El presente artículo presenta un análisis del régimen vigente en materia de la inversión privada extranjera, partiendo de las disposiciones pertinentes incorporadas en el código orgánico de la Producción, comercio e Inversiones (dic. 2010), cotejando las mismas frente a los preceptos establecidos por la constitución de la República del Ecuador relativos al sistema económico y otros ámbitos pertinentes. La evaluación se complementa contrastando las disposiciones legales de reciente vigencia, a los criterios de consistencia de los correspondientes lineamientos del esquema de planificación gubernamental y a varios principios del sistema de reglas internacionales sobre la inversión. Se aportan, finalmente, conclusiones sobre probables líneas de ajuste normativo futuras, resultantes de dicho proceso de comparación analítica.

An unlisted property fund is a private investment vehicle which aims to provide direct property total returns and may also employ financial leverage which will accentuate performance. They have become a far more prevalent institutional property investment conduit since the early 2000’s. Investors have been primarily attracted to them due to the ease of executing a property exposure, both domestically and internationally, and for their diversification benefits given the capital intensive nature of constructing a well diversified commercial property investment portfolio. However, despite their greater prominence there has been little academic research conducted on the performance and risks of unlisted property fund investments. This can be attributed to a paucity of available data and limited time series where it exists. In this study we have made use of a unique dataset of institutional UK unlisted non-listed property funds over the period 2003Q4 to 2011Q4, using a panel modelling framework in order to determine the key factors which impact on fund performance. The sample provided a rich set of unlisted property fund factors including market exposures, direct property characteristics and the level of financial leverage employed. The findings from the panel regression analysis show that a small number of variables are able to account for the performance of unlisted property funds. These variables should be considered by investors when assessing the risk and return of these vehicles. The impact of financial leverage upon the performance of these vehicles through the recent global financial crisis and subsequent UK commercial property market downturn was also studied. The findings indicate a significant asymmetric effect of employing debt finance within unlisted property funds.

Significant increases in direct private investment in developing countries in recent decades have also led to increased interest in political risk insurance. Of importance to transnational advocacy networks are the environmental and social impacts of guaranteeing loans for private sector projects in developing countries with weak or no social or environmental safeguards. This article examines how transnational advocacy networks have attempted to influence political risk insurers to become sustainable development guarantors through a case study of the World Bank Group’s Multilateral Investment Guarantee Agency (MIGA). Analyzing how advocacy networks influenced MIGA’s projects, policies, and accountability institutions enables greater understanding of how to ‘politicize finance.’ It also assesses the likelihood of shaping political risk insurance identities to become sustainable development guarantors. The outcomes of such an analysis however, question the extent to which politicizing finance necessarily leads to further greening of the international development lending process.

Corruption is a phenomenon that plagues many countries and, mostly, walks hand in hand with inefficient institutional structures, which reduce the effectiveness of public and private investment. In countries with widespread corruption, for each monetary unit invested, a sizable share is wasted, implying less investment. Corruption can also be a burden on a nation’s wealth and economic growth, by driving away new investment and creating uncertainties regarding private and social rights. Thus, corruption can affect not only factors productivity, but also their accumulation, with detrimental consequences on a society’s social development. This article aims to analyze and measure the influence of corruption on a country’s wealth. It is implicitly admitted that the degree of institutional development has an adverse effect on the productivity of production factors, which implies in reduced per capita income. It is assumed that the level of wealth and economic growth depends on domestic savings, foster technological progress and a proper educational system. Corruption, within this framework, is not unlike an additional cost, which stifles the “effectiveness” of the investment. This article first discusses the key theories evaluating corruption’s economic consequences. Later, it analyzes the relation between institutional development, factor productivity and per capita income, based on the neoclassical approach to economic growth. Finally, it brings some empirical evidence regarding the effects of corruption on factor productivity, in a sample of 81 countries studied in 1998. The chief conclusion is that corruption negatively affects the wealth of a nation by reducing capital productivity, or its effectiveness.

A situação atual dos sistemas de saneamento básico no Brasil, bem como o quadro regulatório e institucional do setor, são o resultado de conturbados antecedentes e de políticas descontínuas, determinadas por aspectos conjunturais e pela alternância entre momentos de maior e menor disponibilidade de recursos. A privatização e a concessão de serviços oferece perspectivas concretas de redefinição da trajetória de evolução do setor, com o estabelecimento de um padrão mais constante e regular de crescimento dos índices de cobertura e de modernização dos sistemas e das técnicas de gestão. A lógica do investimento privado implica na orientação pelo lucro e na configuração de estruturas de menor risco para os recursos comprometidos com o empreendimento. O project finance é uma técnica de financiamento que permite a repartição de riscos entre os participantes, reduzindo parcelas individuais e, conseqüentemente, agregando maior atratividade ao negócio. O presente estudo terá por objetivo analisar o setor de saneamento básico e o project finance, buscando identificar as possibilidades e os impactos presumíveis da introdução e difusão da técnica como alternativa de financiamento para o setor no Brasil.

O grau de influência política ao qual o judiciário está submetido tem profusas implicações sobre desenvolvimento econômico. Para que o compromisso de não expropriação pelo executivo seja crível, é necessário que o judiciário seja livre para intermediar imparcialmente as disputas entre o Estado e seus cidadãos. Se há muita influência política no judiciário, a credibilidade de tal comprometimento está maculada, o que desencoraja investimentos privados, assim prejudicando o crescimento econômico. No Brasil, uma peculiaridade institucional permite que seja feita uma comparação inédita na literatura. Como há duas cortes, o Supremo Tribunal Federal (STF) e o Superior Tribunal de Justiça (STJ), que versam sobre matérias similares e tem distintas restrições à indicação de seus membros, é possível comparar o grau de influência política ao qual elas estão submetidas. Desta forma, propõe-se testar: 1- se há efeito da indicação política nas decisões dos ministros das duas cortes; 2- se há diferenças do grau de influência política de acordo com as restrições à indicação presidencial de cada corte; 3- se os ministros de ambas as cortes fazem uso estratégico de seus cargos, ou seja, ativamente beneficia o partido que o indicou. Dos efeitos testados, encontra-se evidências do segundo e, parcialmente, do terceiro.

O tema central de pesquisa deste estudo é avaliar se a adoção de regras de proteção à novas cultivares de plantas e à modificação genética, impactou as estratégias adotadas pelas empresas nos segmentos de sementes de soja e milho do Brasil, quando comparadas às dos Estados Unidos. Os resultados dessa dupla comparação demonstraram que, no caso do milho híbrido, por contar com uma proteção natural, o estímulo aos investimentos privados ocorreram independentemente da existência de regras formais de apropriação. Essas regras foram essenciais para favorecer tais investimentos na soja, como se nota na transformação da indústria no Brasil após meados da década de 1990. Além disso, embora a modificação genética tenha ocorrido tanto em eventos com características agronômicas, os quais promovem como consequência o aumento de produtividade, quanto para a modificação qualitativa do produto, a demanda do produtor agrícola concentrou-se pelo primeiro tipo, cujo retorno é diretamente apropriado pelo agricultor. Verifica-se ainda, que a complexidade do processo de pesquisa e desenvolvimento e a necessidade de investimentos com altas características locacionais justificam o alto nível de consolidação global dos segmentos de sementes com os de biotecnologia e agroquímicos. Nesses segmentos, a possibilidade de apropriação sobre os direitos da inovação, mostra-se fundamental para motivar os investimentos privados.

This paper investigates the interaction between investment in education and in life-expanding investments, in a simple two-period model in which individuaIs are liquidity constrained in the first period. We show that under low leveIs of health and capital, investments in human capital and in health are complement: since the probability of survival is small, there is littIe incentive to invest in human capital; therefore the return on health investment is also low. This reinforcing effect does not hold for higher leveIs of health or capital, and the two investments become substitute. This property has many consequences. First, subsidizing health care may have dramatically different effects on private investment in human capital, depending on the initial leveI of health and capital. Second, the assumption that mortality is endogenous induces an increase in inequality of income: since health investment is a normal good, the return on education is also lower for poor individuaIs. Third,in a non-overlapping generation madel with non-altruistic agents, the hea1th leveI of the population has strong consequences on growth. For a very low leveI of hea1th, mortality is too high for the investment on education to be profitable. For a higher, but still low, levei of hea1th the economy grows on1y if the initial stock of capital is high enough; bad health and low capital create a poverty trapo Fourth, we compare redistributive income policies versus public hea1th measures. Redistributing income reduces both static and dynamic inequality, but slows growth. In contrast, a paternalistic health policy that forces the poor to invest in hea1th reduces dynamic inequality and may foster growth.

Defined as public space or space open of common use, the square is a fundamental space for the urban life. Its function depends so much of the historical context, as of its location in the city, but general way, it is associated to leisure activities. In spite of its importance, many Brazilian squares are abandoned and degraded, some are used improperly, other they never left the paper and they are wastelands, most of the time, transformed in garbage deposits. The lack of appropriate equipments in the squares or to the precariousness of the same ones, such as banks, illumination and places for the different age groups; the lack of the "nature", in other words, of green; and the maintenance lack is some of the problems observed at the squares of Natal/RN. The maintenance is essential factor for the own existence of the square, so much in relation to the physical quality of the space, as in relation to the presence, or no, of users. In that work, we studied the squares of Natal/RN and the partnership public-private as form of shared administration of the public space. Our objective is to understand as it feels that partnership in the production and maintenance of squares in Natal/RN and which the benefits for the involved parts. For so much, we rescued the production of squares historically in the city of Natal/RN; We analyzed the legislation that regularizes the adoption of squares in some Brazilian municipal districts and the Bill of Adoption of Public Squares and of Sports and Green Areas in Natal/RN; and, last we analyzed three natalenses squares that had private investment in the construction, it reforms and/or maintenance. The "partnerships" involved exchange for land, environmental and social compensations, always assisting to the private interests, and nothing was registered or documented in the competent public organs. With that dissertation we wanted to contribute for the valorization of the squares and the relevance of the construction, renewal and maintenance of those public spaces in the city of Natal/RN, as life spaces, of encounters, of leisure

Scientific research plays a fundamental role in the health and development of any society, since all technological advances depend ultimately on scientific discovery and the generation of wealth is intricately dependent on technological advance. Due to their importance, science and technology generally occupy important places in the hierarchical structure of developed societies, and they receive considerable public and private investment. Publicly funded science is almost entirely devoted to discovery, and it is administered and structured in a very similar way throughout the world. Particularly in the biological sciences, this structure, which is very much centered on the individual scientist and his own hypothesis-based investigations, may not be the best suited for either discovery in the context of complex biological systems, or for the efficient advancement of fundamental knowledge into practical utility. The adoption of other organizational paradigms, which permit a more coordinated and interactive research structure, may provide important opportunities to accelerate the scientific process and further enhance its relevance and contribution to society. The key alternative is a structure that incorporates larger organizational units to tackle larger and more complex problems. One example of such a unit is the research network. Brazil has utilized such networks to great effect in genome sequencing projects, demonstrating their relevance to the Brazilian research community and opening the possibility of their wider utility in the future.
