The presented work is an essay rather than a scientific dissertation. The author wants to put an impact on the source of conflicts regarding the complex subject of heritage management and conservation in comparison with the local needs and the given context. The paper attempts to show the role of local communities and their cooperation with authorities as well as the effects of such cooperation. The area of research comprises the problems arising in the field of implementing external rules on the local field, challenges appearing regarding the needs of local communities and the efforts of official authorities trying to implement the principles of the conventions. The problems arise when local communities display the lack of understanding and do not share the common idea of heritage conservation. This is caused mainly by the decreasing possibilities of comfortable life. The author tries to identify the main and wrongful approaches as ‘Gone with the Wind’, ‘The Prince and The Pauper’, ‘Heart of Darkness’ or ‘Scarlet letter’. The focus will be put to explain what the areas are where a mutual misunderstanding arise and why all parts to the problem present different points of view. What creates a value? Is it a heritage object or maybe the other values need a stronger protection? When the general duty and the need to protect the heritage is regarded as a controversy and when it is considered as a value within a given community? The international public interest in heritage protection is often regarded as an attempt to diminish the sovereign power of the community and provokes severe controversies and tensions. The major problem envisaged today seems to be the massive and increasing urbanisation and the destruction of the vestiges still existing of traditional cultures, when we consider century urban post-industrial districts of Upper Silesia in Poland, the medieval cities in Western Europe, the traditional nomad Masaya villages in Kenya or the remains of vanished cultures in various regions of Asia. The preferred platform of cooperation between the parts of the conflict includes divergent needs, beliefs and practices of communities and the possible fields of reconciling the abovementioned. Chosen examples of the best practices considering mutual cooperation will be underlined.

This thesis investigates the crossover from and intersection between tangible and intangible heritage in the context of World Heritage. Since the start of the twenty-first century, intangible heritage has become increasingly important in international cultural heritage conservation theory and practice. In heritage literature, intangible heritage has been theorized in relation to tangible or built heritage, thereby extending the definition of cultural heritage to consider a holistic perspective. New heritage conservation instruments have been created for the protection of intangible heritage, such as most prominently the 2003 UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage. The changing conception of cultural heritage that goes beyond tangible heritage has also influenced existing instruments like the 1972 UNESCO Convention concerning the protection of the World Cultural and Natural Heritage. The thesis studies how intangible heritage has been recognized and interpreted in implementing the concept of cultural heritage as defined by the World Heritage Convention. It examines the historical development of the concept of World Cultural Heritage with the aim of tracing the construction of intangible heritage in this context. The thesis consists of six chapters. The introduction sets out the research problem and research question. In the literature review, international cultural heritage conservation is portrayed as the research context, the knowledge gap between World Heritage and intangible heritage is identified and an understanding of the research problem deepened, and methods from similar research in the subject area are presented. The methodology in the third chapter describes choices made concerning the research paradigm, research approach and strategy, the use of concepts and illustrative examples, as well as data collection and analysis methods. Knowledge is constructed using primarily a historical approach and related methods. Through the analysis of pertinent documents and heritage discourses, an understanding of the concept of intangible heritage is developed and the concept of World Cultural Heritage is investigated. In the fourth chapter, intangible heritage is studied by looking at specific cultural heritage discourses, that is, a scientific, a UNESCO, and an ICOMOS discourse. Intangible heritage is theorized in relation to the concepts of tangible heritage, heritage value, and cultural heritage. Knowledge gained in this chapter serves as a theoretical lens to trace the recognition of and tease out interpretations of intangible heritage in the context of implementing the concept of World Cultural Heritage. The results are presented in chapter five. A historical development is portrayed in five time periods and for the concepts of cultural heritage, Outstanding Universal Value, the criteria to assess World Heritage value, and authenticity. The conclusion summarizes the main outcomes, assesses the thesis’ contribution to scientific knowledge as well as its limitations, and outlines possible further research. The main results include the identification of the term intangible heritage as an indicator for a paradigm shift and a new approach to conceiving cultural heritage in international cultural heritage conservation. By focusing on processes and the living relationship between people and their environment or place, intangible heritage emphasizes the anthropological. In the context of this conception, intangible heritage takes on two meanings. First, value is attributed by people and hence, is inherently immaterial. Secondly, place is constituted of a tangible-intangible continuum in terms of attributes. A paradigm shift and increasing recognition of an anthropological approach to cultural heritage were identified for all discourses, that is, UNESCO, ICOMOS, the scientific field, and World Heritage. For World Heritage, intangible heritage was recognized indirectly in terms of historical associations during the 1970s and 1980s. The anthropological shift occurred in the early 1990s. The term intangible was introduced and the meaning of intangible heritage was extended to include cultural associations. The subsequent decade is characterized by a process of internalization and implementation of the new approach to cultural heritage. The 2003 Intangible Cultural Heritage Convention created momentum. By the early 2010s, while not explicitly recognizing the immaterial character of values, a holistic approach to cultural heritage was fully endorsed that considers the idea of intangible attributes as carriers of values. An understanding of the recognition of intangible heritage through the implementation of the World Heritage Convention and scientific research in general provide an important knowledge base for implementing the Convention in a more coherent, objective, and well-informed way.

In today’s world heritage worldwide are at the risk not only because of natural process of decay and destruction but also by social change like urbanization, globalization and homogenization of cultures. With these emerging problems, the heritage conservation discourse also has reached to a new dimension including broader range of concepts like tangible heritage, intangible heritage, community participation, indigenous knowledge and many more. Even with the changing scenario in the international context about the heritage conservation, Nepal’s heritage conservation still focus on monuments, sites and buildings. In add to that the conservation practices are still top-down approach and community involvements are limited only in plans. While numerous intangible heritages like masking dances chariot processions, festivals and rituals, which form an integral part of the daily social life of people are still being continued and managed by the community and its people, without with out serious attention form the government. In Kathmandu Valley these heritages has been maintained with the traditional social association of people known as “Guthi” which has been continuing since 5th Century. Most of the tangible and intangible heritages have survived for centuries because of this unique association of people. Among the numerous festivals of the Kathmandu Valley, the festival Yenya Punhi was chosen as a case for this study, which is also a major festival of Kathmandu. This festival is the perfect example for the study as its celebrated in the city that is the most urbanized city of Nepal with the challenges of the every modern city like social changes and urbanization. Despite modern challenges Guthi still plays a major role in the heritage conservation in Kathmandu Valley. Now there are some interventions of the various formal institutions. So this study will be focusing on the management, continuity and problems of the festival along with Nepal’s position in terms of intangible heritage conservation. The problem of Kathmandu and Yenya Punhi festival is the problem of every country in the similar situation so with this case study it can be a good example for finding solutions of the similar problem not only the other festivals within Nepal but also elsewhere in the world; Resumo: Conexão de Património: Festival Yenya Punhi um caminho de fortalecimento de identidade: A experiência de Catmandu Nos dias de hoje, os patrimónios mundiais encontram-se em risco, não só devido ao processo natural de degradação e destruição, mas também pelas mudanças sociais, tais como a urbanização, globalização e homogeneização de culturas. Com o emergir destes problemas, o discurso de conservação de Património atingiu também uma nova dimensão, incluíndo uma área mais abrangente de conceitos, como por exemplo, património material, património imaterial, participação da comunidade, conhecimento indígena, entre outros. Mesmo com este cenário de mudança no contexto mundial de conservação do património, a preservação do património do Nepal continua a focar-se em monumentos, sítios e edíficios. A acrescentar a isso, as práticas de conservação ainda têm uma abordagem descendente e os envolvimentos da comunidade são limitados por planificações. Enquanto que os numerosos patrimónios imateriais como danças com máscaras, procissões, festivais e rituais, os quais formam uma parte integral da vida diária social das pessoas que as continuam e as gerem em comunidade, sem uma atenção séria por parte do governo. No Vale de Catmandu, este património tem sido mantido pela associação tradicional de pessoas conhecidas como ''Guthi'' desde o século V. A maior parte destes patrimónios materiais e imateriais tem sobrevivido durante séculos graças a esta associação única de pessoas. Entre os numerosos festivais do Vale de Catmandu, o festival Yenya Puhni foi escolhido para este estudo, pois é também um grande festival em Catmandu. Este festival é o exemplo perfeito para este estudo, pois é celebrado na cidade mais urbanizada do Nepal, com os desafios das cidades modernas tais como mudanças sociais e urbanização. Apesar dos desafios da modernização, os ''Guthi'' ainda desempenham um papel importante na preservação do património do Vale de Catmandu. Agora, existem algumas intervenções de várias instituições formais Então, este estudo irá focar-se na gestão, continuidade e problemas do festival, juntamente com a posição do Nepal em termos de conservação de património imaterial. O problema de Catmandu e do festival Yenya Punhi é o problema de todos os países em situação semelhante então, este estudo pode ser um bom exemplo para encontrar soluções de problemas parecidos, não só em outros festivais no Nepal mas também para qualquer parte do mundo.

The present article investigates the linkages between conserving cultural heritage, maintaining cultural diversity and enforcing human rights. While there seems to be a growing awareness of these linkages in international heritage and human rights circles, they remain poorly understood by many heritage practitioners who see their conservation work merely as a technical matter. The article argues that it is essential for practitioners engaged in heritage conservation projects to understand the broader economic, political and social context of their work. However, heritage scholars and teachers, too, need to recognise that there can be many motives behind official heritage interventions, that such action is sometimes taken primarily to achieve political goals, and that it can undermine rather than strengthen community identity, cultural diversity and human rights. Such a reorientation is an extension of the paradigm shift in which heritage is understood as cultural practice. In this more critical heritage studies discipline human rights are brought to the foreground as the most significant part of the international heritage of humanity.

Chapters reveal the disjunctions between international frameworks and national implementation and assess how internationally agreed concepts can be misused to justify unsustainable practices or to further economic globalisation and political nationalism. The exclusion of many local communities from development policies, and the subsequent erosion of their cultural heritage, is also discussed, with the collection emphasising the importance of ‘grass roots’ heritage and exploring more inclusive and culturally responsive conservation strategies. Paesaggio ed infrastrutture viarie sono un binomio molto forte: il primo ha insito il concetto di accessibilità, in quanto non può esistere senza la presenza di un osservatore; la strada, invece, trova i fattori che la connotano nel suo rapporto con la morfologia su cui insiste. Le infrastrutture viarie sono elemento strutturale e strutturante non solo di un territorio, ma anche di un paesaggio. Le attuali esigenze di mobilità portano oggi a ripensare ed adeguare molte infrastrutture viarie: laddove è possibile si potenziano le strutture esistenti, in diversi casi si ricorre a nuovi tracciati o a varianti di percorso. Porsi il problema di conservare itinerari testimoni della cultura materiale ed economica di una società implica considerazioni articolate, che travalicano i limiti del sedime: una via è un organismo più complesso della semplice linea di trasporto in quanto implica tutta una serie di manufatti a supporto della mobilità e soprattutto il corridoio infrastrutturale che genera e caratterizza, ovvero una porzione variabile di territorio definita sia dal tracciato che dalla morfologia del contesto. L’evoluzione dei modelli produttivi ed economici, che oggi porta quote sempre maggiori di popolazione a passare un tempo sempre minore all’interno del proprio alloggio, rende la riflessione sulle infrastrutture viarie dismesse o declassate occasione per la progettazione di spazi per l’abitare collettivo inseriti in contesti paesaggistici, tanto urbani che rurali, tramite reti di percorsi pensate per assorbire tagli di mobilità specifici e peculiari. Partendo da queste riflessioni la Tesi si articola in: Individuazioni del contesto teorico e pratico: Lo studio mette in evidenza come la questione delle infrastrutture viarie e del loro rapporto con il paesaggio implichi riflessioni incrociate a diversi livelli e tramite diverse discipline. La definizione dello spazio fisico della strada passa infatti per la costruzione di un itinerario, un viaggio che si appoggia tanto ad elementi fisici quanto simbolici. La via è un organismo complesso che travalica il proprio sedime per coinvolgere una porzione ampia di territorio, un corridoio variabile ed articolato in funzione del paesaggio attraversato. Lo studio propone diverse chiavi di lettura, mettendo in luce le possibili declinazioni del tema, in funzione del taglio modale, del rapporto con il contesto, del regime giuridico, delle implicazioni urbanistiche e sociali. La mobilità dolce viene individuata quale possibile modalità di riuso, tutela e recupero, del patrimonio diffuso costituito dalle diversi reti di viabilità. Antologia di casi studio: Il corpo principale dello studio si basa sulla raccolta, analisi e studio dello stato dell’arte nel settore; gli esempi raccolti sono presentati in due sezioni: la prima dedicata alle esperienze più significative ed articolate, che affrontano il recupero delle infrastrutture viarie a più livelli ed in modo avanzato non concentrandosi solo sulla conversione del sedime, ma proponendo un progetto che coinvolga tutto il corridoio attraversato dall’infrastruttura; la seconda parte illustra la pratica corrente nelle diverse realtà nazionali, ponendo in evidenza similitudini e differenze tra i vari approcci.

Urban centres base their resilience on the ability to evolve and adapt as needed throughout their life. Although constantly developing, changing and subsuming nature for its needs, the current age of environmental awareness requires that cities progress in a more conscious and considered way. While they have become the dominant form of human habitation, there now exists a need to integrate 'green' solutions into urban centres to address social, physical and environmental wellbeing. The means of implementing the vast array of possible solutions without negative impacts is not clear; cities are complex systems, layering meaning, history and cultural memory ‐ they are a manifestation of shared cultural values, and as such, they do not allow a tabula rasa approach of 'blanket' solutions. All around us, cities are continuing to develop and change, and although their form is varied ‐ sprawling cities with density and sustainability problems; or collapsing cities with 'dead' centres and dilapidated districts – a common issue is the resilience of the local identity. The strength or resilience of cities lies in the elements which have become fixed points in the urban structure, giving character and identity to a shared urban experience. These elements need to be identified and either maintained or revitalised. Similarly, the identification of urban elements which can most viably be modified without compromising character and identity of place, will assist in making concrete contributions to increasing both the sustainability and experience of cities, making them more resilient. Through an examination of case studies, this paper suggests a framework to inform urban renewal assessing the widespread elements which generate an urban identity, beyond the traditional approach of heritage conservation for cultural or tourist purposes. The rapid contemporary alteration of urban structures requires an innovative methodology which satisfies on one side the need of new sustainable performances and, on the other, the resilience of the local character.

Problèmes d'approvisionnement et de consommation d'énergie, de démographie et d’urbanisation, la conservation du patrimoine bâti se trouve, en ce début de 21e siècle, face à de nombreux défis. Cela d'autant plus que la façon de percevoir le patrimoine bâti a considérablement évolué depuis le début du 20e siècle (chapitre 1) changeant ainsi les raisons qui mènent à l'appropriation d'un bâtiment patrimonial. Face à l'importance accordée aujourd'hui à l'énergie en général et plus particulièrement à celle consommée par les bâtiments (chapitre 2), comment les enjeux liés à la conservation patrimoniale et ceux liés à l'énergie - via son utilisation et sa production - se confrontent-ils ? Si selon les principes du développement durable (chapitre 3) la conservation du patrimoine bâti associée à une gestion efficace de ses besoins énergétiques semble apparaître comme une évidence, qu’en est-il dans la pratique ? Comment les professionnels du patrimoine bâti intègrent-ils les aspects de l'énergie consommée par les bâtiments ? Comment envisagent-ils l'installation et l'utilisation d'énergies renouvelables dans les bâtiments patrimoniaux ? Afin de trouver des réponses issues de la réalité de la pratique patrimoniale québécoise, ce mémoire - en se limitant à des professionnels avec une formation d'architecte (chapitre 4) - cherche à évaluer, d'une part, dans quelle mesure les chartes et lois appliquées au Québec considèrent les questions énergétiques (chapitre 5) et, d'autre part, à définir l'état d'esprit avec lequel les professionnels de la conservation du patrimoine bâti au Québec approchent, dans leur pratique, les questions liées à l'énergie consommée ainsi que l'utilisation d'énergies renouvelables (chapitre 6).

Devant le contexte actuel des crises environnementale et sociale, on ne peut que s’interroger sur la capacité du domaine de la conservation du patrimoine à intégrer les principes et les concepts liés au développement durable. Alors que plusieurs liens entre la conservation du patrimoine culturel et le développement durable existent, il devient nécessaire de solidifier cette union. Réalisée en amont du projet de conservation, l’évaluation patrimoniale basée sur l’approche par les valeurs permet d’établir la signification d’un lieu selon les valeurs qui lui sont associées. Il y a cependant lieu de se questionner : au-delà des valeurs historiques, esthétiques ou architecturales traditionnellement attribuées au patrimoine bâti, quel intérêt accorde-t-on aux dimensions environnementales, économiques et sociales? Le postulat de ce mémoire est qu’il est essentiel d’élargir l’évaluation patrimoniale afin d’y intégrer de nouvelles valeurs liées au développement durable. Nous nous proposons d’étudier la faisabilité de ceci en élaborant un modèle d’évaluation patrimoniale basé sur une approche par les valeurs qui prend en compte l’ensemble des valeurs inhérentes au patrimoine bâti, c’est-à-dire les aspects culturels, sociaux, économiques et environnementaux. Cette proposition se traduit en une grille d’évaluation qui comporte ces dimensions. Afin de confronter notre hypothèse au réel, nous procéderons à une étude de cas : le Silo no.5 situé dans le Vieux-Port de Montréal. Aux termes de cette recherche, nous estimons être en mesure d’identifier les limites de notre expérimentation et de déterminer ce qui pourrait être fait pour contribuer aux efforts en conservation. Il nous apparaît que les recherches effectuées dans le cadre de ce mémoire sont susceptibles d’intéresser toute personne oeuvrant dans le domaine de la conservation du patrimoine.

Cette thèse contribue à l'état actuel des connaissances sur la compatibilité des nouveaux bâtiments avec les environnements urbains historiques. Elle suit un mode de présentation classique: Introduction, Revue de Littérature, Méthodologie, Résultats, Discussion et Conclusion. Le problème étudié est le manque d'orientation pour intégrer les processus de développement et de sauvegarde dans les contextes établis. La littérature récente révèle que les règles de préservation, aussi appelées normes et lignes directrices, ne peuvent pas garantir une relation compatible entre une intervention et son milieu. La pensée contemporaine dans le domaine de la conservation et de la gestion du patrimoine invite donc l’exploration d'autres moyens pour lier la nouvelle architecture à l'ancienne. Ainsi, le présent projet de recherche explore une approche alternative aux règles de préservation en vue d’atteindre le but de nouveaux bâtiments compatibles et d’améliorer la prise de décision fondée sur les valeurs. Pour produire des résultats spécifiques et convaincants, un cas a été sélectionné. Celui-ci est une ville dans la région du Golfe Arabe : la Ville de Koweït. Le résultat principal est le développement d’une approche, mise en œuvre en posant des questions approfondies sur le lieu, la conception et la construction des nouveaux bâtiments. Les questions suggérées dans la thèse mettent l’accent sur les valeurs patrimoniales et les choix de conception afin de permettre un changement réfléchi au sein des environnements urbains historiques. Elles aident aussi à évaluer les nouvelles propositions de projets au cas par cas. Pour démontrer comment cette approche pourrait être présentée et utilisée par les requérants et les évaluateurs, un modèle théorique est proposé. Ce modèle a ensuite été discuté avec des professionnels locaux et internationaux qui ont identifié ses forces et ses limites. En conclusion, l’ensemble des résultats montre que la mise à disposition de règles et / ou de questions approfondies n’est pas une solution satisfaisante puisqu’il y a d'autres enjeux importants qui devraient être abordés: comment appliquer l'orientation efficacement une fois qu’elle a été créée, comment développer la compétence liée à la prise de décision fondée sur les valeurs et comment insérer la conservation du patrimoine dans la mentalité du gouvernement local et des communautés. Lorsque ces enjeux seront traités, le patrimoine pourra devenir partie intégrante du processus de planification, ce qui est le but ultime. Enfin, cinq axes de recherche sont recommandés pour poursuivre l’exploration des idées introduites dans cette étude.

Hanoi promotes itself both as a place for foreign investment in urban development and as the 'cradle of Vietnamese civilisation'. Special status is given to places of national heritage significance, and policy makers and planners face challenges of balancing heritage conservation and modern development. By contrast, the former capital, Hue, continues to decline economically relative to other Vietnamese cities and is discovering value in its imperial heritage as a 'vector for development'. These Vietnamese capital cities demonstrate that heritage conservation is a key consideration in government efforts to improve the position of their constituencies in the newly-shaping global and national economic systems.
