L’elaborato si propone di analizzare i principali punti di contatto, nell’ordinamento domestico, tra le funzioni esercitate dalla giurisdizione ordinaria civile e le attribuzioni delle Autorità amministrative indipendenti, nel tentativo di delineare un quadro sistematico dei rapporti. Nella prima parte dell’indagine, ci si sofferma sui variegati strumenti di risoluzione delle controversie coniati in seno alle Autorità indipendenti, cercando di sviluppare un’essenziale classificazione per categorie omogenee, al fine di vagliare la compatibilità dei diversi modelli con il dato costituzionale. Successivamente, si sposta l’indagine sulle interferenze emergenti con riferimento a quelle attività delle Authorities assimilabili all’applicazione della legge al caso concreto nel contesto del pubblic enforcement. Tra queste, spicca la delicata questione del valore dei provvedimenti delle Authorities nei (correlati) processi civili risarcitori, soprattutto a seguito dell’entrata in vigore dell’art. 7, d.lgs. 3/2017, che ha plasmato un inedito «vincolo» per il giudice ordinario all’accertamento dell’AGCM. Alla previsione normativa si associa la tendenza giurisprudenziale a riconoscere una particolare “attitudine probatoria” anche ai provvedimenti di altre Autorità indipendenti, pur in assenza di specifica previsione normativa. Nel corso della trattazione, più che limitarsi ad esprimere una preferenza tra le diverse soluzioni già proposte dalla dottrina, si cerca di gettare le basi per un’interpretazione autonoma e sistematica del fenomeno. Adottando un approccio quanto più possibile interdisciplinare, si cercano di coniugare i punti di approdo della teoria generale dell’accertamento giuridico con quelli, gius-pubblicistici, della categoria dell’accertamento amministrativo. Si passa, infine, a vagliare le condizioni affinché tale ipotetico modello unitario possa ritenersi compatibile con altri valori di rilievo costituzionale e non solo, utilizzando quale parametro di riferimento l’art. 6 Cedu, come interpretato dalla Corte di Strasburgo.

Extreme weather events related to deep convection are high-impact critical phenomena whose reliable numerical simulation is still challenging. High-resolution (convection-permitting) modeling setups allow to switch off physical parameterizations accountable for substantial errors in convection representation. A new convection-permitting reanalysis over Italy (SPHERA) has been produced at ARPAE to enhance the representation and understanding of extreme weather situations. SPHERA is obtained through a dynamical downscaling of the global reanalysis ERA5 using the non-hydrostatic model COSMO at 2.2 km grid spacing over 1995-2020. This thesis aims to verify the expectations placed on SPHERA by analyzing two weather phenomena that are particularly challenging to simulate: heavy rainfall and hail. A quantitative statistical analysis over Italy during 2003-2017 for daily and hourly precipitation is presented to compare the performance of SPHERA with its driver ERA5 considering the national network of rain gauges as reference. Furthermore, two extreme precipitation events are deeply investigated. SPHERA shows a quantitative added skill over ERA5 for moderate to severe and rapid accumulations in terms of adherence to the observations, higher detailing of the spatial fields, and more precise temporal matching. These results prompted the use of SPHERA for the investigation of hailstorms, for which the combination of multiple information is crucial to reduce the substantial uncertainties permeating their understanding. A proxy for hail is developed by combining hail-favoring environmental numerical predictors with observations of ESWD hail reports and satellite overshooting top detections. The procedure is applied to the extended summer season (April-October) of 2016-2018 over the whole SPHERA spatial domain. The results indicate maximum hail likelihood over pre-Alpine regions and the northern Adriatic sea around 15 UTC in June-July, in agreement with recent European hail climatologies. The method demonstrates enhanced performance in case of severe hail occurrences and the ability to separate between ambient signatures depending on hail severity.

Este trabalho versa sobre o percurso acadêmico do graduando no curso de Especialização em Saúde da Família e sua atuação profissional na Secretaria Municipal de Saúde de Belo Horizonte, desenvolvendo as atividades no Núcleo de Apoio à Saúde da Família (NASF) na Unidade Básica de Saúde Dom Joaquim (UBSDJ) por meio do Programa Academias da Cidade. Sabe-se que na contemporaneidade as doenças crônicas não transmissíveis (DCNT) devido a transição epidemiológica dos últimos anos firmou-se como uma das principais causas de doenças que atinge a população mineira. Dentre os fatores de risco para as DCNT o sedentarismo figura-se como o ponto chave desse estudo ao tentar-se investigar as causas de sua presença em um grupo de usuárias que freqüentam a UBSDJ situada na regional Nordeste de Belo Horizonte. Este trabalho busca construir um Plano de ação que atenue as condições desfavoráveis das usuárias sedentárias que fazem parte do Grupo de Qualidade de Vida Dom Joaquim (GQVDJ) e amenize os principais nós críticos encontrados pelos profissionais da saúde e usuários da UBSDJ. Entre os problemas encontrados os que foram mais relevantes para a construção do plano de ação são os seguintes: estilo de vida inadequado das usuárias do GQVDJ; poucos espaços para a prática de atividade física na UBSDJ, a falta de trabalho interdisciplinar e intersetorial na realização das ações pelos profissionais da saúde. O plano de ação proposto neste estudo tem como sugestão ações educativas para a população, reestruturação da forma de trabalho do Nasf, com proposta de alteração na carga horária de seus profissionais, assim como um trabalho intersetorial, na busca da criação de parcerias com outras entidades da sociedade civil em busca de ampliação de espaços para a promoção de saúde e principalmente para a conscientização das usuárias do GQVDJ da importância do auto-cuidado e co-responsabilização pela saúde. Mostrando que adoção de um estilo de vida saudável (prática de atividade física, dieta equilibrada, combate ao fumo e ao álcool), não depende apenas dos profissionais da Atenção Primária à Saúde (APS) mas também dos usuários do sistema.

O câncer do colo do útero é a neoplasia maligna mais freqüente do trato genital feminino no Brasil e no mundo é a quarta causa. Trata-se de uma doença de crescimento lento e silencioso, porém totalmente curável se prevenido se tratado precocemente. Diante do aspecto epidemiológico que esta doença ocupa este estudo objetiva avaliar a qualidade do registro do Sistema de informação do Câncer do Colo do Útero no município de Araxá. Trata-se uma pesquisa descritiva, exploratória, a partir de uma investigação bibliográfica dos estudos da literatura, realizada por meio dos portais da Biblioteca Virtual em Saúde, Biblioteca Virtual do CEABSF, usando os descritores: Neoplasias do Colo do Útero, Sistemas de Informação. As bases de dados consideradas foram Lilacs (Literatura Latino Americana e do Caribe em Ciências de Saúde), Scielo (Scientific Electronic Library on Line) e Medline (Literatura Internacional em Ciência da Saúde), sendo selecionados os artigos que abordavam os assuntos relacionados ao objetivo da pesquis . O critério de amostra foi pré-determinada, pois a amostra não foi á nível municipal e sim de determinado setor que realiza o atendimento da atenção secundária da rede pública da cidade. Os dados coletados da Unidade Básica de Saúde representam uma pequena amostra dos exames realizados no município, uma vez que não existem dados computados no Sistema de Informação do Colo de Útero do município. Os dados foram levantados no mês de abril de 2011, manualmente, por meio do registro de resultados de exames de citologia, colposcopia, biópsia e cauterização realizada no período de janeiro á dezembro de 2010 na Unidade. Não existe um Sistema de informação nas Unidades Básicas de Saúde do município, o que dificulta a compilação e análise dos dados levantados. A busca ativa e rastreamento das mulheres para realização de exames ginecológicos são ações presentes no dia a dia dos profissionais de saúde desta unidade, isto garante freqüência regular ao ginecologista e realização de exames ginecológicos dentro do período preconizado pelo Ministério da Saúde em 2006. No município de Araxá, o SISCOLO não é alimentado pelo município, devido ao errado fluxo que ocorre a nível regional, ou seja, os laboratórios prestadores de serviços digitam a base de dados, mas transferem esses dados para regional de saúde que se encontra em Uberaba.A GRS (Gerência Regional de Saúde) após consolidação destes dados envia relatórios aos municípios para que realizem busca ativa e seguimento das mulheres com resultados alterados de citopatológico. Conclui-se que é preciso informatização e base de dados mais sólidos, para informações mais claras e objetivas no intuito de desenvolver trabalhos educativos diante dos dados coletados. Salientamos ainda que a prevenção não depende somente de aspectos técnicos, mas também de ações de educação em saúde, que devem orientar a prática dos profissionais para desenvolver ações de prevenção e detecção precoce do câncer de colo uterino.

The goals of this study are to identify the potencialities avaiable in elementary public schools for the development of an educational process wich includes environmental issues helpping to find its integration with university in order to contribuite raises teaching levels for a better comprehension of regional environmental problems. Research data were collected through questionnaires and interviews with geography teachers analyising theirs activities and perspectives on the environmental crisis and environmental education. The study also offers sugestions for the devellopment of interdisciplinaires programs trying to contibute for the construction of citizenship showing the importance of better comprehension from environmental problems which includes physical, economics, social, political and cultural aspects.

Multi-element analyses of sediment samples from the Santos-Cubatão Estuarine System were carried out to investigate the spatial and seasonal variability of trace-element concentrations. The study area contains a rich mangrove ecosystem that is a habitat for tens of thousands of resident and migratory birds, some of them endangered globally. Enrichments of metals in fine-grained surface sediments are, in decreasing order, Hg, Mn, La, Ca, Sr, Cd, Zn, Pb, Ba, Cu, Cr, Fe, Nb, Y, Ni and Ga, relative to pre-industrial background levels. The maximum enrichment ranged from 49 (Hg) to 3.1 (Ga). Mercury concentrations were greater in the Cubatão river than in other sites, while the other elements showed greater concentrations in the Morrão river. Concentrations of Mn were significantly greater in winter and autumn than in summer and spring. However, other elements (e.g. Cd and Pb) showed the opposite, with greater concentrations in summer and spring. This study suggests that seasonal changes in physical and chemical conditions may affect the degree of sediment enrichment and therefore make the assessment of contamination difficult. Consequently, these processes need to be considered when assessing water quality and the potential contamination of biota.

A solid-phase in-line extraction system for water samples containing low levels of emerging contaminants is described. The system was specially developed for large volume samples (up to 4 L) using commercial solid-phase extraction (SPE) cartridges. Four sets containing PTFE-made connectors, brass adapters and ball valves were used to fit SPE cartridges and sample bottles to a 4-port manifold attached to a 20 L carboy. A lab-made vacuum device was connected to the manifold cap. The apparatus is robust and less expensive than the typical available system. Its also provides less experimental handling, avoiding cross contamination and sample losses.

The difficulty in adapting European dairy cows breeds in Brazil affect considerably the milk production sector. Brazilian climatic conditions are not totally favorable and the development of new tecnologies is needed for the animals express their genetic potential, as well as their best feed conversion. An economical analysis of the applied investment in the free-stall climatization equipment in dairy housing, for estimating studies related to profit, possibility of return investment as well as time for this return is necessary. The objective of this research was to evaluate the influence of climatization investment in the milk production process and analyze the economical aspect of this investment. There were used 470 high productive dairy cows with genetic and morphologic homogeneous characteristics, and analyzed in two similar periods. Investment calculations were done using Excell®. The results were satisfactory and the invested capital was proved to return to the producer in a short term, 57 days.

In the last few years the sugar-cane mechanical harvested area has increased, especially in regions with appropriated slop. The use of this technology brings some inconveniences, such as, the increase in the percentage of extraneous matter, which causes the reduction of technological quality of the raw material, and losses in the field. Extraneous matter (trash) is composed of tops and leaves in major percentage, plus soil and roots, and eventually some metal parts. In the green cane harvest system the percentage of extraneous matter has a tendency to increase due to the great amount of vegetal matter to be processed. The increase in the blower fan speed to reduce the amount of extraneous matter can lead to an unacceptable economic level of raw material losses. The main objective of this work was, using a cane loss monitor, to evaluate and quantify the amount of visible losses of sugar cane through the primary extractor at two different fan speeds. Afterwards these losses were related to the harvester cleaning efficiency. The piezoelectric transducer shows a reasonable sensibility. The results show that the cleaning efficiency in the primary extractor (85% mean), the cane losses (between 5.68% and 2.15%) and fan speed are interrelated. The total losses and specially splinters (between 3.19% and 0.91%), showed a significant difference among the treatments.

Currently, owing to the occurrence of environmental problems, along with the need of environmental preservation, both the territory management of Hydrographic Basin and the conservation of natural resources have proven to have remarkable importance. Thus, the mean goal of the research is to raise and scrutinize social-economic and technologic data from the Mogi Guaçu River Hydrographic Basin (São Paulo, Brazil). The aim is to group municipalities with similar characteristics regarding the collected data, which may direct joint actions in the Hydrographic Basin Management. There were used both the methods of factorial analysis and automatic hierarchical classifications. Additionally, there is going to be applied a Geographical Information System to represent the outcomes of the methods aforementioned, through the evolvement of a geo-referenced database, which will allow the obtainment of information categorically distributed including theme maps of interest. The main characteristics adopted to group the municipalities were: agricultural area, sugar cane production, small farms, animal production, number of agriculture machinery and equipments and agricultural income. The methodology adopted in the Mogi Guaçu River Hydrographic Basin will be analyzed vis-à-vis its appropriateness on basin management, as well as the possibility of assisting the studies on behalf of the São Paulo Hydrographic Basin groups, to regional development.

One of the problems found in mechanical harvest of sugar cane is the lack of synchronism between the harvest machine and the infield wagon, causing crop losses as well as operational capacity. The objective of the present research was to design a system capable of helping to synchronize the sugar cane harvest machine with the wagon. The communication between tractor and harvest machine is wireless. Two ultrasound sensors coupled to the elevator and a microprocessor manage such information, generating a correct synchronization among the machines. The system was tested in laboratory and on field performing its function adequately, maintaining the two machines in synchronization, indicating and alerting the operators their relative positions. The developed system reduced the sugar cane lost in 60 kg ha-1 comparing to the harvest with the system turned off.

The MINUS system was developed as a minimally invasive procedure that uses a diaphyseal cephalic extramedullary implant for the treatment of transtrochanteral fractures of the femur in elderly patients. The implant consists of a sliding screw coupled to a plate adapted to the minimally invasive technique. The surgical access is approximately three centimeters in length located on the lateral surface of the hip, below the projection of the small trochanter. A perfectly adapted instrument was used for the procedure, which also requires the use of an image intensifier, reducing surgery time and rate of bleeding. The objective of this study is to present a new instrument and implant, developed specifically for treatment with the minimally invasive technique, reducing the length of the conventional surgical access from 10 to three centimetres. This new implant was given the commercial name of MINUS System.

Problems identified in the study and analysis of the phonology of Brazilian Indian languages belonging to the Macro-Jê branch such as Kaingang, Maxakali, and Mebengokre led the author to confirm the accuracy of some intuitions on the part of Piggott (1992) and Rice (1993) on dealing with relations between nasality and sonorancy (D'Angelis 1998). The applicability of the approach to the distinct processes of nasality and nasalization in Portuguese was verified with surprising results that recover some intuitions of Trubetzkoy (1939) and contribute to reconfirm the Mattoso Câmara's (1953; 1970) considerations, but at the same time go beyond them. This article presents the result of this investigation and its conclusions that suggest the validity and the necessity of reexamining even the phonemic inventory of the Portuguese language, an issue not at all questioned in the teaching of phonology, to take into account the linguistic changes in the phonological system of that language in the last fifty years.

This text which discusses the central theme of the National Conference on Education (CONAE), held in Brasília from 28th March to 1st April 2010, deals with the concept of a National System of Education in articulation with the National Plan of Education. To that end, after pointing to the basic uses of the concept of system, it discusses the question of the National System of Education exploring the federative question in order to reveal the complete compatibility of the organization of the National System of Education with the federative regime. Thereafter, it deals with the historical meaning of the National Plan of Education demonstrating that the plan is a demand of the system, since planned action is implicit in systematized education. Thus the National Plan of Education is fulfilling those goals and objectives for which it is responsible.

OBJECTIVE: To evaluate the positive predictive value for BI-RADS (Breast Imaging Reporting and Data System) categories 3, 4 and 5, correlating mammographic and histological diagnosis in non-palpable breast lesions. MATERIALS AND METHODS: Analytical-descriptive study of 169 women submitted to stereotactic localization for surgical biopsy of non-palpable breast lesions. Mammographic and histological findings were correlated, analyzing the predictive positive value for each category. RESULTS: Forty-two (24.8%) cases were diagnosed with breast cancer - only one in category 3, 19 in category 4, and 22 in category 5. The positive predictive value for categories 3, 4A, 4B, 4C and 5 were, respectively, 3.4%, 10.3%, 11.3%, 36% and 91.7%. Microcalcifications were the most frequent finding related to malignancy, present in 61.5% of these cases. CONCLUSION: The present study has demonstrated that BI-RADS allows a safe prediction of high suspicion of malignancy in lesions category 5 and low suspicion for category 3. As regards the category 4, the positive predictive value has shown a progressive increase in subcategories A, B and C, demonstrating that this subclassification represents an invaluable contribution for a more detailed and accurate assessment of lesions suspicious for malignancy.
