Any organisation that captures personal data in Canada for processing is deemed tohave a ‘real and substantial connection’ to Canada and thus fall within thejurisdiction of the Personal Information Protection and Electronic Documents Act(PIPEDA) and of the Office of the Privacy Commissioner of Canada (OPC). Whathas been the experience of enforcing Canadian privacy protection law on US-basedsocial networking services? We analyse some of the high-profile enforcement actionsby the Privacy Commissioner. We also test compliance through an analysis of theprivacy policies of the top 23 SNSs operating in Canada and through the use of accessto personal information requests. Our analysis suggests that non-compliance iswidespread, and is explained by the countervailing conceptions of jurisdictioninherent in corporate policy and technical system design.

While comparative law has become a key discipline, its instrumentalist use has turned out to be a powerful weapon: it is the ‘pen’ by which the identity of and differences in law’s geopolitics are continually written and rewritten. Given its attractive functionalist essence, comparative law is gaining increasing international credit as a way of developing newer theories of sovereignty and governance in a framework in which law is conceived of less as a set of rules and more as a symbolic vestimentum of global soft power. The present contribution critically investigates the relationship between distortive views of comparative law’s geopolitics and the intimate essence of the doctrine aimed at creating the ‘aspatial’, unbounded, illimitable (and hence intangible) liberal global order whose governance appears to transcend the idea and form(s) of law through which the ‘politicization’ and ‘juridification’ of modernity have been achieved in the last century. In doing so, it also addresses why such an alliance has made it easier to ‘discover’ and ‘sell’ the smooth and rectilinear land of the figuratively unspoken and unwritten as the terra incognita that lies over what is created by the constructivist political intervention(s) of the modern nation-state

We apply the concept of exchangeable random variables to the case of non-additive robability distributions exhibiting ncertainty aversion, and in the lass generated bya convex core convex non-additive probabilities, ith a convex core). We are able to rove two versions of the law of arge numbers (de Finetti's heorems). By making use of two efinitions. of independence we rove two versions of the strong law f large numbers. It turns out that e cannot assure the convergence of he sample averages to a constant. e then modal the case there is a true" probability distribution ehind the successive realizations of the uncertain random variable. In this case convergence occurs. This result is important because it renders true the intuition that it is possible "to learn" the "true" additive distribution behind an uncertain event if one repeatedly observes it (a sufficiently large number of times). We also provide a conjecture regarding the "Iearning" (or updating) process above, and prove a partia I result for the case of Dempster-Shafer updating rule and binomial trials.

Esta dissertação analisa a influência das instituições militares, particularmente a Escola Militar, no período de 1912 a 1944, na configuração urbana de Realengo, bairro localizado no subúrbio do município do Rio de Janeiro. Tendo como principal corpus documental os relatórios do Ministério da Guerra e a legislação pertinente, são estabelecidos marcos históricos para análise do processo de transformação da antiga zona rural do município em uma área militar, enfatizando os impactos que incidiram sobre a região em decorrência da transferência da sede da Escola Militar do Brazil, da Praia Vermelha para o Realengo. Preliminarmente, são identificadas as primeiras unidades militares que ocuparam a região, estabelecendo conexões entre o funcionamento dessas organizações, a constituição do seu patrimônio e o desenvolvimento urbano de Realengo. Para contextualização, também são apresentadas as sedes ocupadas pela Escola Militar ao longo do século XIX e as circunstâncias que motivaram sua saída da Praia Vermelha no início do século XX. O recorte temporal se inicia no período compreendido entre o início do século XIX, quando as chamadas terras realengas foram doadas à Câmara da cidade do Rio de Janeiro por D. João VI; atravessa o século XX, quando se consolidaram o patrimônio da Escola Militar em Realengo e a urbanização do bairro; e chega aos dias atuais, quando, após a extinção da escola, a decadência e o abandono são as marcas das antigas edificações militares do bairro. Também são assinalados o funcionamento da Fábrica de Cartuchos e a criação de duas grandes áreas militares, a Vila Militar de Deodoro e o Campo dos Afonsos. Por fim, são levantadas as perspectivas e ações do Exército Brasileiro e de outros órgãos da sociedade na preservação do patrimônio e da memória da antiga escola.

This study aimed to map the key positions regarding the constitutionality of the Maria da Penha Law (Law 11.340/2006) in the Brazilian judicial system. The law, the result of political struggles by the Brazilian feminist movement, has been the subject of discussions in the public sphere and actions aimed at consolidating its constitutionality before the Federal Supreme Court. We examined and discussed the arguments used in the Courts, intending to show that the creation of law is not limited to the legislative moment, but rather that its social meaning is also constituted through disputes within the Judiciary.
