Dans le présent mémoire, je revisite l’oeuvre de Foucault à la lumière des analyses qu’il offre entre 1981 et 1984 dans ses derniers cours au Collège de France. À l’encontre de l’avis qui voit une rupture dans la pensée foucaldienne – opinion justifiée par la transition radicale qu’opère Foucault depuis l’étude de la relation entre pouvoir et savoir à l’analyse des techniques de subjectivation dans l’Antiquité – j’illustre qu’il y a continuité et complémentarité entre ses analyses des années 1970 et ses démonstrations des années 1980. Foucault trouve, au fondement de la pratique politique gréco-romaine, une éthique définie comme travail de soi sur soi. Aussi tente-t il, au travers de ses dernières analyses, de réactualiser l’askêsis comme fondement oublié de l’éthique, et l’êthos comme condition d’efficacité de la politique. Si, jusqu’en 1980, Foucault s’intéresse aux mécanismes et aux dispositifs permettant le gouvernement de la population, à partir de 1980, c’est la question du gouvernement de soi comme condition nécessaire du gouvernement des autres qui investit ses analyses. L’objectif de ce mémoire est d’illustrer, à partir de la redéfinition foucaldienne de l’éthique, la présence d’une nouvelle théorie de la résistance dans ses derniers cours au Collège de France. Par voie de conséquence, je propose implicitement des éclaircissements sur la fonction qu’occupent L’Usage des plaisirs et le Souci de soi, ultimes publications de l’auteur, au sein de son oeuvre.

Ce mémoire se concentre sur le problème de la régression épistémique. Il s’agit d’un problème très important puisqu’il remet en question la possibilité de la justification. Nous nous intéresserons aux détails de ce problème, ainsi qu’aux réponses qui lui sont offertes. Traditionnellement, deux réponses sont concurrentes : le fondationnalisme et le cohérentisme. La première propose d’arrêter la régression à un fondement, alors que la seconde propose de s’intéresser à la cohérence partagée par les croyances. Toutefois, le but de notre mémoire est de présenter et de défendre une troisième solution : l’infinitisme. Introduite dans les années 1990 par Peter Klein, l’infinitisme est une des plus récentes théories de la justification et, malgré son intérêt, elle est encore très peu défendue. Cette théorie propose de résoudre le problème de la régression en basant la justification des croyances sur des séries infinies et non répétitives de raisons. Cette idée est intéressante, car l’infinitisme renverse le problème d’origine, puisque les régressions infinies sont généralement perçues comme étant un problème pour la connaissance et la source du scepticisme. Notre objectif est de montrer que l’infinitisme est la meilleure solution possible au problème de la régression. Pour ce faire, nous faisons la synthèse des principaux arguments pour l’infinitisme. Cela nous permettra de distinguer trois types d’infinitisme pour ensuite retenir un de ces types, une forme impure d’infinitisme, comme étant le meilleur. Finalement, nous confronterons l’infinitisme à ces critiques pour montrer qu’il s’agit d’une théorie de la justification qui est réellement viable.

Prenant l’affaire Probo Koala en Côte d’Ivoire comme l’élément déclencheur d’une observation, ce mémoire étudie les fondements des mouvements transfrontières illégaux des déchets dangereux des pays développés vers les pays en développement. En effet, nonobstant la pluralité des dispositions juridiques internationales, le transfert des déchets illicites demeure une actualité dans les pays du tiers monde dont particulièrement ceux de l’Afrique noire et à la fois un tabou dans ceux du Nord et du Sud. Les deux domaines proposés, droit international et national, montrent comment les faiblesses et la non-application des dispositions juridiques conduisent à des actes socialement irresponsables. De ce fait, des réformes tant au niveau juridique que judiciaire ainsi que l’implication des parties prenantes sont suggérées comme solutions pour combattre ce fléau.

This article offers a theoretical interpretation of the dispositions on land restitution contained in the famous “Victims’ Bill”, which was debated in the Colombian Congress during the year 2008. The bill included specific mechanisms aimed at guaranteeing the restitution of land to victims of the Colombian armed conflict. At the time, the bill was endorsed by all the main political actors in the country –notably the government and the elites that support it, on the one hand, and victims’ and human rights organizations and other opposition groups, on the other–. The fact that the restitution of land to victims of the Colombian armed conflict was being considered as a serious possibility by all political actors in the country seemed to indicate the existence of a consensus among actors whose positions are ordinarily opposed, on an issue that has traditionally led to high levels of polarization. This consensus is quite puzzling, because it seems to be at odds with the interests and/or the conceptions of justice advocated by these political actors, and because the restitution of land faces enormous difficulties both from a factual and a normative point of view, which indicates that it may not necessarily be the best alternative for dealing with the issue of land distribution in Colombia. This article offers an interpretation of said consensus, arguing that it is only an apparent consensus in which the actors are actually misrepresenting their interests and conceptions of justice, while at the same time adopting divergent strategies of implementation aimed at fulfilling their true interests. Nevertheless, the article concludes that the common adherence by all actors to the principle of restorative justice might bring about its actual realization, and thus produce an outcome that, in spite (and perhaps even because) of being unintended, might substantively contribute to solving the problem of unequal land distribution in Colombia. Even though the article focuses in some detail on the specificities of the 2008 Bill, it attempts to make a general argument about the state of the discussion on how to deal with the issue of land distribution in the country. Consequently, it may still be relevant today, especially considering that a new Bill on land restitution is currently being discussed in Congress, which includes the same restitution goals as the Victims’ Bill and many of its procedural and substantive details, and which therefore seems to reflect a similar consensus to the one analyzed in the article.

Le cas que nous exposons ici est extrait d’un travail de recherche plus vaste ayant pour objet une analyse comparative de plusieurs institutions1 où vivent et se transmettent des savoirs sécuritaires propres à l’escalade. Notre étude met en face à face des institutions clairement identifiées comme didactiques - c’est le cas de l’école au sens large de l’acception - c’est-à-dire des institutions où l’intention de transmettre y est toujours mise en avant, mais aussi d’autres institutions «à la limite» du didactique telles les organismes de loisirs sportifs, ainsi que des institutions a priori non didactiques comme une famille ou un groupe d’amis, où le mode de transmission des savoirs relève majoritairement d’un système d’apprentissage par frayage (Delbos & Jorion, 1990), (Hutchins, 1995). Le sujet est abordé sous l’angle didactique de la gestion des risques (Mangeant, 2008). La recherche repose en partie sur la théorie des situations didactiques (Brousseau, 1998) et notamment la notion de contrat entendu comme une convention implicite, mais aussi pour nous dans notre sujet, comme accord explicite sur les règles de fonctionnement. Elle s’appuie également sur le modèle de l’action enseignante et le triplet des genèses (Sensevy, Mercier & Schubauer- Leoni, 2000) et plus précisément sur le principe de l’action conjointe du professeur et des élèves (Sensevy & Mercier, 2007). Le travail s’attache à démontrer que des phénomènes de contrat, peuvent être à l’origine de failles dans la sécurité, et potentiellement pourvoyeurs de futurs accidents. Ainsi, au-delà du manque de vigilance communément invoqué, il y aurait donc des causes didactiques à l’occurrence des accidents, dont les explications sont parfois à rechercher à l’origine dans la formation des intervenants ou dans le mode de transmission des savoirs

Twenty-five small soil-filled perspex boxes arranged in a square, with dwarf sunflowers growing in them, were used to study micro-scale advection. Hydrological heterogeneity was introduced by applying two different amounts of irrigation water (low-irrigation, L, versus high-irrigation, H). The nine central boxes (4 H, 4 L and I bare box) were precision weighing lysimeters, yielding diurnal measurements of evaporation. After the onset of soil water stress, a large difference in latent heat flux (up to 4-fold) was observed between the lysimeters of the H and L treatments, mainly caused by large differences between H and L stomatal conductance values. This resulted in micro-advection, causing H soil-sunflower systems to evaporate well above equilibrium latent heat flux. The occurrence of micro-advective enhancement was reflected in large values of the Priestley-Taylor constant (often larger than 2.0) and generally negative values of sensible heat flux for the H treatment. Indicators are commonly recommended as tools for assessing the attainment of development, and the current vogue is for aggregating a number of indicators together into a single index. It is claimed that such indices of development help facilitate maximum impact in policy terms by appealing to those who may not necessarily have technical expertise in data collection, analysis and interpretation. In order to help counter criticisms of over-simplification, those advocating such indices also suggest that the raw data be provided so as to allow disaggregation into component parts and hence facilitate a more subtle interpretation if a reader so desires. This paper examines the problems involved with interpreting indices of development by focusing on the United Nations Development Programmes (UNDP) Human Development Index (HDI) published each year in the Human Development Reports (HDRs). The HDI was intended to provide an alternative to the more economic based indices, such as GDP, commonly used within neo-liberal development agendas. The paper explores the use of the HDI as a gauge of human development by making comparisons between two major political and economic communities in Africa (ECOWAS and SADC). While the HDI did help highlight important changes in human development as expressed by the HDI over 10 years, it is concluded that the HDI and its components are difficult to interpret as methodologies have changed significantly and the 'averaging' nature of the HDI could hide information unless care is taken. The paper discusses the applicability of alternative models to the HDI such as the more neo-populist centred methods commonly advocated for indicators of sustainable development. Generally poor productivity, delays, low profitability and exceeded budgets are Common problems in modern construction management, however it seems that a basic obstacle lies far deeper in the understanding of a firm's fundamental mission, its existence. The main objective of this paper therefore is to examine the operational living of a construction firm and by doing that to reveal the key problem or the solution for a construction firm - its organization. A firm as a social system in which interactions between its constitutive components (employees) are surordinated to its maintenance (keeping a system alive) is an autopoietic social system. Two domains of external perturbations are uncovered to which a construction firm has to adapt (market driven and project driven perturbations). Constructed conceptual model of an autopoietic organization is based upon two necessary and sufficient operational domains that a firm has to create in order to become an autopoietic, adaptive social system. The first one is a domain of interactions between employees and other operationally external systems, which is representing an idea-generating domain of interactions. The second is employee's autonomous operational domain, which embodies employee's autonomy and individuality and represents a necessary condition for the establishment of an idea-generating domain. Finally, it is recognized that interactions within these four domains keep a construction firm alive.

Foot and mouth disease (FMD) is a major threat, not only to countries whose economies rely on agricultural exports, but also to industrialised countries that maintain a healthy domestic livestock industry by eliminating major infectious diseases from their livestock populations. Traditional methods of controlling diseases such as FMD require the rapid detection and slaughter of infected animals, and any susceptible animals with which they may have been in contact, either directly or indirectly. During the 2001 epidemic of FMD in the United Kingdom (UK), this approach was supplemented by a culling policy driven by unvalidated predictive models. The epidemic and its control resulted in the death of approximately ten million animals, public disgust with the magnitude of the slaughter, and political resolve to adopt alternative options, notably including vaccination, to control any future epidemics. The UK experience provides a salutary warning of how models can be abused in the interests of scientific opportunism.
