Transitional provisions are defined as the set of regulations that rule juridical relationships on the occasion of a legislative change. Out of this context of law succession, their indiscriminate application can lead to serious inconsistencies. The analysis of a Spanish private law example is offered to illustrate this fact. It concerns the administrative authorization for the demolition of rented buildings in the cities. A regulation repealed more than fifteen years ago and however widespread utilised on ancient constructions that, after recent urban development, have acquired great economic value; something that in the end explains the current importance of such provisions. What is happening in Spain: denaturalization of the original figure due to a mixture of formalist interpretations and speculative market interests, is presented here to call the attention on the necessary limitation of transitional provisions’ effects.

Las organizaciones en la actualidad deben encontrar diferentes maneras de sobrevivir en un tiempo de rápida transformación. Uno de los mecanismos usados por las empresas para adaptarse a los cambios organizacionales son los sistemas de control de gestión, que a su vez permiten a las organizaciones hacer un seguimiento a sus procesos, para que la adaptabilidad sea efectiva. Otra variable importante para la adaptación es el aprendizaje organizacional siendo el proceso mediante el cual las organizaciones se adaptan a los cambios del entorno, tanto interno como externo de la compañía. Dado lo anterior, este proyecto se basa en la extracción de documentación soporte valido, que permita explorar las interacciones entre estos dos campos, los sistemas de control de gestión y el aprendizaje organizacional, además, analizar el impacto de estas interacciones en la perdurabilidad organizacional.

El presente estudio expone metodologías tomadas como estrategias las cuales están basadas en la filosofía Lean, estas buscan la reducción de desperdicios acompañado de un mejoramiento continuo. La metodología se tomó como un modelo de gestión para la empresa Casa de Banquetes Álvaro O. Castañeda, específicamente su proceso productivo. Por medio de un análisis inicial del flujo de valor y el análisis de evaluación de oportunidades Lean, se estableció un plan de flujo de valor con unas fases que contemplan objetivos, metas, tiempos de ejecución, responsables, proceso afectado para la mejora continua y un tiempo de seguimiento, con el fin último de aumentar el valor agregado de servicio al cliente.

We quantify the effects on poverty and income distribution in Ecuador of bilateral trade liberalization with the US and a budget-neutral value added tax increase which seeks to compensate tariff revenue losses. We stress the study of fiscal policies that the government could tap in order to compensate for tariff revenue loss. This is a very important issue for Ecuador because this country adopted the US dollar as its currency in 2000, forgiving the use of important policy instruments. To study these issues we combine a reduced-form micro household income and occupational choice model (using 2005/6 data from the Ecuadorian LSMS) with a standard single-country computable general equilibrium model (employing a 2004 SAM). We follow a sequential approach that simulates the full distributional impact of trade and tax policies. We find that the impact of these policy changes on extreme poverty and income distribution is small but positive.

Algunos cambios recientes en la política agrícola en Colombia se han orientado hacia la implementación de medidas de apoyo directo a los productores, con el fin de proteger su ingreso y fomentar una mayor competitividad del sector. No obstante, estimaciones acerca del impacto esperado de este tipo de instrumentos, medido en té rminos de cambios en el valor agregado, indican que este es reducido. Como quiera que la política emplea diferentes instrumentos para el logro de sus objetivos, surge la pregunta de cuál es el grado de dependencia que los resultados esperados presentan respecto a la forma como los recursos son asignados a dichos instrumentos. Este estudio utiliza un modelo de equilibrio general computable para explorar este problema, para un conjunto de tres de los principales instrumentos de política utilizados en la actualidad, en un contexto de corto plazo. Los resultados indican que, en presencia de rigideces de corto plazo y, en particular, de inmovilidad del capital entre actividades productivas, todos los instrumentos de política llevan a la obtención de resultados modestos y que, en un escenario de mediano y largo plazo, el comportamiento de la inversión parece ser crítico para la obtención de impactos más significativos y para el logro de los objetivos de política buscados.

El siguiente trabajo de grado para la Facultad de Administración de la Universidad del Rosario, tiene como objetivo principal realizar un análisis financiero de la compañía NEORIS COLOMBIA S.A.S., empresa resultante de las soluciones innovadoras que creó CEMEX, uno de los productores de cemento más grandes y rentables del mundo, y que se dedica a brindar consultoría interna de tecnología. Asimismo, indagar las implicaciones que tienen los cambios y el avance en los sistemas de implementación tecnológico de empresas dedicadas a TI en las finanzas de esta compañía. El presente trabajo busca determinar de qué manera NEORIS COLOMBIA S.A.S. implementa sus recursos para ser una de las empresas de consultoría más importantes de Colombia a pesar del incremento de la competencia en el sector dedicado a consultoría de TI brindando soluciones de tecnología emergente y servicios de outsourcing, que va de la mano con los avances tecnológicos que exige cada vez más el mundo actual. Aunque dentro del mercado la competencia es infaltable, NEORIS busca crear relaciones a largo plazo con proveedores de servicios generales, personas con la experiencia y el conocimiento y excelencia técnica necesaria para desarrollar aplicaciones y servicios especializados en una diversidad de plataformas tecnológicas que le permita seguir siendo una empresa líder. Para este análisis financiero, se utilizarán diferentes herramientas e indicadores financieros que ayudarán a identificar, analizar y evaluar si la compañía es viable o no.

El artículo analiza con detalle la procedencia del arbitraje y otros medios alternativos de solución de controversias en materia tributaria, comenta el desarrollo que han tenido los medios alternativos de solución de controversias en materia tributaria en el Ecuador, trata sobre el arbitraje tributario en el ámbito interno de los estados, defendiendo su procedencia frente a los principios de legalidad y de indisponibilidad de la obligación tributaria, así como respecto del principio de exclusividad de jurisdicción, estudia el arbitraje tributario internacional, con énfasis en el contemplado en los convenios para evitar la doble imposición y en el previsto para disputas derivadas de la utilización de precios de transferencia, y, finalmente, se refiere a la procedencia del arbitraje en el caso propuesto en el Ecuador por las empresas petroleras para la devolución del IVA.

La devolución del IVA consiste en un régimen tributario especial que se aplica en función de consideraciones específicas y en atención a la calidad que ostentan los sujetos pasivos que se benefician del mismo. Para que esta devolución proceda –en el caso de empresas públicas–, es indispensable que estas se encuentren constituidas de conformidad con las disposiciones de la Ley orgánica de Empresas Públicas o, en su defecto, hayan cumplido con las disposiciones específicas del régimen de transición contemplado para que las empresas públicas o estatales existen tes, las sociedades anónimas en las que el Estado es accionista, las empresas subsidiarias y las empresas de las Fuerzas armadas y de la Policía Nacional se conviertan en nuevas empresas públicas. En este contexto, el presente trabajo pretende analizar, de conformidad con el contenido de la Ley Orgánica de Empresas Públicas, el momento a partir del cual se genera el derecho a la devolución del Impuesto al valor agregado, para las empresas públicas, así como cuestionar ciertas inconsistencias que se desprenden de esta Ley.

Faced by the realities of a changing climate, decision makers in a wide variety of organisations are increasingly seeking quantitative predictions of regional and local climate. An important issue for these decision makers, and for organisations that fund climate research, is what is the potential for climate science to deliver improvements - especially reductions in uncertainty - in such predictions? Uncertainty in climate predictions arises from three distinct sources: internal variability, model uncertainty and scenario uncertainty. Using data from a suite of climate models we separate and quantify these sources. For predictions of changes in surface air temperature on decadal timescales and regional spatial scales, we show that uncertainty for the next few decades is dominated by sources (model uncertainty and internal variability) that are potentially reducible through progress in climate science. Furthermore, we find that model uncertainty is of greater importance than internal variability. Our findings have implications for managing adaptation to a changing climate. Because the costs of adaptation are very large, and greater uncertainty about future climate is likely to be associated with more expensive adaptation, reducing uncertainty in climate predictions is potentially of enormous economic value. We highlight the need for much more work to compare: a) the cost of various degrees of adaptation, given current levels of uncertainty; and b) the cost of new investments in climate science to reduce current levels of uncertainty. Our study also highlights the importance of targeting climate science investments on the most promising opportunities to reduce prediction uncertainty.

We seek to address formally the question raised by Gardner (2003) in his Elmhirst lecture as to the direction of causality between agricultural value added per worker and Gross Domestic Product (GDP) per capita. Using the Granger causality test in the panel data analyzed by Gardner for 85 countries, we find overwhelming evidence that supports the conclusion that agricultural value added is the causal variable in developing countries, while the direction of causality in developed countries is unclear. We also examine further the use of the Granger causality test in integrated data and provide evidence that the performance of the test can be increased in small samples through the use of the bootstrap.

The Mediterranean region is one of the major centres of origin and diversification of cultivated plants and many crop wild relatives are found there. In addition, many native species are still widely harvested from the wild for food, medicine and other uses and some of these have potential for development as alternative crop especially in marginal zones. While there have been several recent initiatives that address the cataloguing and conservation of these species, such as the Network on Identification, Conservation and Use of Wild Plants in the Mediterranean Region (MEDUSA and the Bioversity International (IPGRI) studies on Underutilized Mediterranean Species (VMS), no comprehensive assessment has yet been made and little work undertaken on their agricultural potential. It has been confidently predicted that consequences of global change in the Mediterranean region - population movements and migrations, changes in disturbance regimes, and climate change - will be serious. One the one hand, this will affect the survival prospects of many of these underutilized species and on the other hand it will enhance their importance as the source of potential new crop germplasm. The conservation and availability of genetic diversity of both crops and underutilized species is essential if we are to be able to meet the increasing demand for food and other crops that will be adapted to the new ecoclimatic envelopes that will develop in the region as a consequence of global change. The rapid rate of climatic and other change that is expected adds urgency to the task of assessing, conserving and sustainably using this rich diversity of wild species of economic value in the region but new strategies will be need to be developed to achieve this. The Mediterranean region has the potential of becoming a major source of new crop development in the coming decades.

The term microfibril angle (MFA) in wood science refers to the angle between the direction of the helical windings of cellulose microfibrils in the secondary cell wall of fibres and tracheids and the long axis of cell. Technologically, it is usually applied to the orientation of cellulose microfibrils in the S2 layer that makes up the greatest proportion of the wall thickness, since it is this which most affects the physical properties of wood. This review describes the organisation of the cellulose component of the secondary wall of fibres and tracheids and the various methods that have been used for the measurement of MFA. It considers the variation of MFA within the tree and the biological reason for the large differences found between juvenile (or core) wood and mature (or outer) wood. The ability of the tree to vary MFA in response to environmental stress, particularly in reaction wood, is also described. Differences in MFA have a profound effect on the properties of wood, in particular its stiffness. The large MFA in juvenile wood confers low stiffness and gives the sapling the flexibility it needs to survive high winds without breaking. It also means, however, that timber containing a high proportion of juvenile wood is unsuitable for use as high-grade structural timber. This fact has taken on increasing importance in view of the trend in forestry towards short rotation cropping of fast grown species. These trees at harvest may contain 50% or more of timber with low stiffness and therefore, low economic value. Although they are presently grown mainly for pulp, pressure for increased timber production means that ways will be sought to improve the quality of their timber by reducing juvenile wood MFA. The mechanism by which the orientation of microfibril deposition is controlled is still a matter of debate. However, the application of molecular techniques is likely to enable modification of this process. The extent to which these techniques should be used to improve timber quality by reducing MFA in juvenile wood is, however, uncertain, since care must be taken to avoid compromising the safety of the tree.

Managing a construction project supply chain effectively and efficiently is extremely difficult due to involvement of numerous sectors that are supported by ineffective communication system. An efficient construction supply chain system ensures the delivery of materials and other services to construction site while minimising costs and rewarding all sectors based on value added to the supply chain. The advancement of information, communication and wireless technologies is driving construction companies to deploy supply chain management strategies to seek better outputs. As part of the emerging wireless technologies, contextaware computing capability represents the next generation of ICT to the construction services. Conceptually, context-awareness could be integrated with Web Services in order to ensure the delivery of pertinent information to construction site and enhance construction supply chain collaboration. An initial study has indicated that this integrated system has the potential of serving and improving the construction services delivery through access to context-specific data, information and services on as-needed basis.

The construction industry has incurred a considerable amount of waste as a result of poor logistics supply chain network management. Therefore, managing logistics in the construction industry is critical. An effective logistic system ensures delivery of the right products and services to the right players at the right time while minimising costs and rewarding all sectors based on value added to the supply chain. This paper reports on an on-going research study on the concept of context-aware services delivery in the construction project supply chain logistics. As part of the emerging wireless technologies, an Intelligent Wireless Web (IWW) using context-aware computing capability represents the next generation ICT application to construction-logistics management. This intelligent system has the potential of serving and improving the construction logistics through access to context-specific data, information and services. Existing mobile communication deployments in the construction industry rely on static modes of information delivery and do not take into account the worker’s changing context and dynamic project conditions. The major problems in these applications are lack of context-specificity in the distribution of information, services and other project resources, and lack of cohesion with the existing desktop based ICT infrastructure. The research works focus on identifying the context dimension such as user context, environmental context and project context, selection of technologies to capture context-parameters such wireless sensors and RFID, selection of supporting technologies such as wireless communication, Semantic Web, Web Services, agents, etc. The process of integration of Context-Aware Computing and Web-Services to facilitate the creation of intelligent collaboration environment for managing construction logistics will take into account all the necessary critical parameters such as storage, transportation, distribution, assembly, etc. within off and on-site project.
