Intertemporal social-evaluation rules provide us with social criteria that can be used to assess the relative desirability of utility distributions across generations. The trade-offs between the well-being of different generations implicit in each such rule reflect the underlying ethical position on issues of intergenerational equity or justice. We employ an axiomatic approach in order to identify ethically attractive socialevaluation procedures. In particular, we explore the possibilities of using welfare information and non-welfare information in a model of intertemporal social evaluation. We focus on the individuals’ birth dates and lengths of life as the relevant non-welfare information. As usual, welfare information is given by lifetime utilities. It is assumed that this information is available for each alternative to be ranked. Various weakenings of the Pareto principle are employed in order to allow birth dates or lengths of life (or both) to matter in social evaluation. In addition, we impose standard properties such as continuity and anonymity and we examine the consequences of an intertemporal independence property. For each of the Pareto conditions employed, we characterize all social-evaluation rules satisfying it and our other axioms. The resulting rules are birth-date dependent or lifetime-dependent versions of generalized utilitarianism. Furthermore, we discuss the ethical and axiomatic foundations of geometric discounting in the context of our model.

L’internationalisation des services génétiques s’explique à la fois par la rareté de certains troubles génétiques et par le nombre restreint de laboratoires effectuant des tests spécialisés. Par leur nature même, les tests génétiques comportent des risques et doivent faire l’objet d’un contrôle serré. L’absence de contrôle international des laboratoires génétiques soulève d’importantes questions juridiques et éthiques. Le présent mémoire démontre, dans un premier article, les normes d’encadrement des laboratoires génétiques canadiens. Un second article compare des normes d’encadrement des laboratoires génétiques dans quatre pays membres de l’OCDE : la France, les États-Unis, l’Australie et le Royaume-Uni. Dans troisième article, les principaux droits des patients des services génétiques au Canada, aux États-Unis, en Australie et au Royaume-Uni sont comparés. Finalement, un quatrième article analyse les implications éthiques de la coexistence de différentes normes d’encadrement des laboratoires et des droits des patients, dans le contexte actuel d’internationalisation des services génétiques. Cette analyse éthique est effectuée selon trois perspectives reconnues : le principisme, l’utilitarisme et le déontologisme. L’hétérogénéité des normes régissant les laboratoires génétiques soulève des questions éthiques et démontre la nécessité d’ouvrir un dialogue international afin d’uniformiser les normes d’encadrement des laboratoires génétiques.

L’augmentation croissante du nombre de nouvelles maladies et des possibilités de traitements existants ou en cours d’étude et ayant pour but la guérison des patients atteints, ont amené les chercheurs à pousser davantage leurs recherches biomédicales sur des sujets humains. La conduite de recherches biomédicales sur des sujets humains est une étape cruciale pour la compréhension de la maladie et, par conséquent, l’avancement des connaissances permettant d’éradiquer un jour certaines maladies répandues à l’échelle planétaire, tel le virus de l’immunodéficience humaine (VIH) causant le syndrome d’immunodéficience acquise (SIDA). Aujourd’hui, ces importantes recherches sont conduites partout à travers le monde mais plus particulièrement dans des pays en développement où les populations sont davantage vulnérables. C’est précisément à cause de cette pratique que différents acteurs de ce milieu ont reconsidéré certains aspects éthiques de ces recherches. Ce mémoire examine donc les différentes normes éthiques en vigueur qui gouvernent la recherche sur des sujets humains, afin de voir comment celles-ci tiennent compte des caractéristiques des populations des pays en développement. Cette comparaison nous guide ensuite vers un survol de trois approches philosophiques pour fins d’application à la recherche biomédicale sur des sujets humains et ce, par le biais d'une étude de cas. Suite à ces trois étapes et à la lumière d’une analyse critique des différents écrits recensés sur le sujet, une conclusion s’impose quant à l’importance de renforcer l’application des normes éthiques universelles entourant la recherche biomédicale sur des sujets humains et ce, justement parce celle-ci est surtout conduite sur des populations vulnérables de pays en développement.

Ibn Khaldûn(1332-1406) fut homme d’Etat et historien des conflits et des changements politiques au Moyen-Orient et en Afrique du Nord. Il a écrit la Muqaddima, une vaste analyse du déclin de la civilisation arabe. Dans cet ouvrage l’ «éthique du Juste » est présentée comme l’obéissance à la loi et l’application des sciences rationnelles à la tradition. Ceci le mène à condamner l’ « éthique du Bien » en tant que calcul de son propre bonheur. Le conflit actuel reflète bien ce dualisme sous de nouvelles formes d’eudémonisme telle que l’utilitarisme. Sa théorie du changement politique et des conflits est toujours d’actualité : le développement économique conduit à la destruction des dynasties au pouvoir ; ce dernier repose sur l’Asabiya, une forme spécifique du capital social. Le pouvoir politique dure trois générations et connaît une évolution faite d’essor, d’apogée et de déclin. Cette théorie des « trois phases » du développement permet de mieux comprendre les conflits que connaît actuellement le monde arabe.

This paper investigates the moral duties that human rights NGOs, such as Amnesty International, and development NGOs, such as Oxfam, have in relation to human rights – especially in relation to the human right to a decent standard of living. The mentioned NGOs are powerful new agents on the global scene, and according to many they might be duty-bearers in relation to human rights. However, until now their moral duties have hardly been investigated. The present paper investigates NGO duties in relation to human rights by looking in particular to a moral theory recently proposed by Leif Wenar, a theory which has some similarities to utilitarianism. In applying this theory, a case for human-rights duties of NGOs is developed mainly by considering the indispensable role that civil society plays in protecting human rights. The paper concludes that, at least, NGOs bear duties with regard to human rights when, as in certain real-life cases, NGO involvement is the only way to achieve acceptable protection against standard threats to certain goods, such as a decent standard of living.

L’inflation a diminué de façon importante dans les pays riches depuis le début des années 80. Cette baisse de l’inflation n’est pas un hasard et peut, en partie, être liée à la mise en place de nouvelles institutions et politiques monétaires. Ce mémoire examine la relation qui existe entre deux de ces institutions, l’indépendance politique et le conservatisme d’une banque centrale, et l’idéal d’égalité économique. Peut-on, demandons-nous, être égalitariste et défendre, à la fois, l’indépendance politique d’une banque centrale et la volonté «conservatrice» de faire de l’inflation une priorité relativement au chômage? Le mémoire se divise en trois grandes parties. Une version crédible de l’égalitarisme économique est d’abord présentée. La relation qui existe entre le phénomène d’inflation et l’égalitarisme est, ensuite, examinée. Une réflexion critique sur les fondements théoriques de l’indépendance politique et du conservatisme est, enfin, développée. Nous concluons que la théorie égalitariste ne permet pas, à elle seule, de déterminer si un modèle particulier de banque centrale est moralement désirable. Pour se porter à la défense d’une banque centrale indépendante et conservatrice, un égalitariste doit adhérer à des prémisses économiques contestées.

En este documento se quiere demostrar que una teoría que pretenda fundamentar la política social que no permita las comparaciones interpersonales es inadecuada. Por esta razón, el punto de partida es una crítica a la economía normativa neoclásica. Esta crítica consiste, en últimas, en una crítica al concepto de bienestar de los utilitaristas. Se plantea que el bienestar entendido como utilidad excluye información relevante para juzgar el bienestar de las personas, y se propone que el concepto de bienestar del profesor Amartya Sen es adecuado como base de una teoría para la política social.

Lean construction is considered from a human resource management (HRM) perspective. It is contended that the UK construction sector is characterised by an institutionalised regressive approach to HRM. In the face of rapidly declining recruitment rates for built environment courses, the dominant HRM philosophy of utilitarian instrumentalism does little to attract the intelligent and creative young people that the industry so badly needs. Given this broader context, there is a danger that an uncritical acceptance of lean construction will exacerbate the industry's reputation for unrewarding jobs. Construction academics have strangely ignored the extensive literature that equates lean production to a HRM regime of control, exploitation and surveillance. The emphasis of lean thinking on eliminating waste and improving efficiency makes it easy to absorb into the best practice agenda because it conforms to the existing dominant way of thinking. 'Best practice' is seemingly judged by the extent to which it serves the interests of the industry's technocratic elite. Hence it acts as a conservative force in favour of maintaining the status quo. In this respect, lean construction is the latest manifestation of a long established trend. In common with countless other improvement initiatives, the rhetoric is heavy in the machine metaphor whilst exhorting others to be more efficient. If current trends in lean construction are extrapolated into the future the ultimate destination may be uncomfortably close to Aldous Huxley's apocalyptic vision of a Brave New World. In the face of these trends, the lean construction research community pleads neutrality whilst confining its attention to the rational high ground. The future of lean construction is not yet predetermined. Many choices remain to be made. The challenge for the research community is to improve practice whilst avoiding the dehumanising tendencies of high utilitarianism.

Despite the growing intensity of the debate about environmental management, it is only recently that rural practice surveyors have become aware of its significance and potential. Consequently, few surveyors are yet in a position to offer professional advice, despite evidence from the RICS's client needs survey that nearly half of all existing clients require more advice on environmental matters. As a prerequisite to becoming involved in environmental management, it is clear that chartered surveyors have to develop new skills alongside new perceptions of their work. Rather than being conterminous, however, the alignment of these attributes reflects a fundamental tension. This is focused on the dichotomy between the strategic construction of the environment as a basis for realigning corporate policy and the more limited evocation of environmentalism as potential new business. This paper seeks to explore the nature and policy context of sustainable development, in the process examining its significance for rural chartered surveyors. In doing so, the paper will seek to contrast the essentially anthropocentric utilitarianism of surveyors' current attitudes with the radical agenda inferred by a more ecocentric, sustainable development approach to professional management and advice. The paper will conclude with a discussion about how far the principles of sustainable development can be incorporated into the management of surveying businesses, and what this implies for the future of the rural practice chartered surveyor as land manager.

In the last decades of the 21st century, Corporate Social Responsibility (CSR) has become one of the most widely debated issues in business management, concerning researchers, politicians, managers and society at large. With multilateral implications in economic and social life, CSR refers, essentially, to the discussion about the boundaries of business intervention in society and the ethical limits that should regulate that intervention. It questions the impact of business practices in social well-being, the role left for corporations and for the State in attending to community needs, and which are, at last, the responsibilities that tie enterprises to society. In this research, CSR is approached from the perspective of its ethical foundations, based on the moral reasoning of the business manager, as a key organizational leader with relevant decision power. Specifically, the research aims to understand how the personal human value system and the ethical orientation of managers influence their attitude towards CSR, considering this attitude as an indicator of managerial behavior that translates into corporate performance. Theoretically, CSR concept is discussed and presented as a set of social commitments, based on a strict interpretation of its meaning. As to human values, its philosophical roots are briefly analyzed and Schwartz modern motivational theory is addressed as main reference for studying the personal value system of managers in this research. Concerning ethics, based on classical theory from moral philosophy, references are seek in John Stuart Mill¿s utilitarianism, Immanuel Kant¿s deontological absolutism, John Rawls¿s theory of justice and the ethics of virtue inspired by Aristotle¿s moral thoughts. Based on an extended literature review, research hypothesis are proposed as part of a theoretical model of analysis named Individual Attitude Towards Social Responsibility Model. In order to test the theory¿s empirical validity, it was conducted a field study with 252 Brazilian managers, mainly from the metropolitan areas of São Paulo and Rio de Janeiro. Results show that managerial attitude aligned with CSR principles is favored by conservative personal values, protectors of stability and centered on collective will, and by an ethical orientation based on egalitarianism as postulated by distributive justice principles. However, results also show that the influence of values and personal ethics on managerial attitude towards CSR only occur in managers younger than 30 years old. Findings and their meanings are discussed, as well as summarized in the Axiological and Ethical Determinants of Managers¿ Social Commitment Model. Finally, methodological limitations are evaluated and clues for further research are suggested.

O trabalho apresentado neste relatório tem por objetivo pesquisar a constituição e o desenvolvimento da confiança entre os empresários participantes do programa Cooperar para Competir, o qual compõe o conjunto de treinamentos oferecidos para o Arranjo Produtivo Local de Birigui pelo SEBRAE-SP em parceria com instituições locais como o Sindicato da Indústrias do Calçado e Vestuário de Birigui, o SESI de Birigui, entre outros. Em termos de metodologia, foi escolhido o método qualitativo para desenvolver uma pesquisa exploratória de estudo de caso (o Cooperar para Competir) e foram utilizadas duas técnicas de pesquisa – a entrevista aberta ou não-dirigida e a técnica de história oral. Para o seu desenvolvimento, foram estabelecidas três grandes áreas de investigação que, juntas, ofereceriam uma visão abrangente do tema analisado: a) a primeira grande área é responsável pelo estudo do contexto e da estrutura econômica do APL em geral, bem como de seus agentes presentes naquela região e suas particularidades. Nesta primeira parte são apresentadas discussões sobre clusters, sua importância e representatividade no Brasil e no mundo, bem como uma análise do cluster calçadista de Birigui de acordo com o Modelo Diamante proposto por Porter (1999); b) a segunda área abrange tanto a estrutura formal do Cooperar para Competir em cada uma das turmas quanto o processo dinâmico do curso, seus momentos críticos e as estratégias pedagógicas adotadas a cada momento em vista dos desafios. Esta parte contextualiza o programa, apresenta sua estrutura e reflete a construção das bases de cooperação em sala de aula por uma perspectiva axiológica; c) a terceira área, por fim, é caracterizada pela pesquisa de campo, quando foram investigadas as vivências, experiências e impactos dos e nos participantes do ponto de vista subjetivo e como eles entenderam os efeitos em suas vidas profissional e pessoal. As entrevistas abertas foram realizadas com dois grupos de participantes, o Grupo Graduado e o Grupo Novo, a fim entender o desenvolvimento de ambos os grupos, os resultados alcançados pelo primeiro e o efeito da suspensão do programa no segundo. Todo o processo seguido durante a pesquisa permitiu que se chegasse a inúmeras conclusões, como o porquê do sucesso do programa Cooperar para Competir – o sucesso, neste caso, reside no desenho pedagógico que atende a dimensão axiológica, ou seja, não apenas se falou de cooperação, mas se produziu cooperação ao integrar competências, interesses e valores. O programa serviu, então, como um espaço filosófico e laboratorial. Assim, o conteúdo e a sequência seguidos também tem sua importância relativizada frente as relações e a construção de algo que transcende o caráter utilitarista ou funcionalista das disciplinas. As entrevistas individuais e em grupo mostraram que se reconhecerem como iguais foi um fator gerador de confiança entre os participantes, a qual também é expressa quando estes se abrem para compreenderem o modo como os outros atribuem significados para a relação de desconfiança e confiança e passam a estabelecer um sistema de significação comum. Além disso, a consciência de sua realidade e o reconhecimento de sua responsabilidade junto a si mesmo, à sua empresa, ao projeto desenvolvido no Cooperar para Competir e à comunidade de Birigui marcam, também, a mudança do esquema mental de sapateiro para empresário.
