O presente trabalho analisa a atuao do Poder Jurisdicional ao abordar as questes concernentes aos grandes impactos socioambientais no Estado do Par, assim considerados aqueles que no apenas causam efeitos nocivos estritamente ecolgicos, mas tambm de carter social. A partir do estudo de casos emblemticos, escolhidos por representarem situaes de vis socioambiental, foi aferida a relao entre a atuao jurisdicional e o modelo de desenvolvimento econmico sediado na intensa explorao dos recursos naturais do Par, mas com sensveis seqelas ecolgicas e sociais. As concluses apontam que, na aferio dos casos emblemticos selecionados, os argumentos jurdicos vinculados s noes de desenvolvimento socioeconmico tm sido recepcionados com precedncia em relao proteção ambiental, na rbita dos tribunais, em que pese sejam muito bem definidos os marcos jurdicos de regulao das atividades humanas causadoras de grandes impactos ambientais.

As Unidades de Conservao so sub-divididas em duas categorias: Proteção Integral, com objetivos de manuteno do ecossistema livre da interferncia humana na qual permitido apenas o uso indireto; e de Desenvolvimento Sustentvel, que tem por objetivo equilibrar a conservao da natureza com o uso sustentvel dos recursos naturais. O Parque de Jacupiranga era localizado na regio sul do estado de So Paulo, denominada Vale do Ribeira, sendo criado em 1961 com aproximadamente 141 mil ha e cerca de 8 mil moradores presentes no seu interior, incluindo comunidades tradicionais, quilombolas, e agricultores migrantes de outros estados. O mosaico de Jacupiranga foi criado em 2008, com o objetivo de atender reivindicaes dos moradores que sofriam restries de suas atividades por estar dentro de uma unidade de conservao de proteção integral, com isso, o antigo PEJ sofreu a recategorizao, e foram criadas 3 unidades de proteção integral e 7 de uso sustentvel na antiga rea do parque. O objetivo foi analisar as mudanas socioeconmicas e ambientais das famlias que sofreram com a recategorizao do antigo Parque Estadual do Jacupiranga para a Reserva de Desenvolvimento Sustentvel (RDS) dos Quilombos de Barra do Turvo e a rea de Proteção Ambiental (APA) do Planalto do Turvo, Mosaico de Jacupiranga/SP, onde a legislao ambiental permite a presena de moradores bem como suas atividades de subsistncia. A coleta de dados foi feita pelo processo de entrevistas estruturadas realizadas com 12 moradores escolhidos por indicao dos prprios moradores das reas tanto da APA quando da RDS. Com isso, pode-se observar uma maior liberdade nas atividades de uso da terra praticadas pelos moradores, contudo, mesmo com a recategorizao, os investimentos pblicos locais no so suficientes para propiciar uma boa qualidade de vida para as famlias das reas analisadas

The work is to demonstrate the scope of modern-day major regulatory provisions and the policies implemented to adoption of biofuels in the national energy matrix. The adoption of biofuels as an alternative to fossil fuels, is based on the realization of the fundamental right to an ecologically balanced environment mitigating hazards and environmental hazards arising from a postmodern society. However, the change in the Brazilian energy matrix observe the precepts of certain environmental principles to essentially environmental preservation The proposed Environmental rule of law is founded on the realization of the right (duty) key to an ecologically balanced environment for sustainable development. Thus, it is up to the State, in addition to considering the dangers and risks fruits of government decisions, present the possible instruments to mitigate the irreversible environmental damage to the environment. The management of environmental risks present in the ideals of an Environmental rule of law, plays an important role in the preservation and economic development, using, therefore, of acautelatrios legal instruments, such as environmental licensing and the ecological-economic zoning, measures adopted in the light of the principles of precaution and preservation. The adoption of research in the environmental field, improvement and development of environmental technology, building a system to observe ecological changes, imposition of environmental policy objectives to be achieved in the medium and long term and systematization of organizations plan a protection policy environmental, are essential measures to control possible environmental risks and damage guided by the aforementioned environmental principles. Thus, it will be used the inductive method of approach, starting from the analysis of the new perspective of Environmental rule of law and the implementation of biofuels in the context of a post-modern society, marked by uncertainty and the risk of damage, from the study of the principles of caution, maintaining and cautionary measures in mitigating the hazards and potential risks.

A partir do levantamento dos valores recebidos pelos municpios situados na regio do Quadriltero Ferrfero, em Minas Gerais, em decorrncia do ICMS Ecolgico, repassado pelo Estado e da Compensao Financeira pela Explorao de Recursos Minerais (CFEM) recebida da Unio, este artigo relativiza o potencial do ICMS Ecolgico para incentivar os municpios mineradores a criarem ou apoiarem unidades de conservao (UCs) em seus territrios. Nesta discusso, trazem-se tona avaliaes tcnicas e acadmicas sobre a qualidade da proteção ambiental realizada nas UCs ali situadas e destacam-se os conflitos de interesses entre a minerao e a proteção ambiental na regio. Por fim, conclui ser necessrio aprimorar o ICMS Ecolgico em Minas Gerais e propem-se medidas para tornar a conservao ambiental mais interessante economicamente para os municpios.

Esta dissertao trata da avaliao de impacto ambiental e das suas relaes com o procedimento de licenciamento ambiental. Procura-se mostrar de que modo ambos manifestam-se metodolgica e procedimentalmente no processo histrico e so permeados pela poltica. Em primeiro lugar, so expostos e discutidos os fatos que cercaram a incluso da metodologia da avaliao de impacto ambiental no procedimento de licenciamento ambiental, no Brasil. Tambm a metodologia da avaliao de impacto ambiental e o atual procedimento de licenciamento ambiental brasileiro so detalhados e discutidos. Aps isso, estuda-se o caso do licenciamento ambiental do Complexo Terrestre Cyclone 4, que leva discusso acerca de como a legitimao de hierarquias que privilegiam o conhecimento cientfico e tecnolgico em relao aos saberes locais tem sido combatida e subvertida ou, por outro lado, tem prevalecido, nos procedimentos de licenciamento ambiental e nas avaliaes de impacto ambiental que ocorrem, presentemente, no Brasil

The aim of this study is to investigate the eco-environmental vulnerability, its changes, and its causes to develop a management system for application of eco-environmental vulnerability and risk assessment in the Apodi-Mossory estuary, Northeast Brazil. This analysis is focused on the interference of the landscape conditions, and its changes, due to the following factors: the oil and natural gas industry, tropical fruits industry, shrimp farms, marine salt industry, occupation of the sensitive areas; demand for land, vegetation degradation, siltation in rivers, severe flooding, sea level rise (SLR), coastal dynamics, low and flat topography, high ecological value and tourism in the region and the rapid growth of urbanization. Conventional and remote sensing data were analyzed using modeling techniques based on ArcGIS, ER-Mapper, ERDAS Imagine and ENVI software. Digital images were initially processed by Principal Component Analysis and transformation of the maximum fraction of noise, and then all bands were normalized to reduce errors caused by bands of different sizes. They were integrated in a Geographic Information System analysis to detect changes, to generate digital elevation models, geomorphic indices and other variables of the study area. A three band color combination of multispectral bands was used to monitor changes of land and vegetation cover from 1986 to 2009. This task also included the analysis of various secondary data, such as field data, socioeconomic data, environmental data and prospects growth. The main objective of this study was to improve our understanding of eco-environmental vulnerability and risk assessment; its causes basically show the intensity, its distribution and human-environment effect on the ecosystem, and identify the high and low sensitive areas and area of inundation due to future SLR, and the loss of land due to coastal erosion in the Apodi-Mossor estuary in order to establish a strategy for sustainable land use. The developed model includes some basic factors such as geology, geomorphology, soils, land use / land cover, vegetation cover, slope, topography and hydrology. The numerical results indicate that 9.86% of total study area was under very high vulnerability, 29.12% high vulnerability, 52.90% moderate vulnerability and 2.23% were in the category of very low vulnerability. The analysis indicates that 216.1 km and 362.8 km area flooded on 1m and 10m in sea levels respectively. The sectors most affected were residential, industrial and recreational areas, agricultural land, and ecosystems of high environmental sensitivity. The results showed that changes in eco-environmental vulnerability have a significant impact on the sustainable development of the RN state, since the indicator is a function of sensitivity, exposure and status in relation to a level of damage. The model were presented as a tool to assist in indexing vulnerability in order to optimize actions and assess the implications of decisions makers and policies regarding the management of coastal and estuarine areas. In this context aspects such as population growth, degradation of vegetation, land use / land cover, amount and type of industrialization, SLR and government policies for environmental protection were considered the main factors that affect the eco-environmental changes over the last three decades in the Apodi-Mossor estuary.
