Scopo dell’elaborato risulta l’analisi del rapporto tra atto politico e motivazione politica. Partendo da una ricostruzione storica, l’obiettivo del lavoro è mettere in luce i profili problematici ed i riflessi che l’atto politico – tema apparentemente sopito tanto a livello dottrinale, quanto giurisprudenziale - ricomincia, soprattutto grazie a un certo numero di recenti pronunce dei giudici amministrativi, ad avere, fornendo nuovi spunti di riflessione. Proprio questa nuova tendenza giurisprudenziale, diventa l’oggetto di analisi del terzo capitolo. In esso si esamina il repertorio di casistica giurisprudenziale in materia di atti di alta amministrazione. In breve, tale capitolo viene orientato all’esame di tutte quelle tipologie di atti emergenti dalla valutazione caso per caso effettuata dalla giurisprudenza che, nel tempo, sono state fatte rientrare nel novero degli atti di alta amministrazione, al fine di mettere in evidenza la necessità di un riequilibrio della categoria dell’atto di alta amministrazione, che ormai sembra non apparire più rispondente alla ratio della sua previsione, verso l’emersione di una nuova categoria: il provvedimento amministrativo a motivazione politica. In particolare, si sostiene come non si possano ritenere rientranti tra gli atti di alta amministrazione quegli atti a carattere puntuale a motivazione politica, cioè sorretti da ragioni di fiduciarietà politica, quali, ad esempio, le nomine di carattere fiduciario, strettamente informate dalla contingenza politica. Evidentemente, se tale base giustificativa costituisce la ratio sottesa alla legittimità di tali nomine, non si comprende la ragione per cui l’atto di revoca degli incarichi derivanti da tali nomine sia sottoposto ad un sindacato di ragionevolezza cui sfugge la nomina stessa da cui origina. Ed allora non può non ammettersi che anche l’atto di revoca possa essere sorretto da una motivazione politica perché, altrimenti, perderebbe ragione d’essere anche la nomina stessa. La corrispondenza di disciplina tra nomina e revoca si renderebbe necessaria in quanto, in caso contrario, risulterebbero vanificate fin dall’inizio le esigenze garantiste da assicurare ai singoli e si rischierebbe di bloccare il corretto esercizio della funzione di governo. Si propone, allora, la prospettazione della nuova categoria del provvedimento amministrativo a motivazione politica come quella categoria che, contraddistinta dal carattere della fiduciarietà, venga in soccorso agli organi politici per un recupero effettivo del loro ruolo senza impingere con le esigenze di tutela dei singoli. L’ultimo capitolo della tesi, quindi, si incentra su “Il provvedimento a motivazione politica: una nuova categoria della politicità”. Si tenta di ricostruirne il particolare regime di disciplina, mettendo in evidenza i limiti e le deroghe alle previsioni della l. n. 241/1990, nonchè la peculiarietà di ritenere integrato il requisito della motivazione nella forma del “venir meno della fiducia”. Scopo dell’ultima parte del lavoro diviene, quindi, quello di comprendere quale volto assume la politicità degli atti nell’ordinamento contemporaneo. Si ipotizzano, infatti, tre facce della politicità degli atti, dislocate su tre diversi livelli: atto politico, atto di alta amministrazione e provvedimento amministrativo a motivazione politica.

The question “artificial nutrition and hydration (ANH) is therapy or not?” is one of the key point of end-of-life issues in Italy, since it was (and it is also nowadays) a strategic and crucial point of the Italian Bioethics discussion about the last phases of human life: determining if ANH is therapy implies the possibility of being included in the list of treatments that could be mentioned for refusal within the living will document. But who is entitled to decide and judge if ANH is a therapy or not? Scientists? The Legislator? Judges? Patients? This issue at first sight seems just a matter of science, but at stake there is more than a scientific definition. According to several scholars, we are in the era of post-academic Science, in which Science broaden discussion, production, negotation and decision to other social groups that are not just the scientific communities. In this process, called co-production, on one hand scientific knowledge derives from the interaction between scientists and society at large. On the other hand, science is functional to co-production of social order. The continuous negotation on which science has to be used in social decisions is just the evidence of the mirroring negotation for different way to structure and interpret society. Thus, in the interaction between Science and Law, deciding what kind of Science could be suitable for a specific kind of Law, envisages a well defined idea of society behind this choice. I have analysed both the legislative path (still in progress) in the living will act production in Italy and Eluana Englaro’s judicial case (that somehow collapsed in the living will act negotiation), using official documents (hearings, texts of the official conference, committees comments and ruling texts) and interviewing key actors in the two processes from the science communication point of view (who talks in the name of science? Who defines what is a therapy? And how do they do?), finding support on the theoretical framework of the Science&Technologies Studies (S&TS).

Translations, says Gideon Toury, are facts of target cultures – but the perceived status of source texts has a bearing on how these are reflected or refracted in the target language. This proposition is particularly evident in the case of classics: when translators have to work on literary creations occupying a pivotal position in the source/target cultures, they adopt strategies of literalness and ennoblement which betray a quasi-religious awe – on the one hand, a desire to ruffle the surface of the revered original as little as possible; and on the other, a determination to reproduce the supposed “classical qualities” of the classic even when they are not present in the source. In this dissertation, Paola Venturi studies how the “idea of classic” influences translation theory and practice, and substantiates her theoretical observations by looking at Italian translations of eighteenth- and nineteenth-century English classics. A marked – and historically determined – disparity between source and target readerships, and the translators’ reverence for their prestigious originals, conspire to produce Italian versions which are much more “wooden” and “elegant” than their English counterparts.

Local worlds, global economies. For an ethnography of microcredit in Italy. The research main purpose is to provide an anthropological analysis of a microcredit project targeting migrant women in Venice, Italy. Microcredit is a globally widespread financial strategy. Muhammad Yunus’ Grameen Bank success in Bangladesh was pivotal in promoting microfinance as one of the most important poverty alleviation strategies in the Development Countries. Post Industrial Countries adopted microcredit to foster “non bankable” categories – notably immigrants, women and young people - financial inclusion. The history of the Venice project is reconstructed starting from the perspectives of its main characters (promoters, social workers, beneficiaries and local stakeholders). Their positioned representations are analyzed in order to understand how different actors reproduced or renegotiated some of the main rhetorics underpinning the hegemonic “microcredit discourse”. Specifically, keywords such as “sustainability”, “empowerment” and “trust” are critically deconstructed to see how they are meant and translated into practice by different actors. Fieldwork data allows some considerations on the Italian way to microfinance.

In this work we examine the reference to cultural elements in a sample of 13 textbooks of Spanish as a foreign language for Italian students. The aim is to observe how they treat the cultural component in the particular context of Spanish language teaching to Italians. In this context, especially relevant issues are the linguistic and cultural proximity between Italy and Spain, and the present fascination for Spain, which has given rise to some interesting phenomena, among others, a massive emigration of Italian youths to Spain.

The research examines which cultural and linguistic instruments can be offered to provide adult migrants with formative access to citizenship competences. Starting from the questions: How can individuals of all community groups present in a nation-state acquire high standards of linguistic, sociolinguistic and discourse competences in order to be fully integrated, that is to participate and be included in social activities in the public domain such as work and institutional environments? How are these competencies developed in an educational context? How do adult migrants behave linguistically in this context, according to their needs and motivations? The research hypothesis aimed at outlining a formative project of citizenship education targeted at adult foreign citizens, where a central role is assigned both to law education and linguistic education. Acoordingly, as the study considered if the introduction of a law programme in a second language course could be conceived as an opportunity to further the access to active citizenship and social participation, a corpus of audiodata was collected in law classes of an Italian adult professional course attended by a 50% of foreign students. The observation was conducted on teacher and learner talk and learner participation in classroom interaction when curriculum legal topics were introduced and discussed. In the classroom law discourse two dimensions were analyzed: the legal knowledge construction and the participants’ interpersonal and identity construction. From the analysis, the understanding is that drawn that law classes seem to represent an educational setting where foreign citizens have an opportunity to learn and practise citizenship. The social and pragmatic approach to legal contents plays a relevant role, in a subject which, in non-academic contexts, loses its technical specificity and refers to law as a product of social representation. In the observed educational environment, where students are adults who bring into the classroom multiple personal and social identities, legal topics have the advantage of increasing adult migrants’ motivation to ‘go back to school’ as they are likely to give hints, if not provide solutions, to problems relating to participation in socio-institutional activities. At the same time, these contents offer an ideal context where individuals can acquire high discourse competences and citizenship skills, such as agency and critical reflection. Besides, the analysis reveals that providing adult learners with materials that focus on rights, politics and the law, i.e. with materials which stimulate discussion on concerns affecting their daily lives, is welcomed by learners themselves, who might appreciate the integration of these same topics in a second language course.

La materia della responsabilità medico-sanitaria è stata interessata nell’ultimo decennio da significative innovazioni, innescate da diversi fattori, quali gli eccezionali progressi scientifici e tecnologici, l’influenza dei diritti stranieri e, in particolare, quello di fonte comunitaria. Tale fenomeno trascende il rapporto diretto medico-paziente e coinvolge la struttura sanitaria e la dimensione organizzativa della stessa. Sintomatica di tali innovazioni è la profonda evoluzione terminologica. Attualmente, infatti, si fa riferimento alla responsabilità medica o medico-sanitaria e non più alla responsabilità del medico, in quanto non può trascurarsi l’indispensabile apporto del personale infermieristico, delle ostetriche, degli assistenti sanitari e dei tecnici delle diverse branche della medicina. Si assiste, pertanto, ad un fenomeno di «spersonalizzazione» ed aggravamento della complessità dell’attività sanitaria: al trattamento propriamente diagnostico e terapeutico, si affiancano altre attività, di tipo informativo, alberghiero, assistenziale, così come nuove tipologie di trattamenti, quali la chirurgia estetica e ricostruttiva, il potenziamento fisico e muscolare, la sterilizzazione, la modificazione dei caratteri sessuali esterni. Ultimamente, poi, l’attenzione si è spostata sul destinatario dell’attività medica e, in particolar modo, sul consenso informato ai trattamenti sanitari e, soprattutto, alle modalità in cui lo stesso viene prestato. Al contempo, sono emersi aspetti di diritto costituzionale, attinenti alla tutela della persona, dei dati personali e sensibili, al diritto alla salute, concepito come diritto dell’essere umano in quanto tale, a prescindere dal requisito della cittadinanza, di diritto amministrativo, riguardanti l’organizzazione delle strutture sanitarie, di diritto penale e di deontologia professionale. All’incedere dei progressi scientifici e tecnologici raggiunti, tuttavia, corrisponde l’accanito desiderio di rivalsa in caso di fallimento delle cure e dei trattamenti o di esiti nefasti degli stessi, la quale ha condotto ad una sensibile accentuazione dei giudizi di responsabilità in campo medico. Basti pensare che, nell’ultimo decennio, i processi civili sono addirittura triplicati per il concatenarsi di molteplici concause: l’aumento delle patologie curate, l’evoluzione qualitativa dei mezzi di cura, la sensibilizzazione delle associazioni a difesa dei diritti del malato, l’allungamento della vita media dell’uomo, la pressione dei mass-media, la maggior consapevolezza dei propri diritti da parte del cittadino, la stessa evoluzione della responsabilità civile e delle sue funzioni. Ciò ha comportato, tra l’altro, un certo grado di uniformità nella disciplina applicabile agli illeciti, a prescindere dal titolo contrattuale o extracontrattuale della responsabilità.

Background: Brain cooling (BC) represents the elective treatment in asphyxiated newborns. Amplitude Integrated Electroencephalography (aEEG) and Near Infrared Spectroscopy (NIRS) monitoring may help to evaluate changes in cerebral electrical activity and cerebral hemodynamics during hypothermia. Objectives: To evaluate the prognostic value of aEEG time course and NIRS data in asphyxiated cooled infants. Methods: 12 term neonates admitted to our NICU with moderate-severe Hypoxic-Ischemic Encephalopathy (HIE) underwent selective BC. aEEG and NIRS monitoring were started as soon as possible and maintained during the whole hypothermic treatment. Follow-up was scheduled at regular intervals; adverse outcome was defined as death, cerebral palsy (CP) or global quotient < 88.7 at Griffiths’ Scale. Results: 2/12 infants died, 2 developed CP, 1 was normal at 6 months of age and then lost at follow-up and 7 showed a normal outcome at least at 1 year of age. The aEEG background pattern at 24 hours of life was abnormal in 10 newborns; only 4 of them developed an adverse outcome, whereas the 2 infants with a normal aEEG developed normally. In infants with adverse outcome NIRS showed a higher Tissue Oxygenation Index (TOI) than those with normal outcome (80.0±10.5% vs 66.9±7.0%, p=0.057; 79.7±9.4% vs 67.1±7.9%, p=0.034; 80.2±8.8% vs 71.6±5.9%, p=0.069 at 6, 12 and 24 hours of life, respectively). Conclusions: The aEEG background pattern at 24 hours of life loses its positive predictive value after BC implementation; TOI could be useful to predict early on infants that may benefit from other innovative therapies.

Background & Aims: This study investigates whether the aetiologic changes in liver disease and the improved management of hepatocellular carcinoma (HCC) have modified the clinical scenario of this tumour over the last 20 years in Italy. Methods: Retrospective study based on the analysis of the ITA.LI.CA (Italian Liver Cancer) database including 3027 HCC patients managed in 11 centres. Patients were divided into 3 groups according to the period of HCC diagnosis: 1987–1996 (year of the ‘‘Milano criteria’’ publication), 1997–2001 (year of release of the EASL guidelines for HCC), and 2002–2008. Results: The significant changes were: (1) progressive patient ageing; (2) increasing prevalence of HCV infection until 2001, with a subsequent decrease, when the alcoholic aetiology increased; (3) liver function improvement, until 2001; (4) increasing ‘‘incidental’’ at the expense of ‘‘symptomatic’’ diagnoses, until 2001; (5) unchanged prevalence of tumours diagnosed during surveillance (around 50%), with an increasing use of the 6- month schedule; (6) favourable HCC ‘‘stage migration’’, until 2001; (7) increasing use of percutaneous ablation; (8) improving survival, until 2001. Conclusions: Over the last 20 years, several aetiologic and clinical features regarding HCC have changed. The survival improvement observed until 2001 was due to an increasing number of tumours diagnosed in early stages and in a background of compensated cirrhosis, and a growing and better use of locoregional treatments. However, the prevalence of early cancers and survival did not increase further in the last years, a result inciting national policies aimed at implementing surveillance programmes for at risk patients.
