Los TBI (Tratado Bilateral de Inversión) o también denominado los APPI (Acuerdo de Protección y Promoción de las Inversiones) son acuerdos que buscan la Protección y la Promoción de las inversiones que hagan los nacionales de un Estado en otro Estado conocido como el “Estado Receptor”. Los TBI y APPI fueron concebidos dentro del proceso de descolonización que le siguió a la Segunda Guerra Mundial. Esto se debe a que los Estados que habían colonizado otros territorios, ahora Estados soberanos y sus nacionales, seguían teniendo fuertes lazos e intereses económicos. Con el ánimo de protegerse de posibles expropiaciones, los Estados europeos liderados por Alemania, firmaron un número importante de TBI y APPI, no solamente con sus antiguas colonias, sino con otras. De esta manera, Alemania, Suiza, Holanda, Italia, Bélgica y Suecia suscribieron al menos cuarenta tratados de este tipo con varios Estados asiáticos, africanos y del medio oriente entre 1959 y 1965. Estados Unidos se demoró unos veinte o treinta años más, porque los estadounidenses no solamente aspiraban a obtener protección para sus inversionistas, sino que además solicitaban que se abriera y liberara la economía de los Estados firmantes. Finalmente, fue en la administración de Ronald Reagan que los Estados Unidos comenzó a suscribirlos.

El artículo se propone escrutar, a la luz del caso argentino, la concepción de propiedad privada subyacente en las respuestas de las instituciones internacionales de arbitraje en el marco de las controversias entre Estados e inversores transnacionales. Se entiende que el análisis del caso argentino puede echar luz en la materia al tratarse del país con mayor número de demandas en su contra.

La importancia y el efecto práctico de la CNY son indiscutibles desde hace mucho tiempo. La CNY ha regulado, directa o implícitamente, todos los pilares fundamentales del arbitraje internacional, proporcionando un marco jurídico uniforme para el desarrollo de este mecanismo alternativo de resolución de conflictos. La CNY ha obligado a sus Estados contratantes a reconocer y ejecutar los acuerdos y laudos arbitrales con independencia de sus regulaciones e intereses locales. Así, por su alcance casi universal, la CNY ha alcanzado una relevancia extraordinaria. Conjuntamente con su relevancia, la CNY ha proporcionado fundamentos adicionales para sostener la existencia de una jurisdicción arbitral autónoma que difiera de los ordenamientos jurídicos de cada Estado Contratante. Este planteamiento ha alcanzado aún mayor relevancia al ser avalado por la doctrina, los profesionales del arbitraje y la jurisprudencia de varios países -siendo su máximo exponente la jurisdicción francesa-. Atendiendo a las consecuencias prácticas de este debate, esta tesis abordará (CAP 1) una revisión de la CNY y sus principales disposiciones que sugieren el "estatus constitucional" de la CNY, (CAP 2) los modelos filosóficos del arbitraje internacional, (CAP 3) el fenómeno de la ejecución de los laudos arbitrales anulados por los tribunales nacionales, y (CAP 4) la autonomía jurídica del laudo dictado en un arbitraje internacional respecto de la sede del mismo.

Este trabalho acadêmico explora, em linhas gerais, a questão da adaptação do contrato de investimento internacional, e o tema ‘cláusula de hardship’ em específico. Objetiva-se efetuar uma análise detalhada da cláusula de hardship, como meio de adaptação e flexibilização de contratos internacionais de investimento sob a ótica da prática jurídica e mercantil contemporânea. A discussão se centra no contraste entre a possibilidade de adaptação do contrato por circunstâncias imprevisíveis e o imperativo de previsibilidade no investimento. Nesse sentido, o estudo busca oferecer soluções práticas para o dilema existente entre a necessidade de segurança na relação econômica (cumprimento do contato) e a prevenção da possibilidade de ruína financeira para quaisquer das partes no caso de uma mudança brusca no contexto dos negócios. O trabalho está centrado em uma investigação teórica acerca dos temas de readaptação contratual; diferenças entre sistemas jurídicos de estados-nações, e suas consequências no comércio internacional; e a cláusula de hardship em si. Como forma de contribuir para uma compreensão prática na questão da adaptação do contrato de investimento internacional devido a fatores imprevistos, este trabalho analisa casos reais e tendências atuais observadas na arbitragem internacional.

Abstract The importance of thrombosis and anticoagulation in clinical practice is rooted firmly in several fundamental constructs that can be applied both broadly and globally. Awareness and the appropriate use of anticoagulant therapy remain the keys to prevention and treatment. However, to assure maximal efficacy and safety, the clinician must, according to the available evidence, choose the right drug, at the right dose, for the right patient, under the right indication, and for the right duration of time. The first International Symposium of Thrombosis and Anticoagulation in Internal Medicine was a scientific program developed by clinicians for clinicians. The primary objective of the meeting was to educate, motivate and inspire internists, cardiologists and hematologists by convening national and international visionaries, thought-leaders and dedicated clinician-scientists in Sao Paulo, Brazil. Dynamical systems modeling tumor growth have been investigated to determine the dynamics between tumor and healthy cells. Recent theoretical investigations indicate that these interactions may lead to different dynamical outcomes, in particular to homoclinic chaos. In the present study, we analyze both topological and dynamical properties of a recently characterized chaotic attractor governing the dynamics of tumor cells interacting with healthy tissue cells and effector cells of the immune system. By using the theory of symbolic dynamics, we first characterize the topological entropy and the parameter space ordering of kneading sequences from one-dimensional iterated maps identified in the dynamics, focusing on the effects of inactivation interactions between both effector and tumor cells. The previous analyses are complemented with the computation of the spectrum of Lyapunov exponents, the fractal dimension and the predictability of the chaotic attractors. Our results show that the inactivation rate of effector cells by the tumor cells has an important effect on the dynamics of the system. The increase of effector cells inactivation involves an inverse Feigenbaum (i.e. period-halving bifurcation) scenario, which results in the stabilization of the dynamics and in an increase of dynamics predictability. Our analyses also reveal that, at low inactivation rates of effector cells, tumor cells undergo strong, chaotic fluctuations, with the dynamics being highly unpredictable. Our findings are discussed in the context of tumor cells potential viability.

The "Yearbook of Private International Law" provides all about the conflict of laws developments of 2012 and 2013 in one book: Volume XIV (2012/2013) includes contributions on the proposed codification of the General Part of Private International Law in Europe, on the reform of the Chinese legal system as well as on defamation and violation of personality rights (the latter in a whole section). Furthermore, the book deals with the application of EU legislation on jurisdiction and enforcement of judgements, the recognition of judgements overturned by another judgement, and the conflict of decisions in international arbitration. Reports and court decisions from the Netherlands, Turkey, India, Finland, Croatia and Switzerland and a summary of two dissertations on the role of sovereignty and choice of courts agreements complete the book.

An analysis of the alternatives of compensation in relation to international investment disputes is relevant, because a pecuniary award is not always the appropriate remedy to solve disputes arising between investors and States. This is the case because States may be increasingly interested in opting for a different type of compensation. Furthermore, it is still not clear whether arbitral tribunals have recognised alternative types of awarding damages in respect of international investments disputes. This analysis comprises two principal components, the first, is to identify whether or not the tribunals may render an award that not only demands the payment of a sum of money but also considers some other means of compensation. The second, centres on how compliance with these non-pecuniary awards may be demanded. Our approach to these two principal components will always revolve around the idea of respecting the sovereignty of the State, bearing in mind that the execution of an arbitral award, which obliges the State to refrain from or to perform an act in its territory, relies precisely on the sovereignty of the State to execute it.

It is in the interest of most states to eliminate double taxation (i.e. the payment of the same tax in two jurisdictions) of transnational commercial enterprises. Because such disputes involve, on the one hand, the state imposition of taxes, a right universally asserted by all states, and private entities on the other, taxation disputes between such parties are not, on their face, easily susceptible to arbitration. This article analyzes two dispute settlement procedures-the OECD First Model Tax Convention and a similar EU Convention-with the exclusive focus on disputes relating to the imposition of double taxation. It will look at the ways in which state roles may vary under these procedures from assisting in the negotiation process to taking a part similar to, but with important differences from, diplomatic protection on behalf of an affected enterprise. The article will examine the situations under which the settlement procedure is required and/or available, how the procedures are triggered, the obligations and parts played by the parties, the means by which the disputes are resolved (from negotiations to tribunals) and the limitations of the procedures. Are they “taxpayer friendly”? As a result the reader may draw comparisons between the two procedures. Finally, the article will look at the proposed OECD Arbitration Clause which is intended to be incorporated into Article 25 of the OECD Model Tax Convention as well as how these mechanisms relate and/or conflict with bilateral tax treaties and the GATS.
