Technology discloses man’s mode of dealing with Nature, the process of production by which he sustains his life, and thereby also lays bare the mode of formation of his social relations, and of the mental conceptions that flow from them (Marx, 1990: 372) My thesis is a Sociological analysis of UK policy discourse for educational technology during the last 15 years. My framework is a dialogue between the Marxist-based critical social theory of Lieras and a corpus-based Critical Discourse Analysis (CDA) of UK policy for Technology Enhanced Learning (TEL) in higher education. Embedded in TEL is a presupposition: a deterministic assumption that technology has enhanced learning. This conceals a necessary debate that reminds us it is humans that design learning, not technology. By omitting people, TEL provides a vehicle for strong hierarchical or neoliberal, agendas to make simplified claims politically, in the name of technology. My research has two main aims: firstly, I share a replicable, mixed methodological approach for linguistic analysis of the political discourse of TEL. Quantitatively, I examine patterns in my corpus to question forms of ‘use’ around technology that structure a rigid basic argument which ‘enframes’ educational technology (Heidegger, 1977: 38). In a qualitative analysis of findings, I ask to what extent policy discourse evaluates technology in one way, to support a Knowledge Based Economy (KBE) in a political economy of neoliberalism (Jessop 2004, Fairclough 2006). If technology is commodified as an external enhancement, it is expected to provide an ‘exchange value’ for learners (Marx, 1867). I therefore examine more closely what is prioritised and devalued in these texts. Secondly, I disclose a form of austerity in the discourse where technology, as an abstract force, undertakes tasks usually ascribed to humans (Lieras, 1996, Brey, 2003:2). This risks desubjectivisation, loss of power and limits people’s relationships with technology and with each other. A view of technology in political discourse as complete without people closes possibilities for broader dialectical (Fairclough, 2001, 2007) and ‘convivial’ (Illich, 1973) understandings of the intimate, material practice of engaging with technology in education. In opening the ‘black box’ of TEL via CDA I reveal talking points that are otherwise concealed. This allows me as to be reflexive and self-critical through praxis, to confront my own assumptions about what the discourse conceals and what forms of resistance might be required. In so doing, I contribute to ongoing debates about networked learning, providing a context to explore educational technology as a technology, language and learning nexus.

In global policy documents, the language of Technology-Enhanced Learning (TEL) now firmly structures a perception of educational technology which ‘subsumes’ terms like Networked Learning and e-Learning. Embedded in these three words though is a deterministic, economic assumption that technology has now enhanced learning, and will continue to do so. In a market-driven, capitalist society this is a ‘trouble free’, economically focused discourse which suggests there is no need for further debate about what the use of technology achieves in learning. Yet this raises a problem too: if technology achieves goals for human beings, then in education we are now simply counting on ‘use of technology’ to enhance learning. This closes the door on a necessary and ongoing critical pedagogical conversation that reminds us it is people that design learning, not technology. Furthermore, such discourse provides a vehicle for those with either strong hierarchical, or neoliberal agendas to make simplified claims politically, in the name of technology. This chapter is a reflection on our use of language in the educational technology community through a corpus-based Critical Discourse Analysis (CDA). In analytical examples that are ‘loaded’ with economic expectation, we can notice how the policy discourse of TEL narrows conversational space for learning so that people may struggle to recognise their own subjective being in this language. Through the lens of Lieras’s externality, desubjectivisation and closure (Lieras, 1996) we might examine possible effects of this discourse and seek a more emancipatory approach. A return to discussing Networked Learning is suggested, as a first step towards a more multi-directional conversation than TEL, that acknowledges the interrelatedness of technology, language and learning in people’s practice. Secondly, a reconsideration of how we write policy for educational technology is recommended, with a critical focus on how people learn, rather than on what technology is assumed to enhance.

The subject of this dissertation is the nature of the environmental transformations, both symbolic and physical, that took place in Colombia between 1850 and 1930. This period begins with the attempt by the Colombian elite to leave behind colonial ties, overcome economic disorganization, and link Colombia to the international market. These efforts were part of a general project to “civilize” this tropical country. The period closes with the transition toward an industrialization and urbanization process led by the Colombian state during the 1930s. ^ Frequently, environmental studies as an academic field are dominated by biological concerns. However, most environmental thinking accepts their interdisciplinary nature. Under this framework not only spatial but also symbolic concerns are key elements in understanding environmental transformations. ^ This study finds that despite several attempts to transform the Colombian landscape physically, most of the substantive changes were localized and circumscribed to the Andean region. Other changes were mainly symbolic. This dissertation thus uses the Amazon as one of several regions that did not experience significant changes in the forest canopy. While highlanders originally dreamed of the Amazon as an untapped El Dorado, their failed attempts to exploit the region caused them to imagine it as a nightmarish “green hell”. ^ This dissertation concentrates on three pairs of concepts: tropicality/civilization, landscape/territory, and symbolic/material changes. It presents both a general vision of Colombia and case studies of three regions: Cundinamarca, and Cauca Valley are used to compare with the Amazon region that is developed at length. Whereas mainstream Colombian histories have either fixated on the Andean highlands or, in a relegated second place, on the Caribbean region, this dissertation attempts to significantly contribute to the historiography of Colombia by focusing on the largely neglected Amazonian region. ^ To understand imageries about Colombia's landscape, the dissertation relies on travel writings, chorographic descriptions and maps. It also makes uses legal documents and other published primary sources, including literary pieces and memoirs. ^

In his discussion - S Corporations Can Benefit Many Closely-Held Hospitality Firms - by John M. Tarras, Assistant Professor, School of Hotel, Restaurant & Institutional Management at Michigan State University, Assistant Professor Tarras initially offers: “Organization as an S corporation has many advantages for hospitality firms since passage of the Tax Reform Act of 1986. The author discusses those advantages and lists the disadvantages as well.” In the opening paragraphs Tarras alludes to the relationship between hospitality firms, S corporations, and the Tax Reform Act of 1986, and then defines what an S corporation is. “An S corporation is a form of business entity that combines many of the tax advantages of partnerships with the legal attributes of a corporation, including limited liability for its shareholders. Its name is obtained from a subchapter of the Internal Revenue Code. Except for tax purposes, the S corporation is treated in the same manner as any regular corporation. Like a partnership, income and losses for an S corporation are generally passed through directly to shareholders for inclusion on their individual returns. An S corporation thus avoids the double tax problem facing regular corporations.” There are certain criteria to be met and caveats to be avoided in qualifying for S corporation status. Tarras lists and cites these for you. “Due to the complicated nature of S corporations, the election may be inadvertently terminated if the eligibility requirements are violated,” Tarras expands and cites. As the article suggests at the outset, there are advantages and disadvantages to S corporation status; the author outlines some examples for you. “Traditionally, the S corporation has been used by hospitality firms wishing to avoid the "double tax" problem of a regular corporation,” Tarras informs you. “Regular corporations are taxed once at the corporate level, and again at the shareholder level when income is distributed to shareholders in the form of dividends.” Tarras advises you as to why an S corporation is an advantage in this situation. “Since the S corporation generally is not subject to any corporate taxes, it generally makes no difference whether distributions to shareholders of S corporations are characterized as compensation or dividends,” thus the double tax is avoided. This is just one such positive illustration. Assistant Professor Tarras wants you to know: “Perhaps the most important reason to consider the S corporation has to do with the downward revision of tax rates for both individuals and corporations.” He highlights a case study for you. Some of the disadvantages of S corporation affiliation are the caveats alluded to earlier. They include, “the limitation of an S corporation of 35 shareholders,” Tarras cites. “Also, there are limits as to who may own stock in an S corporation.” These are but two of the limitations of an S corporation. Tarras closes with a further glimpse of the down-sides of an S corporation.

In the discussion - Ethics, Value Systems And The Professionalization Of Hoteliers by K. Michael Haywood, Associate Professor, School of Hotel and Food Administration, University of Guelph, Haywood initially presents: “Hoteliers and executives in other service industries should realize that the foundation of success in their businesses is based upon personal and corporate value systems and steady commitment to excellence. The author illustrates how ethical issues and manager morality are linked to, and shaped by the values of executives and the organization, and how improved professionalism can only be achieved through the adoption of a value system that rewards contributions rather than the mere attainment of results.” The bottom line of this discussion is, how does the hotel industry reconcile its behavior with that of public perception? “The time has come for hoteliers to examine their own standards of ethics, value systems, and professionalism,” Haywood says. And it is ethics that are at the center of this issue; Haywood holds that component in an estimable position. “Hoteliers must become value-driven,” advises Haywood. “They must be committed to excellence both in actualizing their best potentialities and in excelling in all they do. In other words, the professionalization of the hotelier can be achieved through a high degree of self-control, internalized values, codes of ethics, and related socialization processes,” he expands. “Serious ethical issues exist for hoteliers as well as for many business people and professionals in positions of responsibility,” Haywood alludes in defining some inter-industry problems. “The acceptance of kickbacks and gifts from suppliers, the hiding of income from taxation authorities, the lack of interest in installing and maintaining proper safety and security systems, and the raiding of competitors' staffs are common practices,” he offers, with the reasoning that if these problems can occur within ranks, then there is going to be a negative backlash in the public/client arena as well. Haywood divides the key principles of his thesis statement - ethics, value systems, and professionalism – into specific elements, and then continues to broaden the scope of each element. Promotion, product/service, and pricing are additional key components in Haywood’s discussion, and he addresses each with verve and vitality. Haywood references the four character types - craftsmen, jungle fighters, company men, and gamesmen – via a citation to Michael Maccoby, in the portion of the discussion dedicated to morality and success. Haywood closes with a series of questions derived from Lawrence Miller's American Spirit, Visions of a New Corporate Culture, each question designed to focus, shape, and organize management's attention to the values that Miller sets forth in his piece.

In - Service Management Concepts: Implications for Hospitality Management – a study by K. Michael Haywood, Associate Professor, School of Hotel and Food Administration, University of Guelph, Ontario, Canada, Associate Professor Haywood initially proffers: “The study and application of hospitality management has progressed on its own for many years; however, managers are not immune to the knowledge gained from study of other service industries. The author synthesizes what is happening in the area of service management, looks at its relevance to hospitality management, and identifies a few important implications of service management for hospitality managers.” The author draws a distinction between non-denominated service management, and service management as it applies to the hospitality industry. This is done to make an apparent comparison, as many people would assume the two are one in the same. They are not, and the contrast works well here. “While much of what we already know about effective management applies to service industries, some of the traditional concepts of management are inadequate in solving the problems faced by service businesses,” Haywood points out. “If a body of knowledge to be known as service management already exists, or is being developed, where does it fit relative to hospitality management,” Haywood asks. According to John Bateson, Testing a Conceptual Framework for Consumer Service Marketing, there are four criteria used to judge service management. Haywood details these for you, the reader, by way of citation. Haywood points to the difficulty in pin-pointing the intangibles that underpin the service industry. Since service is a concept rather than a touchable good, such as inventory, problems arise for both the organization and the client. Haywood points to a classic study of four service industries in France to illustrate the problems, although no realistic suggestions address the issues. “Over the past few years a variety of system models have been developed to explain the service process, that is, how the service is designed, produced, delivered, and consumed,” Haywood offers. These models are depicted in Appendices A-E. In offering perspectives on how the hospitality industry can gain from the experiences of service management, Haywood observes: “Service management places particular emphasis on a strategic outlook. Hospitality firms would be wise to carefully examine how they are perceived in the marketplace vis-a-vis their service concept, position, competitive situation, and management’s leadership abilities.” “Learning from the experiences of other service firms can help keep a company on track, that is, providing needed and valued services,” he closes the thought.

In his study - File Control: The Heart Of Business Computer Management - William G. O'Brien, Assistant Professor, The School of Hospitality Management at Florida International University, initially informs you: “Even though computers are an everyday part of the hospitality industry, many managers lack the knowledge and experience to control and protect the files in these systems. The author offers guidelines which can minimize or prevent damage to the business as a whole.” Our author initially opens this study with some anecdotal instances illustrating the failure of hospitality managers to exercise due caution with regard to computer supported information systems inside their restaurants and hotels. “Of the three components that make up any business computer system (data files, programs, and hard-ware), it is files that are most important, perhaps irreplaceable, to the business,” O’Brien informs you. O’Brien breaks down the noun, files, into two distinct categories. They are, the files of extrinsic value, and its counterpart the files of intrinsic value. An example of extrinsic value files would be a restaurant’s wine inventory. “As sales are made and new shipments are received, the computer updates the file,” says O’Brien. “This information might come directly from a point-of-sale terminal or might be entered manually by an employee,” he further explains. On the intrinsic side of the equation, O’Brien wants you to know that the information itself is the valuable part of this type of file. Its value is over and above the file’s informational purpose as a pragmatic business tool, as it is in inventory control. “The information is money in the legal sense For instance, figures moved about in banking system computers do not represent dollars; they are dollars,” O’Brien explains. “If the record of a dollar amount is erased from all computer files, then that money ceases to exist,” he warns. This type of information can also be bought and sold, such as it is in customer lists to advertisers. Files must be protected O’Brien stresses. “File security requires a systematic approach,” he discloses. O’Brien goes on to explain important elements to consider when evaluating file information. File back-up is also an important factor to think about, along with file storage/safety concerns. “Sooner or later, every property will have its fire, flood, careless mistake, or disgruntled employee,” O’Brien closes. “…good file control can minimize or prevent damage to the business as a whole.”

In her discussion - Understanding Annual Reports of Hospitality Firms - by Elisa S. Moncarz, Associate Professor, School of Hospitality Management, Florida International University, Associate Professor Moncarz initially offers: “Management bears full responsibility for the reporting function of annual reports prepared by publicly-held companies designed to provide interested parties with information that is useful in making business and economic decisions. In Part I the author reviews the content of annual reports of firms in the hospitality industry, while looking at recent developments affecting annual reports. Part 11, in a subsequent issue, will comprise an in-depth examination of the annual report of an actual firm in the hospitality industry, focusing on suggested guidelines and recommendations for how to use annual reports as an aid to the decision-making process in the hospitality industry.” This article is to be considered a primer on reading and understanding annual reports, as well as a glimpse into the dynamics that affect them. In defining what an annual report is, Associate Professor Moncarz informs you with citation, “Annual reports are required by the Securities Exchange Commission (SEC) ¹ for all companies with securities sold to the general public. These reports, which must be issued within 90 days after the close of the calendar (or fiscal) year, comprise a primary source of information about these companies,” she further reports. “Indeed, the official version of the company's history is summed up yearly in its annual report by providing full information of the company's operations over the period as well as what the company is gearing up to accomplish in the next year,” Professor Moncarz closes the definition. Why should thus happen over and above SEC requirements? The financial component is an important one; the author offers her informed view: “The major objective of financial statement reporting is to provide information that is useful to present and potential investors, creditors, and other financial statement users in making rational investment, credit, and similar decisions. Thus, financial statements represent the primary (and most reliable) source of knowledge about a particular firm in the hospitality industry.” The above two paragraphs crystallize the requirement and the objective of annual reports. “A typical annual report of a hospitality firm contains a number of standard features which may be broken down into the following three sections…” General, financial data, and supplementary data are variously bounded and circumscribed for you. As a marketing device and feel-good initiative, the annual report is a useful tool for a hospitality corporation that is in-the-black, and focused on the future, says the author. She cites the Marriott Corporation’s 1985 annual report as an example. Of course, an annual report can also be a harbinger of bad news for shareholders as well. Notes/footnotes and disclosure are key elements to the credibility of any annual report; Professor Moncarz discusses these concepts at length. “Given the likelihood that the hospitality industry will continue to face an uncertain economic environment for some time, financial statement users should become more demanding in their need for information that will help assure the firm's survival and evaluate its ability to generate earnings, increase the firm's investment value, and provide for its future growth,” Professor Moncarz says. “Accordingly, understanding annual reports in the hospitality industry should become even more critical.”

In the discussion - Indirect Cost Factors in Menu Pricing – by David V. Pavesic, Associate Professor, Hotel, Restaurant and Travel Administration at Georgia State University, Associate Professor Pavesic initially states: “Rational pricing methodologies have traditionally employed quantitative factors to mark up food and beverage or food and labor because these costs can be isolated and allocated to specific menu items. There are, however, a number of indirect costs that can influence the price charged because they provide added value to the customer or are affected by supply/demand factors. The author discusses these costs and factors that must be taken into account in pricing decisions. Professor Pavesic offers as a given that menu pricing should cover costs, return a profit, reflect a value for the customer, and in the long run, attract customers and market the establishment. “Prices that are too high will drive customers away, and prices that are too low will sacrifice profit,” Professor Pavesic puts it succinctly. To dovetail with this premise the author provides that although food costs measure markedly into menu pricing, other factors such as equipment utilization, popularity/demand, and marketing are but a few of the parenthetic factors also to be considered. “… there is no single method that can be used to mark up every item on any given restaurant menu. One must employ a combination of methodologies and theories,” says Professor Pavesic. “Therefore, when properly carried out, prices will reflect food cost percentages, individual and/or weighted contribution margins, price points, and desired check averages, as well as factors driven by intuition, competition, and demand.” Additionally, Professor Pavesic wants you to know that value, as opposed to maximizing revenue, should be a primary motivating factor when designing menu pricing. This philosophy does come with certain caveats, and he explains them to you. Generically speaking, Professor Pavesic says, “The market ultimately determines the price one can charge.” But, in fine-tuning that decree he further offers, “Lower prices do not automatically translate into value and bargain in the minds of the customers. Having the lowest prices in your market may not bring customers or profit. “Too often operators engage in price wars through discount promotions and find that profits fall and their image in the marketplace is lowered,” Professor Pavesic warns. In reference to intangibles that influence menu pricing, service is at the top of the list. Ambience, location, amenities, product [i.e. food] presentation, and price elasticity are discussed as well. Be aware of price-value perception; Professor Pavesic explains this concept to you. Valuable genetic variation for bean breeding programs is held within the common bean secondary gene pool which consists of Phaseolus albescens, P. coccineus, P. costaricensis, and P. dumosus. However, the use of close relatives for bean improvement is limited due to the lack of knowledge about genetic variation and genetic plasticity of many of these species. Characterisation and analysis of the genetic diversity is necessary among beans' wild relatives; in addition, conflicting phylogenies and relationships need to be understood and a hypothesis of a hybrid origin of P. dumosus needs to be tested. This thesis research was orientated to generate information about the patterns of relationships among the common bean secondary gene pool, with particular focus on the species Phaseolus dumosus. This species displays a set of characteristics of agronomic interest, not only for the direct improvement of common bean but also as a source of valuable genes for adaptation to climate change. Here I undertake the first comprehensive study of the genetic diversity of P. dumosus as ascertained from both nuclear and chloroplast genome markers. A germplasm collection of the ancestral forms of P. dumosus together with wild, landrace and cultivar representatives of all other species of the common bean secondary gene pool, were used to analyse genetic diversity, phylogenetic relationships and structure of P. dumosus. Data on molecular variation was generated from sequences of cpDNA loci accD-psaI spacer, trnT-trnL spacer, trnL intron and rps14-psaB spacer and from the nrDNA the ITS region. A whole genome DArT array was developed and used for the genotyping of P. dumosus and its closes relatives. 4208 polymorphic markers were generated in the DArT array and from those, 742 markers presented a call rate >95% and zero discordance. DArT markers revealed a moderate genetic polymorphism among P. dumosus samples (13% of polymorphic loci), while P. coccineus presented the highest level of polymorphism (88% of polymorphic loci). At the cpDNA one ancestral haplotype was detected among all samples of all species in the secondary genepool. The ITS region of P. dumosus revealed high homogeneity and polymorphism bias to P. coccineus genome. Phylogenetic reconstructions made with Maximum likelihood and Bayesian methods confirmed previously reported discrepancies among the nuclear and chloroplast genomes of P. dumosus. The outline of relationships by hybridization networks displayed a considerable number of interactions within and between species. This research provides compelling evidence that P. dumosus arose from hybridisation between P. vulgaris and P. coccineus and confirms that P. costaricensis has likely been involved in the genesis or backcrossing events (or both) in the history of P. dumosus. The classification of the specie P. persistentus was analysed based on cpDNA and ITS sequences, the results found this species to be highly related to P. vulgaris but not too similar to P. leptostachyus as previously proposed. This research demonstrates that wild types of the secondary genepool carry a significant genetic variation which makes this a valuable genetic resource for common bean improvement. The DArT array generated in this research is a valuable resource for breeding programs since it has the potential to be used in several approaches including genotyping, discovery of novel traits, mapping and marker-trait associations. Efforts should be made to search for potential populations of P. persistentus and to increase the collection of new populations of P. dumosus, P. albescens and P. costaricensis that may provide valuable traits for introgression into common bean and other Phaseolus crops.

Cette recherche constitue un essai de théorie critique féministe matérialiste et radicale. Elle poursuit principalement un objectif de dénonciation de la structure actuelle du droit du logement. À partir d’un cadre conceptuel fondé sur le féminisme matérialiste et radical, elle souhaite faire ressortir le point de vue de la classe des femmes dans l’habitation. Le droit du logement est ici utilisé dans un sens large, puisqu’il se réfère à la fois au logement comme phénomène juridique, mais aussi sociologique. À l’intérieur de la discipline juridique, il renvoie à l’ensemble des législations actuellement en vigueur au Québec en ce qui concerne la vie à domicile. Notre étude se concentre sur deux modes d’occupation des lieux, à travers le droit de propriété et le système locatif. Le droit au logement fait l’objet d’une reconnaissance internationale dans les textes portant sur les droits humains. Il est reconnu comme le « droit à un logement suffisant ». Au Canada et au Québec, il ne fait pas l’objet d’une reconnaissance explicite, malgré les engagements pris sur la scène internationale. Un portrait statistique, appuyé sur le critère du sexe, permet de mettre en évidence qu’il existe des écarts entre les hommes et les femmes en ce qui concerne la mise en application du droit du logement. Les femmes accèdent plus difficilement à un logement; elles y effectuent la majorité du travail domestique, de service et de « care » et elles sont les principales victimes des violences commises à domicile. Dans le système d’habitation, l’expérience des femmes se comprend comme une appropriation à la fois privée et collective par la classe des hommes, telle que réfléchie par Colette Guillaumin, qui se concentre autour de la division sexuelle du travail et des violences sexuées. Le droit du logement, dans sa forme actuelle, repose sur l’appropriation de la force de travail des femmes et de leur corps. Ces deux critères permettent de construire une grille d’analyse féministe matérialiste et radicale pour analyser la structure du droit du logement, tel que conçu en droit civil. Cette analyse féministe permet également de situer le droit étatique comme une pratique patriarcale. Cette dernière contribue à assurer le maintien du système d’habitation, qui est assimilable à un système hégémonique, au sens développé par Gramsci. Cette étude réfléchit sur le droit du logement dans le climat politique néolibéral. Le néolibéralisme est développé comme une idéologie qui impose une rationalité marchande à l’ensemble des politiques étatiques. À partir d’une méthode décrite comme métathéorique externe radicalement réflexive, puisqu’elle propose l’importation d’outils conceptuels étrangers à la discipline du droit moderne, nous réfléchissons de manière radicale la construction du droit civil et des institutions qui encadrent le droit du logement. La collecte des données s’effectue à partir de la recherche documentaire. Quatre institutions du droit civil seront examinées dans le détail, soit le sujet du droit, la dichotomie privé/public, la médiation du droit du logement par les biens immeubles, à travers le rapport contractuel et le droit de propriété, et finalement les notaires. L’analyse féministe du sujet du droit insiste sur un paradoxe. D’une part, l’universalité présumée de ce sujet, laquelle permet de poser l’égalité et la liberté pour toutes les personnes juridiques. Or, plutôt que d’être neutre sexuellement comme le prétend le droit positif, nous démontrons comment ce sujet est constamment un membre de la classe des hommes. D’autre part, nous analysons comment le droit reconnaît le sexe de ses sujets, mais surtout comment cette sexualité est construite sur l’idéologie naturaliste. Ce modèle de sujet masculin est fondamental dans la construction du droit du logement. L’étude féministe de la dichotomie privé/public en fait ressortir le caractère situé. En effet, si par essence aucun domaine ou enjeu n’est en soit privé ou public, le processus de qualification, lui, est un acte de pouvoir. Nous verrons comment le droit civil crée des zones de droit privé, comprises comme des zones de non-droit pour les femmes. La qualification de privé dévalue également le travail accompli par cette classe de sexe. Le droit du logement est pourtant centré sur le rapport contractuel et sur le droit de propriété. Il importe alors d’examiner la nature du consentement donné par les femmes comme groupe social dans les contrats de vente et de location. Ces contrats ne prennent pas en compte l’expérience des femmes dans leur formation. Les catégories qui y sont attachées, telles que vendeur.e ou locataire, représentent le point de vue de la classe des hommes. Bien que la popularité de la copropriété auprès de la classe des femmes semble porteuse d’un vent de changement, nous analysons comment le discours dominant qui l’entoure instrumentalise certaines revendications féministes, tout en laissant dans l’ombre la question du travail domestique et des violences sexuées. Finalement, nous nous intéressons aux notaires en les repensant comme des intellectuel.les organiques, tels que conçu.es par Gramsci, pour la classe des hommes. Cette fonction d’intellectuel.les permet de mettre en lumière comment chaque transaction immobilière favorise la reproduction des intérêts patriarcaux, remettant ainsi en question la nature des devoirs de conseil et d’impartialité du notariat. À la lumière de cette analyse, le Code civil du Québec est qualifié dans une perspective féministe matérialiste et radicale pour devenir un système qui institutionnalise l’appropriation des femmes par l’entremise du droit du logement. Ce travail de recherche permet d’envisager certaines pistes de réflexion pour des rénovations potentielles des pratiques juridiques entourant le droit du logement, notamment la pratique notariale, tournées vers des objectifs féministes de justice sociale.
Resumo:
Cette thèse a comme objectif de démontrer combien Alaric et ses Goths étaient Romains dans pratiquement toutes les catégories connues sur leur compte. Pour ce faire, l’auteur a puisé dans les sciences sociales et a emprunté le champ conceptuel de l’éminent sociologue Pierre Bourdieu. À l’aide du concept d’habitus, entre autres choses, l’auteur a tenté de faire valoir à quel point les actions d’Alaric s’apparentaient à celles des généraux romains de son époque. Naturellement, il a fallu étaler le raisonnement au long de plusieurs chapitres et sur de nombreux niveaux. C’est-à-dire qu’il a fallu d’abord définir les concepts populaires en ce moment pour « faire » l’histoire des barbares durant l’Antiquité tardive. Pensons ici à des termes tels que l’ethnicité et l’ethnogenèse. L’auteur s’est distancé de ces concepts qu’il croyait mal adaptés à la réalité des Goths et d’Alaric. C’est qu’il fallait comprendre ces hommes dans une structure romaine, au lieu de leur octroyer une histoire et des traditions barbares. Il a ensuite fallu montrer que la thèse explorait des avenues restées peu empruntées jusqu’à aujourd’hui. Il a été question de remonter jusqu’à Gibbon pour ensuite promouvoir le fait que quelques érudits avaient autrefois effleuré la question d’Alaric comme étant un homme beaucoup moins barbare que ce que la tradition véhiculait à son sujet, tel que Fustel de Coulanges, Amédée Thierry ou encore Marcel Brion. Il s’agissait donc de valider l’angle de recherche en prenant appui d’abord sur ces anciens luminaires de la discipline. Vint ensuite l’apport majeur de cette thèse, c’est-à-dire essentiellement les sections B, C et D. La section B a analysé la logistique durant la carrière d’Alaric. Cette section a permis avant tout de démontrer clairement qu’on n’a pas affaire à une troupe de brigands révoltés; le voyage de 401-402 en Italie prouve à lui seul ce fait. L’analyse approfondie de l’itinéraire d’Alaric durant ses nombreux voyages a démontré que cette armée n’aurait pas pu effectuer tous ces déplacements sans l’appui de la cour orientale. En l’occurrence, Alaric et son armée étaient véritablement des soldats romains à ce moment précis, et non pas simplement les fédérés barbares de la tradition. La section C s’est concentrée sur les Goths d’Alaric, où on peut trouver deux chapitres qui analysent deux sujets distincts : origine/migration et comparaison. C’est dans cette section que l’auteur tente de valider l’hypothèse que les Goths d’Alaric n’étaient pas vraiment Goths, d’abord, et qu’ils étaient plutôt Romains, ensuite. Le chapitre sur la migration n’a comme but que de faire tomber les nombreuses présomptions sur la tradition gothe que des érudits comme Wolfram et Heather s’efforcent de défendre encore aujourd’hui. L’auteur argumente pour voir les Goths d’Alaric comme un groupe formé à partir d’éléments romains; qu’ils eurent été d’une origine barbare quelconque dans les faits n’a aucun impact sur le résultat final : ces hommes avaient vécu dans l’Empire durant toute leur vie (Alaric inclus) et leurs habitus ne pouvaient pas être autre chose que romain. Le dernier chapitre de la section C a aussi démontré que le groupe d’Alaric était d’abord profondément différent des Goths de 376-382, puis d’autres groupes que l’on dit barbares au tournant du 5e siècle, comme l’étaient les Vandales et les Alamans par exemple. Ensemble, ces trois chapitres couvrent la totalité de ce que l’on connait du groupe d’Alaric et en offre une nouvelle interprétation à la lumière des dernières tendances sociologiques. La section D analyse quant à elle en profondeur Alaric et sa place dans l’Empire romain. L’auteur a avant tout lancé l’idée, en s’appuyant sur les sources, qu’Alaric n’était pas un Goth ni un roi. Il a ensuite analysé le rôle d’Alaric dans la structure du pouvoir de l’Empire et en est venu à la conclusion qu’il était l’un des plus importants personnages de l’Empire d’Orient entre 397 et 408, tout en étant soumis irrémédiablement à cette structure. Sa carrière militaire était des plus normale et s’inscrivait dans l’habitus militaire romain de l’époque. Il a d’ailleurs montré que, par ses actions, Alaric était tout aussi Romain qu’un Stilicon. À dire le vrai, mis à part Claudien, rien ne pourrait nous indiquer qu’Alaric était un barbare et qu’il essayait d’anéantir l’Empire. La mauvaise image d’Alaric n’est en effet redevable qu’à Claudien : aucun auteur contemporain n’en a dressé un portrait aussi sombre. En découle que les auteurs subséquents qui firent d’Alaric le roi des Goths et le ravageur de la Grèce avaient sans doute été fortement influencés eux aussi par les textes de Claudien.

Le traitement des émotions joue un rôle essentiel dans les relations interpersonnelles. Des déficits dans la reconnaissance des émotions évoquées par les expressions faciales et vocales ont été démontrés à la suite d’un traumatisme craniocérébral (TCC). Toutefois, la majorité des études n’ont pas différencié les participants selon le niveau de gravité du TCC et n’ont pas évalué certains préalables essentiels au traitement émotionnel, tels que la capacité à percevoir les caractéristiques faciales et vocales, et par le fait même, la capacité à y porter attention. Aucune étude ne s’est intéressée au traitement des émotions évoquées par les expressions musicales, alors que la musique est utilisée comme méthode d’intervention afin de répondre à des besoins de prise en charge comportementale, cognitive ou affective chez des personnes présentant des atteintes neurologiques. Ainsi, on ignore si les effets positifs de l’intervention musicale sont basés sur la préservation de la reconnaissance de certaines catégories d’émotions évoquées par les expressions musicales à la suite d’un TCC. La première étude de cette thèse a évalué la reconnaissance des émotions de base (joie, tristesse, peur) évoquées par les expressions faciales, vocales et musicales chez quarante et un adultes (10 TCC modéré-sévère, 9 TCC léger complexe, 11 TCC léger simple et 11 témoins), à partir de tâches expérimentales et de tâches perceptuelles contrôles. Les résultats suggèrent un déficit de la reconnaissance de la peur évoquée par les expressions faciales à la suite d’un TCC modéré-sévère et d’un TCC léger complexe, comparativement aux personnes avec un TCC léger simple et sans TCC. Le déficit n’est pas expliqué par un trouble perceptuel sous-jacent. Les résultats montrent de plus une préservation de la reconnaissance des émotions évoquées par les expressions vocales et musicales à la suite d’un TCC, indépendamment du niveau de gravité. Enfin, malgré une dissociation observée entre les performances aux tâches de reconnaissance des émotions évoquées par les modalités visuelle et auditive, aucune corrélation n’a été trouvée entre les expressions vocales et musicales. La deuxième étude a mesuré les ondes cérébrales précoces (N1, N170) et plus tardives (N2) de vingt-cinq adultes (10 TCC léger simple, 1 TCC léger complexe, 3 TCC modéré-sévère et 11 témoins), pendant la présentation d’expressions faciales évoquant la peur, la neutralité et la joie. Les résultats suggèrent des altérations dans le traitement attentionnel précoce à la suite d’un TCC, qui amenuisent le traitement ultérieur de la peur évoquée par les expressions faciales. En somme, les conclusions de cette thèse affinent notre compréhension du traitement des émotions évoquées par les expressions faciales, vocales et musicales à la suite d’un TCC selon le niveau de gravité. Les résultats permettent également de mieux saisir les origines des déficits du traitement des émotions évoquées par les expressions faciales à la suite d’un TCC, lesquels semblent secondaires à des altérations attentionnelles précoces. Cette thèse pourrait contribuer au développement éventuel d’interventions axées sur les émotions à la suite d’un TCC.
