A presente Tese busca refletir sobre as características e o significado do Benefício de Prestação Continuada (BPC) como componente da política de Assistência Social. Este benefício constitui o principal direito da Assistência Social, pois é o único garantido constitucionalmente e garante o pagamento de um salário mínimo mensal a idosos com 65 anos ou mais e pessoas com deficiência, cuja renda mensal familiar seja inferior a do salário mínimo por pessoa. A Tese procura analisar, portanto, as mudanças propostas, os resultados alcançados e os desafios que se colocam para o BPC no município do Rio de Janeiro, em face das novas perspectivas apresentadas para este benefício a partir de 2005 pelo Sistema Único de Assistência Social (SUAS) e, posteriormente, pelo Decreto 6.214/2007. Para a efetivação dessa proposta foi realizada uma pesquisa que procurou compreender a situação e as características atuais do desenvolvimento deste Benefício, no município em apreço, no âmbito da política de Assistência Social e do Instituto Nacional de Seguro Social (INSS). O estudo desenvolvido pela Tese revelou, entre outros aspectos, que apesar do intenso movimento, em termos de proposições, que se processa na esfera federal da política de Assistência Social com vistas a encaminhar as mudanças previstas para o BPC, este esforço não tem o respaldo político necessário que dê impulso a essas propostas e crie condições efetivas para elas se materializarem, principalmente na esfera municipal, que é onde a política, de fato, se concretiza. Assim, no período analisado, o ano de 2010, mantinha-se a concepção do BPC como um fator externo à política municipal de Assistência Social do Rio de Janeiro. Na realidade, essa situação reflete o histórico distanciamento da Assistência Social em relação a este benefício, que apesar de ter sido fundamental para a institucionalização desta política como uma das áreas componentes da Seguridade Social, continua, na atualidade, a não ter uma real identidade com a Assistência Social.

Este trabalho tem como objetivo discutir a existência de uma subcidadania brasileira e suas repercussões para o campo do direito. Para isso, decidiu-se trabalhar com a tese do sociólogo Jessé Souza de que o Brasil teria vivido uma modernização seletiva, que ao importar as práticas modernas sem uma correspondente homogeneização das classes sociais, teria relegado pelo menos um terço da população à subcidadania. Após realizar uma análise crítica desta tese, confrontando-a ainda com o que seria, para o próprio Jessé Souza, o cânone tradicional de interpretação do Brasil, formado pelas obras de Sérgio Buarque de Holanda, Raymundo Faoro e Roberto DaMatta, procurou-se refletir sobre as repercussões da tese da modernização seletiva para o campo do direito. Sob a chave de que a cidadania, entendida como uma igual dignidade, é a próprio fundamento dos direitos, discutiu-se que a existência de uma subcidadania no Brasil deveria ser levada em conta pelo campo do direito, tanto para se problematizar a distância entre a positivação dos institutos e sua concretização como para promover uma abertura do direito às lutas por reconhecimento e cidadania

Propõe-se estudo teórico com o objetivo de examinar a extensão e os limites da proteção jurídica concedida aos nascituros no ordenamento jurídico brasileiro. Há décadas a doutrina nacional se debruça acerca da exegese mais adequada do art. 4 do Código Civil de 1916, que, atualmente, corresponde ao art. 2 do Código Civil, com pequenas modificações textuais, mas sem alterar substancialmente o dispositivo. O Código Civil aparentemente optou pela atribuição da personalidade civil somente após o nascimento com vida, assegurando, contudo, os direitos do nascituro desde a concepção. O próprio Código Civil prevê expressamente direitos ao nascituro, como o direito a se beneficiar de doação e herança, o direito ao reconhecimento de paternidade e o direito à curatela. Nas últimas décadas outras leis infraconstitucionais reforçaram a proteção do nascituro, para resguardar direitos próprios do nascituro, entre eles o direito à assistência pré-natal, o direito à saúde e à integridade física e o direito aos alimentos. Não obstante, é costumeira a consciência de que o reconhecimento desses direitos pressupõe a concessão da personalidade civil desde a concepção, visto que a titularidade deles dependeria do gozo pleno da personalidade. Embora, pelo perfil do interesse, não haja óbice ao reconhecimento de situações patrimoniais, existenciais e dúplices, que podem ser titularizadas pelo nascituro, a preocupação do legislador nacional sempre se centrou nos aspectos patrimoniais. Diante da existência de situações jurídicas subjetivas merecedoras de proteção por parte do ordenamento jurídico titularizáveis pelos nascituros, pretende-se identificar e revelar os direitos extrapatrimoniais do ente por nascer como merecedores de tutela no direito brasileiro. Mediante pesquisa bibliográfica, observada a metodologia do direito civil constitucional, serão examinados os conceitos de nascituro, bem como as teorias existentes sobre os direitos que lhe são assegurados, com vista à possibilidade de proteção de seus direitos existenciais

Data on meaning of working (MOW) were collected from 905 respondents in Beijing area through a stratified sampling procedure of the questionnaire used in the restudy of meaning of working (which is still on going, adapted for using in China). Some parts of the factor structure obtained in this study are similar to what found by the MOW International Research Team (1987). Detailed analysis and cross-cultural comparisons were concentrated on the most similar parts societal norms about working (SNW). T-scores of the obligation norm (ON) and entitlement norm (EN) of Chinese were calculated based on the reaction frequencies of relevant items provided by the MOW International Research Team and shown as follows. The results reveal the obligation orientation characteristic of Chinese respondents. And more, 4 SNW patterns of Chinese respondents were obtained through multivariate cluster analysis and multivariate discrimination analysis and shown as follows. The influences of antecedent variables on SNW and the consequences of SNW were analyzed. Two questions were raised from these analyses: 1) The present measurements of SNW are not able to reflect the nature of the relation and dependency between ON and EN and are not free from social desirability; 2) the relationship between SNW and actual working behaviors need to be tested while the relationship between SNW and several work intentions was confirmed. A forced-choice scale of SNW was designed to overcome the shortcomes of the original scale. This scale includes 30 items. Each item is composed of a ON statement and a EN statement with similar values of social desirability. A repertory grids test was used to exam the constructure validity and to analyze the differences of cognitive structures of the 4 SNW patterns. The results indicated that the new scale had a good discrimination power. An experiment was designed to test the relationship of SNW and the actual work behaviors of the respondents. The respondents' action in completing a task was chosen as working behavior index. 4 hypotheses were tested: 1) higher obligation orientation subjects are more likely to complete tasks no matter overtime; 2) scheduled tasks are more likely to be completed no matter overtime; 3) the obligation norm about working is positively correlated with general obligation norms; and, 4) external motivtors will enhance lower obligation orientation subjects' working motivation more than higher obligation orientation subjects' the results verified hypothesis 1 and 3, but didn't support hypothesis 2 and 4 these findings will have great implication in administrating.

W niniejszym artykule autor przedstawił sposób odtworzenia normy prawnej zawierającej prawo do ochrony zdrowia na podstawie przepisu prawnego art. 68 ust. 1 Konstytucji RP. Przełożenie przepisu prawnego na normę prawną odbyło się zgodnie z założeniami derywacyjnej koncepcji wykładni, której istotą jest uzyskanie równoznaczności pomiędzy przepisem a odtworzoną z niego normą. W tym celu konieczne było przeprowadzenie wszystkich trzech faz wykładni: porządkującej, rekonstrukcyjnej i percepcyjnej. Niniejszy artykuł ukazuje, jak przebiegają poszczególne czynności interpretacyjne podejmowane w oparciu o dyrektywy derywacyjnej koncepcji wykładni. Pozwala to zobaczyć w szczegółowy sposób przebieg procesu przekształcania przepisu prawnego w normę prawną. Rezultatem przeprowadzonej wykładni było uzyskanie dostatecznie jednoznacznej normy prawnej. Na tej podstawie wykazano, że prawo do ochrony zdrowia jest zasadą prawa, ponieważ możliwe było odniesienie treści normy prawnej do określonych kryteriów. Ponadto, norma prawna odtworzona na podstawie przepisu konstytucyjnego zawiera wszystkie elementy, przede wszystkim określa adresata i nakazane zachowanie. Pozwala to wskazać sytuacje prawne, jakie wyznacza odtworzona w toku wykładni norma prawna, czyli obowiązek, uprawnienie i prawo podmiotowe. Postrzeganie konstytucyjnego prawa do ochrony zdrowia jako normy prawnej umożliwia także znacznie szersze i głębsze rozpatrzenie aspektów jego obowiązywania. W tym kontekście szczególnie przydatna jest derywacyjna koncepcja wykładni prawa.

Describes the case law illustrating that forceful exclusion of the non-occupying party is not a prerequisite to entitlement to an occupation rent. Considers the calculation of the parties' respective credits where the occupying party has made mortgage repayments since the separation and the other is entitled to an occupation rent.

There is abundant empirical evidence on the negative relationship between welfare effort and poverty. However, poverty indicators traditionally used have been representative of the monetary approach, excluding its multidimensional reality from the analysis. Using three regression techniques for the period 1990-2010 and controlling for demographic and cyclical factors, this paper examines the relationship between social spending per capita —as the indicator of welfare effort— and poverty in up to 21 countries of the region. The proportion of the population with an income below its national basic basket of goods and services (PM1) and the proportion of population with an income below 50% of the median income per capita (PM2) were the two poverty indicators considered from the monetarist approach to measure poverty. From the capability approach the proportion of the population with food inadequacy (PC1) and the proportion of the population without access to improved water sources or sanitation facilities (PC2) were used. The fi ndings confi rm that social spending is actually useful to explain changes in poverty (PM1, PC1 and PC2), as there is a high negative and signifi cant correlation between the variables before and after controlling for demographic and cyclical factors. In two regression techniques, social spending per capita did not show a negative relationship with the PM2. Countries with greater welfare effort for the period 1990-2010 were not necessarily those with the lowest level of poverty. Ultimately social spending per capita was more useful to explain changes in poverty from the capability approach.

2013 marks 10 years since the Sexual Offences Act 2003 was passed. That Act made significant changes to the law of rape which appear now to have made very little difference to reporting, prosecution or conviction rates. This article argues that the Act has failed against its own measures because it remains enmeshed within a conceptual framework of sexual indifference in which woman continues to be constructed as man’s (defective) other. This construction both constricts the frame in which women’s sexuality can be thought and distorts the harm of rape for women. It also continues woman’s historic alienation from her own nature and denies her entitlement to a becoming in line with her own sexuate identity. Using Luce Irigaray’s critical and constructive frameworks, the article seeks to imagine how law might ‘cognize’ sexual difference and thus take the preliminary steps to a juridical environment in which women can more adequately understand and articulate the harm of rape.

Advocates of semi-structured interview techniques have often argued that rapport may be built, and power inequalities between interviewer and respondent counteracted, by strategic self-disclosure on the part of the interviewer. Strategies that use self-disclosure to construct similarity between interviewer and respondent rely on the presumption that the respondent will in fact interpret the interviewer's behaviour in this way. In this article we examine the role of interviewer self-disclosure using data drawn from three projects involving interviews with young people. We consider how an interviewer's attempts to ‘do similarity’ may be interpreted variously as displays of similarity or, ironically, as indicators of difference by the participant, and map the implications that this may have for subsequent interview dialogue. A particular object of concern relates to the ways in which self-disclosing acts may function in the negotiation of category entitlement within interview interactions.

The paper addresses two connected questions: firstly, in what ways might ‘public’ and ‘private’ spaces in cities be gendered; and secondly, what might this mean for the possibilities for complex forms of civility in a divided city such as Belfast? The specific focus on gendered dynamics of entitlement to inhabit urban space in this paper begins with some consideration of debates about the quality and experience of everyday life in cities, and the emergence of commonsense notions of ‘public’ and ‘private’ behaviour. Following this, key research concerned with the gendered dynamics of claimed collective, and particularly national, identities are outlined, in order to consider the significance of this literature for any study of the gender dynamics of life in a contested political context such as Belfast.

This article examines hospital provision in Ireland during the early twentieth century. It examines attempts by the newly independent Irish Free State to reform and de-stigmatise medical relief in former workhouse infirmaries. Such reforms were designed to move away from nineteenth century welfare regimes which were underpinned by principles of deterrence. The reform initiated in independent Ireland - the first attempted break-up of the New Poor Law in Great Britain or Ireland - was partly successful. Many of the newly named County and District Hospitals provided solely for medical cases and managed to dissociate such health care provision from the relief of poverty. However, some hospitals continued to act as multifunctional institutions and provided for various categories including the sick, the aged and infirm, 'unmarried mothers' and 'harmless lunatics'. Such institutions often remained associated with the relief of poverty. This article also examines patient fee-payment and outlines how fresh terms of entitlement and means-testing were established. Such developments were even more pronounced in voluntary hospitals where the majority of patients made a financial contribution to their treatment. The article argues that the ability to pay at times determined the type of provision, either voluntary or rate-aided, available to the sick. However, it concludes that the clinical condition of patients often determined whether they entered a more prestigious voluntary hospital or the former workhouse. Although this article concentrates on two Irish case studies, County Kerry and Cork City; it is conceptualised within wider developments with particular reference to the British context.
