• For the purposes of this chapter, “health law” encapsulates regulation of the medical and health professions, the administration of health services and the maintenance of public health to the extent that it is connected to the provision of health services. • There are diverging views as to whether health law can be regarded as a discrete “area of law”. • Health law draws on other areas of law such as tort law, criminal law and family law. It also draws upon other disciplines, most notably medical and health ethics. • Social and economic forces have influenced the development and direction of health law, and these forces may become even more influential in the future. • The increasingly globalised world has implications for Australia's health systems and raises questions and creates commitments in respect of the international community. • Technological developments, including in respect of treatment, diagnosis and information management, create ongoing challenges for health law. • Patient rights, human rights and consumerism are increasingly key drivers in the development of health law. • Health law is significant to contemporary Australian society because of the gravity of the topics that fall within its ambit, its social relevance to so many aspects of human existence and endeavour, the important role it plays in protecting the vulnerable, and the extent to which it engages with fundamental principles of justice.

This article considers the extent to which a claimed process must be repeatable or reproducible in order to be patentable according to Australian patent law. It asks whether a process must yield identical or near-identical results each time the process is invoked, or if not, what degree of repeatability is required. The question is relevant when considering, among other things, the patentability of some methods of medical treatment and diagnosis, biotechnology inventions and business methods.

This chapter identifies ways in which laws are capable of responding to child maltreatment, both as an immediate regulator of conduct, and as an influence on a society’s cultural development and approach to children’s welfare. Informed by practices and experiences in selected common law systems, the chapter provides examples of legal mechanisms that can inform discussion of optimal strategies to identify and manage child maltreatment in many different societies. Both positive and negative aspects of these mechanisms are noted. While controversies arise as to what kinds of laws are best in preventing and responding to child maltreatment, and even, more fundamentally, whether there is a role for law in protecting children, this chapter offers evidence that a variety of legal tools can be employed to address child abuse and neglect, for any cultural setting in which there is willingness to act to prevent and treat its various forms.

In this Primer, our aims are to explain what statutory interpretation is and why it is important. We also aim to note some of the more difficult concepts and ideas you will need to understand when reading a statute, when deciding if it is relevant to a legal problem, and, if so, how it applies to that problem. We do not aim to provide an overview of the rules of Statutory Interpretation, but only to focus on areas that have created well-known difficulties for students and practitioners alike, such as the concept of the intentions of Parliament and the correct use of intrinsic materials.

BACKGROUND Law is increasingly involved in clinical practice, particularly at the end of life, but undergraduate and postgraduate education in this area remains unsystematic. We hypothesised that attitudes to and knowledge of the law governing withholding/withdrawing treatment from adults without capacity (the WWLST law) would vary and demonstrate deficiencies among medical specialists. AIMS We investigated perspectives, knowledge and training of medical specialists in the three largest (populations and medical workforces) Australian states, concerning the WWLST law. METHODS Following expert legal review, specialist focus groups, pre-testing and piloting in each state, seven specialties involved with end-of-life care were surveyed, with a variety of statistical analyses applied to the responses. RESULTS Respondents supported the need to know and follow the law. There were mixed views about its helpfulness in medical decision-making. Over half the respondents conceded poor knowledge of the law; this was mirrored by critical gaps in knowledge that varied by specialty. There were relatively low but increasing rates of education from the undergraduate to continuing professional development (CPD) stages. Mean knowledge score did not vary significantly according to undergraduate or immediate postgraduate training, but CPD training, particularly if recent, resulted in greater knowledge. Case-based workshops were the preferred CPD instruction method. CONCLUSIONS Teaching of current and evolving law should be strengthened across all stages of medical education. This should improve understanding of the role of law, ameliorate ambivalence towards the law, and contribute to more informed deliberation about end-of-life issues with patients and families.

This article reports on a study which reviewed all publicly available succession law judgments in Australia during a 12-month period. The article begins with a brief overview of the relevant Australian law and the method adopted for the case review to provide some context for the analysis that follows. It then shifts to its primary objective: to provide an overview of Australian estate litigation during this period with a particular focus on analysing the family provision contests, which comprised over half the cases in the sample. The article examines how many estates were subject to family provision claims, who were contesting them, and to what extent those challenges were successful. The article also considers variation in estate litigation across Australian states and the impact of estate size on contests. It concludes by identifying the themes that emerged from these judicial cases and outlines their significance for law and practice reform.

In 2015 the QLRC is conducting an inquiry into whether to extend legislative mandatory reporting duties for physical abuse and sexual abuse to early childhood education and care practitioners. The current legislation does not require these practitioners to report suspected cases of significant harm from physical or sexual absue to child welfare agencies. Based on the literature, and a multidisciplinary analysis, our overall recommendation is that we endorse the extension to selected early childhood education and care practitioners of Queensland’s current mandatory reporting duty in the Child Protection Act 1999 s 13E.

- Background Palliative medicine and other specialists play significant legal roles in decisions to withhold and withdraw life-sustaining treatment at the end of life. Yet little is known about their knowledge of or attitudes to the law, and the role they think it should play in medical practice. Consideration of doctors’ views is critical to optimizing patient outcomes at the end of life. However, doctors are difficult to engage as participants in empirical research, presenting challenges for researchers seeking to understand doctors’ experiences and perspectives. - Aims To determine how to engage doctors involved in end-of-life care in empirical research about knowledge of the law and the role it plays in medical practice at the end of life. - Methods Postal survey of all specialists in palliative medicine, emergency medicine, geriatric medicine, intensive care, medical oncology, renal medicine, and respiratory medicine in three Australian states: New South Wales, Victoria, and Queensland. The survey was sent in hard copy with two reminders and a follow up reminder letter was also sent to the directors of hospital emergency departments. Awareness was further promoted through engagement with the relevant medical colleges and publications in professional journals; various incentives to respond were also used. The key measure is the response rate of doctors to the survey. - Results Thirty-two percent of doctors in the main study completed their survey with response rate by specialty ranging from 52% (palliative care) to 24% (medical oncology). This overall response rate was twice that of the reweighted pilot study (16%). - Conclusions Doctors remain a difficult cohort to engage in survey research but strategic recruitment efforts can be effective in increasing response rate. Collaboration with doctors and their professional bodies in both the development of the survey instrument and recruitment of participants is essential.

Child sexual abuse is widespread and difficult to detect. To enhance case identification, many societies have enacted mandatory reporting laws requiring designated professionals, most often police, teachers, doctors and nurses, to report suspected cases to government child welfare agencies. Little research has explored the effects of introducing a reporting law on the number of reports made, and the outcomes of those reports. This study explored the impact of a new legislative mandatory reporting duty for child sexual abuse in the State of Western Australia over seven years. We analysed data about numbers and outcomes of reports by mandated reporters, for periods before the law (2006-08) and after the law (2009-12). Results indicate that the number of reports by mandated reporters of suspected child sexual abuse increased by a factor of 3.7, from an annual mean of 662 in the three year pre-law period to 2448 in the four year post-law period. The increase in the first two post-law years was contextually and statistically significant. Report numbers stabilised in 2010-12, at one report per 210 children. The number of investigated reports increased threefold, from an annual mean of 451 in the pre-law period to 1363 in the post-law period. Significant decline in the proportion of mandated reports that were investigated in the first two post-law years suggested the new level of reporting and investigative need exceeded what was anticipated. However, a subsequent significant increase restored the pre-law proportion, suggesting systemic adaptive capacity. The number of substantiated investigations doubled, from an annual mean of 160 in the pre-law period to 327 in the post-law period, indicating twice as many sexually abused children were being identified.

Benjamin Libet ha argumentado que cambios específicos en la actividad electroencefalográfica del córtex cerebral son registrados varios cientos de milisegundos antes que las personas tengan la intención consciente para actuar. Según Libet este hallazgo prueba que los movimientos voluntarios se inician de manera inconsciente. Siendo así, pone en duda nuestra percepción de libre albedrío según la cual nosotros somos iniciadores conscientes de nuestras acciones voluntarias. En este artículo haré objeciones empíricas a su modelo experimental argumentando que Libet no mide en realidad lo que él cree que está midiendo y, que el uso de electroencefalografía con electrodo de registro en cuero cabelludo no suministra datos fiables que permitan correlacionar cambios de la actividad cerebral y fenómenos psíquicos. También haré objeciones teóricas a las conclusiones filosóficas derivadas de sus experimentos, argumentado que la acción simple (mover el dedo) no puede ser una acción paradigmática para estudiar libre albedrío y que Libet al no estudiar la naturaleza de las intenciones distales ni su probable rol causal en la formación de intenciones proximales, no puede demostrar que el cerebro decide inconscientemente iniciar la acción. Concluyo que Libet nunca llega a probar que no actuamos por nuestro propio libre albedrío.

Il progetto di ricerca che presentiamo nasce dalla virtuosa combinazione di teoria e prassi didattica nello spirito della ricerca-azione. Scopo del presente lavoro è elaborare un percorso didattico di formazione alla traduzione specializzata in ambito medico-scientifico, tecnico ed economico-giuridico per la combinazione linguistica spagnolo-italiano all’interno della cornice istituzionale concreta dell’università italiana oggi. La nostra proposta formativa si fonda su tre elementi: la ricognizione del mercato attuale della traduzione per la combinazione linguistica indicata, l’individuazione degli obiettivi formativi in base al modello di competenza traduttiva scelto, l’elaborazione del percorso didattico per competenze e basato sull’enfoque por tareas di traduzione. Nella progettazione delle modalità didattiche due sono gli aspetti che definiscono il percorso proposto: il concetto di genere testuale specializzato per la traduzione e la gestione delle informazioni mediante le nuove tecnologie (corpora, banche dati terminologiche e fraseologiche, memorie di traduzione, traduzione controllata). Il presente lavoro si articola in due parti: la prima parte (quattro capitoli) presenta l’inquadramento teorico all’interno del quale si sviluppa la riflessione intorno alla didattica della traduzione specializzata; la seconda parte (due capitoli) presenta l’inquadramento metodologico e analitico all’interno del quale si elabora la nostra proposta didattica. Nel primo capitolo si illustrano i rapporti fra traduzione e mondo professionale; nel secondo capitolo si presenta il concetto di competenza traduttiva come ponte tra la formazione e il mondo della traduzione professionale; nel terzo capitolo si ripercorrono le tappe principali dell’evoluzione della didattica della traduzione generale; nel quarto capitolo illustriamo alcune tra le più recenti e complete proposte didattiche per la traduzione specializzata in ambito tecnico, medico-scientifico ed economico-giuridico. Nel quinto capitolo si introduce il concetto di genere testuale specializzato per la traduzione e nel sesto capitolo si illustra la proposta didattica per la traduzione specializzata dallo spagnolo in italiano che ha motivato il presente lavoro.

La tesi si ripropone di analizzare la figura dell’immigrato italiano nella Lione del Periodo interbellico. Partendo da considerazioni generali sull’immigrazione in Francia, il primo capitolo fornisce una visione generale sulla percezione degli stranieri oltralpe e indaga su come essi vengano confrontati a una società che li inquadra in rigide classificazioni identitarie, favorendo o meno la loro integrazione a seconda della nazionalità. Svolte queste premesse, il secondo capitolo è incentrato sugli italiani stanziatisi nel capoluogo della regione Rodano-Alpi. Con una prima analisi sulle principali aree di provenienza dei migranti, l’attenzione viene successivamente spostata sulle zone di arrivo, esaminando soprattutto i nuclei periferici che si sviluppano attorno alle grandi industrie, spesso in condizioni igieniche e ambientali del tutto precarie, e che accolgono la maggior parte dei lavoratori italiani. Il terzo capitolo si focalizza sul delicato gioco di equilibri tra fascismo e antifascismo. Se, da un lato, il regime tenta di controllare la vita dei cittadini italiani all’estero, coinvolgendo i consolati italiani, le associazioni cattoliche, sportive e musicali, dall’altro, i fuoriusciti e gli ambienti di sinistra vogliono allontanare gli italiani dalla sfera di influenza fascista. Un attento approfondimento è dedicato ai protagonisti di questi scontri e ai loro ideali. Gli anni ’30 sono caratterizzati da una serie di avvenimenti che influenzano significativamente la vita dei singoli migranti. Innanzi tutto, la Grande Depressione, che scatena aspre reazioni di xenofobia, obbligando numerosi immigrati al rientro in patria. Ma non solo, l’adesione italiana al Fronte popolare e alla guerra civile spagnola sono altri oggetti di studio del quarto capitolo. Il quinto capitolo conclude infine questo percorso. Incentrato sulla Seconda guerra mondiale, analizza gli immigrati italiani divisi tra occupazione tedesca, regime di Vichy, esercito e Resistenza francese.

Il seguente elaborato presenta la proposta di traduzione verso l’italiano del libro di poesia per l’infanzia “El lenguaje de las cosas” (2011), dell’autrice cilena María José Ferrada, illustrato da Pep Carrió ed edito dalla casa editrice spagnola El Jinete Azul. “El lenguaje de las cosas” è composto da 24 brevi poesie in versi liberi, ognuna di esse dedicata a un diverso oggetto della casa: attraverso un linguaggio semplice e immediato e originali intrecci di metafore, l’autrice invita i lettori a guardare ciò che li circonda con occhi diversi, regalando loro qualche attimo di dolcezza e strappando sempre un sorriso. Tutti i componimenti sono accompagnati dalle raffinate illustrazioni di Pep Carrió e, pertanto, durante il processo di traduzione è stato necessario prestare particolare attenzione sia al livello del suono e del linguaggio poetico che alla stretta interazione tra parole e immagini. Il lavoro è suddiviso in diverse sezioni: una prima parte di presentazione del libro originale e della sua autrice; la proposta di traduzione con relativo commento alle problematiche traduttive e alle diverse strategie impiegate; le interviste realizzate all’editore Antonio Ventura e alla scrittrice María José Ferrada; e infine una breve analisi del ruolo della poesia nella letteratura per l’infanzia e delle prospettive editoriali della versione italiana del libro, accompagnata dalla rispettiva scheda di presentazione editoriale.
