This book documents and evaluates the growing consumer revolution against digital copyright law, and makes a unique theoretical contribution to the debate surrounding this issue. With a focus on recent US copyright law, the book charts the consumer rebellion against the Sonny Bono Copyright Term Extension Act 1998 (US) and the Digital Millennium Copyright Act 1998 (US). The author explores the significance of key judicial rulings and considers legal controversies over new technologies, such as the iPod, TiVo, Sony Playstation II, Google Book Search, and peer-to-peer networks. The book also highlights cultural developments, such as the emergence of digital sampling and mash-ups, the construction of the BBC Creative Archive, and the evolution of the Creative Commons. Digital Copyright and the Consumer Revolution will be of prime interest to academics, law students and lawyers interested in the ramifications of copyright law, as well as policymakers given its focus upon recent legislative developments and reform proposals. [ES] El proyecto se desarrolla bajo la lógica de la economía digital y la economía cultural. Se toma como eje fundamental el desarrollo de la economía digital potenciada por fuertes economías de escala, posibilitando una ventaja de mercado para las marcas culturales en la difusión de su imagen a su mercado objetivo. Se estudia la efectividad de la marca de la institución Basque Culinary Center, observando una mayor centralidad de sus chefs en una red formada por grandes cocineros posteriormente a la creación del centro con respecto a una anterior, a través del medio digital El País. De esta manera se produce un fortalecimiento de la marca BCC, en términos de visibilidad online.

Digital Economy is one of the crucial elements promoted by the Digital Britain Report June 2009 and its Implementation Plan August 2009 in order to maintain and further the UK’s position as one of the world’s leading digital knowledge economies. Therefore, the application of Digital Technologies is high in the agenda. As pervasive digital technologies become more widely available, it becomes increasingly important to understand the legal implications of digital assets produced via digital technologies in collaborative design communication. Architects and engineers depend on intellectual property law to protect their original works. Copyright protection is automatic once a tangible medium of expression in any form of an innovative material, conforming the Copyright Designs and Patents Act 1988, is created. Although copyright law provides automatic protection to all original architectural plans, the limitation is that it only protects the expression of ideas but not the ideas themselves. The purpose of this research is to explore how effective the UK’s copyright law regime is for protecting the rights and interests of architects and engineers in their works as digital assets. The UK’s copyright law is ripe for modernisation not only to protect the rights of designers but also to further UK’s position in digital economy.

The new digital technologies have led to widespread use of cloud computing, recognition of the potential of big data analytics, and significant progress in aspects of the Internet of Things, such as home automation, smart cities and grids and digital manufacturing. In addition to closing gaps in respect of the basic necessities of access and usage, now the conditions must be established for using the new platforms and finding ways to participate actively in the creation of content and even new applications and platforms. This message runs through the three chapters of this book. Chapter I presents the main features of the digital revolution, emphasizing that today’s world economy is a digital economy. Chapter II examines the region’s strengths and weaknesses with respect to digital access and consumption. Chapter III reviews the main policy debates and urges countries to take a more proactive approach towards, for example, regulation, network neutrality and combating cybercrime. The conclusion highlights two crucial elements: first, the need to take steps towards a single regional digital market that can compete in a world of global platforms by tapping the benefits of economies of scale and developing network economies; and second, the significance of the next stage of the digital agenda for Latin America and the Caribbean (eLAC2018), which will embody the latest updates to a cooperation strategy that has been in place for over a decade.

The Internet revolution and the digital environment have spurred a significant amount of innovative activity that has had spillover effects on many sectors of the economy. For a growing group of countries – both developed and developing – digital goods and services have become an important engine of economic growth and a clear priority in their future-oriented economic strategies. Neither the rapid technological developments associated with digitization, nor their increased societal significance have so far been reflected in international economic law in a comprehensive manner. The law of the World Trade Organization (WTO) in particular, has not reacted in any proactive manner. A pertinent question that arises is whether the WTO rules are still useful and able to accommodate the new digital economy or whether they have been rendered outdated and incapable of dealing with this important development? The present think-piece seeks answers to these questions and maps the key issues and challenges which the WTO faces. In appraisal of the current state of affairs, developments in venues other than the WTO, and proposals tabled by stakeholders, some recommendations for the ways forward are made.

In assessing the challenges facing Andrus Ansip, as Vice-President-designate for the Digital Single Market, and Günther Oettinger, as Commissioner-designate for Digital Economy and Society, Colin Blackman and Andrea Renda find that leadership and building real consensus among the member states will be the main keys to achieving what is, in their view, the most ambitious and important of the new Commission’s objectives. And, as they note further, their challenge is even greater, if one considers that, if successful, the Digital Agenda will have to be the last one. Five years from now, the ‘digital agenda’ will have become, simply, the agenda.

Today, global economic performance largely depends on digital ecosystems. E-commerce, cloud, social media, sharing economy are the main products of the modern innovative economic systems which are constantly raising new regulatory questions. Meanwhile the United States has an unimpeachable dominance in innovation and new technologies, as well as a large and open domestic market, the EU is only recently discovering the importance of empowering the European digital economy and aims to break down its highly fragmented cross-border online economic environment. As global economy is rapidly becoming digital, Europe’s effort to create and invest in common digital market is understandable. The comprehensive investigations launched by the European Commission into the role of social network, search engine, or sharing economy internet platforms, which are new generation technologies dominated by American firms; or the recent decision of the Court of Justice of the European Union declaring that the Commission’s US Safe Harbor Decision is invalid1 might be considered as part of an anti-American protectionist policy. However, these measures could rather be seen as part of a broader trend to foster European enterprises in technology developments.
