Datenherrschaft – an Ethically Justified Solution to the Problem of Ownership of Patient Information

Patient information systems are crucial components for the modern healthcare and medicine. It is obvious that without them the healthcare cannot function properly – one can try to imagine how brain surgery could be done without using information systems to gather and show information needed for an operation. Thus, it can be stated that digital information is irremovable part of modern healthcare. However, the legal ownership of patient information lacks a coherent and justified basis. The whole issue itself is actually bypassed by controlling pa- tient information with different laws and regulations how patient information can be used and by whom. Nonetheless, the issue itself – who owns the patient in- formation – is commonly missed or bypassed. This dissertation show the problems if the legislation of patient information ownership is not clear. Without clear legislation, the outcome can be unexpected like it seems to be in Finland, Sweden and United Kingdom: the lack of clear regulation has come up with unwanted consequences because of problematic Eu- ropean Union database directive implementation in those countries. The legal ownership is actually granted to the creators of databases which contains the pa- tient information, and this is not a desirable situation. In healthcare and medicine, we are dealing with issues such as life, health and information which are very sensitive and in many cases very personal. Thus, this dissertation leans on four philosophical theories form Locke, Kant, Heidegger and Rawls to have an ethically justified basis for regulating the patient infor- mation in a proper way. Because of the problems of property and ownership in the context of information, a new concept is needed and presented to replace the concept of owning, that concept being Datenherrschaft (eng. mastery over in- formation). Datenherrschaft seems to be suitable for regulating patient infor- mation because its core is the protection of one’s right over information and this aligns with the work of the philosophers whose theories are used in the work. The philosophical argumentation of this study shows that Datenherrschaft granted to the patients is ethically acceptable. It supports the view that patient should be controlling the patient information about themselves unless there are such specific circumstance that justifies the authorities to use patient information to protect other people’s basic rights. Thus, if the patients would be legally grant- ed Datenherrschaft over patient information we would endorse patients as indi- viduals who have their own and personal experience of their own life and have a strong stance against any unjustified paternalism in healthcare. For persons with disabilities, the activities that able-bodied people take for granted can be major, often insurmountable challenges. Attempting to enter a restaurant for lunch with friends can result in lengthy and adversarial litigation if the facility is not accessible to a person with a disability or other mobility impairment. This litigation would be initiated after the individual was effectively refused service; a refusal based on hislher personal physical characteristics. If a shopping mall is not equipped with "access amenities", then the disabled person may be excluded from shopping there and thus exercising consumer freedom. If workplaces are not equipped to accommodate the access needs of persons with disabilities, then those people are effectively barred from gainful employment there. If a municipal goveniment building is inaccessible to disabled persons, then they may be excluded from participating in council meetings. These are all activities that the majority of the population enjoys as a matter of course, in that they represent the functions of a free citizen in a free society. If a person is excluded from such activities because of some personal characteristic, then that person is subjected to differential or discr~minatory treatment. The guarantees provided in Canadian feden! and provincial rights legislation, are such that people are not to be discriminated againsL Where buildings and facilities othen\iise open to the public are not accessible for persens with disabilities, then those people are being discriminated against. To challenge these discriminatory practices, individuals initiate complaints through the administrative justice system. To address the extent to which this is a problem, many sources were consulted. Constitutional lawyers, tribunal members, advocates for the disabled and land use planners were interviewed. Case law and legislation were reviewed. Literature on citizenship theory, dispute resolution and dispute avoidance was compiled and assessed. And, the field of land use planning was analyzed (drawing on the WTiter's educational and experiential background) as a possible alternative method for effecting systemic access for persons with disabilities. The conclusion of this study is that there does exist a proactive method for assuring access, a method that can apply the systemic remedy needed to deal with this problem. The current method, which is an adversarial and piecemeal complaint process, has proven ineffective in remedying this discrimination problem~ Failure to provide an appropriate remedy means that persons with disabilities will not enjoy the degree of citizen status enjoyed by the able-bodied. This is the current circumstance, and since equity is the aim of rights legislation, and since such legislative and administrative frameworks have failed in that purpose, then an alternative method is necessary. An alternative model is the one in which land use planning is based. It has conflict avoidance and conflict minimization as underpinnings. And, most importantly, land use planning is already a proyen method of combatting discrimination.

This thesis compares the foreign economic poUcy dimension of the development strategies adopted by the governments of two Commonwealth caribbean countries: The Hardey government In Jamaica, and the· Williams government in Trlnidad and T ooago, The foreign economic policIes adopted by these governments appeared, on the surface~ to be markedly dissimilar. The Jamakan strategv on the one hand, emphasised self-reliance and national autonomy; and featured the espousal of radical oonaHgnment together with attempts to re-deftne the terms of the Islands externaa economIc relaUoos. The Trinidadian strategy 00 the other hand, featured Uberal externaUy-oriented growth poUctes, and close relatjoos with Western governments and financial institutions. Th1s study attempts to identify the explanatory factors that account for the apparent dlssimUarUy 1n the foreign economic policies of these two govemnents. The study is based on a comparison of how the structural bases of an underdeveloped ecooomYg and the foreign penetration and vulnerabUUy to external pressures asSOCiated wUh dependence, shape and influence foreign economic poUcy strategy. The framework views fore1gn ecooom1c strategy as an adaptive response on the part of the decision makers of a state to the coostralnts and opportunities provided by a particular situation. The · situat i 00' in this case being the events, conditions, structures and processes, associated wUh dependente and underdevelopment. The results indicate that the similarities and dissimHarities in the foreign economic policies of the governments of Jamaica and Trinidad were a reflecUon of the simHarities and dissimilarities in their respective situations. The conclusion derived suggests that If the foreign pol1cy field as an arena of choice, Is indeed one of opportunities and constraints for each and every state, then poHcy makers of smaU, weak, hlghW penetrated and vulnerable states enter thlS arena with constraints outweighing opportunities. This places effective limits 00 their decisional latitude and the range of policy options avaUable. Policy makers thus have to decide critical issues with few estabUshed precedents, in the face of domestic social and political cleavages, as wen as serious foreign pressures. This is a reflection not only of the trappings of dependence, but also of the Umned capabilities arising from the sman size of the state, and the Impact of the resource-gap In an underdeveloped economy. The Trinidadian strategy 1s UlustraUve of a development strategy made viable through a combination of a fortuitous circumstance, a confluence of the interests of influential groups» and accurate perception on the part of poUcy makers. These factors enabled policy makers to minimise some of the constraints of dependence. The faUure of Manlets strategy on the other hand, 15 iHustraUve of the problems involved tn the adoption of poUcles that work against the interest of internal and external political and economic forces. It is also tUustraUve of the consequences of the faUure 00 the part of policy makers to clarify goals, and to reconcile the values of rapid economic growth with increased self-reliance and national autonomy. These values tend to be mutuany Incompatible given the existing patterns of relations in the jnternational economy.

L’échange de fichiers musicaux par Internet permet de faire très exactement ce que toute loi sur le droit d’auteur cherche à interdire : priver de leurs droits les compositeurs, interprètes et agents de distribution des œuvres musicales. Pour l’industrie du disque, le défi est à la fois d’ordre juridique et d’ordre technique. Les lois actuelles sur le droit d’auteur suffiront-elles d’une part à protéger ses intérêts, et dans le cas où les tribunaux acquiesceraient à ses nombreuses demandes, lui faudra-t-il d’autre part tenter de mettre un frein aux progrès technologiques grâce auxquels les internautes peuvent télécharger massivement et en toute impunité leurs pièces musicales préférées? La jurisprudence américaine montre bien que dans les cas où on a cherché aux États-Unis à se servir de la loi sur le droit d’auteur pour bloquer l’utilisation d’une technologie innovatrice, les tribunaux, pour des motifs politiques et juridiques, n’ont fait preuve d’aucune sympathie pour les titulaires de droits d’auteur. En fait, lorsque les tribunaux ont cherché à trop restreindre l’utilisation d’un nouveau mode de dissémination des œuvres, le Congrès est intervenu pour rétablir l’équilibre entre les intérêts des créateurs et ceux des utilisateurs de cette technologie. Au Canada, le droit protège très bien les compositeurs et les interprètes, mais beaucoup moins bien les compagnies de disques. En ce moment, la loi canadienne sur le droit d’auteur accorde à ces dernières un droit d’auteur limité sur leurs produits. Elles peuvent multiplier les exemplaires d’un disque, et le « reproduire sur un support matériel quelconque ». C’est ici que naissent les difficultés : les compagnies productrices de disques n’ont pas un droit clairement identifié à l’égard d’une « représentation » de l’œuvre musicale ou d’une « exécution publique » ou d’une « transmission au public par télécommunication ». Le Parlement canadien aura des choix importants à faire.

La polyarthrite rhumatoïde (PR) est une maladie auto-immune chronique. Elle est caractérisée par une inflammation persistante touchant de multiples petites articulations, causant douleurs, rougeurs, gonflements et déformations. Des études menées auprès de patients et d’animaux ont démontré que certains auto-anticorps, cytokines et enzymes tissue-déstructives sont des médiateurs importants dans le développement de la PR. Au cours des deux dernières décennies, les traitements de fond (DMARDs en anglais) ont été démontrés très efficaces pour traiter la PR. D'autre part, des effets secondaires ont été rapportés pour ces traitements, par exemple l'augmentation du risque d'infections opportunistes. L’objectif de ce travail est d’acquérir des connaissances sur le rôle du TL1A (TNF-like molécule 1 A; TNFSF15) et son partenaire Nob1 (Pno1 ; YOR145c) dans la pathogenèse de la PR afin de découvrir de nouveaux médicaments contre ces molécules dans l'avenir. TL1A est un membre de la famille du TNF. Il déclenche des signaux co-stimulateurs via le récepteur de mort 3 (DR3) et induit la prolifération ainsi que la production des cytokines pro inflammatoires par les lymphocytes. Des données multiples suggèrent l'implication de la cascade TL1A-DR3 dans plusieurs maladies auto-immunes. Donc, nous avons proposé les hypothèses suivantes:1) la production locale de TL1A dans les articulations est un composant d’un cercle vicieux qui aggrave la PR; 2) dans la PR, la production de TL1A dans les organes lymphoïde augmente la production d’auto-anticorps pathogénique. Au cours de ce travail, nous avons démontré que la TL1A aggrave la maladie chez les souris où l’arthrite a été induite par le collagène (AIC). Par ailleurs, nous avons constaté que l’expression de TL1A est élevée dans les tissus atteints de PR ainsi que dans les ganglions lymphatiques drainant de la souris AIC. Mécaniquement, nous avons découvert que la TL1A est induite par le TNF-α et IL-17 produits par les cellules T in vitro. Ces résultats montrent directement que les TL1A-DR3 jouent un rôle essentiel dans la pathogenèse de la PR. De plus, afin de poursuivre notre étude, la TL1A a été génétiquement supprimée dans les souris (TL1A KO). Nous avons montré que les souris TL1A KO n’ont aucune anomalie apparente et aucun dysfonctionnement du système immunitaire dans des conditions normales. Cependant, ces souris manifestent des AIC améliorées et une réduction significative des niveaux d'anticorps, anti-collagène du type II i dans le sérum. Nous avons trouvé que les ganglions lymphatiques de drainage (dLNs) de souris KO étaient plus petites avec une cellularité inférieure comparativement aux souris WT de 14 jours après l’immunisation. De plus, nous avons découvert que le DR3 a été exprimé par les cellules plasmatiques dans l’étape de la différenciation terminale et ces cellules surviennent mieux en présence de TL1A. La conclusion de cette étude apporte des nouvelles connaissances sur le rôle de TL1A qui amplifie les réponses humorales d’AIC. Nous avons suggéré que TL1A pourrait augmenter la réponse d’initiation d'anticorps contre collagène II (CII) ainsi que prolonger la survie des cellules plasmatiques. Une autre molécule qui nous intéresse est Pno1. Des études antérieures menées chez la levure ont suggéré que Pno1 est essentielle pour la néogénèse du protéasome et du ribosome Le protéasome étant crucial pour la différenciation terminale des cellules plasmatiques pendant les réponses humorales chez les mammifères, nous avons donc supposé que Pno1 joue un rôle dans la production d'anticorps pathogenique dans la PR via la voie du protéasome. Nous avons donc généré des souris génétiquement modifiées pour Pno1 afin d’étudier la fonction de Pno1 in vivo. Cependant, une mutation non-sens dans le Pno1 provoque une létalité embryonnaire à un stade très précoce chez les souris. D'autre part, une réduction de 50% de Pno1 ou une surexpression de Pno1 n’ont aucun effet ni sur le fonctionnent des cellules T et B, ni sur les activités du protéasome ainsi que sur la réponse humorale dans l’AIC. Ces résultats suggèrent que Pno1 est une molécule essentielle sans redondance. Par conséquent, il n’est pas une cible appropriée pour le développement de médicaments thérapeutiques. En conclusion, nos études ont révélé que la TL1A n’est pas essentielle pour maintenir les fonctions du système immunitaire dans des conditions normales. En revanche, il joue un rôle critique dans la pathogenèse de la PR en favorisant l'inflammation locale et la réponse humorale contre des auto-antigènes. Par conséquent, une inhibition de la TL1A pourrait être une stratégie thérapeutique pour le traitement de la PR. Au contraire, Pno1 est essentiel pour la fonction normale des cellules. Une délétion totale pourrait entraîner des conséquences graves. Il n’est pas une cible appropriée pour développer des médicaments de la PR.

Light emitting polymers (LEPs) are considered as the second generation of conducting polymers. A Prototype LEP device based on electroluminescence emission of poly(p-phenylenevinylene) (PPV) was first assembled in 1990. LEPs have progressed tremendously over the past 20 years. The development of new LEP derivatives are important because polymer light emitting diodes (PLEDs) can be used for the manufacture of next-generation displays and other optoelectronic applications such as lasers, photovoltaic cells and sensors. Under this circumstance, it is important to understand thermal, structural, morphological, electrochemical and photophysical characteristics of luminescent polymers. Unprocessed seafood harbor high number of bacteria, hence are more prone to spoilage. In this circumstance, the use of spice in fish for reduction of microorganism can play an important role in seafood processing. Many essential oils from herbs and spices are used widely in the food, health and personal care industries and are classified as GRAS (Generally regarded as safe) substances or are permitted food additives. A large number of these compounds have been the subject of extensive toxicological scrutiny. However, their principal function is to impart desirable flavours and aromas and not necessarily to act as antimicrobial agents. Given the high flavour and aroma impact to plant essential oils, the future for using these compound as food preservatives lies in the careful selection and evaluation of their efficacy at low concentrations but in combination with other chemical preservatives or preservation processes. For this reason they are worth of study alone or in combination with processing methods in order to establish if they could extend the shelf-life of foods. In this study, the effect of the spices, clove, turmeric, cardamom, oregano, rosemary and garlic in controlling the spoilage and pathogenic bacteria is investigated. Their effect on biogenic amine formation in tuna especially, histamine, as a result of bacterial control is also studied in detail. The contribution of spice oleoresin in the sensory and textural parameters is investigated using textural profile analysis and sensory panel. Finally, the potential of spices in quality stabilization and in increasing the shelf–life of tuna during frozen storage is analysed

Verschiedene Bedeutungen sind mit dem Begriff Mode verbunden. Mode ist nicht ausschließlich ein Synonym für Bekleidung. Vielmehr bezeichnet Mode den ständigen Wandel kollektiver Verhaltensweisen und bildet damit das Gegenstück zu Traditionen. Die Vergänglichkeit einer Mode ist ebenso Merkmal wie ein Verhalten, daß aus der Interaktion der Menschen resultiert. Mode läßt sich als exogener Schock modelliert oder durch endogene Prozesse erzeugt abbilden. Im synergetischen Modell erzeugen Personen auf der Makroebene bestimmte Ordner, die als Moden interpretiert werden können und an denen sich die Individuen wiederum orientieren. Neben einer umfassenden Betrachtung des Terminus Mode wird der Stand der sozial- und wirtschaftswissenschaftlichen Forschung zur Erklärung von Mode referiert. Ausgangspunkt der Dissertation ist das Fehlen eines ökonomischen Erklärungsansatzes der Mode, der unter Berücksichtigung der wesentlichsten Motive menschlichen Handelns die Vielseitigkeit dieses kollektiven Phänomens in einem mathematischen Modell abbildet. Ein solches Modell wird in der Arbeit entwickelt. Neben den sozial abhängigen Verhaltensweisen, die ein fundamentales Wesensmerkmal der Mode darstellen, gilt dem Aspekt der Neuheit im Kontext der Mode besondere Aufmerksamkeit. Auf das Problem, Neugierdeverhalten und Neuheit zu modellieren, wird detailliert eingegangen. Es ist weder Ziel der Arbeit, den Ursprung der inhaltlichen Ausgestaltung einer Mode zu identifizieren, noch die konkreten Entstehungszusammenhänge von Neuheit herauszuarbeiten. Vielmehr wird der Wirkungszusammenhang von Neuem im Kontext der Mode analysiert, um verschiedene Entstehungszusammenhänge von Mode darstellen zu können. Außerdem wird eine eigene empirische Studie zum Verhalten von Personen in bezug auf Kleidung und deren Neuartigkeit vorgestellt. Die Erhebungsdaten werden mit Hilfe der sogenannten Kohonenkarte klassifiziert, wobei insbesondere nichtlineare Zusammenhänge zwischen den Variablen berücksichtigt werden können. Im Rahmen eines synergetischen Erklärungsansatzes ist diese Karte deshalb von großem Interesse, weil sie sich selbst organisiert und deshalb dem synergetischen Erklärungsansatz modelladäquat ist.

Interviews with more than 40 leaders in the Boston area health care industry have identified a range of broadly-felt critical problems. This document synthesizes these problems and places them in the context of work and family issues implicit in the organization of health care workplaces. It concludes with questions about possible ways to address such issues. The defining circumstance for the health care industry nationally as well as regionally at present is an extraordinary reorganization, not yet fully negotiated, in the provision and financing of health care. Hoped-for controls on increased costs of medical care – specifically the widespread replacement of indemnity insurance by market-based managed care and business models of operation--have fallen far short of their promise. Pressures to limit expenditures have produced dispiriting conditions for the entire healthcare workforce, from technicians and aides to nurses and physicians. Under such strains, relations between managers and workers providing care are uneasy, ranging from determined efforts to maintain respectful cooperation to adversarial negotiation. Taken together, the interviews identify five key issues affecting a broad cross-section of occupational groups, albeit in different ways: Staffing shortages of various kinds throughout the health care workforce create problems for managers and workers and also for the quality of patient care. Long work hours and inflexible schedules place pressure on virtually every part of the healthcare workforce, including physicians. Degraded and unsupportive working conditions, often the result of workplace "deskilling" and "speed up," undercut previous modes of clinical practice. Lack of opportunities for training and advancement exacerbate workforce problems in an industry where occupational categories and terms of work are in a constant state of flux. Professional and employee voices are insufficiently heard in conditions of rapid institutional reorganization and consolidation. Interviewees describe multiple impacts of these issues--on the operation of health care workplaces, on the well being of the health care workforce, and on the quality of patient care. Also apparent in the interviews, but not clearly named and defined, is the impact of these issues on the ability of workers to attend well to the needs of their families--and the reciprocal impact of workers' family tensions on workplace performance. In other words, the same things that affect patient care also affect families, and vice versa. Some workers describe feeling both guilty about raising their own family issues when their patients' needs are at stake, and resentful about the exploitation of these feelings by administrators making workplace policy. The different institutions making up the health care system have responded to their most pressing issues with a variety of specific stratagems but few that address the complexities connecting relations between work and family. The MIT Workplace Center proposes a collaborative exploration of next steps to probe these complications and to identify possible locations within the health care system for workplace experimentation with outcomes benefiting all parties.

Es una investigación pionera que pretende comprender el desarrollo del fenómeno social Nueva Era en Bogotá, por ello el objetivo de este estudio es indagar sobre los motivos que tiene los bogotanos para consumir productos y servicios de la Nueva Era. A partir de una metodología de investigación cualitativa donde se utilizaron técnicas de recolección tales como: la entrevista semi-estructurada, el cuestionario y la observación participante donde las unidades de análisis fueron los propietarios y consumidores de tres centros calificados Nueva Era que fueron, Serviteca del Alma, Centro Unifinismo, Wahikarie de Colombia E.U, se logro corroborar la hipótesis que el capitalismo informacional con su economía de mercado y la globalización que han generado una sociedad de red, ha desatado una crisis de sentido en los individuos, el llamado mercado Nueva Era es una alternativa para resolver dicha problemática.

Las empresas son creadas por personas para las personas, y son estas quienes se encargan de crear, hacer surgir, modificar y gestionar cada uno de los conceptos de empresa, para así lograr modificar caminos y lograr ser perdurables. Son fundamentales las personas que componen la organización, aclarando que existen muchos factores internos - externos que influyen de diversas maneras en la organización. Flexibilidad y capacidad de respuesta son elementos claves, estos se reflejan con más importancia cuando de diseñar estrategia se trata. Es claro que en todos los sectores de la economía mundial las empresas unen esfuerzos para crear nuevos modelos de respuesta para así hacerle frente a cualquier circunstancia que se pueda presentar. Tener una sencilla pero muy completa idea, SER LA CADENA MAS GRANDE DE PANADERÍAS, que con el tiempo alcanzo una perfección optima, logrando ser perdurable, en un sector que claramente está saturado por la falta de innovación y ventajas competitivas. Ventajas que PAN PA YA, supo aprovechar, saliéndose del esquema tradicional y buscando nuevas estrategias de venta, nuevos productos teniendo como escudo protector la calidad de sus productos, y la innovación como su principal arma. El éxito de PAN PA YA, en gran medida se dio gracias a la creación de la necesidad de un producto de calidad; innovación, capacitación de personal, desarrollo de nuevos y exquisitos productos, ingredientes sencillos para una receta que cualquiera puede tener y que les permitió lograr en muy poco tiempo consolidar una exitosa empresa.

La cooperación Internacional para el desarrollo ha jugado un papel determinante en las dinámicas de desarrollo de los países de África, sin embargo, las organizaciones internacionales que la promocionan tienen el riesgo de ser sesgadas por influencias de Estados que patrocinan la Cooperación Internacional, hecho que genera, irremediablemente, injerencia política; esto se puede ver reflejado en la ECOWAS y sus programas energéticos.

En la actualidad los conflictos internos son cada vez más permeables y sus vínculos más estrechos. Esta circunstancia significa que las acciones que tienen su origen en el exterior, afectan de manera creciente el desenvolvimiento de los antagonismos internos. Basándose en un enfoque transaccional, el autor estudia el fenómeno en la perspectiva de la seguridad interactiva y construye el modelo de ‘echar una mano’ que toma en cuenta cinco dimensiones y permite sistematizar las diferentes posibilidades de acción exterior en el desarrollo de la actual realidad conflictiva.---At the present moment internal conflicts are more permeable and have greater ties between them. This circumstance means that the actions that have foreign origin affect in a growing manner the development of internal antagonisms. Based on a transactional focus, the author studies the phenomena in the interactive security perspective and builds the “giving a hand model” that, upon taking into account five dimensions, allows to categorize the different foreign action possibilities in the development of the present conflictive reality.

Durante la década de 1930 el capitalismo industrial organizó diferentes espacios de la política y la cultura en Colombia. A través del estudio de caso de Coltabaco, se caracterizan tres momentos de los vínculos del capitalismo industrial con la sociedad colombiana. En el primer momento, se la describen los vínculos políticos que hicieron visible diferentes formas de participación política del sector industrial y su relación con las regiones, las instituciones (públicas y privadas) y las elites dominantes, así como se subraya la importancia del mercado interno para la industria del tabaco. En el segundo momento, se caracterizan los vínculos entre Coltabaco y el sector rural a partir de la labor pedagógica de Coltabaco para la producción de la hoja, así mismo, se describen las representaciones del cultivador vinculado a la industria que fueron difundidas en el sector rural; finalmente, los vínculos entre Coltabaco y el sector urbano se analizan en la tensión por la relación mujer-cigarrillo.
