O trabalho analisa fundamentos sociológicos e filosóficos da responsabilidade civil objetiva, especificamente da responsabilidade “pelo risco”. Parte do pressuposto de que o modo que a maior parte da doutrina civilista que analisa o instituto mitiga as potencialidades do mesmo ser compreendido como um elemento de organização das sociedades funcionalmente diferenciadas, caracterizadas pelo excesso de complexidade e pela radical contingência que permeiam a comunicação realizada entre os sistemas sociais, entre os seres humanos e das relações entre estes e aqueles. Conclui que o risco é uma característica insuperável de tais sociedades, e, analisando as consequências do mesmo para a formação do sujeito capaz de comprometer-se com uma vida política, propõe, baseado principalmente nos estudos filosóficos de Paul Ricoeur e na dogmática constitucional de Robert Alexy, que a responsabilidade civil objetiva seja elevada ao nível jurídico e moral de dever fundamental do sujeito de direito, precipuamente no bojo das relações travadas entre os particulares.

Il lavoro è una riflessione sugli sviluppi della nozione di definizione nel recente dibattito sull'analiticità. La rinascita di questa discussione, dopo le critiche di Quine e un conseguente primo abbandono della concezione convenzionalista carnapiana ha come conseguenza una nuova concezione epistemica dell'analiticità. Nella maggior parte dei casi le nuove teorie epistemiche, tra le quali quelle di Bob Hale e Crispin Wright (Implicit Definition and the A priori, 2001) e Paul Boghossian (Analyticity, 1997; Epistemic analyticity, a defence, 2002, Blind reasoning, 2003, Is Meaning Normative ?, 2005) presentano il comune carattere di intendere la conoscenza a priori nella forma di una definizione implicita (Paul Horwich, Stipulation, Meaning, and Apriority, 2001). Ma una seconda linea di obiezioni facenti capo dapprima a Horwich, e in seguito agli stessi Hale e Wright, mettono in evidenza rispettivamente due difficoltà per la definizione corrispondenti alle questioni dell'arroganza epistemica e dell'accettazione (o della stipulazione) di una definizione implicita. Da questo presupposto nascono diversi tentativi di risposta. Da un lato, una concezione della definizione, nella teoria di Hale e Wright, secondo la quale essa appare come un principio di astrazione, dall'altro una nozione della definizione come definizione implicita, che si richiama alla concezione di P. Boghossian. In quest'ultima, la definizione implicita è data nella forma di un condizionale linguistico (EA, 2002; BR, 2003), ottenuto mediante una fattorizzazione della teoria costruita sul modello carnapiano per i termini teorici delle teorie empiriche. Un'analisi attenta del lavoro di Rudolf Carnap (Philosophical foundations of Physics, 1966), mostra che la strategia di scomposizione rappresenta una strada possibile per una nozione di analiticità adeguata ai termini teorici. La strategia carnapiana si colloca, infatti, nell'ambito di un tentativo di elaborazione di una nozione di analiticità che tiene conto degli aspetti induttivi delle teorie empiriche

In this article, we refine a politics of thinking from the margins by exploring a pedagogical model that advances transformative notions of service learning as social justice teaching. Drawing on a recent course we taught involving both incarcerated women and traditional college students, we contend that when communication among differentiated and stratified parties occurs, one possible result is not just a view of the other but also a transformation of the self and other. More specifically, we suggest that an engaged feminist praxis of teaching incarcerated women together with college students helps illuminate the porous nature of fixed markers that purport to reveal our identities (e.g., race and gender), to emplace our bodies (e.g., within institutions, prison gates, and walls), and to specify our locations (e.g., cultural, geographic, socialeconomic). One crucial theoretical insight our work makes clear is that the model of social justice teaching to which we aspired necessitates re-conceptualizing ourselves as students and professors whose subjectivities are necessarily relational and emergent.

Esta pesquisa surge da minha preocupação sobre os valores pedagógicos no ensino superior: quais são, quais os seus fundamentos filosóficos, como são concebidos e aplicados na prática docente e especificamente na formação de professores em um curso de Pedagogia. Os conhecimentos, saber-fazer, métodos e habilidades que são mobilizados diariamente, nas salas de aula, com o fim de formar outros professores, também são partes desta busca. O referencial fundamenta-se nas concepções de Paulo Freire sobre valores pedagógicos e sobre educação, a partir da sua visão antropológica, gnosiológica e política do ser humano e de uma sociedade mais justa e equilibrada. O objetivo freiriano é uma educação libertadora que supere as contradições entre opressores e oprimidos, para evitar, por meio da educação, que elas sejam mantidas ou resolvidas a partir de uma solução individual ou por meios violentos. Somente um conjunto de valores pedagógicos bem assimilados e praticados, por parte dos docentes e daqueles que participam do processo educativo, permitem a superação da opressão: diálogo, humildade, fé nos homens, pensar crítico, ética, amor. A aceitação e realização desses valores permitirão não somente melhorar a educação em si, mas a sociedade como um todo. A pesquisa inclui reflexões sobre o ensino brasileiro e a qualidade dos professores com relação ao agir na formação e na sua própria transformação individual como seres críticos, ao usar os valores pedagógicos objeto do pensamento de Freire. Como instrumentos metodológicos, foram utilizados: leitura de textos e artigos de Paulo Freire e de outros comentadores e educadores brasileiros e estrangeiros; questionários fechados que permitiram coletar dados sobre o clima e a cultura organizacional e verificar que a educação nacional ainda está presa a estruturas históricas tradicionais, as quais se manifestam em conteúdos e metodologias que não resolvem a crise educacional do nosso país. Esses questionários foram aplicados a alguns professores, escolhidos por amostragem, do curso de Pedagogia de uma instituição superior em São Paulo. Os resultados desta pesquisa apontam que as opiniões dos professores entrevistados revelam um enfoque pouco participativo. Em alguns aspectos, eles demonstram que não há o hábito de diálogo sobre os problemas educacionais, como também não há abertura para medidas inovadoras que poderiam contribuir para com a qualidade do ensino e aprendizado. Isso demonstra o abismo entre o discurso e a prática docente colaborando para a falta de inspiração e de consciência crítica que todo profissional deve possuir, como valor pedagógico.(AU)

Purpose - To introduce the contents of the special issue, and provide an integrative overview of the development of observational methodologies in marketing research, as well as some directions for the future. Design/methodology/approach - A historical review of the development of observational methods, beginning with philosophical foundations, is provided. Key philosophical debates are summarized, and trends in observational methods are described and analyzed, with particular reference to the impact of technology. Following this, the contributions to the special issue are summarized and brought together. Findings - Observational research in marketing is more than the well-known method of "participant-observation." In fact, technology has the potential to revolutionize observational research, and move it beyond a solely "qualitative" method. The internet, video, scanner-tracking, and neuroimaging methods are all likely to have a big impact on the development of traditional and innovative observation methods in the future. The articles in the special issue provide a good overview of these developments. Research limitations/implications - The views of the authors may differ from those of others. Practical implications - Observation is a far more wide-ranging strategy than many perceive. There is a need for more expertise in all types of observational methodologies within marketing research schools and departments, in order to take account of the vast opportunities which are currently emerging. Originality/value - Provides an original perspective on observational methods, and serves as a useful overview of trends and developments in the field.

Exploration of intangible world is under the serious influence of esotericism. Mystics, religions, unrestrained use of metaphors, fairy tales, gossips, unverified and uncertified “facts” – all this needs accurate well-disposed, but sound scientific consideration. Our society really needs new ideas, new approaches and new paradigms. Technological civilization becomes more and more complicated, risky and ecologically critical. The current level of AI research cannot guarantee successful solution of societal control and management. Besides, the human being itself practically did not change its mental and psychological abilities for many thousands years. We can lose control over our society and its technology, if we do not change cardinally ourselves. In this text, I tried to approach this problem – the problem of our noosphere from materialistic viewpoint.

My research attempts to demonstrate how Sábato’s essays have pursued a progressive path that reflects the evolving process of his vision. In light of his essays, I will delineate the themes of solitude, death, desperation, robotization of man, and finally, hope as the antithesis. In my analysis I examine the model created in Sartre’s Existentialism. I also visit the model followed by Nicholas Berdyaeff, who at least offers the possibility of salvation in a world conceived by and for Nothingness. I investigate how these and other tendencies had an initial influence on the essays studied in my research. I concentrate on those essays whose discourse is conditioned by the philosophical foundations of a being that inquires and discerns, discovers and denounces, and finally struggles with the impossibility of reaching the absolute. This foresight, at times apocalyptic, at times utopian, is already present in Sábato’s early works. In my study I attempt to establish how Sábato, in oscillating between the demonic and the romantic, the infernal and utopian, constructs his vision of the world through the symbiotic intertwining of both the fictional and essayistic genres. I focus on an author compromised by a constant debate with the paradoxes and dichotomies that, according to Sábato himself, define Modernity.

Abstract: This informative and interactive teaching symposium posits the Positive Peer Leadership Mentoring Program (PPLM) as an evidence-based wrap-around service for youth and families in Miami-Dade who are involved in the school-to-prison pipeline. Presenters first provide information to initiate the dialogic process of discerning and interpreting the school-to-prison pipeline, impacted by costs of incarceration for Black youth and families and the move toward effective mental health services in the juvenile justice system. Then, participants experience an interactive pedagogical mentoring format set forth in PPLM as the first step toward transforming the school-to-prison pipeline in their own classroom or other educational setting.

Stereotype threat (Steele & Aronson, 1995) refers to the risk of confirming a negative stereotype about one’s group in a particular performance domain. The theory assumes that performance in the stereotyped domain is most negatively affected when individuals are more highly identified with the domain in question. As federal law has increased the importance of standardized testing at the elementary level, it can be reasonably hypothesized that the standardized test performance of African American children will be depressed when they are aware of negative societal stereotypes about the academic competence of African Americans. This sequential mixed-methods study investigated whether the standardized testing experiences of African American children in an urban elementary school are related to their level of stereotype awareness. The quantitative phase utilized data from 198 African American children at an urban elementary school. Both ex-post facto and experimental designs were employed. Experimental conditions were diagnostic and non-diagnostic testing experiences. The qualitative phase utilized data from a series of six focus group interviews conducted with a purposefully selected group of 4 African American children. The interview data were supplemented with data from 30 hours of classroom observations. Quantitative findings indicated that the stereotype threat condition evoked by diagnostic testing depresses the reading test performance of stereotype-aware African American children (F[1, 194] = 2.21, p < .01). This was particularly true of students who are most highly domain-identified with reading (F[1, 91] = 19.18, p < .01). Moreover, findings indicated that only stereotype-aware African American children who were highly domain-identified were more likely to experience anxiety in the diagnostic condition (F[1, 91] = 5.97, p < .025). Qualitative findings revealed 4 themes regarding how African American children perceive and experience the factors related to stereotype threat: (1) a narrow perception of education as strictly test preparation, (2) feelings of stress and anxiety related to the state test, (3) concern with what “others” think (racial salience), and (4) stereotypes. A new conceptual model for stereotype threat is presented, and future directions including implications for practice and policy are discussed.

Suszko’s Thesis is a philosophical claim regarding the nature of many-valuedness. It was formulated by the Polish logician Roman Suszko during the middle 70s and states the existence of “only but two truth values”. The thesis is a reaction against the notion of many-valuedness conceived by Jan Łukasiewicz. Reputed as one of the modern founders of many-valued logics, Łukasiewicz considered a third undetermined value in addition to the traditional Fregean values of Truth and Falsehood. For Łukasiewicz, his third value could be seen as a step beyond the Aristotelian dichotomy of Being and non-Being. According to Suszko, Łukasiewicz’s ideas rested on a confusion between algebraic values (what sentences describe/denote) and logical values (truth and falsity). Thus, Łukasiewicz’s third undetermined value is no more than an algebraic value, a possible denotation for a sentence, but not a genuine logical value. Suszko’s Thesis is endorsed by a formal result baptized as Suszko’s Reduction, a theorem that states every Tarskian logic may be characterized by a two-valued semantics. The present study is intended as a thorough investigation of Suszko’s thesis and its implications. The first part is devoted to the historical roots of many-valuedness and introduce Suszko’s main motivations in formulating the double character of truth-values by drawing the distinction in between algebraic and logical values. The second part explores Suszko’s Reduction and presents the developments achieved from it; the properties of two-valued semantics in comparison to many-valued semantics are also explored and discussed. Last but not least, the third part investigates the notion of logical values in the context of non-Tarskian notions of entailment; the meaning of Suszko’s thesis within such frameworks is also discussed. Moreover, the philosophical foundations for non-Tarskian notions of entailment are explored in the light of recent debates concerning logical pluralism.

Inherent in the task of theorising is a responsibility for ongoing critical reflection of the ideas presented (Steele, 2010). To that end, this article responds to the invitation extended by McCold and Wachtel to examine the conceptual theory of restorative justice they first presented in 2003 and which continues to be promoted globally. One particular aspect of their theory, the Social Discipline Window, is examined. Drawing on a qualitative, critical case study conducted in schools in Ontario, Canada, the article illustrates: (a) how unexamined theory can be problematic and promote practice that counters the principles of restorative justice; and (b) how people's lives can be impacted by power dynamics inherent in the theory presented (Woolford, 2009). In response, a revised Relationship Window is presented along with examples of how it can affect practice that is more consistently aligned with the philosophical foundations of restorative justice.

Cette thèse porte sur les fondements philosophiques des institutions démocratiques canadiennes et analyse comment leur conception réelle contribue à les atteindre. Pour passer de la théorie à la pratique, la démocratie doit être institutionnalisée. Les institutions ne sont pas que de simples contraintes sur les actions du gouvernement. Elles incarnent des normes démocratiques. Cependant, les théories démocratiques contemporaines sont souvent abstraites et désincarnées. Alors qu’elles étudient les fondements normatifs de la démocratie en général, elles réfléchissent rarement sur les mécanismes permettant d’atteindre l’idéal démocratique. À l’inverse, la science politique tente de tracer l’ensemble du paysage institutionnel entourant l’action de l’État. Mais l’approche de la science politique a une faiblesse majeure : elle n’offre aucune justification épistémologique ou morale des institutions démocratiques. Cette dichotomie entre les principes et les institutions est trompeuse. Les principes de la démocratie libérale sont incarnés par les institutions. En se concentrant sur les fondements philosophiques des institutions démocratiques et libérales, cette thèse fait revivre une longue tradition d’Aristote à John Stuart Mill et réunissant des penseurs comme Montesquieu et James Madison. Actuellement, la recherche universitaire se détourne encore des questions institutionnelles, sous prétexte qu’elles ne seraient pas assez philosophiques. Cependant, le design institutionnel est une question philosophique. Cette thèse propose des améliorations pour que les institutions démocratiques remplissent leur rôle philosophique de manière plus adéquate. Le suicide médicalement assisté est utilisé comme un exemple de l’influence des institutions sur la démocratie.
