Affirmer que les citoyens des démocraties occidentales sont l’objet d’une surveillance systématique efficace et à grande échelle a de quoi provoquer une réaction incrédule. Démagogie, diront certains. Pourtant, les progrès réalisés dans les technologies de collecte, de traitement et de stockage d’information forcent une réflexion sur cette hypothèse. Il a été souligné justement que les coûts élevés liés aux moyens rudimentaires employés par les polices secrètes d’antan endiguaient en quelque sorte la menace. Les filatures, les infiltrations, les rapts nocturnes de dissidents pêchaient par manque de subtilité. Au contraire, le génie des techniques modernes vient de ce qu’elles n’entravent pas le quotidien des gens. Mais au-delà du raffinement technique, le contrôle panoptique de la masse atteint un sommet d’efficience dès lors que celle-ci est amenée à y consentir. Comme le faisait remarquer le professeur Raab : « [TRADUCTION] La surveillance prospère naturellement dans les régimes autoritaires qui ne s’exposent pas au débat public ni à la critique. Lorsqu’elle est utilisée dans des régimes dits démocratiques, elle est légitimée et circonscrite par des arguments de nécessité ou de justifications spéciales, tout comme la censure »[1]. Or, le droit, en tant que discours de rationalité, accomplit savamment ce travail de légitimation. C’est dans cet esprit qu’une analyse radicale des règles de droit encadrant le droit à la vie privée apporte une lucidité nouvelle sur notre faux sentiment de sécurité.

The customary laws of Union Territory of Lakshadweep islands are a challenge for judicial institution as well as administrative machinery. With the peculiarities of socio-legal institutions, Lakshadweep system stands apart from the mainstream of legal systems in India. How far do the charismatic modernisation trends flowing into the Lakshadweep society affect the people already protected by the uncodified laws of the past? Many are the issues at this stage. This study analyses them. It examines the growth, evolution and development of the legal system in the islands vis-a-vis the administrative mechanism imposed by the mainland ethos and culture.

P>1. The use of indicators to identify areas of conservation importance has been challenged on several grounds, but nonetheless retains appeal as no more parsimonious approach exists. Among the many variants, two indicator strategies stand out: the use of indicator species and the use of metrics of landscape structure. While the first has been thoroughly studied, the same cannot be said about the latter. We aimed to contrast the relative efficacy of species-based and landscape-based indicators by: (i) comparing their ability to reflect changes in community integrity at regional and landscape spatial scales, (ii) assessing their sensitivity to changes in data resolution, and (iii) quantifying the degree to which indicators that are generated in one landscape or at one spatial scale can be transferred to additional landscapes or scales. 2. We used data from more than 7000 bird captures in 65 sites from six 10 000-ha landscapes with different proportions of forest cover in the Atlantic Forest of Brazil. Indicator species and landscape-based indicators were tested in terms of how effective they were in reflecting changes in community integrity, defined as deviations in bird community composition from control areas. 3. At the regional scale, indicator species provided more robust depictions of community integrity than landscape-based indicators. At the landscape scale, however, landscape-based indicators performed more effectively, more consistently and were also more transferable among landscapes. The effectiveness of high resolution landscape-based indicators was reduced by just 12% when these were used to explain patterns of community integrity in independent data sets. By contrast, the effectiveness of species-based indicators was reduced by 33%. 4. Synthesis and applications. The use of indicator species proved to be effective; however their results were variable and sensitive to changes in scale and resolution, and their application requires extensive and time-consuming field work. Landscape-based indicators were not only effective but were also much less context-dependent. The use of landscape-based indicators may allow the rapid identification of priority areas for conservation and restoration, and indicate which restoration strategies should be pursued, using remotely sensed imagery. We suggest that landscape-based indicators might often be a better, simpler, and cheaper strategy for informing decisions in conservation.

We apply the concept of exchangeable random variables to the case of non-additive robability distributions exhibiting ncertainty aversion, and in the lass generated bya convex core convex non-additive probabilities, ith a convex core). We are able to rove two versions of the law of arge numbers (de Finetti's heorems). By making use of two efinitions. of independence we rove two versions of the strong law f large numbers. It turns out that e cannot assure the convergence of he sample averages to a constant. e then modal the case there is a true" probability distribution ehind the successive realizations of the uncertain random variable. In this case convergence occurs. This result is important because it renders true the intuition that it is possible "to learn" the "true" additive distribution behind an uncertain event if one repeatedly observes it (a sufficiently large number of times). We also provide a conjecture regarding the "Iearning" (or updating) process above, and prove a partia I result for the case of Dempster-Shafer updating rule and binomial trials.
