El derecho internacional, como el derecho administrativo de cada Estado, se encuentra vinculado a la finalidad universal del derecho. No obstante, la influencia de la comunidad internacional en los asuntos jurídicos de los Estados está generando, con el auge de la globalización, mecanismos o instrumentos que de forma no impositiva pero sí persuasiva, vienen delimitando las competencias estatales. Estos instrumentos ejercen la función de ordenar los ámbitos de validez de dichas competencias jurídicas y administrativas internas, a través de formas declaratorias de carácter internacional, mediante normas jurídicas blandas denominadas soft law. El amplio y variado uso del soft law en temas como los derechos humanos y el medio ambiente plantea una dificultad para la teoría tradicional de fuentes, inspirada en la voluntad de los Estados, los cuales se constituyen a partir de su soberanía estatal (hard law). Esto sugiere una dicotomía jurídica, en donde el soft law se contrasta con las reglas legales que definen obligaciones específicas de hard law, es decir, “son normas o principios más abiertos o generales en su contenido y significado, comprendiéndose como suaves. En tal caso, el Soft Law plantea una apertura a la internacionalización y democratización del derecho administrativo. La creciente adopción de instrumentos de soft law de influencia internacional o global permite la participación de actores no estatales, tales como las organizaciones no gubernamentales (ONG), y de carácter civil en la construcción de políticas e instrumentos que en ocasiones adquieren más legitimidad que las leyes creadas para atender tales asuntos.

Resumen El autor ilustra este ensayo con el caso Véliz Franco (Guatemala, diciembre de 2001), el cual descarna la brutalidad de la agresión, la escasa información académica y forense sobre el feminicidio adolescente y la inercia estatal por hallar a los responsables de esta manifestación de homicidio. De igual manera, resalta el papel de las organizaciones no gubernamentales ante la Comisión Interamericana de Derechos Humanos (CIDH), en especial la necesidad de contrarrestar la impunidad generalizada en el caso de los y las adolescentes. En la audiencia 12.578, la abogada y experta guatemalteca Claudia Paz saca a relucir las debilidades de la investigación e identifica las fallas elementales del Estado guatemalteco al delimitar la escena del crimen y las piezas de la evidencia. Abstract The author illustrates this essay with the Véliz Franco’s case (Guatemala, December 2001), which narrates the brutality of the aggression, the lack of information on the feminicide towards teenagers and the state inertia to seek the perpetrators of such crimes. The article also highlights the role of Non-Governmental Organizations (NGO’s) before the Inter-American Commission of Human Rights, especially on the need to combat the generalized impunity in cases of murders of teenagers. In the audience 12.578 the Guatemalan lawyer and expert, Claudia Paz, brings up the weaknesses of the investigation and identifies the core failures of the state to specify the crime scene and the pieces of evidence. The primary aim of this thesis is to analyse legal and governance issues in the use of Environmental NPR-PPMs, particularly those aiming to promote sustainable practices or to protect natural resources. NPR-PPMs have traditionally been thought of as being incompatible with the rules of the World Trade Organization (WTO). However, the issue remains untouched by WTO adjudicatory bodies. One can suggest that WTO adjudicatory bodies may want to leave this issue to the Members, but the analysis of the case law also seems to indicate that the question of legality of NPR-PPMs has not been brought ‘as such’ in dispute settlement. This thesis advances the argument that despite the fact that the legal status of NPR-PPMs remains unsettled, during the last decades adjudicatory bodies have been scrutinising environmental measures based on NPR-PPMs just as another expression of the regulatory autonomy of the Members. Though NPR-PPMs are regulatory choices associated with a wide range of environmental concerns, trade disputes giving rise to questions related to the legality of process-based measures have been mainly associated with the protection of marine wildlife (i.e., fishing techniques threatening or affecting animal species). This thesis argues that environmental objectives articulated as NPR-PPMs can indeed qualify as legitimate objectives both under the GATT and the TBT Agreement. However, an important challenge for the their compatibility with WTO law relate to aspects associated with arbitrary or unjustifiable discrimination. In the assessment of discrimination procedural issues play an important role. This thesis also elucidates other important dimensions to the issue from the perspective of global governance. One of the arguments advanced in this thesis is that a comprehensive analysis of environmental NPR-PPMs should consider not only their role in what is regarded as trade barriers (governmental and market-driven), but also their significance in global objectives such as the transition towards a green economy and sustainable patterns of consumption and production.
