El presente trabajo de grado tiene como propósito evidenciar los cambios que se generaron en las dinámicas sociales de los residentes y comerciantes del barrio San Bernardo, cuando se decidió declarar este territorio idóneo para el Tratamiento de Renovación Urbana como resultado de una serie de especulaciones originadas por parte de la comunidad debido a la incertidumbre generada por la presencia de las entidades distritales en este barrio de Bogotá.

The recent advances in CMOS technology have allowed for the fabrication of transistors with submicronic dimensions, making possible the integration of tens of millions devices in a single chip that can be used to build very complex electronic systems. Such increase in complexity of designs has originated a need for more efficient verification tools that could incorporate more appropriate physical and computational models. Timing verification targets at determining whether the timing constraints imposed to the design may be satisfied or not. It can be performed by using circuit simulation or by timing analysis. Although simulation tends to furnish the most accurate estimates, it presents the drawback of being stimuli dependent. Hence, in order to ensure that the critical situation is taken into account, one must exercise all possible input patterns. Obviously, this is not possible to accomplish due to the high complexity of current designs. To circumvent this problem, designers must rely on timing analysis. Timing analysis is an input-independent verification approach that models each combinational block of a circuit as a direct acyclic graph, which is used to estimate the critical delay. First timing analysis tools used only the circuit topology information to estimate circuit delay, thus being referred to as topological timing analyzers. However, such method may result in too pessimistic delay estimates, since the longest paths in the graph may not be able to propagate a transition, that is, may be false. Functional timing analysis, in turn, considers not only circuit topology, but also the temporal and functional relations between circuit elements. Functional timing analysis tools may differ by three aspects: the set of sensitization conditions necessary to declare a path as sensitizable (i.e., the so-called path sensitization criterion), the number of paths simultaneously handled and the method used to determine whether sensitization conditions are satisfiable or not. Currently, the two most efficient approaches test the sensitizability of entire sets of paths at a time: one is based on automatic test pattern generation (ATPG) techniques and the other translates the timing analysis problem into a satisfiability (SAT) problem. Although timing analysis has been exhaustively studied in the last fifteen years, some specific topics have not received the required attention yet. One such topic is the applicability of functional timing analysis to circuits containing complex gates. This is the basic concern of this thesis. In addition, and as a necessary step to settle the scenario, a detailed and systematic study on functional timing analysis is also presented.

Choosing properly and efficiently a supplier has been challenging practitioners and academics since 1960’s. Since then, countless studies had been performed and relevant changes in the business scenario were considered such as global sourcing, quality-orientation, just-in-time practices. It is almost consensus that quality should be the selection driver, however, some polemical findings questioned this general agreement. Therefore, one of the objectives of the study was to identify the supplier selection criteria and bring this discussion back again. Moreover, Dickson (1966) suggested existing business relationship as selection criterion, then it was reviewed the importance of business relationship for the company and noted a set of potential negative effects that could rise from it. By considering these side effects of relationship, this research aimed to investigate how the relationship could influence the supplier selection and how its harmful effects could affect the selection process. The impact of this phenomenon was investigated cross-nationally. The research strategy adopted was a controlled experiment via vignette combined with discrete choice analysis. The data collections were performed in China and Brazil. By examining the results, it could be drawn five major findings. First, when purchasers were asked to declare their supplier selection priorities, quality was stated as the most important independently of country and relationship. This result was consistent with diverse studies since 60’s. However, when purchasers were exposed to a multi-criteria trade-off situation, their actual selection priorities deviate from what they had declared. In the actual decision-making without influence of buyer-supplier relationship, Brazilian purchasers focused on price and Chinese buyers prioritized delivery then price. This observation reinforced some controversial prior studies of Verma & Pullman (1998) and Hirakubo & Kublin (1998). Second, through the introduction of the buyer-supplier relationship (operationalized via relational capital) in the supplier selection process, this research extended the existing studies and found that Brazilian buyers still focused on price. The relationship became just another criterion for supplier selection such as quality and delivery. However, from the Chinese sample, the results suggested that quality was totally discarded and the decision was majorly made through price and relationship. The third finding suggested that relational capital could legitimate the quality and sustainability of the supplier and replaces these selection criteria and made the decisional task less complex. Additionally, with the relational capital, the decision-makings were associated to few biases such as availability cognition, commitment, confirmatory and perceived biases. By analyzing the purchasers’ behavior, relational capital inducted buyers of both countries to relax in their purchasing requirements (quality, delivery and sustainability) leading to potential negative effects. In the Brazilian sample, the phenomenon of willing to pay a higher price for a lower quality offer demonstrated to be a potential counterproductive and suboptimal decision. Finally, the last finding was associated to the cultural effect on the buyers’ decisions. From the outcome, it is possible to observe that if a purchaser’s cultural background is more relation-oriented, the more he will tend to use relational capital as a decision heuristic, thus, the purchaser will be more susceptible to the potential relationship’s side effects

Este trabalho se propõe a fazer uma análise do processo da reforma legislativa trazida pela lei 12.853/13 ao sistema brasileiro de gestão coletiva de direitos autorais da execução pública musical, centralizado na figura do Escritório Central de Arrecadação e Distribuição. Para tanto, é feita uma descrição de como esse sistema funcionava anteriormente, quais as críticas a ele apresentadas e quais mudanças a nova lei trouxe. Aborda-se o conceito de gestão coletiva, a organização deste setor no Brasil, a CPI do Senado Federal sobre o Ecad, o julgamento deste órgão por ilícitos antitruste pelo Conselho Administrativo de Defesa Econômica, o processo legislativo da reforma e as ADIs propostas no Supremo Tribunal Federal contra ela. Assim é exposto como o discurso de autonomia na gestão coletiva é substituído pelo da regulação, que se mostra mais adequado à realidade brasileira para sanar grande parte dos problemas encontrados no setor e melhorar a situação de titulares e usuários de direitos autorais. Neste campo eivado de conflitos e disputas, agora está nas mãos do Supremo Tribunal Federal decidir pela constitucionalidade da nova lei.

The independence of the United States and the revolutions that emerged in Europe in the eighteenth century led to the birth of the written constitution, with a mission to limit the power of the State and to ensure fundamental rights to citizens. Thus, the Constitution has become the norm and ultimate founding of the State. Because of this superiority felt the need to protect her, emerging from that constitutional jurisdiction, taking control of constitutionality of provisions his main instrument. In Brazil, the constitutionality control began with the Constitution of 1891, when "imported" the American model, which is named after incidental diffuse model of judicial review. Indeed, allowed that any judge or court could declare the unconstitutionality of the law or normative act in a concrete case. However, the Brazilian Constituent did not bring the U.S. Institute of stare decisis, by which the precedents of higher courts eventually link the below. Because of this lack, each tribunal Brazilian freely decide about the constitutionality of a rule, so that the decision took effect only between the parties to the dispute. This prompted the emergence of conflicting decisions between judicantes organs, which ultimately undermine legal certainty and the image of the judiciary. As a solution to the problem, was incorporated from the 1934 Constitution to rule that the Senate would suspend the law declared unconstitutional by the Supreme Court. With the introduction of abstract control of constitutionality, since 1965, the Supreme Court went on to also have the power to declare the invalidity of the provision unconstitutional, effectively against all without the need for the participation of the Senate. However, it remained the view that in case the Supreme Court declared the unconstitutionality of the fuzzy control law by the Senate would continue with the competence to suspend the law unconstitutional, thus the decision of the Praetorium Exalted restricted parties. The 1988 Constitution strengthened the abstract control expanding legitimized the Declaratory Action of Unconstitutionality and creating new mechanisms of abstract control. Adding to this, the Constitutional Amendment. No. 45/2004 brought the requirement of general repercussion and created the Office of Binding Precedent, both to be applied by the Supreme Court judgments in individual cases, thus causing an approximation between the control abstract and concrete constitutional. Saw themselves so that the Supreme Court, to be the guardian of the Constitution, its action should be directed to the trial of issues of public interest. In this new reality, it becomes more necessary the participation of the Senate to the law declared unconstitutional in fuzzy control by the Supreme Court can reach everyone, because such an interpretation has become obsolete. So, to adapt it to this reality, such a rule must be read in the sense that the Senate give publicity to the law declared unconstitutional by the Supreme Court, since mutated constitutional

Com o objetivo de avaliar o efeito de doses de cloreto de mepiquat aplicadas de forma parcelada, foi conduzido, em Jaboticabal, SP, um experimento com a cultivar de algodoeiro IAC 22. O delineamento experimental foi o de blocos casualizados, com 13 tratamentos e 4 repetições. O efeito do cloreto de mepiquat sobre a redução da altura das plantas foi mais evidenciado pela dose total aplicada do que pelo uso do esquema de parcelamento. A menor dose estudada (55 g/ha) foi suficiente para que as plantas, por ocasião da colheita, estivessem com altura inferior a 1,30 m. O cloreto de mepiquat proporcionou redução no comprimento dos ramos e um melhor equilíbrio entre as partes reprodutiva e vegetativa. As características peso de capulho, peso de 100 sementes, porcentagem de fibra e produção de algodão em caroço, não foram significativamente afetadas pelos tratamentos.

Currently, the world meat trade is undergoing substantial changes as a consequence of the spread of transboundary animal diseases. These diseases have resulted in the implementation of trade embargoes applied nation-wide against infected countries, contrary to the principle of regionalization. This principle allows a country to declare part of its territory free from a given disease even though there have been outbreaks in other regions thus averting the need to suspend all exports. Its application consists in the formal recognition that a zone is disease- or pest-free. This article presents some of the disputes caused by reluctance to apply the regionalization principle in the case of the three main transboundary diseases that have affected meat trade in recent years: "mad cow disease", foot and mouth disease, and avian flu. This article analyses the positions taken by some consumer markets and the challenges that the principal exporting nations have faced when confronted with trade embargoes.

Between December 2007 and June 2009 the United States witnessed 18 months of recession that became known as the subprime crisis. Beginning in the housing market, the crisis moved into the banking and financial markets and spread throughout the entire economy through a domino effect, affecting the majority of other businesses. A major reflection of this was the large rise in unemployment rates due to business slashing jobs in an attempt to preserve cash. Although the crisis has officially ended, the unemployment rate reached over 10% in 2010 in the United States. American's continue to seek new jobs in a very difficult employment market, while attempting to manage the family household budget. American household income, which decreased either by pay cuts, job loss, and the effects of inflation, leads the majority of Americans to declare that the crisis had not yet ended. The crisis has spread to the world in varying degrees. Brazil was one of the countries least affected due to government policies and the large amount of foreign exchange. Although the crisis has affected Brazil only slightly, we will show how it reached this country and how the government solved this problem. This research paper will explain how the subprime crisis began, how it manifested itself in the U.S. economy and throughout the population. Also, it will show the crisis’ effects in Brazil and show some statements from Americans with their respective views and their experiences relative to the crisis

Anthrax is not commonly considered so important a menace to swine as it is to other forms of live stock, in which the disease is apt to declare itself with terrifying severity. In comparison with the marked mortality frequently observed in cattle, the tangible losses caused by anthrax in swine seem negligible. As recent as 25 years ago, there still were observers who sincerely doubted the occurrence of the disease in hogs and this opinion found some support in the many reported failures to induce the infection in that animal species by artificial methods.

MRSA ist der wohl bekannteste nosokomiale Infektionserreger weltweit. Die aktuelle Situation ist aufgrund der schnellen Ausbreitung, vor allem von caMRSA, in einigen Ländern besorgniserregend. Für den Raum Mainz konnte innerhalb der fünf Untersuchungsjahre eine stabile Populationsstruktur nachgewiesen werden, welche hauptsächlich aus deutschlandweit bekannten Epidemiestämmen gebildet wird. Als Besonderheit ergab sich die Dominanz des spa-Typs t003 (> 70 %), sowie das Vorherrschen hoch klonaler Strukturen an UMM und KKM. Diese Umstände lassen auf eine weite Verbreitung von MRSA, speziell des spa-Typs t003, innerhalb der Bevölkerung schließen. Die Bestätigung dieser Vermutung bedarf jedoch weiterer prospektiver Forschung außerhalb der Kliniken.rnAn der UMM konnte im Untersuchungszeitraum 2004-2008 keine Zunahme von klassischen PVL-positiven caMRSA (t008, t019 und t044) festgestellt werden, womit zumindest momentan noch keine Verdrängung von haMRSA durch caMRSA belegt werden konnte.rnDie von WITTE et al. (2004) postulierte 5 % Grenze für den häufigsten detektierten Typ einer Typisierungsmethode muss dahingehend modifiziert werden, dass diese Bedingung zwar allgemein für ein Typisierungsverfahren, nicht aber für lokale Populationen gelten sollte. Im Falle des Vorherrschens klonaler Linien und Subtypen würde keine Methode ausreichend diskriminatorische Eigenschaften aufweisen.rnDie Kombination von spa-Typisierung und PFGE konnte, mit Einschränkungen für den vorherrschenden t003, als geeignet im Falle der Keimdifferenzierung während eines Ausbruchs befunden werden. Als vorteilig für die Interpretation würde sich die Einführung eines generellen MRSA-Screenings für jeden Patienten bei Aufnahme auswirken.rnDie Überprüfung der Thesen von FRÉNAY et al. 1994 ergab keinen Zusammenhang zwischen einer X-Region ≥ 8 Repeats und einem erhöhtem Virulenzpotential. Bezüglich des gesteigerten epidemischen Potentials wurde festgestellt, dass lange X-Regionen generell häufiger auftreten als kurze und somit ein begünstigender Einfluss bei der Kolonisation vermutet aber nicht bewiesen werden kann.rnFür die Detektion von klassischen caMRSA konnte ein Ablaufschema mit Interpretationsrichtlinien erarbeitet werden, welches eine korrekte Differenzierung auch ohne die Einbeziehung patientenbezogener Daten ermöglicht. Die Anlage einer lokalen PFGE-Datenbank zeigte sich dabei als unbedingt notwendig um strittige Fälle als ha- oder caMRSA einzuordnen.rn

This paper examines a trend in European and American High Courts to endorse majority religion by transforming it into “culture”, and thus by secularizing it. To dissociate religion and state is the hallmark of the liberal state. However, no state has ever managed a perfect separation, not even the American. Under conditions of mounting religious pluralism and ongoing secularization, there is pressure on the state to live up to its “neutrality”. A main strategy to square the circle of neutrality and incomplete dissociation from religion is to declare it “culture”, which gives the state the license to associate or even identify with it (as guardian of nationhood). The paper compares recent American and European High Court rules on religious symbols (especially crucifixes) that exhibits this strategy, addressing similarities and differences as well as the limits and pitfalls of “culturalizing” religion.
