A presente dissertação trata do direito de preferência para a celebração de negócios jurídicos, em geral translatícios de propriedade, que não encontra definição expressa no Código Civil, muito embora diversos dispositivos legais aludam ao referido direito. Na medida em que limita a liberdade contratual do vinculado à prelação, no tocante à escolha do outro contraente, a preferência, de origem legal ou negocial, atribui ao sujeito ativo da relação prelatícia o direito de ser preferido. Para tal, exige-se que o vinculado à preferência tenha decidido, de maneira livre e inequívoca, celebrar um contrato preferível, e que a sua intenção se tenha materializado, com a presença de um terceiro efetivamente interessado em com ele contratar. Constituído o direito do preferente, o que em geral chega a seu conhecimento por meio de notificação extrajudicial remetida pelo obrigado à prelação, pode aquele manifestar interesse em preferir, ou não. No primeiro caso, nasce na esfera jurídica do vinculado à prelação o dever de com ele contratar, nos mesmos termos e condições ajustados com terceiro. Dever este cuja violação, a depender da eficácia, real ou obrigacional, da preferência, possibilitará ao sujeito ativo perseguir não só as perdas e danos por ele eventualmente sofridas em decorrência do desrespeito a seu direito, como também, cumulativamente, lhe facultará exigir o cumprimento específico da obrigação. Neste último caso, o negócio jurídico celebrado entre o obrigado à preferência e terceiro será, perante o preferente, inoponível.

The biography of Charles Bradford Hudson that follows this preface had its seeds about 1965 when I (VGS) was casually examining the extensive files of original illustrations of fishes stored in the Division of Fishes, National Museum of Natural History, Smithsonian Institution. I happened upon the unpublished illustration of a rainbow trout by Hudson and was greatly impressed with its quality. The thought occurred to me then that the artist must have gone on to do more than just illustrate fishes. During the next 20 years I occasionally pawed through those files, which contained the work of numerous artists, who had worked from 1838 to the present. In 1985, I happened to discuss the files with my supervisor, who urged me to produce a museum exhibit of original fish illustrations. This I did, selecting 200 of the illustrations representing 21 artists, including, of course, Hudson. As part of the text for the exhibit, Drawn from the Sea, Art in the Service of Ichthyology, I prepared short biographies of each of the artists. The exhibit, with an available poster, was shown in the Museum for six months, and a reduced version was exhibited in U.S. and Canadian museums during the next 3 years.

Bycatch can harm marine ecosystems, reduce biodiversity, lead to injury or mortality of protected species, and have severe economic implications for fisheries. On 12 January 2007, President George W. Bush signed the Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2006 (MSRA). The MSRA required the U.S. Secretary of Commerce (Secretary) to establish a Bycatch Reduction Engineering Program (BREP) to develop technological devices and other conservation engineering changes designed to minimize bycatch, seabird interactions, bycatch mortality, and post-release mortality in Federally managed fisheries. The MSRA also required the Secretary to identify nations whose vessels are engaged in the bycatch of protected living marine resources (PLMR’s) under specified circumstances and to certify that these nations have 1) adopted regulatory programs for PLMR’s that are comparable to U.S. programs, taking into account different conditions, and 2) established management plans for PLMR’s that assist in the collection of data to support assessments and conservation of these resources. If a nation fails to take sufficient corrective action and does not receive a positive certification, fishing products from that country may be subject to import prohibitions into the United States. The BREP has made significant progress to develop technological devices and other conservation engineering designed to minimize bycatch, including improvements to bycatch reduction devices and turtle excluder devices in Atlantic and Gulf of Mexico trawl fisheries, gillnets in Northeast fisheries, and trawls in Alaska and Pacific Northwest fisheries. In addition, the international provisions of the MSRA have provided an innovative tool through which the United States can address bycatch by foreign nations. However, the inability of the National Marine Fisheries Service to identify nations whose vessels are engaged in the bycatch of PLMR’s to date will require the development of additional approaches to meet this mandate.

The paper reviews the provisions of the White Book on National Security of the Republic of Poland. It states that the issue of health security is not given adequate significance there. The accessibility of health services is considered, in general, solely in terms of their availability. The assumptions concerning the concept of providing the number of beds required in a state of threat to national security and in time of war do not take into account the current socio-economic conditions and need to be reviewed. The conclusions emphasize the dilemmas that emerge as a result of the unilateral promotion of a single category of national security, that is military security, in the context of ensuring health security.
