The human right to water is nowadays more broadly recognised, mainly due to the essential societal function that this resource plays; likewise, because of the present water scarcity is generating conflicts between its different uses. Thus, this right aims at protecting human beings by guaranteeing access to clean water that is essential to satisfy vital human needs. Similarly, access to clean water is an important element to guarantee other rights including the right to life and health. The recognition of the right to water is mainly achieved in two ways: as a new and independent right and as a subordinate or derivative right. Concerning the latter, the right to water can emanate from civil and political rights, such as the right to life; or can be derived from economic, social and cultural rights, including the right to health, the right to an adequate standard of living, and the right to housing. This contribution explores the position of the Inter-American Court of Human Rights regarding the right to water, and analyses whether the Court has recognised the right to water and, if so, in which manner.

Este artículo describe los elementos centrales que conforman dos formas de Estado: el Estado liberal de Derecho y el Estado Social de Derecho. Respecto de este último desarrolla con mayor profundidad dos de sus elementos constitutivos: el valor de la igualdad sustancial o real y el reconocimiento y garantía de los derechos económicos, sociales y culturales. Plantea algunas reflexiones en la coyuntura actual del Ecuador respecto de la constituyente y las ventajas y desventajas del denominado constitucionalismo aspiracional. Finalmente propone la incorporación constitucional de tres aspectos que pueden apuntalar a nivel normativo la igualdad real y los DESC con el fin de consolidar el Estado Social de Derecho y los derechos humanos como razón de ser del Estado y factor de legitimación del mismo. No deja de advertir que la Constitución es una herramienta que puede o no servir para transformaciones sociales y que el reto fundamental de encarnarla en la cotidianidad pasa por un esfuerzo sostenido y complejo.

Using the KOF Index of Globalization and two indices of economic freedom, the authors empirically analyze whether globalization and economic liberalization affect governments’ respect for human rights in a panel of 106 countries over the 1981–2004 period. According to their results, physical integrity rights significantly and robustly increase with globalization and economic freedom, while empowerment rights are not robustly affected. Due to the lack of consensus about the appropriate level of empowerment rights as compared to the outright rejection of any violation of physical integrity rights, the global community is presumably less effective in promoting empowerment rights.
