Comme le déplorent les critiques de l’activisme judiciaire, la Constitution canadienne (y compris sa Charte) donne aux juges le pouvoir d’intervenir en matière de politique publique, un pouvoir qu’ils semblent avoir réussi à élargir de divers moyens. Ils sont donc capables de corriger les défauts d’une politique qui enfreint les droits des requérants et de réparer les torts qu’ils ont encourus. Cet exercice présente cependant plusieurs écueils, souvent graves, du point de vue des requérants et de celui des juges. L’examen des arrêts Wynberg concernant la politique ontarienne de l’IEIP envers les enfants ayant des troubles du spectre autistique illustre certaines de ces difficultés. Ces décisions et celle d’Auton de la Cour suprême du Canada suggèrent que les politiques publiques défectueuses d’une nature complexe et scientifique et dont la responsabilité institutionnelle n’est pas clairement définie n’ont aucune assurance d’être redressées par un recours aux tribunaux.

The intelligibility of historical justice is linked to matters of agency and causation. This article presents an account of historical justice limited to transgenerational collective agents which is immune to the agency and causation problems affecting traditional theories of diachronic justice. The novel theory is applied to the case of African Americans, to whom no reparations for past wrongs have been made up to now. When conceived as a transgenerational collective agent – i.e. as a nation–, the African Americans are shown to be owed reparations by the American polity. These reparations are deemed necessary to the goal of reconciliation and to the establishment of relations of mutual respect, which are construed as preconditions to effective distributive justice, here and now.

Los países que salen de conflictos armados internos deben afrontar el reto de lograr el equilibrio entre los acuerdos para establecer la paz de un lado y la búsqueda de la justicia y la reconciliación de otro. En realidad, los procesos de justicia y reconciliación están bajo la influencia de numerosos factores entre los cuales se cuentan el impacto del conflicto, los recursos disponibles, el grado de voluntad política, la capacidad institucional, las normas legales, entre otros. En este contexto, la justicia transicional, la reparación, las reformas institucionales, la cooperación con la comunidad internacional y la búsqueda de una paz sostenible son temas importantes. Esta monografía se centra en el dilema entre el derecho de las víctimas a la justicia y el derecho a vivir en paz en un régimen democrático con base en el proceso que adelanta el Gobierno con grupos paramilitares.

Estado del arte que recopila pronunciamientos de diversos autores sobre el papel de la Organización de Naciones Unidas, específicamente la Misión MINUGUA, en el proceso de reconstrucción posconflicto en Guatemala comprendido entre el año 1994 y 2004. Se basa en algunas dimensiones de la democratización como son el Estado de Derecho, la democracia representativa, la preeminencia del poder civil, y el fortalecimiento de la cultura democrática. Así mismo, tiene en cuenta los elementos de la justicia transicional, a saber: verdad, justicia y reparación.

This article reviews the evidence collected by diverse national and international organizations regarding the relationship between sexual violence against women, forced displacement, and dispossession in the context of the Colombian armed conflict. To this end, it uses the concept of “sexual violence regimes” to highlight that the endspursued by sexual violence are not always exhausted by simple consummation (that is, the act of sexual violence itself), but depending on the context, can be connected with broader strategic goals of armed actors. At the same time, this document admits the difficulty of proving this relationship with respect to judicial procedures, and thus sets out the possibility of creating a rebuttable presumption, in the framework of “unconstitutional state of affairs” created by judgment T-025 of 2004, that alleviates the burden of proof of the victims, and serves as a catalyst to promote new genderbased mechanisms of reparations.

El objetivo de esta investigación es el de abordar los trabajos académicos, realizados en el periodo comprendido entre 2005 hasta 2011, a propósito de las reparaciones en el marco jurídico de la justicia transicional en Colombia, a saber; la Ley de Justicia y Paz 975 de 2005 y la Ley de Víctimas y Restitución de Tierras Ley 1448 de 2011. Este esfuerzo puso en evidencia que solo hasta la promulgación de una ley con contenido de justicia transicional, el ejercicio investigativo frente a las reparaciones logró un desarrollo y una continuidad. Para lograr dicho objetivo, fue necesaria la implementación de fichas de estudio de cada una de las publicaciones citadas a lo largo de la investigación, sumada a otras herramientas de análisis, que dieron como resultado la clasificación de las producciones académicas en tres grandes tendencias de estudio.

El presente estudio de caso pretende analizar los alcances de la cooperación internacional en materia de justicia transicional y construcción de paz tomando en consideración un proyecto de cooperación internacional emblemático denominado Fortalecimiento Institucional para la Atención a las Víctimas del Conflicto o FORVIC. Para conseguir esto, se analizarán primero los efectos generados por el Proyecto FORVIC en materia de fortalecimiento del Estado de Derecho y lucha contra la impunidad en Colombia, y a partir de los hallazgos se constituirán y se propondrán una serie de condiciones sobre las que puede pensarse la cooperación internacional como un instrumento genuino para la construcción de paz en Colombia.

Preface This study was prepared for the Government of Jamaica following the significant physical damage and economic losses that the country sustained as a result of flood rains associated with the development of Hurricane Michelle. The Planning Institute of Jamaica (PIOJ) submitted a request for assistance in undertaking a social, environmental and economic impact assessment to the Economic Commission for Latin America and the Caribbean (ECLAC) on 14 November 2001. ECLAC responded with haste and modified its work plan to accommodate the request. A request for training in the use of the ECLAC Methodology to be delivered to personnel in Jamaica was deferred until the first quarter of 2002, as it was impossible to mount such an initiative at such short notice. This appraisal considers the consequences of the three instances of heavy rainfall that brought on the severe flooding and loss of property and livelihoods. The study was prepared by three members of the ECLAC Natural Disaster Damage Assessment Team over a period of one week in order to comply with the request that it be presented to the Prime Minister on 3 December 2001. The team has endeavoured to complete a workload that would take two weeks with a team of 15 members working assiduously with data already prepared in preliminary form by the national emergency stakeholders. There is need for training in disaster assessment as evidenced by the data collected by the Jamaican officials engaged in the exercise. Their efforts in the future will be more focused and productive after they have received training in the use of the ECLAC Methodology. This study undertakes a sectoral analysis leading to an overall assessment of the damage. It appraises the macroeconomic and social effects and proposes some guidelines for action including mitigating actions subsequent to the devastation caused by the weather system. The team is grateful for the efforts of the Office of Disaster Preparedness and Emergency Management (ODPEM), the associated government ministries and agencies, the Statistical Institute of Jamaica (STATIN), the Planning Institute of Jamaica and the Inter American Development Bank (IDB) for assistance rendered to the team. Indeed, it is the recommendation of the team that STATIN is poised to play a pivotal role in any disaster damage assessment and should be taken on board in that regard. The direct and indirect damages have been assessed in accordance with the methodology developed by ECLAC (1). The results presented are based on the mission's estimates. The study incorporates the information made available to the team and evidence collected in interviews and visits to affected locations. It is estimated that the magnitude of the losses exceeds the country's capacity to address reparations and mitigation without serious dislocation of its development trajectory. The government may wish to approach the international community for assistance in this regard. This appraisal is therefore designed to provide the government and the international community with guidelines for setting national and regional priorities in rehabilitation and reconstruction or resettlement programmes. A purely economic conception of the problem would be limited. A more integrated approach would have a human face and consider the alleviation of human suffering in the affected areas while attending to the economic and fiscal fallout of the disaster. Questions of improved physical planning, watershed management, early warning, emergency response and structural preparedness for evacuation and sheltering the vulnerable population are seen as important considerations for the post disaster phase. Special attention and priority should be placed on including sustainability and increased governance criteria in making social and productive investments, and on allocating resources to the reinforcing and retrofitting of vulnerable infrastructure, basic lifelines and services as part of the reconstruction and rehabilitation strategy. The Jamaican society and government face the opportunity of undertaking action with the benefit of revised paradigms, embarking on institutional, legal and structural reforms to reduce economic, social and environmental vulnerability. The history of flood devastation in the very areas of Portland and St. Mary shows a recurrence of flooding. Accounts of flooding from the earliest recorded accounts pertaining to 1837 are available. Recurrences in 1937, 1940, 1943 and 2001 indicate an ever-present probability of recurrence of similar events. The Government may wish to consider the probable consequences of a part of its population living in flood plains and address its position vis-à¶is land use and the probability of yet another recurrence of flood rains. Periodontal disease progress by destructive acute phases intercalated by reparative chronic phases. The aim of this study was to investigate the clinical and histological evidence of the periodontal disease reparative phase by analyzing bone wall conditions inside periodontal pockets and histologic images of periodontal pockets, identified in relevant publications. 81 patients with periodontitis, were randomly assigned into this study. Clinical and radiographic parameters were established to diagnose periodontal disease providing a sample of 133 diseased areas, which were treated by modified Widman flap. Documentation by digital photography were recorded in the surgery. Relevant publications showing histological images of periodontal pockets, were identified in Medline, PubMed and Google data base, were scanned and digitalized. All images obtained were evaluated and the presences of the reparative evidence in the zone around the underlying destroyed alveolar bone were critically analyzed. All periodontal bone defects, showed cortical bone reparations at different levels inside periodontal bone defects. All histologic images of periodontal pockets identified in relevant publications showed repaired gingival-attached connective tissue localized above underlying destroyed alveolar bone. All the evidences analyzed in this study suggested that periodontal disease is predominantly chronic, quiescent, showing reparative phases in different levels.

Rotator cuff tears of the shoulder are a common cause of pain and disability. Although surgery is frequently beneficial, re-tearing of the tendons is likely to re-occur. In many cases even if the reparation is successful it will still generate discomfort, problems with mobility, as well as a sharp pain. This project is funded in the cooperation with the Hospital Clinico San Carlos de Madrid. The purpose of this work is to analyze the effect of the surgical repair and the application of different therapies, including mesenchymal stem cell therapy on the biomechanical properties (strength and stiffness) of the repaired tendon. An animal model of rotator cuff tendon reparations has been developed on laboratory rats.To obtain the mechanical response of the healthy and repaired tendons, it was necessary to develop an experimental set up to reproduce the in-vivo working conditions of the tendons (37 ºC, immersed in physiological serum), and especially the load transfer. The biomechanical properties (maximum load and stiffness) have been measured in healthy and repaired tendons. A total of 70 rats are used in this particular study. It has been found that the repaired tendon is stronger than the original on. However, the repaired tendons demonstrate less flexibility than the healthy (original) ones prior to the damage

The church is built on a claycy hillock on top of the village with vcry fort slopcs. The retaining walls Lhat surround the church havc sufTered movements. A soil sludy was done to know its propcrtics and the reason of the movement. Also, the structural roof is broken and it is not fixed to thc walls that can movc. Thc first phase is done, with a pavcd squa rc ovcr an ancient cemetery. The next phase is a new roof structure to support the lean walls. Al'ter that done, the repair inside can start.
