Entre os anos de 2009 a 2012 o município de Duque de Caxias realizou uma parceria com uma organização social civil de interesse público (OSCIP) para gerir seis unidades mistas de saúde. A tuberculose (TB) é um grave problema de saúde pública no Brasil. Em Duque de Caxias o Programa de Controle de Tuberculose necessitava ampliação e descentralização para o maior acesso à população. Objetivo: Este estudo teve como objetivo avaliar o impacto da gestão de uma OSCIP em seis unidades de saúde do município de Duque de Caxias, Estado do Rio de Janeiro, tendo como base os resultados alcançados no Programa de Controle da Tuberculose (PCT). Metodologia: Realizou-se uma pesquisa quantitativa, descritiva, de evolução temporal dos indicadores do PCT, com base em dados secundários gerados através do banco de dados do SINAN/DC, assim como a análise documental do Livro de Registros das Baciloscopias e Culturas do PCT. Levantamento na literatura sobre o tema. Também através de pesquisa eletrônica pela internet realizou-se um levantamento na literatura sobre o tema. Resultado e Discussão: A parceria com a OSCIP possibilitou a descentralização do Programa de Controle da Tuberculose para os quatro distritos do município. Na análise dos indicadores observou-se melhor desempenho das unidades de saúde sob a gerência da OSCIP em alguns indicadores de processo, como realização do exame anti-HIV e percentual de baciloscopias realizadas. Quanto aos indicadores de resultado, em ambos os tipos de gerência, observou-se baixa atuação no alcance das metas nacionais. Conclusão: Apesar das limitações metodológicas, como o curto período de tempo da análise dos indicadores, a utilização de dados secundários (SINAN), o presente estudo permitiu um olhar inicial das vantagens, desvantagens e limitações da parceria com uma OSCIP no serviço público. Serão necessários novos estudos com período maior de tempo além da inclusão de outros indicadores

This paper seeks to investigate the bases for resistance to arbitration in general -and investor arbitration in particular- focusing on the way in which arbitral tribunals deal with notions of public interest and the public good. The paper hypothesises that while courts have within their terms of reference the capacity to consider notions of public interest, arbitral tribunals do not. It is this core difference in the scope of decision making between the two bodies that could render privately organised dispute resolution unsuitable for disputes that have public aspects, like investor-state disputes. The paper discusses the meaning of public interest and the public good as found in the literature. It then proceeds to consider how tribunals in the investment field have dealt with these concepts. This leads to a conclusion urging not abandonment of arbitration as a component of dispute resolution, but caution. It is argued that unchecked growth in private dispute resolution can threaten perceptions of legitimacy and democratic accountability. The paper adopts a socio-legal methodology in considering the effect of legal mechanisms on social and political phenomena. It is also informed by a law and economics methodology in addressing impacts of dispute resolution mechanisms on economic efficiency. The contribution of the paper rests on theorising motivations for resistance to private dispute resolution, a topical issue in light of the TTIP debate.

Campaigns raise public interest in politics and allow parties to convey their messages to voters. However, voters' exposure and attention during campaigns are biased towards parties and candidates they like. This hinders parties' ability to reach new voters. This paper theorises and empirically tests a simple way in which parties can break partisan selective attention: owning an issue. When parties own issues that are important for a voter, that voter is more likely to notice them. Using survey data collected prior to the 2009 Belgian regional elections it is shown that this effect exists independent of partisan preferences and while controlling for the absolute visibility of a party in the media. This indicates that issue ownership has an independent impact on voters' attention to campaigns. This finding shows that owning salient issues yields (potential) advantages for parties, since getting noticed is a prerequisite for conveying electoral messages and increasing electoral success.

The NeO'liberal State and the Crisis ofPublic Service Broadcasting in the Anglo-American Democracies The purpose ofthis analysis ofthe present condition ofpublic service broadcasting in the Anglo- American democracies was to investigate whether such media can still be regarded as the primarypublic spherefor a dialogue between each nation 's civil society and the State. The motivationfor this thesis was based on a presumption that such fora for public discussion on the central issues of each society have become viewed as less relevant bypoliticians andpolicy-makers and thepublics they were intended to serve in the Anglo-American democracies over thepast two decades. It is speculated that this is the case because ofa beliefthat the post-war consensus between the respective States andpublics that led to the construction of the Keynesian Welfare State and the notion ofpublic service broadcasting has been displaced by an individualistic, neo-liberal, laissez-faire ideology. In other words, broadcasting as a consumer-oriented, commercial commodity has superseded concerns pertaining to the importance ofthe public interest. The methodology employed in this thesis is a comparative analysisfrom a criticalpolitical economy perspective. It was considered appropriate to focus on the United Kingdom, Australia, Canada and the\ United States because they comprise the four largest Anglo-American nations with democratic political systems andprimarily market economies. Justificationfor this particular sample is reinforced by thefact that case study countries also share a common socio-political and economic tradition. The evidence assembledfor this thesis consisted almost exclusively ofexisting literature on the subjects ofpublic service broadcasting, global economic andpolitical integration, and the ascendance ofthe 'free-market ' ethos in Western democracies since the late mid- to late-1970s. In essence, this thesis could be considered as a reinterpretation ofthe existing literature relevant to these issues. Several important common features werefound among the political, economic and broadcasting systems of the four case study nations. It is proposed that the prevalence of the neo-liberal world view throughout the political and policy environments of the four countries has undermined the stability and credibility of each nation 's national public service broadcasting organization, although with varying intensity and effect,. Deregulation ofeach nation 's broadcasting system and the supremacy ofthe notion of 'consumer sovereignty' have marginalized the view of broadcasting on any basis other than strictly economic criteria in thefour case study countries. This thesis concludes that,for a reconstruction ofa trulyparticipatory anddemocraticpublicsphere to be realized in the present as well as thefuture, a reassessment ofthe conventional concept ofthe 'public sphere ' is necessary. Therefore, it is recommended that thefocus ofpolicy-makers in each Anglo-American democracy be redirectedfrom that which conceived ofan all-encompassing, large, state-ownedand operated public broadcasting service toward a view which considers alternativeforms ofpublic communication, such as local community and ethnic broadcasting operations, that are likely to be more responsive to the needs of the increasingly diverse and heterogeneous populations that comprise the modem Anglo-American democracies. The traditional conception of public broadcasters must change in accordance with its contemporary environment if the fundamental principles of the public sphere and public service broadcasting are to be realized.

This paper examines the case of a controversial beer advertisement which was promulgated in Bulgaria in 2001, and which provoked eight lawsuits against the brewery, its advertising agency, and the Bulgarian National Television. The case set a precedent in Bulgaria and generated considerable public interest and debate. To the best of the authors’ knowledge this is the first case in Eastern Europe when individuals have challenged companies in the courts of law because of offence caused by an advertisement. The present study discusses how the public bodies responsible for protecting consumer interests and the courts of first instance assessed the advertisement in the context of Bulgarian public policy regarding offensive advertising.

How is the notion of public interest operationalised in the regulatory practices of the International Public Sector Accounting Standards Board (IPSASB)? A fundamental objective in setting international accounting standards for both the private and public sector is to serve the ‘public interest’. Who or what constitutes ‘public interest’ however remains a highly complex and controversial issue. Private sector financial reporting research posits that users (of financial information) are used as a proxy for the ‘public’ and users are further refined to current and potential investors - a small proportion of the public. The debates surrounding public interest are even more contentious in public sector financial reporting which deals with ‘public’ (tax payers’) money. In our study we use Bourdieu’s notion of semi-homogenous fields to show how autonomous and heteronomous pressures from the epistemic community of the accounting profession and political/government interests compete for the right to define the public interest and determine how (by what accounting solutions) this interest is best served. This is a theoretical study grounded in the analysis of empirical data from interviews with the board members of the IPSASB. The main contribution of the paper is to further our understanding of the perceptions of the main decision makers from the ‘inner regulatory circle’ with regards to the problematic construct of public interest. The main findings suggest a paternal and un-reflexive attitude of the board members leading to the conclusion that the public have no real voice in these matters.

Nós analisamos o efeito da emenda constitucional 72/13 no Brasil, que igualou direitos trabalhistas de empregadas domésticas a aqueles de outros empregados. Mostramos que, após a legislação, uma considerável cobertura midiática e um interesse público intensificado aumentou o conhecimento geral de direitos trabalhistas de empregadas domésticas. Como consequência, o não-seguimento de legislações trabalhistas no setor de serviços domésticos ficou mais difícil. Ao mesmo tempo, a necessidade de regulamentar adicionalmente a emenda fez com que custos trabalhistas ficassem praticamente inalterados. Usando uma abordagem de diferença-em-diferenças que compara ocupações selecionadas ao longo do tempo, mostramos que a emenda -- e a discussão que ela causou -- levou a um aumento na formalização e nos salários de empregados domésticos. Então, usando a heterogeneidade do impacto da emenda em grupos demográficos, nossos resultados mostram que emprego doméstico foi reduzido e que mulheres pouco qualificadas saíram força de trabalho e foram para empregos de menor qualidade. Testes de placebo e análises de robustez indicam que nossos resultados não são explicados por diversas interpretações alternativas.

La medicina y la ingeniería del siglo XXI han dado como fruto numerosos avances para la sociedad aunque en la mayoría de los casos los tratamientos suelen ser costosos e invasivos. La educación que recibe la sociedad sobre la salud es escasa, ya que sólo vamos al médico cuando realmente estamos enfermos. Este trabajo presenta nuestra apuesta por las terapias complementarias, para el desarrollo de una metodología terapéutica no invasiva y con un costo muy bajo. La finalidad de esta Tesis, que se enmarca en un equipo multidisciplinar, fruto de la estrecha colaboración en el que participan psicopedagogos, ingenieros y médicos, es perfilar una metodología que luego pueda ser aplicable a patologías neurológicas. Aquí, dejamos sentadas las bases. Faltarán nuevos investigadores que continúen este camino para tener una base de datos lo suficientemente extensa de registros de sujetos que hayan sido sometidos a terapia binaural, para poder sacar unas conclusiones sólidas. La aportación de esta Tesis deja cubierta la aplicación, selección, procesado de señal y desarrollo de algoritmos, test cognitivos indicados para el caso específico que nos ocupa, cálculo de incertidumbre del sistema utilizado para la aplicación del estímulo y desarrollo de un test psicoacústico específico. EL empleo del sonido en medicina como es la musicoterapia o sonoterapia ha experimentado una gran difusión en los últimos años, más de 100.000 nuevas citas bibliográficas han aparecido con respecto al año anterior. Sin embargo, son escasísimas las que hacen referencia a las características físico acústicas del sonido empleado, tan sólo hemos encontrado una par de ellas que correlacionan las características físicas del sonido con el tipo de respuesta terapéutica. No encontramos citas bibliográficas específicas que planteen un modelo experimental científico capaz de reproducir las mismas respuestas ante los mismos parámetros y estímulos. En esta Tesis proponemos el uso de estimulación sonora binaural, que consiste en la utilización de dos tonos puros idénticos pero ligeramente diferentes en frecuencia que se presentan de manera separada cada uno en un oído, como consecuencia, la persona que recibe la estimulación percibe un tercer tono, llamado tono binaural, formado por la diferencia de frecuencia de ambos variando su amplitud. Existen estudios que sugieren que dichas frecuencias binaurales pueden modificar los patrones eléctricos de la actividad cerebral y los niveles de arousal, conociéndose en la literatura bajo el nombre de “entrainment”. Tras la revisión bibliográfica del estado del arte, podemos concluir que es necesario el desarrollo de estudios doble ciego bien diseñados, con el objetivo de establecer una base sólida sobre los efectos de este tipo de estimulación, ya que la mayoría de los beneficios documentados se refieren a muestras muy pequeñas y con poco rigor científico, siendo los resultados positivos obtenidos debidos al efecto placebo. La tecnología binaural es barata siendo cualquier avance en esta dirección de interés público. El objetivo concreto de la investigación es estudiar el potencial de las ondas binaurales en un área en particular: tareas que requieren atención y concentración. Se busca obtener cualquier cambio en las ondas cerebrales que se puedan correlar con la mejoras. A la vista de los resultados de estas investigaciones se intentará aplicar esta metodología en neuropatologías que presenten alguna deficiencia en el área de atención como es el Trastorno de espectro Autista. En esta Tesis presentamos los resultados de dos estudios independientes, el primero para sentar las bases del método (tiempos, diseño de estimulaciones, procesado) en una muestra de 78 adultos sanos, el segundo a partir de los resultados obtenidos en el primero, afinando la metodología y para un grupo de 20 niños entre 8 y 12 años, los resultados del segundo estudio sirven para justificar su aplicación en niños con TEA que presenten déficit de atención. ABSTRACT Medicine and engineering in the 21st century have resulted in advances for society but in most cases the treatments are often costly and invasive. The health education society receive is scarce, since only go to the doctor when we are really sick. With this work I present my commitment to complementary therapies, my little grain of sand in the development of a noninvasive therapeutic approach and very low cost, well and can be used in a preventive manner resulting in a society with less sick. The purpose of this thesis is to outline a methodology that can then be applied to neurological diseases, here we lay the groundwork. New researchers are needed to continue this path for a sufficiently extensive records database of subjects who have undergone binaural therapy, and so to draw firm conclusions. The contribution of this thesis includes: the application, selection, signal processing and algorithm development, indicated cognitive tests for the specific case at hand, calculation of system uncertainty of the system and development of a specific psychoacoustic test. The use of sound in medicine, such as music therapy or sound therapy has experienced a great diffusion in recent years, more than 100,000 new citations have appeared over the previous year but very few are those referring to acoustic physical characteristics of sound employee, we have only found a couple of them that physical sound characteristics are correlated with the therapeutic response. We found no specific citations posing a scientific experimental model capable of reproducing the same answers to the same parameters and stimuli. In this thesis we propose the use of binaural sound stimulation which involves the use of two identical but slightly different in frequency pure tones presented separately each in one ear, as a result the subject perceives a third tone, called binaural tone, formed by the difference in frequency with amplitude variations Studies suggest that these binaural frequencies can modify the electrical patterns of brain activity and arousal levels, being known in the literature under the name of “entrainment”. After the literature review of the state of the art, we conclude, it is necessary to develop well-designed double-blind studies, in order to establish a solid foundation on the effects of such stimulation, since most of the documented benefits relate to very small samples and unscientific may be obtained positive results due to the placebo effect. The binaural technology is cheap being any progress in this direction in the public interest. The specific objective of the research is to study the potential of binaural waves in a particular area: tasks requiring attention and concentration also we want to get any change in brain waves that can correlate with improvements. In view of the results of this research we seek to apply this methodology in neuropathology presenting any deficiency in the area of attention such as Autism Spectrum Disorder. In this thesis we present the results of two independent studies, the first to lay the foundation of the method (times, stimulation design, processing) in a sample of 78 healthy adults, the second from the results obtained in the first, refine the methodology for a group of 20 children between 8 and 12 years, the results of the second study used to justify its use in children with ASD that present attention deficit.

A tanulmány a Public-Private Partnership (PPP) immanens logikai kihívásai közül két kiemelt kérdést elemez: az állami fél közszolgálati-közigazgatási beágyazottságából eredő dilemmákat, valamint az állami és a magánfél eltérő kulturális hátteréből eredő feszültségek jellemzőit. A PPP projektek gyakorlati megvalósítása szempontjából e két kardinális kérdés kifinomult elméleti hátterébe nyújt bepillantást. A közszolgáltatási dilemmák közül azonosítja és tárgyalja a jogszerűség vs. eredményesség, a hatékonyság vs. eredményesség, a centralizáció vs. decentralizáció, a közérdek vs. egyéni szabadságjogok védelme, valamint a kormányzat kicsinyítése vs. jogbiztonság védelme, és a vállalkozói szemlélet vs. közszolgálatiság közti egyensúlyozás kihívásait. Az állami és az üzleti fél kulturális különbözőségének központi motívumaként a döntéshozatalbeli különbséget ragadja meg, és a bizalom szerepét hangsúlyozza a működőképes modell megtalálásának lehetőségeként. = This study analyses two cardinal issues of Public-Private Partnership (PPP) projects’ immanent challenges: the management dilemmas of public services/governance, and the tensions between the private and public parties due to their different cultural imbeddedness. It provides theoretical insights into these two issues of practical relevance. As public service management dilemmas, it identifies the trade-offs between rights vs. effectiveness, efficiency vs. effectiveness, centralization vs. decentralization, protecting the public interest vs. individual freedom, minimizing government vs. protecting human rights, the entrepreneurial approach vs. public service ethos. The study captures the cultural difference between the public and the private parties in their different approaches to decision making, while it concludes that the role of trust is key in finding feasible solutions for PPP models.

The flux of foreign investment into the water industry led to the internationalisation of contracts and of the method of settlement of possible disputes. When disputes over the performance of a water concession give origin to investor-state arbitrations, public authorities are put in a challenging position. The state need to combine two different roles – its role in the provision of services of public interest and the fulfilment of its international legal obligations arising from international investment agreements. The complexity of this relationship is patent in a variety of procedural and substantive issues that have been surfacing in arbitration proceedings conducted before the International Centre for Settlement of Investment Disputes. The purpose of this dissertation is to discuss the impact of investment arbitration on the protection of public interests associated with water services. In deciding these cases arbitrators are contributing significantly in shaping the contours and substance of an emerging international economic water services regime. Through the looking glass of arbitration awards one can realise the substantial consequences that the international investment regime has been producing on water markets and how significantly it has been impacting the public interests associated with water services. Due consideration of the public interests in water concession disputes requires concerted action in two different domains: changing the investment arbitration mechanism, by promoting the transparency of proceedings and the participation of non-parties; and changing the regulatory framework that underpins investments in water services. Combined, these improvements are likely to infuse public interests into water concession arbitrations.

Major infrastructure assets are often governed by a mix of public and private organizations, each fulfilling a specific and separate role i.e. policy, ownership, operation or maintenance. This mix of entities is a legacy of Public Choice Theory influenced NPM reforms of the late 20th century. The privatization of the public sector has resulted in agency theory based ‘self-interest’ relationships and governance arrangements for major infrastructure assets which emphasize economic efficiency but which do not do not advance non-economic public values and the collective Public Interest. The community is now requiring that governments fulfill their stewardship role of also satisfying non-economic public values such as sustainability and intergenerational responsibility. In the 21st century governance arrangements which minimize individual self-interest alone and look to also pursue the interests of other stakeholders have emerged. Relational contracts, Public-Private Partnerships (PPP’s) and hybrid mixes of organizations from the state, market and network modes (Keast et al 2006) provide options for governance which better meet the interests of contractors, government and the community there is emerging a body of research which extends the consideration of the immediate governance configuration to the metagovernance environment constituted by hierarchy, regulation, industry standards, trust, culture and values. Stewardship theory has reemerged as a valuable aid in the understanding of the features of governance configurations which establish relationships between principal and agent which maximize the agent acting in the interests of the principal, even to the detriment of the agent. This body of literature suggests that an improved stewardship outcome from infrastructure governance configurations can be achieved by the application of the emerging options as to the immediate governance configuration, and the surrounding metagovernance environment. Stewardship theory provides a framework for the design of the relationships within that total governance environment, focusing on the achievement of a better, complete stewardship outcome. This paper explores the directions future research might take in seeking to improve the understanding of the design of the governance of major, critical infrastructure assets.

Media organizations are simultaneously key elements of an effective democracy and, for the most part, commercial entities seeking success in the market. They play an essential role in the formation of public opinion and the influence on personal choices. Yet most of them are commercial enterprises seeking readers or viewers, advertising, favorable regulatory decisions for their media, and other assets. This creates some intrinsic difficulties and produces some sharp tensions within media ethics. In this article, we examine such tensions—in theory and practice. We then consider the feasibility of introducing an ethics regime to the media industry—a regime that would be effective in a deregulated environment in protecting public interest and social responsibility. In the article, we also outline a rationale and a methodology for the institutionalization of an acceptable and workable media ethics regime that aims to protect the integrity of the industry in a future of undoubtedly increasing commercial pressure.

Journalism has achieved a crucial importance as a social institution linked with the notion of the public interest. It is still doing so but is nevertheless increasingly challenged by getting networked with the interested publics. This becomes more apparent in times when the media repertoires and audiences as such are changing, when the public relies on more than one news source for the transmission and formulation of world events, but when the importance of TV news nevertheless remains relatively stable. Against this backdrop we may ask what publics contribute to or take away from the new plethora of images and stories saturating the media? This article gives an approximate answer by drawing on a comparative analysis of the present-day presentations of violence on British, German, and Russian television news. Violence in the media is not a new phenomenon, as age-old literary masterpieces like Homer’s Odyssey show, but it is still a very popular one, especially in the news. This article highlights trans-national and national elements in the reporting of violence in three different news cultures. At first glance, both the substantial cross-national violence news flow and the cross-national visual violence flow (key visuals) may be interpreted as distinctly trans-national elements. Event-related textual analysis, however, reveals how the historical rootedness of nations and their specific symbols of power are still very much manifested in respective television mediations of violence. In conclusion, this study recommends the pursuit of conscientious comparisons in journalist research and practice in order to understand what violence news convey in the different arenas of present-day newsmaking.

This paper argues that the increasing visibility of Indigenous families in the mainstream Australian media over the past ten years has produced new opportunities for addressing national injustices of the Stolen Generations. It shows how, as certain celebrities like Ernie Dingo, Nova Peris and Cathy Freeman, have become popular household names, a concurrent public interest in their family backgrounds has grown. Descriptive accounts of relationships and shared histories – propelled by the expansion of the lifestyle television genre in this context – has enabled some stories of the ‘Stolen Generations’ to be seen as ‘ordinary’, and part of a broader sense of everyday Australian life for the first time. With the aid of recent sexual citizenship research, the article illustrates that such middle-class representations give voice to new embodiments of citizenship in the post-apology era, making Indigenous justice more subjectively interconnected with life in the white Australian public sphere.
