In Brazil, the 1946 Constitution enshrined the right to health, having it defined as the possession of the best state of health that the individual can achieve. Already the Federal Constitution of 1988 lifted that right to the status of fundamental social right, which transcends the effectiveness and cure of the disease is based on the joint liability of public entities for the provision of a quality service, efficient and prioritize human dignity and comprehensive evaluation of patients. According to the World Health Organization, the definition of health, first characterized as the mere absence of disease, has become recognized as the need to search for preventive mechanisms to ensure the welfare and dignity of the population. Garantista this context, the growing seem lawsuits that deal with the implementation of public policies, especially in the area of the right to health, the omission of which the Government can result in the risk of death. Hence the concern of law professionals about whether or not the intervention of the judiciary in cases that deal with providing material benefits of health care. It claims to break the principle of separation of powers, disobedience to the principle of equality and the impossibility of judicial intervention in the formulation of public policy to try and exclude the liability of public entities. In contrast, the judiciary has repeatedly guardianships granted injunctions or merit determining the supply of materials indicated by the medical benefits that accompany the treatment of patients who resort to a remedy. In this context, mediation, object of study and resolution presented in this work, is presented as an instrument conciliator between the reserve clause and the right to financially possible existential minimum, as it seeks to serve all through rationalization of health services , avoidance of negativistic influence of the pharmaceutical industry, with prioritizing the welfare of the individual and the quality of relationships. This is alternative way to judicialization that in addition to encouraging and developing active citizen participation in public policy formulation also allows the manager to public knowledge of community needs. It is in this sense that affirms and defends the right to health is no longer the mere provision of medical care and prescription drugs, but a dialogue conscious existential minimum to guarantee a dignified life

The aim of this in vivo study was to evaluate the performance of laser fluorescence (LF) comparing different cut-off limits for occlusal caries detection. One hundred and thirty first permanent molars were selected. Visual examination and LF assessments were performed independently. The extent of caries was assessed after operative intervention. New cut-off limits were established and compared with those proposed by the manufacturer and by Lussi et al. (Eur J Oral Sci 109:14-19, 2001). Similar sensitivity and higher specificity was found at D(2) (considering as disease only dentin caries) when the LF cut-off limits proposed by Lussi et al. and the new one were compared. At the D(3) threshold (considering as disease only deep dentin caries), no statistically significant difference among the cut-off limits for sensitivity was found. However, the new cut-off limits showed higher specificity. The LF device provided good ability to detect dentin caries lesions. Furthermore, the new cut-off limits and the values proposed by Lussi et al. could be suggested for the in vivo detection of occlusal caries.

Mt Etna's activity has increased during the last decade with a tendency towards more explosive eruptions that produce paroxysmal lava fountains. From January 2011 to April 2012, 25 lava fountaining episodes took place at Etna's New South-East Crater (NSEC). Improved understanding of the mechanism driving these explosive basaltic eruptions is needed to reduce volcanic hazards. This type of activity produces high sulfur dioxide (SO2) emissions, associated with lava flows and ash fall-out, but to date the SO2 emissions associated with Etna's lava fountains have been poorly constrained. The Ultraviolet (UV) Ozone Monitoring Instrument (OMI) on NASA's Aura satellite and the Atmospheric Infrared Sounder (AIRS) on Aqua were used to measure the SO2 loadings. Ground-based data from the Observatoire de Physique du Globe de Clermont-Ferrand (OPGC) L-band Doppler radar, VOLDORAD 2B, used in collaboration with the Italian National Institute of Geophysics and Volcanology in Catania (INGV-CT), also detected the associated ash plumes, giving precise timing and duration for the lava fountains. This study resulted in the first detailed analysis of the OMI and AIRS SO2 data for Etna's lava fountains during the 2011-2012 eruptive cycle. The HYSPLIT trajectory model is used to constrain the altitude of the observed SO2 clouds, and results show that the SO2 emission usually coincided with the lava fountain peak intensity as detected by VOLDORAD. The UV OMI and IR AIRS SO2 retrievals permit quantification of the SO2 loss rate in the volcanic SO2 clouds, many of which were tracked for several days after emission. A first attempt to quantitatively validate AIRS SO2 retrievals with OMI data revealed a good correlation for high altitude SO2 clouds. Using estimates of the emitted SO2 at the time each paroxysm, we observe a correlation with the inter-paroxysm repose time. We therefore suggest that our data set supports the collapsing foam (CF) model [1] as driving mechanism for the paroxysmal events at the NSEC. Using VOLDORAD-based estimates of the erupted magma mass, we observe a large excess of SO2 in the eruption clouds. Satellite measurements indicate that SO2 emissions from Etnean lava fountains can reach the lower stratosphere and hence could pose a hazard to aviation. [1] Parfitt E.A (2004). Abstract: In recent decades, the structure of the American family has been revolutionized to incorporate families of diverse and unconventional compositions. Gay and lesbian couples have undoubtedly played a crucial role in this revolution by establishing families through the tool of adoption. Eleven adoptive parents from the state of Connecticut were interviewed to better conceptualize the unique barriers gay couples encounter in the process adoption. Both the scholarly research and the interview data illustrate that although gay couples face enormous legal barriers, the majority of their hardship comes through social interactions. As a result, the cultural myths and legal restrictions that create social hardships for gay adoptive parents forge a vicious and discriminatory cycle of marginalization that American legal history illustrates is best remedied through judicial intervention at the Supreme Court level. While judicial intervention, alone, cannot change the reality of gay parenthood, I argue that past judicial precedent illustrates that such change can serve as a tool of individual, political, and legal validation for the gay community for obtaining equal rights.

The most direct method of investigating past variations of the atmospheric CO2 concentration before 1958, when continuous direct atmospheric CO2 measurements started, is the analysis of air extracted from suitable ice cores. Here we present a new detailed CO2 record from the Dronning Maud Land (DML) ice core, drilled in the framework of the European Project for Ice Coring in Antarctica (EPICA) and some new measurements on a previously drilled ice core from the South Pole. The DML CO2 record shows an increase from about 278 to 282 parts per million by volume (ppmv) between ad 1000 and ad 1200 and a fairly continuous decrease to a mean value of about 277 ppmv around ad 1700. While the new South Pole measurements agree well with DML at the minimum at ad 1700 they are on average about 2 ppmv lower during the period ad 1000-1500. Published measurements from the coastal high-accumulation site Law Dome are considered as very reliable because of the reproducibility of the measurements, high temporal resolution and an accurate time scale. Other Antarctic ice cores could not, or only partly, reproduce the pre-industrial measurements from Law Dome. A comparison of the trends of DML and Law Dome shows a general agreement. However we should be able to rule out co-variations caused by the same artefact. Two possible effects are discussed, first production of CO2 by chemical reactions and second diffusion of dissolved air through the ice matrix into the bubbles. While the first effect cannot be totally excluded, comparison of the Law Dome and DML record shows that dissolved air diffusing to bubbles cannot be responsible for the pre-industrial variation. Therefore, the new record is not a proof of the Law Dome results but the first very strong support from an ice core of the Antarctic plateau.

Este trabajo da cuenta del traspaso de tierras pblicas a manos privadas en dos partidos del nuevo sur bonaerense, Arenales y Ayacucho, entre 1850 y 1880. En l se toma el contexto de revisin de la legislacin rosista sobre tierras y de la aplicacin de las leyes de arrendamientos pblicos y ventas posteriores. Cul fue el impacto de estas leyes en estos territorios; quines fueron sus beneficiarios; cmo afectaron la trama de derechos en torno al acceso a la tierra, son algunos de los interrogantes que se intentan responder.

Este artículo estudia la violencia policial en su desempeño cotidiano alrededor de 1960. Se procuran reconocer los aspectos fundamentales de la misma, que pasaron a formar parte del accionar operativo de la policía y que incorporaron, a escala institucional, las coacciones ilegales como metodología para la 'resolución' de casos. Los mandatos políticos orientados a una determinada idea de 'orden social' y las demandas sociales por 'seguridad y orden' no estuvieron ajenos a la convalidación de las formas de violencia policial. Las fuentes consultadas también arrojan luz sobre los 'debates' al interior de la fuerza policial acerca de su rol como auxiliar de un poder militar represivo y totalitario frente a una sociedad cuyos crecientes reclamos políticos y sociales la convertirían en el 'enemigo interno'. El trabajo concluye en el año 1962, que puede ser visto como un punto de maduración en el cual la policía bonaerense aplicó su experiencia operativa acumulada en el orden cotidiano, a la represión y eliminación de la protesta social y la disidencia política

El desmantelamiento del sistema segregacionista del Apartheid durante la década de 1990 planteó la necesidad de construir una nueva nación basada en una nueva concepción del ser ciudadano. Este hecho implicó, por ende, la conformación de un discurso nacionalista de la nueva Sudáfrica que acompañara tal aspiración de renovación. Este discurso debía incluir un abordaje acerca del traumático pasado reciente; un abordaje acorde con las características de la nueva nación: inclusivo e integrador. Cómo sería posible construir una memoria en la cual los distintos sectores de la sociedad sudafricana se sintieran identificados era un problema de difícil resolución. En este trabajo nos proponemos analizar cómo se evidencia este conflicto en la construcción del nuevo ser sudafricano en la escuela, particularmente en la enseñanza de la historia reciente

Este trabajo se propone caracterizar la formación y el funcionamiento de un mercado de tierras en dos partidos del 'nuevo sur' bonaerense, en el transcurso del siglo XIX. El proceso de apropiación de estas tierras implicó la negociación de las mismas en diferentes instancias y a través de diversas modalidades, lo cual fue configurando un mercado de la tierra, aún antes de la consolidación de la propiedad plena sobre el suelo

Este artículo se centra en la ocupación y apropiación de tierras en una región del sudeste de la provincia de Buenos Aires, que integraba en las primeras décadas del siglo XIX el llamado "nuevo sur": los partidos de Arenales y Ayacucho, entre 1823 y 1860. Comenzaremos por caracterizar el traspaso de estos territorios a particulares, el impacto de las distintas modalidades de transferencia y la evolución de la estructura de tenencia. Esto nos llevará a interrogarnos por los protagonistas de este proceso: ¿quiénes fueron los beneficiarios de este reparto? ¿cómo llegaron a estas tierras del "nuevo sur"? ¿cómo fue la conformación del grupo de propietarios en esta zona?, ¿permanecieron los mismos apellidos a lo largo del período? Además, ¿existieron, en esta zona como en otras regiones, posibilidades de ocupación sin la tenencia legal? La comparación con otros procesos de ocupación y apropiación de terrenos del estado, especialmente al sur del río Salado, nos posibilitará una visión más completa de este caso, que obviamente está integrado en un proceso más amplio.
