privilegiando o princípio da eficiência. Como resultado, a atividade de exploração sustentável de produtos florestais passa a ser transferida pelo Estado, por intermédio do Serviço Florestal Brasileiro, à iniciativa privada. Para o sucesso de uma concessão florestal, os licitantes interessados precisam de uma estimativa da capacidade produtiva da “Unidade de Manejo Florestal”. O estudo disponibilizado pelo Serviço Florestal Brasileiro para fazer essa estimativa é o inventário florestal que, resumidamente, tem a importante missão de antecipar às características vegetais de área que será objeto da concessão. E os resultados desse estudo são a principal fonte de informação para que o licitante calcule o valor que irá ofertar ao Poder Concedente. Ocorre que, por questões técnico-metodológicas que fogem ao conhecimento jurídico, os estudos de inventário florestal estão sujeitos a erros de grande escala, retratando, de maneira ilusória, a realidade da vegetação que compõe área que será concedida. Isto é um risco intrínseco à atividade de exploração sustentável de produtos florestais. Diante desse contexto, caberia ao Serviço Florestal Brasileiro administrar o risco do inventário florestal da maneira mais eficiente possível. Entretanto, não é isso que vem ocorrendo nos contratos de concessão florestal. Sobre a distribuição de riscos em contratos de concessão, a doutrina especializada no tema oferece critérios que, quando seguidos, possibilitam uma alocação dos riscos peculiares a cada atividade à parte que melhor tem condições de geri-los. Esses critérios aumentam a eficiência da concessão. Contudo, os contratos de concessão florestal até hoje celebrados não vêm considerando esses importantes critérios para uma eficiente distribuição de riscos. Como consequência, o risco do inventário florestal é, igualmente a outros inúmeros riscos, negligenciado por esses contratos, aumentando-se a ineficiência dos contratos de concessão. Diante desse panorama, os licitantes interessados na concessão adotam duas posturas distintas, ambas igualmente rejeitáveis: a postura do Licitante Conservador e a postura do Licitante Irresponsável. Esses perfis de licitantes geram, respectivamente, ineficiência à concessão e, caso o erro do inventário florestal efetivamente ocorra, a possibilidade de inviabilidade da concessão. Como resposta a isso – que é exatamente o “problema” que pretendo resolver –, proponho uma solução para melhor administrar o risco do inventário florestal. Essa solução, inspirada em uma ideia utilizada na minuta do contrato de concessão da Linha 4 do Metrô de São Paulo, e baseando-se nos critérios oferecidos pela doutrina para uma distribuição eficiente dos riscos, propõe algo novo: a fim de tornar a os contratos de concessão florestal mais eficientes, sugere-se que o risco do inventário florestal deve ser alocado na Administração Pública, e, caso o evento indesejável efetivamente ocorra (erro do inventário florestal), deve-se, por meio do reequilíbrio econômico-financeiro do contrato, ajustar o valor a ser pago pelo concessionário ao Poder Concedente. Como consequência dessa previsão contratual, as propostas dos licitantes serão mais eficientes, permitindo-se alcançar o objetivo primordial da Lei 11.284/2006: aumento da eficiência da exploração florestal sustentável e preservação do meio ambiente e dos recursos florestais.

O presente trabalho apresenta um estudo sobre a recente Lei n. 12.846/13, em especial sobre o instituto do acordo de leniência, buscando estabelecer um marco para a celebração desses ajustes tendo em vista os direitos e garantias estabelecidos pela Constituição da República Federativa do Brasil de 1988. Inicialmente, aborda-se as intensas mudanças promovidas no Estado moderno e no direito sancionador de forma geral, questiona-se, em seguida, a existência de um núcleo comum entre o direito penal e o direito administrativo sancionador. Busca-se, por fim, propor soluções para maximizar a eficácia do sistema de controle e sanção da Lei n. 12.846/13, tendo em vista a necessidade de se harmonizar a Regulação Pública com a segurança jurídica e os direitos constitucionais da pessoa jurídica investigada, em especial quando ela celebra o acordo de leniência.

The present thesis aimed at understanding how the insertion of music in the work environment contributes to achieving Quality of Work Life. - QWL, under the perspective of biopsychosocial and organizational well-being. As to music insertion we considered the theoretical-empirical perception about how music is inserted at work and its functions on such place. The context where the study was taken was the manufacturing area of a major textile company, located in Natal, state of Rio Grande do Norte, Brazil, in which music is used during labor activities. The only study case was the research strategy adopted, with exploratory and descriptive purposes. The primary data were collected through the focus group technique, applied to the collaborator in the manufacturing sector. The semi-structured interview was done as a complementary tool, directed to the supervisor in that sector. Respecting the theoretical saturation criterion, we formed four focus groups, each one composed of eight members randomly selected, among the seventy-six collaborators in the sector. The data were analyzed qualitatively, through the content analysis technique, more specifically the category analysis. We identified twenty-eight QWL attributes. Six of them were found present in the four focus groups and in the interview. Among these ones, the attribute of Interpersonal Relationship at Work, contemplating the Psychological and Organizational dimensions, was the only one anticipated in four out of fifteen theoretical models here listed. The attribute Music at Work Environment could be inserted in the four QWL dimensions, highlighting the power and relevance of this attribute for the research participants. The way music has been inserted in the labor environment contributes to promoting well-being at work, which goes against theoretical conceptions, especially when it comes to musical genre. We identified nine functions of music at work, among which, Improving Work Conditions, Improving Interpersonal Relationship at Work and Favoring Motivation for Work had to be emphasized for being associated to three QWL attributes. In the total, we highlighted seven associations. The most affected QWL dimension through the insertion of music at work was the Psychological one, followed by the Organizational one. We conclude that music insertion provides biological, social and, above all, psychological and organizational well-being to the contributors, thus contributing to obtaining QWL at the labor environment researched. However, we should consider the context and proceed to periodical plans and adjustments in the way of music insertion so as to avoid health and well-being problems to those people at work

The relationship between the State and the non-governmental organizations (NGOs) needs to be analyzed and debated by the objective to extinguish or to reduce the existent failures in this partnership in order that the whole society may benefit from it. To understand how the partnership between the public and NGOs work is fundamental. The present study searches to contribute to a better understanding of this matter. With this aim, the research focused the partnership formed between Natal Child and Adolescent Council (COMDICA) and NGOs which were selected by public notice in 2007. Theoretical references were based on the Continuum of Collaboration proposed by Austin (2001) that serves to differentiate the degree and the mode of interaction between the two organizations. It was observed that in some points there is a lack in the interaction between COMDICA and the NGOs. The frequent change of the government counselors makes difficult a more intense involvement and partnership awareness with the NGOs. The NGOs members need to be more involved with the activities of COMDICA and search for a larger participation in the assemblies, on the discussions and on the intrinsic council actions. The relationship must also be rethought, since that the partnership must not be limited to financial resources support. The channels of communication must be improved and become more frequent. The evaluation and monitoring of social projects are poor and own methodologies need to be elaborated. Therefore, it is necessary to make some adjustments in this relationship involving not only the partnerships made by the selected ONGs, but also all those who assist the child and the adolescent. A closer relation makes possible a greater effectiveness of the public policies on one side and on the other side improves the performance of the COMDICA and the NGOs

This Masters Degree dissertation seeks to make a comparative study of internal air temperature data, simulated through the thermal computer application DesignBuilder 1.2, and data registered in loco through HOBO® Temp Data Logger, in a Social Housing Prototype (HIS), located at the Central Campus of the Federal University of Rio Grande do Norte UFRN. The prototype was designed and built seeking strategies of thermal comfort recommended for the local climate where the study was carried out, and built with panels of cellular concrete by Construtora DoisA, a collaborator of research project REPESC Rede de Pesquisa em Eficiência Energética de Sistemas Construtivos (Research Network on Energy Efficiency of Construction Systems), an integral part of Habitare program. The methodology employed carefully examined the problem, reviewed the bibliography, analyzing the major aspects related to computer simulations for thermal performance of buildings, such as climate characterization of the region under study and users thermal comfort demands. The DesignBuilder 1.2 computer application was used as a simulation tool, and theoretical alterations were carried out in the prototype, then they were compared with the parameters of thermal comfort adopted, based on the area s current technical literature. Analyses of the comparative studies were performed through graphical outputs for a better understanding of air temperature amplitudes and thermal comfort conditions. The data used for the characterization of external air temperature were obtained from the Test Reference Year (TRY), defined for the study area (Natal-RN). Thus the author also performed comparative studies for TRY data registered in the years 2006, 2007 and 2008, at weather station Davis Precision Station, located at the Instituto Nacional de Pesquisas Espaciais INPE-CRN (National Institute of Space Research), in a neighboring area of UFRN s Central Campus. The conclusions observed from the comparative studies performed among computer simulations, and the local records obtained from the studied prototype, point out that the simulations performed in naturally ventilated buildings is quite a complex task, due to the applications limitations, mainly owed to the complexity of air flow phenomena, the influence of comfort conditions in the surrounding areas and climate records. Lastly, regarding the use of the application DesignBuilder 1.2 in the present study, one may conclude that it is a good tool for computer simulations. However, it needs some adjustments to improve reliability in its use. There is a need for continued research, considering the dedication of users to the prototype, as well as the thermal charges of the equipment, in order to check sensitivity

This research aimed to identify the link between the layout of workspaces in offices and the design strategies for environmental comfort. Strategies surveyed were focused on the thermal, visual and luminic comfort. In this research, visual comfort is related to issues of visual integration within and between the interior and exterior of the building. This is a case study conducted at the administrative headquarters of Centro Regional Nordeste do Instituto de Pesquisas Espaciais (INPE-CRN), located in Natal/RN. The methodological strategy used was the Post-Occupancy Evaluation, which combined the survey data on the building (layout of workspaces, bioclimatic strategies adopted in the design, use of these strategies) with some techniques aimed at acquiring qualitative information related to users. The workspace layout is primordial to satisfaction and productivity of workers. Issues such as concentration, communication, privacy, personal identity, density and space efficiency, barriers (access, visual and even ventilation and lighting), among others, are associated with the layout. The environmental comfort is one of the essential elements to maintaining life quality in workplace. Moreover, it is an important factor in user`s perception of the space in which he or she are inserted. Both layout and environmental comfort issues should be collected and analyzed in the establishment phase of the programming step. That way, it is possible to get adequate answers to these questions in subsequent project phases. It was found that changes in the program that occurred over time, especially concerning persons (number and characteristics), resulted in changes in layout, generating high density and inflexible environments. It turns difficult to adjust the furniture to the occupants` requirement, including comfort needs. However, the presence of strategies for environmental quality provides comfort to spaces, ensuring that, even in situations not considered optimal, users perceive the environment in a positive way. It was found that the relationship between environmental comfort and layout takes the following forms: in changing the perception of comfort, depending on the layout of the arrangements; adjustments in layout, due to needs for comfort; and the elevation of user satisfaction and environmental quality due to the presence of strategies comfort even in situations of inadequate layout

From their early days, Electrical Submergible Pumping (ESP) units have excelled in lifting much greater liquid rates than most of the other types of artificial lift and developed by good performance in wells with high BSW, in onshore and offshore environments. For all artificial lift system, the lifetime and frequency of interventions are of paramount importance, given the high costs of rigs and equipment, plus the losses coming from a halt in production. In search of a better life of the system comes the need to work with the same efficiency and security within the limits of their equipment, this implies the need for periodic adjustments, monitoring and control. How is increasing the prospect of minimizing direct human actions, these adjustments should be made increasingly via automation. The automated system not only provides a longer life, but also greater control over the production of the well. The controller is the brain of most automation systems, it is inserted the logic and strategies in the work process in order to get you to work efficiently. So great is the importance of controlling for any automation system is expected that, with better understanding of ESP system and the development of research, many controllers will be proposed for this method of artificial lift. Once a controller is proposed, it must be tested and validated before they take it as efficient and functional. The use of a producing well or a test well could favor the completion of testing, but with the serious risk that flaws in the design of the controller were to cause damage to oil well equipment, many of them expensive. Given this reality, the main objective of the present work is to present an environment for evaluation of fuzzy controllers for wells equipped with ESP system, using a computer simulator representing a virtual oil well, a software design fuzzy controllers and a PLC. The use of the proposed environment will enable a reduction in time required for testing and adjustments to the controller and evaluated a rapid diagnosis of their efficiency and effectiveness. The control algorithms are implemented in both high-level language, through the controller design software, such as specific language for programming PLCs, Ladder Diagram language.
