Forty-five 12- and 13-year-old females attending Grade 7 in North York, Ontario were randomly selected from a group of 100 females who had volunteered to participate in a oneday hands-on workshop called It's Your Choice at Seneca College. The goals of this intervention were to broaden the career horizons of these students and to help them realize the need to continue mathematics and science through high school in order to keep occupational options unlimited. The young women were given a pre- and post-attitude survey to provide background information. In the month following participation in the workshop the students were interviewed in small groups (S students per group) to discover their perceptions of the impact of the workshop. The interviews revealed that participants felt that after the workshop their feelings of self-confidence increased, specifically with respect to working with their hands. Participants felt more aware of the usefulness and importance of the study of mathematics, science and technology, They also felt that It's Your Choice increased their interest in careers in these domains and helped them to see that these careers are viable choices for females. The interviews also revealed that many of the participants felt that in this society their roles and their choices were influenced and probably limited by the fact that they are female.

A large variety of social signals, such as facial expression and body language, are conveyed in everyday interactions and an accurate perception and interpretation of these social cues is necessary in order for reciprocal social interactions to take place successfully and efficiently. The present study was conducted to determine whether impairments in social functioning that are commonly observed following a closed head injury, could at least be partially attributable to disruption in the ability to appreciate social cues. More specifically, an attempt was made to determine whether face processing deficits following a closed head injury (CHI) coincide with changes in electrophysiological responsivity to the presentation of facial stimuli. A number of event-related potentials (ERPs) that have been linked specifically to various aspects of visual processing were examined. These included the N170, an index of structural encoding ability, the N400, an index of the ability to detect differences in serially presented stimuli, and the Late Positivity (LP), an index of the sensitivity to affective content in visually-presented stimuli. Electrophysiological responses were recorded while participants with and without a closed head injury were presented with pairs of faces delivered in a rapid sequence and asked to compare them on the basis of whether they matched with respect to identity or emotion. Other behavioural measures of identity and emotion recognition were also employed, along with a small battery of standard neuropsychological tests used to determine general levels of cognitive impairment. Participants in the CHI group were impaired in a number of cognitive domains that are commonly affected following a brain injury. These impairments included reduced efficiency in various aspects of encoding verbal information into memory, general slower rate of information processing, decreased sensitivity to smell, and greater difficulty in the regulation of emotion and a limited awareness of this impairment. Impairments in face and emotion processing were clearly evident in the CHI group. However, despite these impairments in face processing, there were no significant differences between groups in the electrophysiological components examined. The only exception was a trend indicating delayed N170 peak latencies in the CHI group (p = .09), which may reflect inefficient structural encoding processes. In addition, group differences were noted in the region of the N100, thought to reflect very early selective attention. It is possible, then, that facial expression and identity processing deficits following CHI are secondary to (or exacerbated by) an underlying disruption of very early attentional processes. Alternately the difficulty may arise in the later cognitive stages involved in the interpretation of the relevant visual information. However, the present data do not allow these alternatives to be distinguished. Nonetheless, it was clearly evident that individuals with CHI are more likely than controls to make face processing errors, particularly for the more difficult to discriminate negative emotions. Those working with individuals who have sustained a head injury should be alerted to this potential source of social monitoring difficulties which is often observed as part of the sequelae following a CHI.

Movement education and adapted physical activity are content areas not addressed in pre-service education or in-service training for Ontario practitioners working with individuals with disabilities in physical environments. Consequently, physical activity is often overlooked by service providers in programming and intervention for exceptional young learners. A formative evaluation, multiple-case study design was employed in this research in which a purposeful sample of expert practitioners performed a guided, descriptive evaluation of a three-day professional development workshop curriculum designed to supplement these areas lacking in professional preparation within their respective cohorts. Case-by-case and comparative analyses illustrated the inherent assumptions and societal constraints which prioritize the structure of professional development within the education system and other government organizations providing services for school-aged persons with disabilities in Ontario. Findings, discussed from a critical postmodern perspective, illustrate the paradoxical nature of Western values and prevailing mind/body dichotomy that guide professional practice in these fields.

Despite its importance to postsecondary students' success, there is little known about academic advisement in Canada. Academic advising can be a very intensive and demanding job, yet it is not well understood what duties or student populations of advising make it so. On a practical level, this study sought to learn more about academic advisement in Ontario universities and provide a general overview of who advisors are and what they do. This study also investigated academic advising duties and time allocation for these responsibilities in an attempt to relate theory to practice incorporating Vilfredo Pareto's theoretical underpinnings to confirm or negate the applicability of the Pareto Principle in relationship to time utilization by advisors. Essentially this study sought to discover which students require the greatest advisement time and effort, and how advisors could apply these findings to their work. Academic advising professionals in Ontario universities were asked to complete a researcher-designed electronic survey. Quantitative data from the responses were analyzed to describe generalized features of academic advising at Ontario universities. Discussion and implications for practice will prompt advisors and institutions using the results of this study to measure themselves against a provincial assessment. Advisors' awareness of time allocation to different student groups can help focus attention where new strategies are needed to maximize time and efforts. This study found that caseload and time spent with student populations were proportional. Regular undergraduate students accounted for the greatest amount of caseload and time followed by working with students struggling academically. This study highlights the need for further evaluation, education, and research in academic advising in Canadian higher education.

Learning to write is a daunting task for many young children. The purpose of this study was to examine the impact of a combined approach to writing instruction and assessment on the writing performance of students in two grade 3 classes. Five forms and traits of writing were purposefully connected during writing lessons while exhibiting links to the four strands of the grade 3 Ontario science curriculum. Students then had opportunities to engage in the writing process and to self-assess their compositions using either student-developed (experimental group/teacher-researcher's class) or teachercreated (control group/teacher-participant's class) rubrics. Paired samples t-tests revealed that both the experimental and control groups exhibited statistically significant growth from pretest to posttest on all five integrated writing units. Independent samples t-tests showed that the experimental group outperformed the control group on the persuasive + sentence fluency and procedure + word choice writing tasks. Pearson product-moment correlation r tests revealed significant correlations between the experimental group and the teacher-researcher on the recount + ideas and report + organization tasks, while students in the control group showed significant correlations with the teacher-researcher on the narrative + voice and procedure + word choice tasks. Significant correlations between the control group and the teacher-participant were evident on the persuasive + sentence fluency and procedure + word choice tasks. Qualitative analyses revealed five themes that highlighted how students' self-assessments and reflections can be used to guide teachers in their instructional decision making. These findings suggest that educators should adopt an integrated writing program in their classrooms, while working with students to create and utilize purposeful writing assessment tools.

This qualitative research study explores how teachers who write social justicefocused curriculum support resources conceptualize curriculum and social justice. Curriculum used in schools reflects underlying assumptions and choices about what knowledge is valuable. Class-based, cultural, racial, and religious stereotypes are reinforced in schooling contexts. Are the resources teachers create, select, and use to promote social justice reproducing and reinforcing forms of oppression? Why do teachers pursue social justice through curriculum writing? What are their hopes for this work? Exploring how Teachers' beliefs and values influence cy.rriculum writing engages the teachers writing and using curriculum support resources in critical reflective thought about their experiences and efforts to promote social justice. Individual and focus group interviews were conducted with four teacher-curriculum writers from Ontario schools. In theorizing my experiences as a teacher-curriculum writer, I reversed roles and participated in individual interviews. I employed a critical feminist lens to analyze the qualitati ve data. The participants' identities influenced how they understand social justice and write curriculum. Their understandings of injustices, either personal or gathered through students, family members, or oth.e. r teachers, influenced their curriculum writing . The teacher-curriculum writers in the study believed all teachers need critical understandings of curriculum and social justice. The participants made a case for representation from historically disadvantaged and underrepresented groups on curriculum writing teams. In an optimistic conclusion, the possibility of a considerate curriculum is proposed as a way to engage the public in working with teachers for social justice.

Understanding the relationship between genetic diseases and the genes associated with them is an important problem regarding human health. The vast amount of data created from a large number of high-throughput experiments performed in the last few years has resulted in an unprecedented growth in computational methods to tackle the disease gene association problem. Nowadays, it is clear that a genetic disease is not a consequence of a defect in a single gene. Instead, the disease phenotype is a reflection of various genetic components interacting in a complex network. In fact, genetic diseases, like any other phenotype, occur as a result of various genes working in sync with each other in a single or several biological module(s). Using a genetic algorithm, our method tries to evolve communities containing the set of potential disease genes likely to be involved in a given genetic disease. Having a set of known disease genes, we first obtain a protein-protein interaction (PPI) network containing all the known disease genes. All the other genes inside the procured PPI network are then considered as candidate disease genes as they lie in the vicinity of the known disease genes in the network. Our method attempts to find communities of potential disease genes strongly working with one another and with the set of known disease genes. As a proof of concept, we tested our approach on 16 breast cancer genes and 15 Parkinson's Disease genes. We obtained comparable or better results than CIPHER, ENDEAVOUR and GPEC, three of the most reliable and frequently used disease-gene ranking frameworks.

This research project examined the behavioural, social, and emotional issues affecting children and youth with conduct disorder. Based on the literature review, the deconstruction of theoretical and empirical studies, and findings from the needs assessment, Conduct Disorder: A Handbook for Elementary School Educators was created. This handbook was developed based on the evidence that conduct problems can most effectively be improved when multiple systems are included in the prevention and intervention of the disorder. Educators, related service providers, and the child all play an important role in designing and implementing effective interventions. Therefore, it is imperative to provide educators with the information necessary to begin this emerging collaborative process. The handbook was created as a tool for educators intending to enhance their knowledge when working with students with conduct disorder. A Needs Assessment was conducted to determine what educators wanted the handbook to contain to assist them in working with students displaying conduct problems. The educators evaluated the handbook, providing constructive feedback and confirming the potential value and practicality of this handbook for elementary school educators. The educators reported an increase in their understanding of conduct disorder, as well as a heightened awareness of the causal factors that contribute to the disorder. The list of community resources and agencies was thought to be a good starting point for educators looking for supplementary aids. The educators indicated that the handbook is a good reference tool to use when teaching students with conduct problems. The educators concluded with the hope that this handbook will be shared with others.

Percy Carruthers Band was born on November 27, 1892 in Toronto, Ontario to Charles Walter Band, a grain merchant and Jessie Camp Shaw Band. He graduated from Upper Canada College and became a broker. He worked at the Dominion Bank and then at Maple Leaf Milling Company. He was stationed at Port Colborne for a while. Before leaving for the front, he was with Bankers Bond Company of Toronto and is also listed as working with the firm of Bailey, Wood and Cross. Lieutenant Band received a Certificate of Military Qualifications on Dec. 24th, 1914. He received his Certificate of Military Instruction on Nov. 30, 1915. He received these certificates while with the 48th Regiment (Highlanders). He enlisted in 1914 and went overseas in August of 1915 as an officer in the 35th Battalion. By August 26, 1915, he is listed as being with the 23rd Reserve Battalion. A year later, in August of 1916 Lieutenant Band arrived in France and was posted to the 2nd Battalion – “The Second Iron”. In 1916, Band was the victim of shell shock received during a charge. He was wounded in April of 1917 at Vimy Ridge yet he remained on duty. At this time he received a gunshot wound to his right jaw. He earned a promotion to Captain on September 16th, 1917. He was wounded again in November of 1917 at Passchendaele where he suffered a gunshot wound to the ear. For his courage and determination Percy Band received the Military Cross on February 18, 1918. He led his company under difficult circumstances even though he was wounded. He was awarded a bar to the Military Cross for gallantry during a successful attack on two villages on December 2nd, 1918. During this attack he led his company against enemy machine guns. It is said that he displayed exceptional leadership qualities and skill during this time. On the 30th of August in 1918, he made a daring reconnaissance to the front under heavy fire in an attack on Upton Wood. He was also commended on his gallantry during attacks on Cagnicourt and the Canal du Nord in September of 1918. He was awarded the second bar to the Military Cross on February 1, 1919. The award of the Croix de Guerre was conferred on Captain Percy Carruthers Band by the President of the French Republic on December 15th, 1918 for distinguished service rendered during the course of the campaign. His general demobilization took place on April 25, 1919. Percy Band married Margaret Julia Woodruff on November 25, 1919, and they had three children: Charles Woodruff Band (1921), Margaret Elizabeth Band (1924) and Robert DeVeaux Woodruff Band (1927). After the war, Mr. Band was a manager at Geo. Weston Bread and Cakes Limited, St. Catharines. Percy Band was also an avid collector. His collections included antique toys and art. He died suddenly on May 19, 1961. The Toronto Telegram published this about him: “Captain Percy Carruthers Band, M.C. with two Bars, Croix de Guerre with Palm – was an officer whose buoyant spirit and gallantry mirrored the vibrant soul of the Battalion. Blythe of heart, yet endowed with a fine sense of responsibility, he gave inspired leadership of No. 3 Company.”

Les professionnels de l'information traversent actuellement une période de redéfinition de leur profession provoquée par la transformation de l'information et des processus informationnels vers un mode de plus en plus électronique. Les systèmes d'information Web (SIW) — c'est-à-dire des systèmes d'information basés sur les technologies Web tels que les sites Web externes, les intranets, les systèmes de commerce électronique et les extranets — font partie des technologies à l'origine de ces changements. Ces systèmes sont de plus en plus adoptés par les organisations et, en particulier, par les gouvernements dans leur volonté de devenir électroniques. Le gouvernement fédéral canadien est reconnu comme un des plus innovateurs en matière de SIW et doit adapter son environnement informationnel, dont font partie les professionnels de l'information, à l'introduction de ces systèmes. Malgré l'innovation que les SIW représentent, peu d'études empiriques ont été menées pour identifier quels sont les intervenants nécessaires à leur mise en place. Aucun consensus n'émerge de la littérature quant à la nature de l'intervention des professionnels de l'information dans ces systèmes. Cette recherche vise à accroître les connaissances sur l'intervention des professionnels de l'information dans les SIW. Pour les besoins de cette recherche, les professionnels de l'information sont définis comme les personnes ayant une maîtrise en bibliothéconomie et sciences de l'information ou toute autre formulation équivalente. Cette recherche étudie quatre questions de recherche qui portent sur : (1) les rôles des professionnels de l'information décrits dans les politiques d'information pan-gouvernementales liées aux SIW ainsi que ceux des autres intervenants mentionnés en lien direct avec les SIW, (2) les types de SIW dans lesquels les professionnels de l'information interviennent, (3) les tâches des professionnels de l'information dans ces SIW, et (4) les autres intervenants qui travaillent dans ces systèmes. Une approche qualitative a été utilisée pour répondre à ces questions et implique quatre modes de collecte des données : (1) des entrevues en profondeur en personne avec des professionnels de l'information impliqués dans des SIW, (2) une analyse des SIW où interviennent ces professionnels de l'information, (3) une analyse des politiques pan-gouvernementales liées aux SIW, et (4) la documentation pertinente. Les professionnels de l'information rencontrés proviennent de sept ministères du gouvernement fédéral canadien, ministères retenus pour leur implication dans les SIW. Les résultats indiquent que les professionnels de l'information rencontrés interviennent dans les SIW aux niveaux micro et macro, c'est-à-dire dans des SIW spécifiques ainsi que globalement au niveau de l'ensemble des SIW d'un ministère ou du gouvernement fédéral. Ces professionnels de l'information sont impliqués dans toutes les dimensions et les phases de développement des SIW. Les tâches liées au contenu sont prédominantes mais les tâches technologiques sont aussi très présentes. Trois variables se dégagent de cette étude qui ont un impact sur l'intervention des professionnels de l'information dans les SIW : les types de SIW, les types de postes occupés par les professionnels de l'information et les types de gouvernance.

This paper is based on case study research conducted in an economically depressed, immigrant gateway neighborhood of Escondido, California. This study has been in progress since 2005 and involves working with children at the local middle school on rights-based community environmental action research projects in coordination with student facilitators in an upper-division university class titled “Children and the Environment.” This case study has suggested inquiry into the practical ethical dimensions of working with children, administrators, and university students on action research. Examples of the ethical questions which arose during this study include: how can continuity for the middle school children be achieved as different groups of university stu- dents move in and out of the project as they take and finish the “Children and the Environment” class, and is it ethical for the middle school children’s work to be facilitated by university stu- dents only freshly trained in the action research technique? This paper explores these and other ethical questions involving power, coercion, tension over expectations, and obligation and provides direction for on-going ethical questions scholars should pursue in involving children in rights-based community environmental action research.

Les systèmes de gestion intégrée en environnement et en santé et sécurité du travail (SGI) sont un nouveau paradigme de gestion dans les organisations modernes. Ces systèmes sont construits à partir des normes ISO 14001 et d’OHSAS 18001, basées sur la prévention des risques et le principe de précaution. La littérature sur les SGI témoigne d’un marasme conceptuel prédominant depuis plus de 10 ans; elle insiste sur l’urgence d’un consensus taxinomique et conceptuel afin de définir les systèmes de gestion intégrée et de différencier le mécanisme d’intégration de celui de l’implantation. Cette lacune conceptuelle enlise les connaissances dans un fossé épistémologique, retardant ainsi le débat dans ce nouveau champ d’études. Les rares connaissances dont nous disposons dans ce domaine proviennent de quelques études théoriques et de six études empiriques, toutes préoccupées par la compatibilité des multiples systèmes et des avantages économiques de leur intégration. Les évidences engendrées par ces études sont insuffisantes pour appréhender la dynamique du nouveau paradigme dont les effets demeurent peu connus. Cette situation révèle l’urgence d’agir dans un contexte où l’utilisation des SGI se multiplie, et où leur tendance à minimiser l’importance des risques devient de plus en plus préoccupante. Aucune étude ne s’est encore penchée sur l’implantation d’un SGI en environnement et en santé et sécurité du travail construit uniquement à partir des normes ISO 14001 et d’OHSAS 18001. Cette connaissance est importante pour expliquer les effets de tels systèmes. C’est dans cette perspective que nous avons réalisé cette première étude empirique d’un SGI selon les normes ISO 14001 et d’OHSAS 18001. Nos questions de recherche portent sur le mode, le degré d’implantation, les effets du SGI, ainsi que sur les facteurs contextuels qui interviennent pour expliquer les variations dans le degré d’implantation et les effets du SGI. Il s’agit d’une recherche à prélèvement qualitatif qui repose sur un devis d’étude de cas, avec des niveaux d’analyse imbriqués, et comportant une double visée descriptive et explicative. Notre échantillon, de type raisonné, regroupait trente-cinq intervenants provenant de différentes instances hiérarchiques ; il incluait également des représentants syndicaux. Notre échantillon était composé de 7 usines, accréditées aux normes ISO 14001, OHSAS 18001, et dispersées dans différentes villes du Québec. Ces usines différaient tant par leur technologie, leur âge, leur taille, et leurs types de production. Nos données ont été recueillies en 2004; elles sont basées sur des entrevues semi dirigées, sur des observations directes lors de la visite des lieux; elles s’appuient aussi sur des consultations de documents internes et sur des outils électroniques implantés. La transcription des entrevues effectuée, le contenu des discours a été catégorisé selon les cinq dimensions du SGI: engagement, planification, mise en opération, contrôle et revue de la direction. Une condensation horizontale avait précédé l’analyse de chaque cas et l’analyse transversale des cas selon une approche à la fois inductive et déductive. Les résultats de notre recherche ont révélé deux modes d’implantation : le mode d’enrichissement et le mode de fusion. Ces modes dépendaient de la nature des structures fonctionnelles en place. La visée d’amélioration continue à la base du SGI n’avait pas réussi à concilier les approches traditionnelles bottom up et top down qui ont dominé cette implantation; son mécanisme était guidé par 4 types de stratégies : l’économie des ressources, le contrôle des forces d’influences, la stratégie des fruits faciles à cueillir et la stratégie à petits pas. Pour analyser le degré d’implantation, nous avons tenu compte de l’effort de structuration du SGI et de la force d’utilisation des processus implantés à chacune des cinq dimensions du SGI. Les résultats de notre recherche révèlent une variabilité certaine du degré d’implantation entre les usines d’une part, et entre les processus associés aux cinq dimensions du SGI d’autre part. L’analyse des discours a permis de produire cinq hypothèses qui soutiennent l’effort de structuration et la force d’utilisation du SGI: (i) l’hypothèse de la force de cohésion, (ii) l’hypothèse de la spécificité du processus, (iii) l’hypothèse de la portée du processus, (iv) l’hypothèse de la capacité organisationnelle, (v) l’hypothèse de l’acceptation du changement. L’implantation du SGI était soumise à l’influence de multiples facteurs; ils étaient de nature politique, structurelle et organisationnelle. Ces facteurs avaient agi sur le processus d’implantation en amorçant une cascade d’interactions au cours desquelles leurs forces d’influences se renforçaient, se neutralisaient ou s’additionnaient pour affecter le degré d’implantation. Les facteurs facilitant touchaient surtout l’effort de structuration ; ils incluaient : l’expérience des systèmes de gestion, l’implication de la direction, celle du syndicat ou du CSS, la structure organisationnelle, le niveau d’éducation, l’âge et la taille de l’usine. Quant aux facteurs contraignants, ils agissaient sur la force d’utilisation ; ils incluaient : la lourdeur procédurale, le manque de temps, le manque de formation, le manque de ressources, la culture organisationnelle, la structure organisationnelle, le fossé intergénérationnel, l’absence du syndicat et l’âge de l’usine. Trois effets proximaux escomptés par l’entreprise ont été observés. (i) La rigueur de la gestion était associée à l’application des exigences du SGI; elle touchait la gouvernance en environnement et en santé et sécurité du travail, les mécanismes de gestion et les procédés de production. (ii) La standardisation était reliée au mode d’implantation du SGI; elle concernait les pratiques, les outils, les méthodes de travail et l’organisation des ressources. (iii) La rupture des silos est un effet relié au mode d’implantation du SGI; elle touchait les structures départementales, les frontières professionnelles, les relations et climat de travail. Ces effets proximaux avaient provoqué plusieurs effets émergents, plus distaux: une augmentation du pouvoir de contrôle syndical, un renforcement de la légitimité des recommandations soumises par les spécialistes professionnels, la création de réseaux inter organisationnels et le transfert du savoir. L’implantation du SGI avait transformé la gouvernance et les pratiques en environnement et en santé et sécurité du travail dans les sept usines. Toutefois, elle ne semblait pas garantir l’immunité du processus de gestion des risques à l’environnement ni à la santé et sécurité du travail. Sa capacité à diluer les risques devait retenir l’attention des politiques de santé publiques et des programmes de prévention des risques à l’environnement et à la santé et sécurité du travail. L’amélioration de la gestion des risques demeurait un effet attendu non observé et soumis à des facteurs contextuels qui pourraient l’empêcher de se concrétiser. À cet égard, le transfert du savoir, renforcé par l’émergence des réseaux inter organisationnels, semblait offrir une avenue beaucoup plus prometteuse et accessible. C’est l’une des contributions de cette recherche. Elle a aussi (i) proposé une typologie des modes d’implantation et des effets du SGI (ii) préconisé une méthode détaillée d’une meilleure appréciation du degré d’implantation (iii) précisé le rôle des facteurs contextuels dans l’explication des variations du degré d’implantation et dans la production des effets, (iv) proposé des hypothèses sur la structuration et l’utilisation du SGI (v) offert une perspective plurielle et approfondie de la dynamique de l’implantation du SGI grâce à la variété de l’échantillon des répondants et des usines. Il s’agit de la première étude de terrain dans le domaine. À notre connaissance, aucune autre étude n’a eu de tels résultats. Cette étude qualitative descriptive de type exploratoire avait pour but l’exploration de la perception des adolescents et des experts en sécurité routière sur les campagnes de sensibilisation actuelles et les programmes de prévention en sécurité routière s’adressant aux adolescents, afin de proposer de nouvelles pistes d’action en prévention des accidents de la route. Le modèle de planification Precede/Proceed de Green et Kreuter (2005) a été utilisé comme cadre de référence. Un groupe de discussion a été réalisé auprès de huit adolescents et des entrevues semi-dirigées ont été réalisées auprès de trois experts en sécurité routière. Les résultats montrent que peu de similitudes existent entre les propos des adolescents et ceux des experts en sécurité routière. Par contre, les similitudes portent sur des aspects importants en sécurité routière comme la prise du risque à l’adolescence, l’implication des parents et l’implication du milieu scolaire. Les résultats de cette étude fourniront aux décideurs de programmes de prévention ou aux personnes agissant de près ou de loin auprès de cette clientèle des pistes de recherches et d’actions pour de futures interventions prometteuses en prévention des accidents de la route chez les adolescents afin de réduire le nombre d’accidents chez les jeunes conducteurs.

Les avocats, praticiens et universitaires qui sont engagés dans le droit des transports internationaux de marchandises par mer ont l’habitude de travailler avec un régime complexe de responsabilité du transporteur maritime. La coexistence de plusieurs conventions régissant ce régime et l’imprécision des textes de ces différentes législations rendent leur application difficile d’où l’échec permanent du voeu d’uniformisation de ce droit. En premier lieu, nous retrouvons le régime de base celui de la Convention de Bruxelles sur l’unification de certaines règles en matière de connaissement, ratifiée le 25 août 1924 et ses Protocoles modificatifs annexés en 1968 et 1979. Il s’agit d’un régime fondé sur la présomption de responsabilité comprenant une liste de cas exonératoires appelés « cas exceptés ». En second lieu figurent les Règles de Hambourg, édictées en 1978, qui établissent un régime basé sur la présomption de faute du transporteur à l’exception de deux cas exonératoires : l’incendie et l’assistance ou la tentative de sauvetage. Enfin, apparaît la Convention sur le contrat de transport international de marchandises effectué entièrement ou partiellement par mer, adoptée par les Nations unies en 2009, sous l’appellation « Les Règles de Rotterdam », qui adopte un régime de responsabilité « particulier ». Cette étude a tenté d’analyser ces mécanismes juridiques mis en place. Pour ce faire, nous nous sommes concentrées sur les sources du dysfonctionnement de ces régimes, afin de favoriser le développement d’initiatives d’uniformisation des règles de responsabilité du propriétaire du navire. L’analyse des textes positifs, de la doctrine et de la jurisprudence, nous a permis de constater que les différentes approches du régime juridique du transporteur maritime des marchandises sous ces différentes législations ne garantissent pas la prévisibilité et la sécurité juridiques recherchées par les différents acteurs maritimes. Par conséquent, l’absence d’un régime cohérent et unifié a créé des incertitudes au sein de la communauté maritime internationale et au sein des tribunaux en cas de litige. Pour surmonter cette réalité complexe, notre thèse propose une approche qui pourra simplifier ce régime, l’approche objective.
