If it comes to the attention of a sheriff, police department or other law enforcement agency that a public offense has been committed in its jurisdiction, the law enforcement agency shall report information concerning such a public offense to the department on a form to be furnished by the department not more than thirty-five days from the time the public offense first comes to the attention of the law enforcement agency. The reports shall be used to generate crime statistics. Le prêt à intérêt était pratiqué par tous les peuples de l'Antiquité préchrétienne, à l'exception du peuple d'Israël. L'auteur examine d'abord l'interdiction du prêt à intérêt dans l'Ancien Testament. Il expose ensuite la pratique du prêt à intérêt en Grèce, avant de détailler les critiques d'Aristote. Enfin, l'auteur retrace l'évolution du prêt (mutuum) et de la réglementation de l'intérêt à Rome, des origines à Constantin. Il met l'accent sur trois grandes controverses parmi les romanistes modernes (XVIe - XXIe s.) : sur le nexum, sur la centesima et, surtout, sur le mystérieux fenus unciarium, le taux d'intérêt fixé par les Douze Tables, pour lequel l'éventail des interprétations va de 1 à 100 % par an ! L'auteur recense les opinions de plus de 400 juristes et historiens, discute les plus importantes et propose sa conclusion. The loan at interest was used by all the peoples of pre-Christian Antiquity, excepting the people of Israel. The author first focuses on the prohibition of lending at interest in the Old Testament. He then explores the use of loans at interest in Greece before examining Aristotle's criticism. Eventually, the author follows the evolution of loan (mutuum) and interest regulation in Rome, from the origins to Constantine. Three great controversies among modern Roman law scholars (16th - 21th) are considered: nexum, centesima and above all, the mysterious fenus unciarium, the interest rate defined by the Twelve Tables, for which the range of interpretations varies between 1 and 100% per year! The author gives an inventory of more than 400 opinions expressed by jurists and historians, discusses the most important ones and suggests a solution.

Presentació de tres bronzes de caràcter jurídic procedents un d'ells d'Hellin i els altres probablement de la Bètica. El primer sembla ésser una limitatio o una adsignatio. El segon sembla correspondre a un passatge d'una llei d'època flàvia, i el tercer és, probablement, una adsignatio.

The roman institution of the separatio bonorum is a pretorian remedy that relies on the principle of equity, created as to protect the deceased creditors and/or legatees. It provides them a"benefit" in the case of selling the goods of the heir-deubtor, enabling them to separate and reserve for themselves that whole patrimonium, as to avoid that by the act of selling, the heirs creditors could go to it; and like this they maintain intact their guarantee, which relies on the whole goods and assets left by the deceased. The separation of patrimonies implied the existence of 2 different groups of goods: that of the heirs" and that one of the deceased, which are not the same in legal terms, in spite of having a common owner at this point, the heir. This institution was regulated in the 6th title of the 42nd book of the Digesto, and in the 72th title, 7th book of the Justinean Code, and its interest is really high due to its material complexity and its procedure. The aim of this work is to analyze the institution of the separatio bonorum in Roman Law, and its importance in the same figure, actually regulated in the 4th book of the Catalan civil code.

Por ser la cuarta vidual, como corroboran las Nov. 53, 6; 74, 5 y 117, 5, una figura vinculada tanto al Derecho de familia, en concreto, a la denominada, en doctrina, cuarta marital o uxoria en su acepción penal, pues en ésta encuentra una parte importante de sus raíces, como al Derecho sucesorio; su historia y fines se entenderán mejor si se integra en la evolución de ambos sistemas. Lo dicho justifica, a mi juicio, el interés de un estudio que, como éste, se centre, por una parte, en la institución que fue el precedente histórico inmediato de la cuarta vidual y, por otra, en el análisis de la Novela que, por primera vez, reguló el derecho a la cuarta en favor del cónyuge viudo, esto es, la 53, 6.

Les « dispositions successorales spéciales » de la lex situs apportent une exception particulière au système unitaire de la loi applicable à la succession. Leur reconnaissance dans le récent Règlement du Parlement européen et du Conseil relatif à la compétence, la loi applicable, la reconnaissance et l'exécution des décisions, et l'acceptation et l'exécution des actes authentiques en matière de successions et à la création d'un certificat successoral européen du 4 juillet 2012 témoigne de l’importance et de l’actualité de cette prévision normative. L’exception trouve sa source dans l’article 15 de la Convention du 1er août 1989 sur la loi applicable aux successions à cause de mort, formule qui fut suivi par l’article 3099 al. 2 du Code civil du Québec. La conception originaire de la règle se situe à l’article 28 de la Loi d’introduction au Code civil allemand de 1896. Ces législations reconnaissent la nécessité de respecter certaines dérogations aux règles successorales ordinaires dont le contenu matériel justifie une rupture exceptionnelle de l’unité de la succession internationale. Ainsi, l’opposition traditionnelle entre le système scissionniste qui divise la loi applicable à la succession en fonction de la nature mobilière ou immobilière des biens et celui qui postule l’unité législative trouve dans le respect des « dispositions spéciales » de la lex rei sitae régissant certains biens de la succession un facteur conciliateur. Il s’agit de respecter un minimum normatif de la loi de l’État où sont situés certains biens de la succession malgré la compétence générale d’une lex successionis étrangère. Ce bloc normatif irréductible se présente comme un pont qui relie les deux solutions extrêmes dans une position intermédiaire où il n’y a plus de scission au sens classique du terme mais où l’unité est néanmoins brisée en raison de certaines considérations substantielles tirées de la destination des biens.

La responsabilidad penal de las personas jurídicas es un tema que adquiere cada vez mayor relevancia en una sociedad que sufre constantes cambios, y en la que se perfeccionan cada vez más las formas de cometer delitos. En el presente trabajo se realiza el estudio sobre la evolución de la figura de la responsabilidad penal de las personas jurídicas, abarcando desde el derecho romano hasta nuestros días. En el desarrollo del mismo, se expone el recorrido a través de las diferentes alternativas normativas y académicas consideradas a nivel mundial, mostrando las características de cada ordenamiento jurídico con respecto a la aceptación, la negación o la obtención de una normatividad en regímenes diferentes al penal frente al tema de estudio. Igualmente, se analizan los avances logrados en Colombia en materia de implementación de una normatividad que regule la responsabilidad de las personas jurídicas. Finalmente, se exponen los mecanismos alternativos de regulación, que brindan una valiosa herramienta para aquellos países en los que la responsabilidad penal de las personas jurídicas se encuentra proscrita.
