This, the first part of a two-part article on the discretionary powers of the courts to order a sale of the family home at the request of a secured creditor, considers whether the enactment of the Trusts of Land and Appointment of Trustees Act 1996 s.15 has led judicial decision making to favour the interests of the co-owner of the home. Reviews cases heard since the coming into force of the Act, looking at the factors taken into account when balancing the interests of the creditor and debtor, including the continued need to have a family home, the availability of other assets to pay off the debt, the size of the debt and the likelihood of repayment.

This, the second part of a two-part article on the discretionary powers of the courts to order a sale of the family home at the request of a secured creditor, continues the review begun in part one of common factors taken into account by the courts in post-1996 cases when balancing the interest of the creditor and debtor. Considers the availability of alternative accommodation, the health of the parties, the right to private and family life, the age of the parties, hardship a sale would cause other family members and delay on the part of the creditor in prosecution of proceedings to recover its debt.

We study experimentally the dynamics of quantum-dot (QD) passively mode-locked semiconductor lasers under external optical injection. The lasers demonstrated multiple dynamical states, with bifurcation boundaries that depended upon the sign of detuning variation. The area of the hysteresis loops grew monotonically at small powers of optical injection and saturated at moderate powers. At high injection levels the hysteresis decreased and eventually disappeared.

We have generated near-transform-limited picosecond pulses(ΔτΔν≈0.45) from a gain-switched diode laser using periodic and chirped fiber Bragg gratings. This configuration reduced the spectral bandwidth from 11 to 0.08 nm and the pulse duration was reduced, from 30 to<18 ps. Average and peak powers of 27 and 770 mW, respectively, were obtained.

This dissertation examines the discursive practice of Argentine costumbrista texts from a novel perspective. In (re)reading the works of selected prominent writers from the late colonial period to the end of the Nineteenth Century, including those of Alonso Carrió de la Vandera, Emeric Essex Vidal, León Pallière, Lucio Vicente López, Lucio V. Mansilla, and Pastor Obligado we focus on the presence of ekphrastic enunciations with a view toward linking the plastic, painterly dimensions of the prose to parallel representations by artists of the same period. Thus the costumbristas are studied in tandem with the watercolors, oil paintings and lithographic compositions of artists such as Carlos Enrique Pellegrim, César Hipólito Bacle, Raymond Monvoisin and Hipólito Moulin. The resulting comparative study of the two arts---the verbal and the pictorial---illustrates the notion described by W. J. T. Mitchell that a literary text may well "represent a work of visual or graphic art." And thus, it provides us with visual, spatial motifs that enhance its powers of representation. ^ In developing our focus on ekphrastic representations we have followed the theoretic studies of Murray Krieger, Jean H. Hagstrum, James Hefferman, John Hollander, W. J. T. Mitchell, Johann Gottfried Herder, and Wendy Steiner among others, all of whom in various ways take their cue from Horace's Ut pictura poesis and the notion that poetry, that is literary discourse, can be likened to a panting and that in both arts there is a refractive quality that makes literature a spoken vehicle of expression and painting a silent, complementary voice. ^ In studying the literary and plastic discourses comparatively what becomes evident is that they share cultural and ideological concerns that center around the notion of self-definition, national identity, and the relation of the individual to the incipient national community (Benedict Anderson). These concerns are highlighted via the depiction of customs, mores, dress, work habits, professions, and social classes. In late colonial literature and painting and especially in the Nineteenth Century, which constitutes the defining period of Argentine political independence, the confluence of the two disciplinary discourses addresses, and underscores the issues of socio-political empowerment in the new Argentine nation. ^

Introduction. Esophageal intramural pseudodiverticulosis is a rare condition characterized by the dilatation of the submucosal glands. Case presentation. We present a case of esophageal intramural pseudodiverticulosis in a 72-year-old Caucasian man who presented with dysphagia and with a background history of alcohol abuse. An upper gastrointestinal endoscopy of our patient showed an esophageal stricture with abnormal mucosal appearances, but no malignant cells were seen at biopsy. Appearances on a barium esophagram were pathognomonic for esophageal intramural pseudodiverticulosis. Conclusion. We demonstrate the enduring usefulness of barium esophagography in the characterization of abnormal mucosal appearances at endoscopy.

The powers of the General Government are so much greater than those of the United States in its relations with the Local Governments, that the central power must win. The next quarter century was marked by struggle, or rather a series of struggles, between the Dominion Government and those of the various provinces with as a general rule contrary to Macdonal's expectations, the latter proving successful. Ontario was the most consistent opponent of centralizing tendencies; her most notably victory was scored in what is known as the Ontario-Manitoba Boundary Dispute. It is out intention to deal with this question primarily as a phase of post-Confederation politics.

This article reassesses the relationship that existed in the period 1649–53 between war in Ireland and politics in England. Drawing upon a largely overlooked Irish army petition, it seeks to remedy an evident disconnect between the respective historiographies of the Cromwellian conquest of Ireland on the one hand and the Rump Parliament on the other. The article reconstructs some of the various disputes over religion, authority and violence that undermined the unity of the English wartime regime in Ireland. It then charts the eventual spilling over of these disputes into Westminster politics, arguing that their impact on deteriorating army-parliament relations in the year prior to Oliver Cromwell’s expulsion of the Rump in April 1653 has not been fully appreciated. The key driver of these developments was John Weaver, a republican MP and commissioner for the civil government of Ireland. The article explains how his efforts both to place restraints on the excessive violence of the conquest and to exert civilian control over the military evolved, by 1652, into a determined campaign at Westminster to strengthen the powers of Ireland’s civil government and to limit the army’s share in the prospective Irish land settlement. Weaver’s campaign forced the army officers in Ireland to intervene at Westminster, thus placing increased pressure on the Rump Parliament. This reassessment also enables the early 1650s to be viewed more clearly as a key phase in the operation of the longer-term relationships of mutual influence that existed between Dublin and London in the seventeenth century.

As an enduring legacy of the conflict, paramilitary policing remains an unpalatable but indisputable fact within Belfast's working-class, Republican communities. Historically, while much attention has been devoted to the causes and consequences of paramilitarism along with the terrorist threat posed by such organizations, little attention has been paid to the influence upon, or relations between, such nonstate policing actors, the communities in which they exist and the delivery of policing by the Police Service of Northern Ireland. While local and international literature surrounding paramilitary violence has tended towards political axiom or physical impact of such activity, the current paper presents an empirical study of the relations between communities and Republican paramilitary organizations who seek to exploit a perceived dearth of state-based policing at the community level within Belfast. Framing the ontology of paramilitary policing and its support from a community, rather than political or security perspective, the paper argues that continuing grass-roots support for this ‘new’ paramilitary policing within Republican communities of Belfast is more complex and nuanced than the political antecedents of the conflict from which such activity emerged – especially in terms of such support surviving successive political negotiations and police reforms since the ‘Good Friday’ Agreement of 1998.

Health policies and the right to health in Portugal underwent profound changes in recent decades, greatly contributed to these transformations the global economic and financial crisis and the influence of neoliberal policies. The interest in this subject arises from a professional practice in the Gabinete do Cidadão National Health Service, and by the lack of public debate and placement of Social Workers on the powers of the Gabinete do Cidadão and the role of social workers in this service. This work aims to contextualize: major changes in health policies and their impact on the right to health in recent years; consider legislative changes that occur between the creation of the Gabinete do Utente and the Gabinete do Cidadão; analyze the work that Social Workers have been developing within the competence of the Gabinete do Cidadão and the right to health. The exploratory research and qualitative nature featured contributions from Social Workers who work in Gabinetes do Cidadão of the northern region of the country, who participated via questionnaire survey. Research conducted it was concluded that the Gabinete do Cidadão only guarantees the right to complain and not the right to health. The possibilities that open to the Social Work Assistant in the Gabinete do Cidadão, for the sake of ensuring the right to health of the collective work. The skills and abilities of Social Work must have in order to promote critical awareness of individuals.
