Le financement des municipalités québécoises repose en majeure partie sur des revenus autonomes, dont la principale source découle de leur pouvoir de taxer la richesse foncière. Par conséquent, le législateur, voulant assurer la stabilité financière des municipalités, a strictement encadré le processus de confection et de révision des évaluations foncières par plusieurs lois et règlements. Ceci n’a tout de même pas empêché l’augmentation des demandes de contestations à chaque nouveau rôle. Débutant par une demande de révision administrative, à l’aide d’un simple formulaire, le litige entre la municipalité et le contribuable peut se poursuivre devant le Tribunal administratif du Québec et même la Cour du Québec, la Cour supérieure et la Cour d’appel, où la procédure devient de plus en plus exigeante. La transition du processus administratif à judiciaire crée parfois une certaine friction au sein de la jurisprudence, notamment au niveau de la déférence à accorder à l’instance spécialisée, ou encore à l’égard de la souplesse des règles de preuve applicables devant cette dernière. Par une étude positiviste du droit, nous analysons tout d’abord la procédure de confection du rôle foncier, en exposant les acteurs et leurs responsabilités, ainsi que les concepts fondamentaux dans l’établissement de la valeur réelle des immeubles. Ensuite, nous retraçons chacune des étapes de la contestation d’une inscription au rôle, en y recensant les diverses règles de compétence, de preuve et de procédure applicables à chaque instance. À l’aide de nombreux exemples jurisprudentiels, nous tentons de mettre en lumière les différentes interprétations que font les tribunaux de la Loi sur la fiscalité municipale et autres législations connexes.

Nowadays, the educative manager or principal has a series of tools of modern administration that allow him/her to guide the educational institution towards quality. Thus, he/she must fulfils a series of functions that are framed within the administrative process, such as planning, organizing, directing and controlling activities in the educational institution. This article´s main objective is to present some of these contributions and the way in which the principal can use them to improve the educational institution. The modern administration puts at the disposal different conceptions that help to visualize the way in which the institution must be managed. The main conclusion that is extracted is that a unique theoretical framework does not exist that can ensure the success of a principal, instead, there must be a use of the best aspects that each of the conceptions that the modern administration have in order to adapt them, according to the circumstances.

Medicine has changed in recent years. Medicare will all of its rules and regulations, worker's compensation laws, managed care and the trend toward more and larger group practices all contributed to the creation of an extremely structured regulatory environment which in turn demanded highly trained medical administrative assistants.^ The researcher noted three primary problems in the identification of competencies for the medical administrative assistant position: A lack of curricula, diverse roles, and a complex environment which has undergone radical change in recent years and will continue to evolve. Therefore, the purposes of the study were to use the DACUM process to develop a relevant list of competencies required by the medical administrative assistant practicing in physicians' offices in South Florida; determine the rank order of importance of each competency using a scale of one to five; cross-validate the DACUM group scores with a second population who did not participate in the DACUM process; and establish a basis for a curriculum framework for an occupational program.^ The DACUM process of curriculum development was selected because it seemed best suited to the need to develop a list of competencies for an occupation for which no programs existed. A panel of expert medical office administrative staff was selected to attend a 2-day workshop to describe their jobs in great detail. The panel, led by a trained facilitator, listed major duties and the respective tasks of their job. Brainstorming techniques were used to develop a consensus.^ Based upon the DACUM workshop, a survey was developed listing the 8 major duties and 71 tasks identified by the panel. The survey was mailed to the DACUM group and a second, larger population who did not participate in the DACUM. The survey results from the two groups were then compared. The non-DACUM group validated all but 3 of the 71 tasks listed by the DACUM panel. Because the three tasks were rated by the second group as at least "somewhat important" and rated "very important" by the DACUM group, the researcher recommended the inclusion of all 71 tasks in program development for this occupation. ^

This working paper shows the evolution of the Aceh conflict until its peaceful resolution in 2005. The key factors in the success of this peace process have been the confluence of several factors related to the internal and external dynamics of the country, including the new political leadership, the decreasing role of the military power, the international support and the meeting of the objectives of both groups, and so on. The end of the conflict in Aceh shows that the administrative decentralization and the promotion of the political participation of the main actors involved have made possible the development of a solid alternative to the arms strategy of conflict resolution used for years in Indonesia.

The Irish Government in March 2008 set a target to identify measure and reduce the Administrative Burden (AB) of domestic regulation for businesses by 25% by the end of 2012 – on foot of a European Council invitation to all member states in March 2007. As part of a cross-Government process led by the Business Regulation Unit of the Department of Jobs, Enterprise and Innovation (DJEI), the Department of Health carried out a measurement exercise in 2012 on the main Information Obligations placed on business by legislation in the areas of Food, Nursing Homes and Pharmacy sectors.The AB baseline measurement for those information obligations is described in this report. The main objective of this dissertation is to create new knowledge on an administrative innovation, its adoption, diffusion and finally its effectiveness. In this dissertation the administrative innovation is approached through a widely utilized management philosophy, namely the total quality management (TQM) strategy. TQM operationalizes a self-assessment procedure, which is based on continual improvement principles and measuring the improvements. This dissertation also captures the theme of change management as it analyzes the adoption and diffusion of the administrative innovation. It identifies innovation characteristics as well as organisational and individual factors explaining the adoption and implementation. As a special feature, this study also explores the effectiveness of the innovation based on objective data. For studying the administrative innovation (TQM model), a multinational Case Company provides a versatile ground for a deep, longitudinal analysis. The Case Company started the adoption systematically in the mid 1980s in some of its units. As part of their strategic planning today, the procedure is in use throughout the entire global company. The empirical story begins from the innovation adoption decision that was made in the Case Company over 22 years ago. In order to be able to capture the right atmosphere and backgrounds leading to the adoption decision, key informants from that time were interviewed, since the main target was to clarify the dynamics of how an administrative innovation develops. In addition, archival material was collected and studied, available memos and data relating to the innovation, innovation adoption and later to the implementation contained altogether 20500 pages of documents. A survey was furthermore conducted at the end of 2006 focusing on questions related to the innovation, organization and leadership characteristics and the response rate totalled up to 54%. For measuring the effectiveness of the innovation implementation, the needed longitudinal objective performance data was collected. This data included the profit unit level experience of TQM, the development of the self assessment scores per profit unit and performance data per profit unit measured with profitability, productivity and customer satisfaction. The data covered the years 1995-2006. As a result, the prerequisites for the successful adoption of an administrative innovation were defined, such as the top management involvement, support of the change agents and effective tools for implementation and measurement. The factors with the greatest effect on the depth of the implementation were the timing of the adoption and formalization. The results also indicated that the TQM model does have an effect on the company performance measured with profitability, productivity and customer satisfaction. Consequently this thesis contributes to the present literature (i) by taking into its scope an administrative innovation and focusing on the whole innovation implementation process, from the adoption, through diffusion until its consequences, (ii) because the studied factors with an effect on the innovation adoption and diffusion are multifaceted and grouped into individual, organizational and environmental factors, and a strong emphasis is put on the role of the individual change agents and (iii) by measuring the depth and consistency of the administrative innovation. This deep analysis was possible due to the availability of longitudinal data with triangulation possibilities.

En continuité avec les ouvrages récents (Veyne 1981, MacMullen 1988 et Kelly 2004) qui tentent de relativiser les effets néfastes de la corruption lors du Bas-Empire, ce travail étudie le suffragium, le processus de nomination des fonctionnaires de bureaux, afin d'évaluer comment les acteurs sociaux du IVe siècle considéraient ce phénomène. Ce système, organisé d'une telle façon que les hauts fonctionnaires devaient fournir des lettres de recommandation aux candidats postulant à des postes au sein de la fonction publique, serait devenu complètement corrompu durant le IVe siècle et les lettres de recommandation auraient commencé à être systématiquement vendues. Pourtant, les lois de Constantin, Constance et Julien ne fournissent aucune preuve tangible que le suffragium était dans tous le cas vénal à cette époque. Bien au contraire, les empereurs ajoutaient la plupart de temps des épithètes au terme suffragium pour spécifier qu'il parle du suffragium vénal. Généralement, les empereurs sont présentés comme farouchement opposés au suffragium et à toutes les tractations qui y sont attachées. Loin d'être aussi hostiles envers les « pratiques corrompues », les empereurs de la dynastie constantinienne firent preuve d'un certain pragmatisme en voyant qu'ils ne pouvaient contrôler toutes les nominations de ceux qui voulaient entrer dans la fonction publique et que ce n'était pas nécessairement à leur avantage de le faire. Les empereurs se concentrèrent plutôt sur les restrictions entourant les promotions afin de faire en sorte que les personnes qui avaient de réels pouvoirs soient celles qui avaient démontré leurs qualités tout au long de leurs années de service. Bien qu'ils n'aient pas concrètement légiféré sur les critères d'embauche des candidats, cela ne veut pas dire que n'importe qui pouvait obtenir un poste. À travers l'étude des lettres de Libanios et de Symmaque, ce travail démontre que les hauts fonctionnaires ne fournissaient pas de lettres à quiconque le demandait, puisque leur réputation pouvait être entachée par le fait d'avoir recommandé un mauvais candidat à un de leurs amis. Les hauts fonctionnaires qui recevaient les recommandations pouvaient également soumettre les candidats à des examens afin d'être certains de la qualité de l'individu. Ce système officieux de contrôle des candidats vint pallier, en partie, les déficits de la législation impériale. Conjointement, la loi et les usages permirent à l'administration de fonctionner en lui fournissant des candidats qui répondaient aux critères de l'époque.

Urban environmental depletion has been a critical problem among industrialized-transformed societies, especially at the local level where administrative authorities’ capacity lags behind changes. Derived from governance concept, the idea of civil society inclusion is highlighted. Focusing on an agglomerated case study, Bang Plee Community in Thailand, this research investigates on a non-state sector, 201-Community organization, as an agent for changes to improve urban environments on solid waste collection. Two roles are contested: as an agent for neighborhood internal change and as an intermediary toward governance changes in state-civil society interaction. By employing longitudinal analysis via a project intervention as research experiment, the outcomes of both roles are detected portrayed in three spheres: state, state-civil society interaction, and civil society sphere. It discovers in the research regarding agglomerated context that as an internal changes for environmental betterment, 201-Community organization operation brings on waste reduction at the minimal level. Community-based organization as an agent for changes – despite capacity input it still limited in efficiency and effectiveness – can mobilize fruitfully only at the individual and network level of civil society sectors, while fails managing at the organizational level. The positive outcomes result by economic waste incentive associated with a limited-bonded group rather than the rise of awareness at large. As an intermediary agent for shared governance, the community-based organization cannot bring on mutual dialogue with state as much as cannot change the state’s operation arena of solid waste management. The findings confine the shared governance concept that it does not applicable in agglomerated locality as an effective outcome, both in terms of being instrumental toward civil society inclusion and being provocative of internal change. Shared environmental governance as summarized in this research can last merely a community development action. It distances significantly from civil society inclusion and empowerment. However, the research proposes that community-based environmental management and shared governance toward civil society inclusion in urban environmental improvement are still an expectable option and reachable if their factors and conditions of key success and failure are intersected with a particular context. Further studies demand more precise on scale, scope, and theses factors of environmental management operation operated by civil society sectors.

Este trabalho teve como objetivo principal fornecer subsídios para uma pequena empresa francesa analisar a viabilidade do seu processo de internacionalização no Brasil, um caminho difícil e cheio de obstáculos. De fato, muitas empresas francesas estão tentando entrar no mercado brasileiro, visto como um país que oferece várias oportunidades para o crescimento e rentabilidade destas empresas. No entanto, por causa da falta de recursos e das dificuldades a serem enfrentadas durante o processo de internacionalização, pequenas empresas devem analisar cuidadosamente a viabilidade de um projeto internacional, antes de entrar no mercado estrangeiro. Assim, trabalhos acadêmicos foram usados como referência para identificar e apresentar os aspectos administrativos, econômicos e culturais que poderiam facilitar ou dificultar o processo de internacionalização. Os principais aspectos administrativos apresentados foram a seleção do mercado internacional, o modo de internacionalização e os desafios do processo de internacionalização. Para os aspectos econômicos, apresentamos as principais tecnologias usadas para financiar pequenas e médias empresas, e o impacto das infra-estruturas nessas tecnologias. Também, para que uma PME possa entender o processo de financiamento, apresentamos o ponto de vista dos Bancos. Aspectos culturais que poderiam facilitar ou dificultar o processo de internacionalização são apontados através de conceitos acadêmicos como "distância cultural" ou "distância psíquica". Este trabalho discute também como as diferenças entre as culturas são susceptíveis em gerar dificuldades ou vantagens, e que a distância cultural também pode ter um impacto no modo de entrada escolhido pela empresa no país de acolhimento.

Historically, the authority to conclude international treaties was exclusively exercised by administrative bodies (or the chief of state). However, recent studies pointed out that the present legislative bodies have come to play a more active role through ratification or the review of treaties in European and American countries. Harrington (2005) studied judicial reform in British dominions and criticized the past executive-dominant treaty-making process as a “democratic deficit” due to a fear that under this system the nation might be bound by international agreements for which a consensus had not been obtained. These studies indicated that people’s participation in the treaty-making process has increased on a global basis, but neither of them provides sufficient descriptive evidence regarding why and how such procedures were established. The present paper therefore attempts to solve these questions by analyzing the legislative and political process of the treaty-making procedure reform in Thailand’s 2007 constitution as a case study.
